3 Completing the G-845 If you don t receive a response within 15 business days from date form sent and you have sufficient documentation to make a decision (NO conflicting data), you may review eligibility status and make disbursements Note in student s file that USCIS exceeded the time allotment and eligibility was determined without their verification If a response is received after disbursement and it conflicts with your data, stop future disbursements and resolve For those students not receiving a secondary confirmation, a paper secondary confirmation must be made the following award year 5 Paper Secondary G-845 School policies and procedures on secondary confirmation - 34 CFR Deadlines, documents, consequences and submission of data Requires unexpired documentation Examine, copy and keep! If you determine the evidence is NOT convincing, student is NOT eligible for FSA funds If documentation appears to demonstrate an eligible noncitizen, submit to DHS to confirm it is valid 6 3

4 Paper Secondary Confirmation G-845 Use new G-845 form (expires 5/31/18) 3 pages (under forms ), includes instructions June 29, 2015 electronic announcement erificationrequestg845form.html Send form within 10 days of receiving documentation to USCIS field office in your area Do NOT send to the US Department of Education 7 Eligible Noncitizens Statuses 15/16 FSA HDBK Vol. 1 Ch. 2 Lawful Permanent Residents Noncitizens legally permitted to live/work in the US permanently Permanent Resident Card I-551 (since 1997); Resident Alien Card I-551 (before 1997); I-94; I-94A; MRIV with stamp, US Travel document Application for permanent resident status is NOT sufficient to determine FSA eligibility Conditional Resident Aliens Eligible if documentation is not expired Visa - Upon endorsement serves as temporary I-551 evidencing permanent residence for 1 year. I-551 Conditional expires in 2 yrs instead of

6 Eligible Noncitizens Statuses Victims of Human Trafficking (GEN-06-09) HHS rather than DHS does certification (fail DHA matches) Review certification or eligibility letter from HHS and contact HHS for validity Battered immigrants-qualified aliens (GEN-10-07) Victims of domestic violence by U.S. citizen/permanent resident spouses. Violence Against Women Act (VAWA) Will not pass DHS match 11 Ineligible Statuses Persons with non-immigrant visas: Work visas, students, visitors, and foreign government officials Someone with a nonimmigrant visa isn t eligible for FSA funds unless she has a Form I-94 with one of the endorsements given in the eligible document section Nonimmigrant visas include - F-1, F-2, or M-1 Student Visa, B-1 or B-2 Visitor Visa, J-1 or J-2 Exchange Visitors Visa, H series or L series Visa (which allow temporary employment in the U.S.), or a G series Visa (pertaining to international organizations Notice of Approval to Apply for Permanent Residence (I-171 or I-464) cannot receive FSA funds. 12 6

7 Ineligible Statuses Family Unity Status Relief from deportation (form I-817) Temporary Residents Live/work under Legalization or Special Agriculture Worker program Illegal aliens under amnesty program Allowed to work, but not eligible for aid until approved Students with Temporary Protected Status on I-94 Employment Authorization Card (I-688A); Employment Authorization Documents; or Temporary Resident Cards (I-688) 13 Ineligible Statuses Deferred Action for Childhood Arrivals (DACA) May be eligible for state or college aid Students with a withholding of removal order U-Visa holders U-Visa holders may convert to lawful permanent resident (LPR) status after they have physically been present in the United States for a continuous period of at least three years after the date of admission given on their U-Visa. *Do not submit ineligible document status for paper secondary confirmation* 14 7

10 Completing the G-845 Photocopy front and back sides of documentation Document mailing If you don t receive a response within a reasonable amount of time (10 federal working days from receipt), contact DHS s Case Resolution Team at (877) to verify that the G-845 was received. * REMEMBER: Receipt of G 845 does not constitute eligibility for Federal Student Aid*

12 23 Student Rights Student has at least 30 days from the time you receive the output document to provide documentation of his immigration status Until the results of the secondary confirmation are received, you can t deny, reduce, or terminate aid to him Must notify in writing student of his ineligibility and give an opportunity to contest decision by submitting additional documents 24 12
