Definitions Awards Mirchi Music Awards 2011 Bangla ( the Awards ) Award Management / Organizers - Entertainment Network (India) Limited ( ENIL or the Company ) EY Ernst & Young Private Limited, process advisors and official tabulators to the winner determination process of the Awards Participant Any organization / individual who sends in an application to participate in the Awards, or whose song / album is chosen or entered for participation in the Awards in any manner Nominee or Finalist Any song / album / person short-listed by the screening jury for evaluation by the Grand Jury Screening Jury - A group of jury persons who will evaluate all entries as part of the process of shortlisting Nominees Technical Jury - A group of jury persons who will evaluate all entries for technical categories as part of shortlisting Nominees and winner determination process Grand Jury - Group of persons appointed by Award Management who will approve the proposed process of the Awards, ratify the nominees shortlisted by the Screening Jury and then vote on the nominees to determine final winners 2. Non Film Categories Category Awards Rabindra Sangeet 1. Album of the year 2. Male vocal 3. Female vocal Bangla band 4. Album of the year - Jury 5. Album of the year Listener s choice Contemporary 6. Album of the year Bengali songs 7. Music composer 8. Lyricist 9. Male vocal 10. Female vocal Remakes of older 11. Song of the Year compositions Instrumental 12. Song of the Year The award categories may be added / deleted / modified based on the level of response received, at the discretion of the Awards management in consultation with the Jury. The parameters for evaluation are determined by the Grand Jury and are subject to revision by them Upcoming artists are those whose music has released first time in last 2 years i.e. calendar year 2009 and Upcoming winners will receive a certificate of merit, not a trophy 3. Call for entries The Awards will be announced in one or more relevant edition(s) and / or by direct communication with potential Participant / Label owners, and that shall be construed to be adequate notice for call for entries. Participants will have to fill and application form to participate in the Awards. 3 Mirchi Music Awards Bangla 2011 To, Ms. Priyanka Dey Radio Mirchi Entertainment Network (India) Limited, Shantiniketan Building, 13 th floor, 8, Camac Street, Kolkata The last date for receipt of entries is Dec 10, 2011 before 6 p.m. Participation of entries after last date specified may be permitted only at the discretion of Awards Management. Awards Management will not be responsible for application forms and / or CDs that are lost or damaged in transit / received late Application forms once submitted and accepted by Awards Management, will be considered as final, no alterations, replacements will be permitted If multiple participants apply for the same project in the same category, then such entries will be treated as one entry for evaluation purpose, and Awards management on best effort will try to contact the owner of the Album to produce evidence of ownership. For the same purpose, Awards Management may ask for addition information / document. Participant has to revert with information / document within 3 days, else the entry will not be considered for Awards process. 4. Eligibility Criteria for participation in the Awards All Indian organizations, communities and persons who have been a part of creation of Bangla film music and non-film music are permitted to participate in the awards i.e. they must be entities with a registered address in India, or persons with Indian citizenship Film music - Songs from the films that released between Jan 1 Dec Private albums - Songs from the private albums that released between Dec 1, 2010 Nov 30, This can be changed at any time and is at the discretion of the Jury. Participation of films not produced in India, or foreign language films dubbed into Indian languages will not be considered, unless the category definition allows the same. While all attempts will be made to gather film release, film song and artist information and non-film albums and songs and artist information correctly and in entirety, due to the fragmented record-keeping nature of the music industry in India, the complete list of films, albums and songs, and artists of songs may not be available or accurate. Attempts will be made to get a complete list from film bodies and / or a music retail store, on a best effort basis. Consequently, Awards management, Juries and their contractors are not responsible for the completeness of all film, song and artist information, which will be gathered on a best effort basis. Participants understand and agree that mere participation in the Awards does not entitle Participants to win a prize. The objective is to recognize only original music. All efforts will be made to ensure copied music is removed from the songs eligible for participation. However, information on the same is subjective, and 100% accurate identification of such songs cannot be guaranteed.

