2 i 4 N y e DOCKET NO APPLICATION OF OUTHWESTERN ELECTRIC POWER COMPANY FOR A CERTIFICATE OF CONVENIENCE ANDiNECESSITY FOR GENERATION AND TRANSMISSION FACILITIES LOCAtED OUTSIDE THE STATE OF TEXAS ' PUBLIC UTILITY COMMISSION OF TEXAS EXAMINER'S REPORT Procedural History On September 8, 1980, Southwestern Electric Power Company (SWEPCO) filed an application reouesting certification of its generation, transmission, and substation facilities within Arkansas and Louisiana. On December 18, 1980, the Staff recommended that the application be granted, except as it relates to the proposed Dolet Hills generating unit and associated substations and transmission lines. On January 22, 1981, SWEPCO filed awaiver of hearing and agreed to apply for certification of the Dolet Hills system via a separate docket. Proper notice was given to all interested persons and no protests, motions to intervene, or requests for hearing have been received. Therefore, the Examiner has determined that a hearing is unnecessary in this docket. Opinion SWEPCO has requested and received certification of its facilities and service areas within Texas, but it has not previously applied for certification of its out-of-state facilities. In; light of the Commission action in Application of El Paso Electric Company, Docket No. 478, 3 P.U.C. Bull. 100 (August 29, 1977) and in Application-of Gulf States Utilities CompIny, Docket No. 857, 3 P.U.C. Bull (March 21, 1978), in which certification was granted for out-of-state facilities when utilities sought to include those facilities in rate base, SWEPCO decided to file this application. Nonetheless, SWEPCO expressly reserves the right to contest the Commission's jurisdiction to certificate out-of-state facilities. SWEPCO's out-of-state facilities are set forth on a map which is attached hereto as Exhibit I. SWEPCO claims that all the facilities depicted on Exhibit I are used, useful, and necessary to the provision of service to customers located in Texas because they are an integral part of the power supply, transmission system, and interconnection points with other electric utilities that enable SWEPCO to operate as an integrated system, thus allowing for economical and reliable service. The Staff Engineer agreed with SWEPCO's assertion, but recommended the Dolet Hills generation station, the Dolet Hills substation, and, the 345 kv line running between Dolet Hills, Louisiana and Shreveport, Louisana not be certificated because the Dolet Hills portion of the System is not scheduled for service until 1986 and is therefore not presently used and useful. The
3 Docket No Page 2 Staff recommended that the Dolet Hills facilities be severed from this docket and that a separate application be required, as is the procedure for any proposed new generating unit. The Examiner concurs, and finding no adverse impact on community values, recreational and park areas, historical and aesthetic values, or environmental areas, recommends certification pursuant to TEX.REV.CIV.STAT.ANN. art. 1446c, g54 (Supp. 1980) of all facilities shown on Exhibit I with the exception of the above-mentioned Dolet Hills facilities. Findings of Fact 1. SWEP80's out-of-state facilities are set forth on the attached Exhibit I. 9. All facilities depicted on Exhibit I, except the Dolet Hills generation station and substation and the 345 kv line running between Dolet Hills, Louisiana and Shreveport, Louisiana, are used, useful, and necessary to the provision of service to customers located in Texas because they form an integral part of the power supply, transmission system and interconnection points with other utilities, thus allowing for economical and reliable service.

The Dolet Hills generation station and substation, and the 345 kv transmission line linking Dolet Hills, Louisiana and Shreveport, Lou isji ana should not be certificated as part of this docket, but should be separately docketed and handled as any proposed new generlating plant. Conclusions of Law 1. The Commission has jurisdiction over this matter pursuant to TEX.RIEV.CIV.STAT.ANN. art. 1446c, SrS (Supp. 1980) [the Act]. 2. The facilities depicted on Exhibit I, with the exception of the Dolet Hills generation station and substation and the 345 kv transmission line connecting Dolet Hills, Louisiana with Shreveport, Louisiana, are necessary for the service, accomodation, convenience, and safety of the public. 3. SWEPCO has fulfilled the criteria of 954 of the Act for those facilities set forth in Conclusion of Law Number The qolet Hills generation station and substation and the 345 kv transmission line connecting Dolet Hills, Louisiana with Shreveport, Louisiana should be severed from this docket and SWEPCO should make separate application for those facilities, which application will be treated as is the case with any proposed new generating plant.
