2 Introduction The purpose of this training is to provide affected Subrecipient agencies with information on the lawful use of the SAVE program, including when and how to use SAVE, and anti-discrimination and privacy requirements 2

3 SAVE Program Overview: Why are we here? The Personal Responsibility and Work Opportunity Reconciliation Act of 1996 (PRWORA the Welfare Act (P.L ) created two categories of immigrants for federal public benefits eligibility purposes: qualified and non qualified. Generally, the law prohibits non qualified immigrants from enrolling in most federal public benefit programs. 3

4 SAVE Program Overview The Welfare Act required federal agencies to identify which of their programs meet the defined criteria of "federal public benefit program". The Department of Health and Human Services determined that LIHEAP is a federal public benefit program, so PRWORA applies to CEAP and LIHEAP WAP funds. Further, the Department of Energy has determined that it will follow HHS s guidance regarding PRWORA, so it applies to DOE WAP as well. 4

5 SAVE Program Overview Note that HHS has determined that in instances where funds are used for multifamily weatherization, PRWORA does not apply. This includes weatherization of multifamily structures using DOE funds and those using LIHEAP funds. State and local agencies that are directly administering federal programs are required to verify the immigration status of all applicants for federal public benefits. Welfare Act 432, 8 USC 1642(b). 5

6 Why Us? The Welfare Act contains an exemption for nonprofit charitable organizations from any requirement to determine, verify, or otherwise require proof of immigrant eligibility or status. Welfare Act 432(d). A State may not require that such organizations determine, verify, or otherwise require proof of the citizenship or immigration status of individuals applying for or receiving benefits. 6

7 Why Us? For this reason, the nonprofit organizations within the network are not included in this requirement. Further, any entity that is not itself a nonprofit charitable organization but whose client eligibility determinations are completed by a non-profit charitable organization (such as a city which subcontracts its client eligibility determination to a nonprofit charitable organization), then that entity may be exempt from the requirement as well. 7

8 Why Only Some Programs? PRWORA applies only to nonexempt federal public benefits and state and local public benefits. Thus, PRWORA restrictions do not apply to all federal, state, and locally funded activities and programs. At this time, CSBG has not been designated a federal public benefit program. Access to important emergency health services, public health assistance and community-based services necessary to protect life and safety remain accessible to all non-u.s. citizens. CEAP Household Crisis requires program eligibility and SAVE eligibility 8

9 When to Start Verification Verification must start January 1, 2014 for clients for whom eligibility determination has not been made. Just as you have to re-certify income, household make-up, etc, you will have to re-verify status. If you have not started alerting your clients, you should start now! 10 Whom to Verify? The Subrecipients responsibility and authority to verify eligibility is limited to verification that is relevant to eligibility for the covered programs. The rules give Subrecipients maximum flexibility with regard to verifying eligibility under PRWORA, as long as that flexibility is exercised in a nondiscriminatory manner. 10

11 Whom to Verify? For example, a Subrecipient may choose to determine whether the applicants meet specific program requirements before verifying U.S. nationality or alien status, but the agency may not vary its procedures depending on whether the applicant looks or sounds foreign, or on other improper criteria. Create a written process and stick to it. 11

12 NO DISCRIMINATION! Benefit granting agencies must verify PRWORA eligibility without regard to sex, color, race, religion, national origin (except to the extent Cuban, Haitian, or Canadian nationality may be relevant in certain cases as specifically provided by PRWORA and this rule, see (definitions of Cuban and Haitian entrant and qualified alien ), ), or disability. 12

13 U.S. Citizenship Status In accordance with the 14th amendment to the U.S. Constitution, any person born in and subject to the jurisdiction of the United States is a citizen of the U.S. at birth; U.S. citizenship may also be DERIVED through U.S. citizen parents when children are born abroad; or U.S. citizenship may be attained through NATURALIZATION after meeting the necessary residency requirements. SAVE is not used to verify citizenship (one exception*). 13

18 Qualified Alien Status All persons not citizens or nationals of the U.S. are aliens which generally are classified as Permanent Residents (Immigrants), Non-Immigrants, or Undocumented Aliens. Permanent Resident Aliens enjoy almost all of the same rights as U.S. citizens. This status may be obtained through a number of different procedures and, unless taken away by administrative hearing, is granted for life. SAVE is used to verify legal residency. 18

19 Qualified Alien Status (cont) Non-Immigrant Aliens are admitted to the U.S. for a temporary period of time and for a specific purpose, most often as a tourist. There are different classes of non-immigrants, and they are identified through letter/number symbols (i.e. B-2). Their documentation will usually consist of a passport containing a visa and an 1-94 Arrival/Departure Record. 19

