1 FIRST NATION COMMUNITY PROFILES KWANLIN Dün FIRST NATION - COMMUNITY OF WHITEHORSE POTLATCH REGALIA -COMPLIMENTS OF YUKON GOVERNMENT PHOTO GALLERY Kwanlin Dün First Nation History Self-government Agreement signed For generations, the people of the Kwanlin Dün First Nation have lived and thrived along the Chu Nínkwän, today s Yukon River. The name Kwanlin itself means water running through canyon and refers to the length of river from Miles Canyon to the Whitehorse rapids. The Traditional Territory of the Kwanlin Dün First Nation was originally occupied by the Tagish Kwan people and is shared with the Ta an Kwäch än Council; Kwanlin Dün respects and acknowledges all who share this territory. Kwanlin Dün First Nation is unique in that the citizens that make up its Nation are not from one tribe or one region. Kwanlin Dün has welcomed people from other Yukon First Nations. Because of the diversity of people, Kwanlin Dün is made up of several linguistic dialects, however, Southern Tutchone, Northern Tutchone, Tagish and Tlingit are the most common. Kwanlin Dun people follow a matriarchal clan system of Wolf or Crow; and due to the diversity and varying traditions Kwanlin Dun has many art, craft and beading styles, as well as many stories and traditions that have been passed down from elders. In 1956, the Department of Indian Affairs unilaterally decided there were too many Indian bands in the Yukon Territory and, for administrative purposes, joined six bands into three. This brought about the amalgamation of the indigenous people between Marsh Lake and Lake Laberge as the Whitehorse Indian Band, known today as the Kwanlin Dün First Nation. In 1988, after many years of being displaced, Kwanlin Dün village was once again relocated to its current placement in the McIntyre subdivision, which also houses the KDFN Government s offices. In 1998, the Whitehorse Indian Band had split into two distinct and independent groups, Kwanlin Dun First Nation and the Ta an Kwäch än Council. On April 1, 25, after decades of negotiation, Kwanlin Dün signed off their Final and Self-Governing Agreements, thus gaining treaty protection under Canada s constitution and became the 1th self-governing First Nation in Yukon. Kwanlin Dün First Nation Treaty became one of the first urban land claim agreements in Canada.

2 KDFN ADMINISTRATIOn Departments of KDFN Public services such as Health, Housing, Education and Social Assistance are provided to Citizens under the Kwanlin Dün Self-government Agreement. Support services for the self-government are provided through the departments of Health, Community Justice, Human Resources, Education, Economic Development, Heritage, Lands and Resources, Housing and Community Services, Finance, and Administration. Economic Development The Kwanlin Dün First Nation Economic Development office oversees all economic development initiatives and intends to generate profits for the Kwanlin Dün First Nation and provide employment and job-training opportunities for its members. The main goal of the department is to create wealth for the First Nation while playing a major role in Yukon economy. REGALIA -COMPLIMENT OF YTG PHOTO GALLERY (Adeline Webber) Heritage, Lands and Resources Department The department of Heritage, Lands and Resources (HLRD), formerly Land Claims Department, is responsible for ensuring the land claims and self-government agreements are implemented. These duties are divided into two main categories: implementing the land and natural resource sections of Kwanlin Dün First Nation s land claim agreements; and taking care of Kwanlin Dün First Nation lands and heritage for the future. The HLRD staff participate in surveying settlement lands, setting up Special Management Areas, managing fish & wildlife, land use planning and forest management planning. As a member of the Development Review Committee, HLRD also provides input to the City of Whitehorse on subdivision and other development plans, zoning and land dispositions, works with Yukon government and other Yukon First Nations on new (successor) and amending legislation for Yukon, and works on new land policies and laws for Kwanlin Dün First Nation lands. Health Department The Kwanlin Dün First Nation Health Department strives to build a strong community that is healthy, family oriented and self-sufficient; the departments work to build a community where cultural values are respected, and motivated people pray, work, and play together. The Health Department is comprised of Health Services, Wellness Services, Duska Daycare, Ashea Head Start and Community Justice Program. The goals of Duska Daycare and Ashea Head Start are to work with families to prepare children for educational opportunities while developing positive self-identities and the desire for life-long learning, all in a healthy and safe environment. The Community Justice program is committed to providing culturally-based holistic services that assist Kwanlin Dün First Nation community members