1 O R D I N A N C E NO AN ORDINANCE calling and providing for the holding of a Special Election in a certain portion of St. Louis County, Missouri, outside the present boundaries of the District, for the purpose of submitting to the qualified electors thereof a proposal for the annexation of the herein described area to The Metropolitan St. Louis Sewer District. WHEREAS, petitions to the Board of Trustees of The Metropolitan St. Louis Sewer District praying for annexation have been received from and signed by more than one hundred of the owners of the land in the hereinafter described area, but such signers do not constitute a majority of owners of land in said area owning more than one-half of the land area therein; and WHEREAS, the Board of Trustees is of the opinion that such area could be annexed and the facilities of the District extended to it, NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF TRUSTEES OF THE METROPOLITAN ST. LOUIS SEWER DISTRICT: Section One. The Board of Trustees of The Metropolitan St. Louis Sewer District hereby grants the petitions for annexation to The Metropolitan St. Louis Sewer District of the area within a certain portion of St. Louis County, Missouri, outside the present boundaries of the District as more particularly described in the Notice of Special Election as contained in Section 5 of this Ordinance. Section Two. A special election be and the same is

2 hereby called and ordered to be held within the boundaries of a certain portion of St. Louis County outside the present boundaries of the District as described in Section One hereof on Tuesday the 10th day of May, 1977, for the purpose of submitting to the qualified electors of said area the following proposition; PROPOSITION Shall there be annexed to The Metropolitan St. Louis Sewer District that area of St. Louis County, Missouri, outside the present boundaries of the District as more particularly described in the Notice of Special Election contained in Section 5 of Ordinance No of said The Metropolitan St. Louis Sewer District, adopted March 23, 1977? Section Three. That said special election shall be held at the polling places in said area as set forth and described in the notice of election as contained in Section Five of this ordinance. The polls of said election shall be opened at the hour of 6:00 o'clock A.M. Central Daylight Saving Time and shall remain open until the hour of 7:00 o'clock P.M. Central Daylight Saving Time on the aforesaid date. Section Four. That the ballots to be used at said special election shall be in substantially the following form, to wit: OFFICIAL BALLOT ST. 3 SPECIAL ELECTION Tuesday, the 10th day of May, 1977 PROPOSITION Shall there be annexed to The Metropolitan St. Louis Sewer District that portion of St. Louis County, Missouri, outside the present boundaries of the District as more particularly described in the Notice of Special Election contained in Section 5 of Ordinance No of said The Metropolitan St. Louis Sewer District, adopted March 23, 1977? FOR THE ANNEXATION OF THE AREA Yes... No (Instructions to voters; to cast a vote in favor of the annexation of area, place a cross (X) mark in the square opposite the word "Yes"; to cast a vote against annexation of area place a cross (X) mark in the square opposite the word "No"). Section Five. That the Secretary-Treasurer be and he is hereby directed to dive notice of said special election by advertisement published once a week for at least three (3) consecutive weeks in the St. Louis Globe-Democrat and in the St. Louis Post-Dispatch, newspapers of general circulation in The Metropolitan St. Louis Sewer District, and in the area proposed to be annexed, the first publication in each of said newspapers to be made at least twenty-one (21) days prior to the date of the election and the last publication to be made not more than seven 3

4 (7) days prior to the date of said election. The said notice shall be in substantially the following form, to wit: NOTICE OF SPECIAL ELECTION ST. LOUIS COUNTY STATE OF MISSOURI Notice is hereby given to the qualified electors of that portion of St. Louis County, State of Missouri, outside the present boundaries of The Metropolitan St. Louis Sewer District, more particularly described as follows: Beginning at the present southeast corner of The Metropolitan St. Louis Sewer Distract as extended by Ordinance No. 1251, adopted December 10, 1964, and being in T.43N., R.7E., St. Louis County, Missouri and on the state line common to the States of Missouri and Illinois, said point being at the intersection of said state line and the eastwardly prolongation of the southern boundary of U.S. Veterans Hospital property; thence southerly along said state line, being along the centerline of the Mississippi River, to its intersection with the common boundary line of St. Louis and Jefferson Counties, Missouri which is also a point on the eastern projection of the centerline of the Meramec River; thence northerly and northwesterly upstream along the aforesaid common County boundary, which is also the centerline of the Meramec River, to its intersection with the south line of T.44N., R.5E.; thence westerly along said south line, and along the south line of T.44N., R.4E., being also the line common to St. Louis and Jefferson Counties, to the intersection of said last described line with the centerline of the Meramec River, being at the southwest corner of Fractional Section 32, T.44N., R.4E. also a point on the common boundary of St. Louis and Jefferson Counties; thence northwesterly and northerly, downstream along the centerline of the Meramec River to its intersection with the southern prolongation of the east line of the tract described as Parcel No. 2 of property conveyed to George Horatio Packwood, Jr. by deed recorded in Book 1641, Page 581, St. Louis County, Missouri Recorder's Office; thence northerly along said prolongation and along said east line to the northeast corner of said Parcel No. 2; thence west along the north line of said Parcel No. 2, and continuing west along the south line of the tract described as Parcel No. 1 in said Packwood deed, to the southwest corner of said Parcel No. 1; thence northerly along the western line of said Parcel No. 1 to 4

