2 WHAT IS DEFERRED ACTION F CHILDHOOD ARRIVALS (DACA)? On June 15th, 2012, President Obama announced a policy called Deferred Action for Childhood Arrivals (DACA). DACA was created to provide temporary relief from deportation for those who arrived in the US at a young age and meet the policy s strict eligibility criteria. Many who are currently eligible for DACA have not applied because they have had trouble gathering the necessary evidence to prove that they meet the criteria. This resource provides suggestions as to how and where to seek out the necessary documents one needs in order to apply for DACA. You don t necessarily need to include all of the documents listed in this resource, but these are some of the most common documents people have used as evidence for their DACA application. Note: The examples listed in the Where to Obtain Documents column are specific to the San Francisco Bay Area. 2

4 CRITERIA/CATEGY OF Proof of Entry to U.S. Before 16th Birthday Proof of Educational Requirements You must be enrolled in or graduated from a Public or private high school or secondary school a GED program. School ID Official Transcripts Attendance Records School Registration Document(s) High School Diplomas or GED Certificate Usually you can find any or all of these documents at your school district office. However, each school district has different procedures or standards by which they release student information so it is important to begin by contacting your district office and finding out what their policy is. In general, federal law protects school records and there are rules that most district offices must follow before releasing them. Most district offices require that people requesting student records provide identification (state ID, consular ID, or passport) and sometimes have them fill out a form. If someone other than the student is requesting the records, some district offices require that these individuals bring something in writing granting permission to the district to release their information to the individual requesting it. Immunization Record Medical Charts Medical Appointment Receipts Most if not all of these can be found at either the clinic or hospital where you receive medical treatment and attend appointments. Sometimes there is a formal request form that must be submitted with a fee in order to obtain a person s records, but this varies from medical center to medical center. It is best to contact the records department at your own particular center to find out what the procedure is. 4

5 CRITERIA/CATEGY OF Tax Returns Tax Transcripts A transcript of a person s taxes can be requested by either calling , or by requesting it online at Proof of Presence on June 15, 2012 Bank Statements Bank statements can be requested at your local branch. If you submit these as proof of evidence, you should make sure that the account number gets whited out. Utility, phone, or other bills Utility and other bills can also be used as long as there is a legible date and the name of the person requesting DACA. If you do not already receive these documents on a monthly basis, they can be acquired by contacting your phone and other service providers. The customer service line can be helpful in providing these documents. Written affidavits from employers, church staff, or school employees Written affidavits (or letters of support) can be included to supplement more concrete evidence such as bank statements, tax returns, school forms, or utility bills but should not be the only form of evidence submitted to establish presence. People who write affidavits should have legal status and be able to provide a copy of their ID 5

6 CRITERIA/CATEGY OF Proof of Criminal Record Arrest Records Police Reports Livescan Reports To find arrest and police reports, you should look for the police report section in your local police website. If you have been arrested but have not been able to locate a police report, you can get a Livescan, or a fingerprint screening.
