Background Information The modernisation of the Dutch legal immigration policy ( Modern Migratiebeleid ) entails a number of procedural changes, that will have an impact on our system of administrative fees. An overview of administrative fees for legal migrants in other Member States will help the decision-making process in the Netherlands. Policy makers and the Parliament are very interested in having a complete overview which allows a comparison between Member States. For this reason, we invite you to answer, as detailed as possible, the question here below. 2. 2 Could you give an overview of administrative fees (legal dues) imposed on third-country national migrants, applying for a residence permit in your country. If possible, we would like to receive this information subdivided into categories of family reunification, employed persons, highly skilled migrants (EMN Glossary Highly- Qualified), students, etc (see attachment for the Dutch categories) and including, if required, the cost for entry visas. Belgium Yes The 2 basic principles are that, firstly, according to the law of 14/03/1968 there can be no difference with the costs asked to Belgian and EU-citizens and secondly that the communes can decide to raise specific taxes for the communes interest (administration costs). In practice our electronic ID-cards cost 10 Euro; paper cards (only for EU-citizens) are free. Communal taxes vary from 0 to 15 Euro. A part from this we also have the "Attestation of Immatriculation" for non-eu-citizens whose stay on the territory can be temporary (i.e. asylum seekers and some categories of family reunification). These cards are only in paper and there is no maximum prize for it, but in reality communes ask (maximum) 10 to 15 Euro. Bulgaria Yes The fees defined in TARIFF 4 FOR THE CHARGES COLLECTED WITHIN THE SYSTEM OF THE INTERIOR MINISTRY UNDER THE LAW OF THE STATE FEES: Art. 10. (1) The following fees shall be collected for extending the term of stay of a foreigner in the Republic of Bulgaria: 1. up to 6 months 200 levs; 2. up to 1 year 500 levs; 3. up to 5 years 800 levs. (2) The term for which the fee under para 1 is collected shall be calculated as of the date of expiry of the latest permit for a foreigner's stay in the Republic of Bulgaria if there is no interruption of the term of stay. (3) A fee of 10 levs shall be collected for a service under para 1. Art. 12. (1) A fee of 1000 levs shall be collected for permitting of foreigner's permanent residence in the Republic of Bulgaria. (2) A fee of 150 levs shall be collected for permanent residence of a foreigner who has married to a Bulgarian citizen. (3) The fees under para 1 and para 2 shall be collected one-time after permitting of the permanent residence of a foreigner. (4) A fee of 10 levs shall be collected for requesting a service under para 1 and para 2. Art. 18. (amend. SG 43/00, amend. SG 86/00; amend. SG 75/07) The foreigners of Bulgarian origin and the Bulgarians, living out of the Republic of Bulgaria shall pay 5 per cent of the fees of art. 10, para 1 and art. 12, para 1, 2 and 3. Art. 19. No fees shall be collected: 1. from foreigners on the basis of mutuality and international agreements to which the Republic of Bulgaria is a party; 2. from foreigners, implementing activity in the Republic of Bulgaria in line of the gratuitous support, rendered by foreign government the response should be removed and the following statement should be added in the relevant response box: "This EMN NCP has provided a response to the requesting EMN NCP. 3 and international organisations; 3. under Art. 10, para 1 and 3 - from foreigners who cannot leave the country due to circumstances beyond their control and urgent medical care, certified with documents by the respective competent bodies; 4. under Art from the foreigners whose Bulgarian identity documents have been forcibly taken away, damaged or destroyed due to circumstances beyond their control as disasters, accidents, catastrophes, robberies and urgent medical care, certified with documents by the respective competent bodies; 8. from the foreigners to whom has been imposed compulsory administrative measure expulsion or forcible escort to the border, entered into force. Art. 45b. (new SG 21/07) For issue of durable or permanent residence card to a member of the family of European Union citizen, who is not European Union citizen shall be collected a fee in extent of 10 levs. Art. 46. For issuance of card for permanently and continuously staying foreigner in the Republic of Bulgaria a fee of 10 levs shall be collected. Art. 46. (new SG 75/07) In order a card to be issued to a foreigner staying permanently and continuously in the Republic of Bulgaria, who is a member of the family of Bulgarian citizens, and who is not a citizen of the European Union, a fee as per Art. 45b shall be collected. 7 Governing Residence of 25 November The fees are charged according to the type of residence title or the kind of official administrative activity. As a rule, the fees do not distinguish between the respective purpose of residence ( 44 to 49 and 51 of the German Ordinance Governing Residence AufenthV). Exceptional regulations are in force for cases in which the settlement permit is linked to the residence of a highly-qualified respectively self-employed person ( 44 no. 1 and 2 of the German Ordinance Governing Residence AufenthV). The fees for granting visa are ruled in 46 of the German Ordinance Governing Residence (AufenthV). Minors are subject to a separate fee scale ( 50 of the German Ordinance Governing Residence AufenthV). Exemptions of respectively reductions in the general rates are reserved for further groups of people for family or humanitarian reasons or public interest ( 52 to 54 of the German Ordinance Governing Residence AufenthV). Please see section 44 ff of the German residence act. AufenthV_en[1].pdf Greece Yes In Greece the administrative fee which is paid for the issuance or renewal of residence permits depends on the duration of the residence permit. Specifically, this amount is defined as follows: a) 150 for residence permits up to one year b) 300 for residence permits