who are involved in the criminal justice system. The Justice Program facilitates processes that involve reconciling victims and offenders, including empowering victims. The Community Justice Program also provides opportunities for the community to utilize its voice in criminal, victim services and child protection matters. Community Services Community Services is responsible for all houses, community buildings and infrastructure that belong to the Kwanlin Dün First Nation. They provide some municipal services to the KDFN communities that are not serviced by the City Of Whitehorse. Community Services oversees the maintenance of all Kwanlin Dün houses as well as the maintenance and operation of all community buildings, including Housing Office, Na Kwa Ta Ku Potlatch House, House of Learning, and the Justice office. It also includes the Jackson Lake camp and the building that houses the water truck at lot 226. Human Resources, Education & Social Assistance Employment Preparation Training provides advice on resume development in order to assist citizens in attaining meaningful employment. Through the Labour Force Alliance and Post-Secondary Education programs, Kwanlin Dün First Nation citizens are able to advance their education and become self-sufficient. Social Assistance is a necessary service that provides financial assistance to those that are unemployed. This department also provides assistance to elders through firewood and home cleaning services. Kwanlin Dün First Nation: 2

4 Kwanlin Dün First Nation Self-Government Agreement Land Claim Agreements The Kwanlin Dün First Nations signed Final and Self-Government Agreements with Yukon and Canada on February 19, 25. The effective date of these agreements was April 1, 25. Governance Structure The Kwanlin Dün government structure is established by its Constitution, which was developed ac cording to the Self-Government Agreement. Among other things, the Constitution provides for five separate branches of government, which includes the General Assembly, the Elders Council, the Youth Council, the Judicial Council and Chief and Council. Traditional Territory The Traditional Territory of the Kwanlin Dün First Nation is centered on the City of Whitehorse. In very generalized terms, this area of historic use and occupation extends west to east from the Kusawa Lake area to east of the Teslin River; and north to south from north of Braeburn to near the south end of Marsh Lake. Settlement Land and Special Management Areas Through the terms of the Umbrella Final Agreement, the Kwanlin Dün First Nation owns the following Settlement Land: km² of Category A Land meaning that the First Nation owns both the surface of the land as well as what is below it (such as minerals and oil and gas) km² of Category B Land meaning that the First Nation owns the surface of the land but not what is below the surface 6.79 km² of land allocated per section of the Final Agreement The Kwanlin Dün First Nation Final Agreement established Kusawa Park and Lewes Marsh Habitat Protection Area as Special Management Areas. Heritage Areas The Kwanlin Dün First Nation Final Agreement required the establishment of the Canyon City heritage site as a Designated Heritage Site. The Kwanlin Dün First Nation Final Agreement also required Yukon to provide $1,25,. to the Kwanlin Dun First Nation for the construction of a cultural centre, as well as the establishment of a working group in respect of Kwanlin Dun waterfront heritage. Financial Compensation In accordance with the terms of Chapter 19 of the Umbrella Final Agreement, the Kwanlin Dün First Nation became entitled, on the Effective Date of its Final Agreement, to its share of the financial compensation package provided by the government of Canada. This amounted to $21,396,353, as measured in 1989 dollars. The Final Agreements include formulae for determining each First Nation s Adjusted Final Share; in the case of the Kwanlin Dün First Nation, factoring in interest, this resulted in 15 annual payments of $3,131,634 starting on the date the Agreement was signed (February 19, 25). Taxation As a self-governing Yukon First Nation, the Kwanlin Dün First Nation has the authority for taxation, for local purposes, of interest in Settlement Land and of occupants and tenants of that land. The First Nation is also able to enter into tax sharing arrangements with Canada and Yukon regarding the sharing of tax-generated revenue. The Kwanlin Dün First Nation is responsible for paying property taxes for some, but not all Settlement Land, in accordance with Chapter 21 of the Final Agreement. Property taxes are not paid on unimproved rural Settlement Land. Economic Development Measures Chapter 22 of the Kwanlin Dün First Nation Final Agreement provides for certain economic development measures intended to provide Yukon Indian People with opportunities to participate in the Yukon economy and to ensure they obtain economic benefits that flow directly from the Agreement. 4