21 Un-Qualified Alien Status Undocumented Aliens are those who may have crossed the border illegally and/or been smuggled into the interior of the U.S., or those who have violated their non-immigrant status by accepting unauthorized employment, remaining longer than permitted or committing some other violation. Undocumented Aliens are not included in the SAVE database and are not eligible for CEAP and WAP services. Just because someone is not in the SAVE database does not mean they are not legal! 21

22 Some Things to Keep in Mind. Only those applicants who answer that they are NOT a citizen or national but are a legal resident need to be verified through SAVE. Applicants who answer that they are neither a citizen or national NOR are a legal resident are not eligible for CEAP or WAP. ONLY the applicant must be verified, not the entire household. For DOE and LIHEAP WAP, verification is not required for the weatherization of multifamily unit buildings. 22

26 Documentation and Status Forms I-130 Petition for Alien Relative (approved or pending), or I-360 Petition for Amerasian, Widow(er), or Special Immigrant (approved or pending) Under the Violence Against Women Act (VAWA), the spouses and children of United States citizens or lawful permanent residents may self-petition to obtain lawful permanent residency without the abuser's assistance or awareness. Petition must show evidence that if believed would be sufficient to prove that he or she is protected under the Violence Against Women Act MUST include verification that the individual responsible for the battery or cruelty is no longer living in the household of the victim. If petition is accepted, person will present a Notice of Prima Facie Determination valid for 150 days. Applies to both men and women 26

28 Lack of Qualified Alien Documentation If a non-citizen applicant presents an expired document or is unable to present any immigration documentation evidencing his or her immigration status, refer the applicant to the local File Control Office (FCO) to obtain documentation of their immigration status. In unusual cases that involve: (1) applicants who are hospitalized or medically disabled, or (2) who can otherwise show good cause for their inability to present necessary documentation, and (3) for whom securing such documentation would constitute an undue hardship, the applicant may provide other identifying documentation, e.g., marriage records, court orders, etc., and the user agency may submit the Document Verification Request (Form G-845). 28

29 In the meantime. USHHS has directed Texas to not delay or deny benefits 1) to a household awaiting verification; 2) because the household has applied for, but does not yet possess the required documentation, or 3) while we assist the household in obtaining such documentation. In such cases, if SAVE certification as been signed, include documentation of the verification request or the application for documentation in the application file and provide assistance for the current bill (can include arrears). 29

30 Privacy Requirements It is essential to protect the privacy of applicants whose personal information is submitted for processing through the SAVE Program. Since SAVE involves collecting and using an individual s personal information, it is the user agency s responsibility to ensure that this information is safeguarded and is used only for the purposes outlined in the contract.. 30

31 Privacy Requirements Failure to properly protect an individual s information can result in identity theft or fraud and can cause considerable inconvenience, harm, or embarrassment to the individual. In addition, violations of the Privacy Act (5 U.S.C 552a) and other applicable laws and regulations may subject user agency employees to criminal penalties. 31

32 Privacy Requirements: Steps to Take Allow only authorized employees to use SAVE. Ensure that only select, trustworthy employees handle information and perform verification queries. Secure access to SAVE. Protect the password you use and ensure that unauthorized users do not gain access to the system. Do not share your password with anyone. Each authorized user should have his or her own password that is not used by or shared with anyone else. 32

33 Privacy Steps (cont) Do not use SAVE for any purpose outside the scope of the contract. Protect and store individuals information properly. Ensure that applicants information is stored in a safe and secure location and that only authorized individuals have access to this information. ALSO: Be aware that USCIS keeps records on ALL searches and additional verification requests. 33

34 Applicant Intake The usual process: 1. Applicant comes in 2. Applicant is given application or intake documents 3. Case manager determines needs 4. Eligibility determination 5. Services delivered SAVE verification becomes number 5, and service delivery becomes number 6 34

35 The Initial Intake Process If you have CSBG, consider making ALL initial intakes CSBG intakes. If a client is only receiving CSBG services, no verification is required. This will ensure that you do not mix verification time/cost with CSBG time/cost. If a client is referred for WAP or CEAP and is eligible, then the requirement to verify status kicks in. 35

36 The WAP and/or CEAP Intake Process All applicants must produce documentation evidencing status, including U.S. citizens. If the applicant is not a citizen or national of the U.S., he or she must present immigration documentation that the user agency will verify through SAVE. Review the supplied documentation. Make sure it includes the correct annotations for the type of document it is indicating that the applicant is in a qualified class. 36

37 The WAP and/or CEAP Intake Process The Department has designed a SAVE certification form as a supplement to your WAP and CEAP application or intake form(s). The following certification must be signed by the applicant: Under penalty of perjury, I certify that I am a U.S. citizen, non-citizen national, or legal resident of the United States. To clarify which, ask the series of questions indicated on the certification form: 37

