1 THE CORPORATON OF THE TOWN OF WHTCHURCH-STOUFFVLLE BY-LAW NUMBER 77-5 A by-law to amend By-law No of The Town of Whitchurch-Stouffville. (restricted area by-law) WHEREAS the matters herein set out are in conformity with the Official Plan of the Town of Whitchurch-Stouffville which is approved and in force at this time. AND WHEREAS there has been no amendment to the Official Plan of the Town of Whitchurch-Stouffville proposed by Council but not approved at this time with which the matters herein set out are not in conformity. NOW THEREFORE THE COUNCL OF THE CORPORATON OF THE TOWN OF WHTCHURCH-STOUFFVLLE ENACTS AS FOLLOWS : l. By-law No as amended is hereby further amended as follows: (l) Schedule "B" to By-law No is hereby amended by changing that part thereof shown on Schedule "X" hereto by endorsing on said Schedule "B" the zone boundaries and zone symbols shown on Schedule "X" to this by-law. (2) Section 5.2 is hereby amended by adding thereto after the words "detached dwelling", the words "semi-detached dwelling". (3) Section is hereby amended by adding thereto the following: THRDLY: All and Singular that certain parcel or tract of land and premises situate, lying and being in the Town of Whitchurch-Stouffville, (formerly Township of Whitchurch), in the Regional Municipality of York, and being composed of Part of Lot 2, Concession 9, Town of Whitchurch Stouffville, and being designated as Parts l and 2 on Plan 65R-2129, Parts l and 2 on Plan 65R-2126, Part l on Plan 65R-244, and Parts l and 2 on Plan 65R-213, all being Reference Plans deposited in the Registry Office for the Registry Division of York North (No. 65). (4) By repealing that part of Section 6 designated as subsection 6.15 thereof and substituting the following: 6.15 R3 USES PERMTTED No person shall use land or erect or use a building or structure in a Residential Third Density (R3) Zone except for one or more of the following uses: All uses permitted in the Rl and R2 zones, semidetached dwellings; and except in any R3 zone located within the area described as, All and Singular that certain parcel or tract of land and premises situate, lying and being in the Town of Whitchurch-Stouffville, (formerly Township of Whitchurch), in the Regional Municipality of York, and being composed of Part of Lot 2, Concession 9, Town of Whitchurch Stouffville, and being designated as Parts l and 2 on Plan 65R-2129, Parts l and 2 on Plan 65R-2126, Part l on Plan

2 2 65R-244, and Parts 1 and 2 on Plan 65R-213, all being Reference Plans deposited in the Registry Office for the Registry Division of York North (No. 65), Boarding Houses; Day Nurseries; and, Duplex Dwellings. (5) By adding to each of subsections , tem 3; , tem 3 and , tem 3 the following: n the area described as, All and Singular that certain parcel or tract of land and premises situate, lying and being in the Town of Whitchurch-Stouffville, (formerly Township of Whitchurch), in the Regional Municipality of York, and being composed of Part of Lot 2, Concession 9, Town of Whitchurch Stouffville, and being designated as Parts 1 and 2 on Plan 65R-2129, Parts 1 and 2 on Plan 65R-2126, Part 1 on Plan 65R-244, and Parts 1 and 2 on Plan 65R-213, all being Reference Plans deposited in the Registry Office for the Registry Division of York North (No. 65), Front Yard (Minimum) 2 feet. 2. This by-law shall take effect from the date of passage by Council and shall come into force upon approval by the Ontario Municipal Board.
