1 TO THE ATTENTION OF FOREIGN CITIZENS PERMANENTLY RESIDING OR IMMIGRATING IN MONGOLIA AND STATELESS PERSONS. A foreign citizen who is married to a person with Mongolian citizenship and residing for over 90 days in Mongolia is referred to as a permanent resident. A foreign citizen who came to live in Mongolia for private business for over 5 years is referred to as an immigrant. 1. A foreign citizen willing to immigrate and reside in Mongolia shall bring \ send to the Office of Immigration, Naturalization and Foreign Citizens the following materials completed through the Diplomatic Representative or Consular Office in his \ her country ( if already in Mongolia may directly address to the Office ): 1.1 Application ( people over 16 years of age ); 1.2 International Health Certificate proving that he \ she has no quarantined diseases and an official medical document certifying that he \ she has been tested for AIDS and sexually transmitted diseases; 1.3 Official reference by an authorized police organization of his \ her country whether he \ she is involved in a crime or in a violation of established laws, and a reference showing the country of citizenship; 1.4 Background of two generations ( people over 16 years of age ); 1.5 A copy of professional certificates and diplomas; 1.6 Completed application form of immigration or permanent residency in Mongolia ( people over 16 years of age ); 1.7 Reference of local administration organization on residential address and family status; 1.8 Written guarantee of capital source while living in Mongolia ( people over 16 years of age ); 1.9 A copy of marriage or divorce certificate(s); 1.10 A copy of birth certificate of children under 16 years of age ( if any ); 1.11 Three 3x4 ID photos ( people over 16 years of age ); 2. All materials shall be completed in the Mongolian language and their translations shall be corroborated by notary public. 3. If a foreign citizen residing in or immigrating to Mongolia wants to extend living term, if a person of 16 years of age wants to have a resident license, and if a foreign citizen who lost or damaged his \ her resident license wants a new one to be re-issued should submit the following materials to the Office: 3.1 Application; 3.2 Passport; 3.3 Resident license ( if for extending the term ); 3.4 Reference of local administration organization; 3.5 Official reference of the Police organization on whether he \ she was involved in a crime, violated rules on residing and traveling in Mongolia; 3.6 Completed application form ( if acquiring for the first time or replacement of resident license ); 3.7 Three 3x4 ID photos; 4. The Office shall resolve the materials completed for residing and immigrating to Mongolia within two months after their receipt, and the materials completed for extending residency term, obtaining first time or re-issued resident license within one month after their receipt or return if they are not completed correctly. 5. Materials for extending the term of permanent residence and immigration in Mongolia should be submitted to the Office one month before their expiration date. 6. Immigrants, permanent residents and stateless people shall bear the following duties: 6.1 Follow the Mongolian laws and regulations by respecting the Mongolian Constitution and respect Mongolian 6.2 Pay tax in accordance with the laws; 6.3 Shall engage in labor, establish an economic entity or manufacturing business and services only after obtaining permission from the Central Employment Office; 6.4 Shall not work as a Mongolian civil servant; 6.5 Within 5 days shall notify about changes appearing in labor engagement, family status ( marriage, divorce, birth of child, adoption of child, death of a family member, annulment of marriage, changes in surname and\ or first or middle name ); 6.6 If it is needed to travel for over 7 days from one administrative unit to another one, shall make registration in the local police organization; 7. If a foreign citizen residing permanently in or immigrating to Mongolia has to travel abroad should leave his \ her resident license at the Office and obtain an exit-entry visa for not more than 120 days a year. 8. A stateless person shall obtain travel document and visa to travel abroad. 9. To commit a crime by violating Mongolian laws, to be employed without permission, violate social order, repeatedly violate the rules on the permission and registration of residing in Mongolia and to delay the extension of the resident license will be the roots for abolishing the permission for residence in Mongolia and will be cause to be expelled from Mongolia. 10. In case of violating the rules of residence and registration in Mongolia, a penalty of Tg 100, ,000 will be imposed in accordance with the Law on Administrative Responsibilities. 2 TO THE ATTENTION OF FOREIGN CITIZENS LIVING IN MONGOLIA FOR LONG TERM. A foreign citizen living in Mongolia for private business for a term from 90 days up to 5 years is referred to as a long term resident for private business. A foreign citizen willing to live for private business for the long term shall complete the following and address it to the Office of Immigration, Naturalization and Foreign Citizens through the Diplomatic Representatives or Consular Office of Mongolia in his \ her country. If already in Mongolia shall address directly to the Office. 