You will not be able to file for a fiance/k1 visa for him as a green card holder, only US citizens can do that. The first thing I would try to find out is if you are even still eligible to be a derivative of your aunt s petition. If you are already over 21, there is a chance that you might have already aged out which will render you ineligible for an immigrant visa/green card. You can look up the Child Status Protection act and do the calculation to see if you have or have not aged out. If he is returning to the UK he must have a firm job offer which starts within three months of is arrival if you want to return with him. Your status as a home vs international fee payer has nothing to do with your citizenship. For example, my son is British and has to pay the international fee, his girlfriend is Japanese and does not. There are two things you have to do to be considered a home fee payer; you need to be both ordinarily resident in the UK for three years prior to your uni start date and you need to be of settled purpose in the UK some time before your course starts. Ordinarily resident means living in the UK for something other than just to study. So for example, if you were just there to do your A levels you would not be ordinarily resident, if your whole family moved over for three years you would be. They can and do check your family s tax status to see if they are filing as UK residents if you claim this status especially if your educational records or family background suggests something different. Of settled purpose means you have the right to be in the UK (no need for a student visa).
