Toffel ( the Trustee ), duly appointed Chapter 7 Trustee of the bankruptcy estates of the Debtors associated with these jointly administered cases, and files his Sixth omnibus objection to claims as follows: 1. This objection is asserted pursuant to 11 U.S.C. 502 and 503(b)(9), Federal Rule of Bankruptcy Procedure Rule 3007 and Local Rule This Court has jurisdiction to consider this matter pursuant to 28 U.S.C and 157. This Motion concerns a core proceeding pursuant to 28 U.S.C. 157(b). Venue of this Motion is proper pursuant to 28 U.S.C and Each of the claims listed on Exhibit A hereto were filed in one or more of the jointly administered cases and designated as a claim filed with priority under 11 U.S.C. 503(b)(9). 4. The Trustee objects to each of the claims listed hereto on Exhibit A on the basis that some or all of the claim is based on goods that were provided outside of the twenty (20) days as set forth in 11 U.S.C. 503(b)(9), reflect charges for labor, reflect charges for freight or reflect charges for rental of equipment, all of which do not qualify for priority under 11 U.S.C. 503(b)(9).

WHEREFORE, the Trustee respectfully requests the Court to enter an order declaring that each of the claims listed on Exhibit A shall be allowed at the reduced amount reflected on said exhibit. Trustee requests all other and further relief to which he may be entitled.