1. Application clearly determined the reason for the long term residence for private business; 2. International health certificate proving that he \ she has no quarantined diseases and an official medical document certifying that he \ she has been tested for AIDS and other sexually transmitted diseases; 3. Official reference by an authorized police organization of his \ her country whether he \ she has been involved in a crime or in a violation of established order, and a document showing country of citizenship; 4. Written guarantee of capital resources while he \ she will live in Mongolia; The Office shall resolve the matter within a month after receiving the materials completed for a long term resident for private business and return them if not completed. The Office will grant permission for long term residence in Mongolia for private business for one year. In necessary cases, it will make an extension of up to one year for one time only. The Office shall send to the Diplomatic Representative or Consular Office the reply in written form to the application which was sent from abroad. Based on permission granted by the Office, the Mongolian Diplomatic Representative or Consular Office in the country shall grant entry visa to the foreign citizen willing to reside in Mongolia for a long term. In accordance with the Central Employment Office a foreign citizen residing for private business for long term could be employed in a governmental or non-governmental organizations and economic entity representative office or hold manufacturing or services by establishing them. The foreign citizen obtained the permission for residing in Mongolia for long term for private business shall bear the following duties: a) Follow the Mongolian laws and regulations by respecting the Mongolian Constitution and respect Mongolian c) Prohibited to be employed without permission; d) Prohibited to establish an organization to hold political activities in the territory of Mongolia, enroll in such organizations and to hold any political activities with any other way; e) Prohibited to organize the promotion of activities which go against Mongolian national solidarity, to advertise, distribute and to use religious sects contrary to national custom and laws, or to participate in any form of violence, pornography and illegal drug use; f) If it is needed to travel for over seven days from one administrative unit to another one, shall make registration in the local police organization; g) Shall not work as a Mongolian civil servant; To commit a crime by violating Mongolian laws, to be employed without permission, violate social order and the rules on the permission and registration of residing in Mongolia will be the roots for abolishing the permission for residence in Mongolia and will cause to be expelled from Mongolia. Penalty of Tg 100, ,000 will imposed in accordance with the Law on Administrative Responsibilities to the foreign citizen who did not make an extension of his \ her residential permission in time. 3 TO THE ATTENTION OF FOREIGN CITIZENS COMING TO MONGOLIA FOR TEMPORARY PERIOD. A foreign citizen living for up to 90 days for private business in Mongolia is referred to as a temporary resident. 1. A foreign citizen has the right to stay in the territory of Mongolia during the valid term of visa granted by Mongolian overseas Diplomatic Representatives or Consular Offices. The visa term is counted as starting from the day of entry into Mongolia. 2. A foreign citizen coming with a visa term of days shall be registered at the Office of Immigration, Naturalization an d Foreign Citizens within 7 days and excluded from registration before leave. 3. It is prohibited for a foreign citizen who came with an individual`s invitation and visa of *H* classification and travel visa of *J* classification to be employed besides the purpose of arrival. 4. A foreign citizen shall bear the following duties while residing and traveling in the territory of Mongolia: a) Follow the Mongolian laws and regulations by respecting the Mongolian Constitution and respect Mongolian traditions and customs; c) Prohibited from establishing an organization to hold political activities in the territory of Mongolia, to enroll in such d) Prohibited from organizing the promotion of activities which go against Mongolian national solidarity, to advertise, distribute or use religious sects contrary to national custom and laws, or to participate in any form of violence, e) Prohibited be employed without permission; f) Prohibited from harming the rights and freedom determined by the Mongolian laws and International Treaty, and the interest of the country`s citizens and other human rights and lawful interests. 5. In the case where a violation of the rules of residence and registration in Mongolia a penalty of Tg will be imposed in accordance with the Law on Administrative Responsibilities.