Y or N (Note that persons born in Puerto Rico, Guam, the US Virgin Islands, American Samoa, Swains Island (or their descendents) are considered citizens). If the client answer is yes to question #1 and presents documentation, Agency can proceed with the normal intake/application process. If the client answer is no, they must proceed to question #2 38

You are given the option to correct the data and retry the query, or proceed with a request for additional verification if the information was entered correctly. 51 The Additional Verification Process In some cases, the system will prompt you to Institute Additional Verification. The user agency MUST conduct additional verification when prompted by the SAVE system. The user agency MUST follow all appropriate instructions and steps when verifying immigration and/or citizenship status. Otherwise, the user agency may deny eligible persons benefits that they are lawfully entitled to receive. 51

53 Additional Verification The Special Comments box allows the agency to enter any other data that might help USCIS verify the applicant s immigration status. For example, if the applicant has another immigration document, the agency could input this information. When entering information about a second immigration document, please follow these guidelines: Include the document type, such as I-551, I-766 or I-797. Include any document numbers, such as the alien number, I- 94 number or receipt number. If possible, the agency should include the name and telephone number of the agency employee submitting the request for verification. This will facilitate quick resolution if further information is required. 53

54 Additional Verification in Process Additional verification takes 3-5 federal working days. When the system response is returned, the DHS response message will change, and the response date field will be populated. 54

59 Additional Manual Verification The response will be provided electronically in federal working days. Click the "Resubmit Verification" Button A pre-populated Form G-845 will open. Users can amend the default return mailing address and change the contact information, input additional document data elements, add additional data elements, and reprint the Form G-845 as frequently as an agency needs. Make LEGIBLE copies of both sides of ALL of the immigration documents provided by the applicant. Send the appropriate document(s) and Form G-845 to the designated Status Verification Operations (SVO) office. 59

61 Electronic Submission for Additional Verification In addition to the Electronic Form G-845 system, SAVE may include a Scan and Upload Tool and a Photo Tool. Scan and Upload enables agencies to electronically attach scanned copies of immigration documents to cases. This new feature will eliminate the mail processing time thereby decreasing the overall verification response time. Cases with a scanned copy of the immigration document will not require submission of a paper Form G-845, reducing administrative time and cost. 61

62 Electronic Submission for Additional Verification Photo Tool allows user agencies to compare the photo on the document presented by the applicant with the associated photo in the electronic record for the I-551 (LPR Card) and I-766 (EAD). This new feature will also support the verification process and the agency s ability to detect fraud rapidly by identifying a photo match/mismatch on the document presented. 62

63 Additional Manual Verification The user agency MUST submit the documentation; the applicant is not responsible for sending in these forms. 65 Check Verification Status To check on the status of verification request, select the Search Cases option from the Case Administration menu. Provide search criteria to narrow the results and submit search. Selects case and check for a status update from SAVE. If the status no longer shows as DHS Verification in Process, then a status verifier has completed the manual search of DHS databases. The case status now displays the results of Additional Verification. 65

68 Go to Manual Verification immediately if: A document appears to be counterfeit or altered. Characteristics of suspect documentation include photograph substitution and ink discoloration. A noncitizen presents unfamiliar DHS documentation, or a document that indicates immigration status but does not contain an Alien Number or I-94 Number. A noncitizen presents immigration documentation with an Alien Number in the 60,000,000 or 80,000,000 series. 68

69 More Direct-to-Manual Verification The noncitizen presents a foreign passport and/or Form I-94 and the Admission for Permanent Residence endorsement is more than 1 year old. The noncitizen has no immigration documentation and is hospitalized or medically disabled, and for whom securing such documentation would constitute an undue hardship. 69

70 Direct to Manual G-845 If the applicant s information has not been entered in SAVE, the G-845 form will have to be completed outside the SAVE system. The form is available on the Online Resources page of SAVE, or Agencies can download the Form G-845 from the USCIS website at Fill the form out electronically. Do not print on the form. 70

71 What if the applicant is not verified? If the immigration status cannot be verified, the user agency will receive a response of Refer to USCIS. The applicant will have to work through USCIS to resolve his her documentation issues. Agency must provide a denial letter with explanation and appeals information. Award or denial of a benefit based on immigration status and the establishment of a fair hearing process for denials of benefits are the responsibilities of the Subrecipient. 71

72 SAVE Appeals Hearing This is a different appeals hearing from the one required for denial of benefits based on program eligibility. The fair hearing and appeals process must include an opportunity for the individual to challenge or contest denials of benefits based in whole or in part on the SAVE Program result, including the provision of information, documents and testimony supporting the claimed immigration status. 72