4 5. Timelines Efforts will be made to adhere to the defined timelines. However, the defined timelines are subject to change based on circumstances Awards Management and its sub-contractors shall not be held accountable / liable for any disruptions / stoppages / interruptions or cancellation of the Awards or its ceremony or any part of its processes or public voting on account of any factors beyond its control 6. Completeness of entries/ Disqualification All the fields in the application form have to be filled with necessary details in English only The application form must be signed by producer of the album ONLY at the designated space in the form. Forms without signatures are liable to be disqualified Incomplete and incorrect application forms and/or failure to comply with rules could lead to disqualification The participant MUST attach CD of album which should include all the songs which are to be included for participation purposed. Awards management is not responsible if the CD is received in damaged condition or the content is not readable. Awards management will try to contact on best effort basis for replacement of damaged CD, but cannot be held liable under any condition. The entry will be disqualified from participation in the Awards in case any false disclosure is identified at any point during the process of the Awards 7. Jury evaluation process The jury reserves the right to re-categories any entry which in their view is incorrectly categorized basis the information filled in the application form Jury has the right to increase or reduce the number of Nominees in any award category Jury s decision on the short-listing will be final and binding on all participants Any additional information, if needed, will be sought from shortlisted nominees. Such information sourced from the participants will become part of the original application. The Jury may decide, in order to maintain high standards of these awards, that there could be no winner in a particular category The determination of who should receive an award for any award category rests with the Final Jury 8. Public award winners The number and type of award categories that could be opened to public voting can be modified and changed at the discretion of the Final Jury and Awards Management ENIL will announce to the public the nominees for the public awards as decided by the jury Voting from the public could be restricted to certain channels of Radio Mirchi ENIL will receive and collate votes received through SMS and / or internet Caps will be applied, as deemed required, to the public votes received. These could be changed at any time at the discretion of the Final Jury or Awards management.

Information about songs / albums / people nominated for awards If at any time it is found that the information pertaining to any song / album / person participating in the Awards is incorrect, the same could be removed from participation Further, any prize given to any such song / album / person could be revoked at the discretion of the Final Jury, for contravention against these rules and regulation, at any time Music determined at any stage to be a significant copy of other previously released music can, at the discretion of the jury, be excluded from the songs eligible for participation Information relating to the lyricist, music director, artists, film producer, film director, mixer, arranger etc of a song or album would be based on information provided on the CD cover of the same 10. General The Jury s decision on all aspects related to the short listing and winner determination process is final and binding on all Participants Decision of Awards Management on all other matters is final and binding on all Participants, Nominees and Finalists, and no correspondence will be entertained on the same Nominated persons could be contacted to provide further information for the final round Participants, Nominees and Winners permit free of cost the use of their name and factual information about their participation in the public media (for the build-up to the Awards, during the Awards ceremony and after the Awards ceremony) and do not have any right to any revenues earned through intellectual property rights generated by the Awards, if any ENIL, the Juries, and its contractors will not be liable for any claims / disputes made by the Participants, Nominees, Winners, rights owners, music companies, etc in relation to the Awards ENIL and its event partners and subcontractors reserve the right to withdraw, or amend the terms of the Awards at any time and does not take responsibility for any loss or damage that any person or organization may suffer as a result of participating or attempting to participate in the Awards, the Awards being withdrawn or its terms amended. ENIL cannot and shall not be accountable / liable for any disruptions / stoppages / interruptions or cancellation of the Awards. ENIL and its contractors can not be held responsible for matters out of its control and for force majeure reasons. Additions, deletions and/or modifications to these Rules are at the discretion of ENIL and the Final Jury, and they may make such additions/deletions and/or modifications, at any time before or after the Awards, prospectively or retrospectively. All disputes relating to or arising out of the Awards shall be subject to the laws of India, and shall be subject to the exclusive jurisdiction of the courts of competent jurisdiction at Mumbai, India. The Participants, Nominees and Winners agree that they shall hold harmless ENIL and event Sponsors, their employees, officers, contractors or other persons and shall defend them against any loss, claim, demands, costs, damages, judgments, expenses or liability arising out of or in connection with any or all claims whether or not groundless, that may

6 be brought against ENIL (and the others mentioned above) by any third party in connection with participation in or winning the Award.