Keil, Jr. and wife by deed recorded in Book 6777, Page 1478; thence northerly along the west line of said Keil property to its intersection with the centerline of Old State Road; thence northerly on said road centerline to its intersection with the south line of the Northeast 1/4 of the Southwest 1/4 of Section 7, T.44N., R.4E.; thence west and north, along the south and west lines, respectively, of said Northeast 1/4 of the Southwest 1/4 of Section 7 to the northwest corner thereof; thence westerly in a straight line to the southeast corner of the Southeast 1/4 of the Northeast 1/4 of Section 12, T.44N., R.3E.; thence west and north along the south and west lines, respectively, of said Southeast 1/4 of the Northeast 1/4 of Section 12 to the northwest corner thereof; thence north along the west line of the Northeast 1/4 of the Northeast 1/4 of said Section 12 to its intersection with the eastern prolongation of the south line of the 5.00 acre tract conveyed to Charles F. Johnson and wife, by deed recorded in Book 1165, Page 293, said Recorder's Office; thence west along said prolongation and along the south line of said 5.00 acre tract to the southwest corner of property conveyed to Loid E. Campbell and wife, by deed recorded in Book 5394, Page 28, said Recorder's Office; thence north feet along the st line of said Campbell property, and its northern prolongation, to the centerline of Brown Road, 25 feet wide; thence west along the centerline of Brown Road to the centerline of Clay Avenue; thence north along the centerline of Clay Avenue to the centerline of Manchester Road; thence west along the centerline of Manchester Road 550 feet,more or less to the centerline of Old Eatherton Road, 40 feet wide; thence north and northwesterly along the centerline of said Old Eatherton Road to its intersection with the centerline of Missouri State Highway No. 109 (New Eatherton Road); thence northerly and northwesterly along the centerline of said Highway No. 109, also known as New Eatherton Road, 60 feet wide, to the point where New Eatherton Road diverges to the right from Highway No. 109, and becomes known as Missouri State Route "C"; thence northerly along the centerline of New Eatherton Road, also known as Missouri Route "C", to its intersection with the centerline of Wild Horse Creek Road (State Highway "CC"); thence continuing northwardly along the centerline of Eatherton Road cross Wild Horse Creek Road to its intersection with the centerline of Olive Street Road; thence westwardly along said centerline of Olive Street Road and its westwardly extension to the common boundary line of St. Louis and St. Charles counties, Missouri, which common boundary line lies in the Missouri River; thence downstream, being generally northeasterly, along said St. Louis - St. Charles County line to its intersection with the state line common to the States of Missouri and Illinois; thence southerly along said state line, being also along the centerline of the Mississippi River to the present northeast corner of The Metropolitan St. Louis Sewer district; and thence westerly, 5

6 southerly and easterly along the present northern, western and southern boundaries, respectively, of The Metropolitan St. Louis Sewer District, to the point of beginning. that a special election will be held in said area on Tuesday, the 10th day of May, 1977, commencing at 6:00 o'clock A.M. Central Daylight Saving Time and closing at 7:00 o'clock P.M. Central Daylight Saving Time on said date, and that at said special election there will be submitted to the qualified electors of said area the question of the annexation of the said area to The Metropolitan St. Louis Sewer District. 20 15270 Old Halls Ferry Road By order of the Board of Trustees of The Metropolitan St. Louis Sewer District, this 23rd day of March, Charles Clardy Secretary-Treasurer Section Six. That, as provided by Section of the Plan of The Metropolitan St. Louis Sewer District, the said special election shall be held and conducted and the returns thereof made, examined, and cast up in the same manner and in all respects as provided by law for the election of state and county officers. All registered voters residing within said area shall be entitled to vote at said election. Section Seven. That the Secretary-Treasurer of this Board shall be and he is hereby directed to file a certified copy of this ordinance with the Board of Election Commissioners for St. Louis County, Missouri, as and for the warrant and authority of the said Board to hold and conduct the special election herein provided for; and the said Board of Election Commissioners is hereby requested to do all things and take all proceedings necessary to the holding and conducting of the said special election. Section Eight. That all ordinances or parts of ordinances which in any manner conflict with the provisions of this ordinance shall be and the same are hereby repealed, insofar 20