4 TO THE ATTENTION OF FOREIGN CITIZENS ARRIVING IN MONGOLIA FOR LONG TERM OFFICIAL BUSINESS. A foreign citizen willing to study, be employed, take an official position in foreign governmental and non-governmental organization or in a representative office of an international organization, head of staff or take similar position in foreigninvested business in Mongolia in accordance with intergovernmental contract for a term of over 90 days is referred to as a long-term resident for official business. 1. A foreign citizen who arrived to work in a joint enterprise, entity, or organization in Mongolia shall come with an entry visa of related classification, and within 7 days shall obtain permission for employment from The Central Employment Office and residential permission by being registered at The Office of Immigration, Naturalization and Foreign Citizens. 2. In case of leaving the country, a foreign citizen employed in Mongolia with permission of an authorized organization shall obtain permission from the Office and get the exit visa. 3. A foreign citizen who arrived for official business for long term can obtain a multiple entry- exit visa in accordance with the permission of a related state administration organization. Basing on the permission of Foreign Investment and Foreign Trade Agency and Central Employment Office, the Office shall grant permission for a multiple visa to the foreign citizen. 4. A foreign citizen who arrived to the country to study or to improve profession in Mongolian Universities, Institutes and Colleges with an entry visa of *S* classification shall obtain permission from the Ministry of Education, Culture and Science and shall be registered at the Office. 5. In the case in which a foreign citizen arriving to the country for official business for long term wants to extend the term of his \ her residence, shall bring to the Office the permission for extension of his \ her work contract from an authorized organization ( Central Employment Office, Foreign Investment and Foreign Trade Agency or Ministry of Education, Culture and Science ) and an official letter from organization or educational institution where he \ she is studying or working one month before visa expiration date. 6. The foreign citizen while residing and traveling in the territory of Mongolia shall bear the following duties: a) Shall follow Mongolian laws and regulations by respecting the Mongolian Constitution and respecting Mongolian c) Prohibited from establishing an organization to hold political activities in the territory of Mongolia, to enroll in such d) Prohibited from organizing the promotion of activities which go against Mongolian national solidarity, to advertise, distribute, or use religious sects contrary to national customs and laws, or to participate in any form of violence, e) Prohibited to be employed without permission; 7. In case of violating Mongolian laws and rules on permission and registration, he \ she shall bear the responsibilities indicated in such laws. In the case of not extending his \ her residential permission on time a penalty of Tg 100, will be imposed in accordance with the Law on Administrative Responsibilities. 8. In the case of committing a crime, violating social order, holding activities prohibited by the law and \ or having administrative charges brought against him \ her, the residential permission will be abolished, and measures for deportation will commence.
5 Office of Immigration, Naturalization and Foreign Citizens TO THE ATTENTION OF FOREIGN CITIZENS VISITING MONGOLIA. A foreign citizen who came to Mongolia for private or official business purposes for up to a term of 30 days is referred to as a visitor. 1. A foreign citizen has the right to stay in the territory of Mongolia during the valid term of visa granted by Mongolian Diplomatic Representatives, Consular Offices and Honorary consulates abroad. The visa term is counted starting from the day of entry into Mongolia. 2. A foreign visitor transiting or with a travel document valid in border area or entered with official passport for a term up to 30 days in Mongolia shall not be registered at The Office of Immigration, Naturalization and Foreign Citizens. If it is impossible to return in his \ her visa term, shall apply with an official letter of request for extension of visa term to the Office three days before visa expiration date. Based on the permission of the Office, the visa term can be extended only once for a term of up to 30 days. In case of making extension of visa term, he \ she shall be registered at the Office and be excluded from registration before departure. 3. A foreign citizen who came by individual invitation with a visa of *H* classification, with a travel visa of *J* classification shall not run private business, be employed or take position in an economic entity, organization for earning profit besides the purpose of arrival. 4. A foreign citizen while residing or traveling in the territory of Mongolia shall bear the following duties: a) Shall follow Mongolian laws and regulations by respecting the Mongolian Constitution and respecting Mongolian b) Prohibited from establishing an organization to hold political activities in the territory of Mongolia, to enroll in such c) Prohibited from organizing the promotion of activities which go against Mongolian national solidarity, to advertise, distribute, or use religious sects contrary to national customs and laws, or to participate in any form of violence, d) Prohibited to be employed without permission; 5. In the case of violating the rules on visiting and transiting in Mongolia a penalty of Tg will be imposed in accordance with the Law on Administrative Responsibilities.