up to two years and c) 450 for residence permits up to three years. Especially for residence permits with a duration of ten years as well as for the status of long-term resident the fee is 900. The following categories do not fall under the obligation of administrative fees: a) minors (under 18) of all categories b) Scholars of ministries, organizations, institutions of public benefit, State Scholarship Foundation as well as scholars of the Fulbright Foundation c) scholars of military schools d) applicants for residence permit for humanitarian reasons e) victims of trafficking f) family members of Greek or E.U. citizen g) parents of Greek minors and h) Egyptians who fall under the Greece Egypt bilateral agreement. The fee to be charged for the issuance of national long-stay visas (in order a third country national to enter Greece and apply for residence permit) is 37,50. Third country nationals who are family members of Greek or E.U. citizen or of a national of a State party to the EEA Agreement and who are exercising their right to free movement, children under six years and researchers don t pay fee for visas. For nationals from Russia, Ukraine, FYROM, Bosnia Herzegovina, Serbia, Montenegro, Albania and Moldova the fees are 35. Hungary Yes The asked administrative fees in Hungary are the following: I. The costs regarding visa 1. Application for issuing airport transit visa, transit visa or short-stay visa 60 EUR 2. Application for the extension of transit visa or short-stay visa 17 EUR 3. Application for issuing seasonal employment visa 40 EUR II. The costs regarding residence permit 1. Application for issuing residence permit and visa for entitlement to receive a residence permit 60 EUR 2. Application for issuing residence permit in case of applying in Hungary 60 EUR 3. 8 4. Applications for the replacement of the residence permit 20 EUR 5. Applications for the exchange of the residence permit 17 EUR Regarding administrative fees there is no distinction pursuant to the different categories of migrants. Ireland Yes Certificates of Registration Legally resident non-eea nationals who have entered the State with the intention of residing in Ireland for a period of more than three months must register with their local immigration registration officer. A fee of 150 is charged in respect of each immigration certificate of registration issued to a non-eea national. Certain classes of persons are exempt from payment, as follows: 1. Convention Refugees 2. Persons who have been reunified with such refugees under section 18 of the Refugee Act 1996 (persons that may be reunified include: spouse; unmarried child under 18 years; parent if the refugee is under 18 years and unmarried; or, at the discretion of the Minister for Justice, Equality and Law Reform, another dependant relative of the refugee). 3. Persons who are under 18 years of age at the time of registration 4. Spouses, widows and widowers of Irish citizens 5. Spouses and Dependants of EU nationals who receive a residence permit under Directive 2004/38/EC. 6. Programme Refugees, as defined by section 24 of the Refugee Act 1996.( "a programme refugee" means a person to whom leave to enter and remain in the State for temporary protection or resettlement as part of a group of persons has been given by the Government and whose name is entered in a register established and maintained by the Minister for Foreign Affairs.) Visas Visa processing fees are as follows: Single Journey Multiple Journey Transit Certain categories of persons are exempt: - Spouses and certain family members of EEA nationals, including Irish citizens. - Applicants from some countries are not required to pay a fee. This changes from time to time. Italy Yes For each person, the residence permit applicant has to submit a postal payment for the electronic residence permit issue (equivalent to euro) plus a further electronic cash replacing the former stamp showing that the necessary duties have been paid (equal to euro). The application must be sent by registered post mail, with an additional expenditure of euro. These administrative costs are 8 of 14

9 valid for the most part of residence categories. Exceptions are those applicants which residence permit is issued only by the police authority (the so called Questura ). This is the case of applications for political asylum, medical care, sports, justice, minority, minor integration, humanitarian reasons, or long term residence permit for foreign relatives of an Italian or EU citizen, etc. In these cases there is not the issue of an electronic residence permit and the applicant has to pay just the quoted electronic stamp (14,62). SOURCE: The Ministry of Foreign Affairs is competent for entry visa issue, through the network of consular services. The cost varies depending on the visa type and there are specific exceptions for nationals of certain countries. Generally, the national visa for long stays cost 75,00 euro (type D visa). SOURCE: Latvia Yes NL_migrants fees_annex.doc Lithuania Yes We do not divide the fees according to various categories of immigrants; the fee is the same for everyone: Fees for temporary residence permits: - Issuance or renewal: 300 litas (87 euro); - A fee of the residence card: 20 litas (6 euro) Fees for EU family member s residence cards: - Issuance and renewal: 10 litas (3 euro) Fees for permanent residence permits: - Issuance: 150 litas (44 euro) - Renewal: 40 litas (12 euro) - Issuance of the residence card: 20 litas (6 euro) Children under the age of 16 are exempted from the fees requirement. The entry visas are free of charge. Malta Yes The cost of a residence permit is Euros for each year (or part thereof) of validity whatever the category of permit. No fee is payable in respect of residence cards issued to third country nationals who are family members of EU nationals. 9 of 14

10 The Cost for the issue of a Visa is set at 60 but the cost may vary and a fee of 30 applies to certain countries. Netherlands Yes The answer from the Netherlands is contained in this annex, which gives a complete overview of fees charged on all categories of legal migrants NL Immigration Adm Fees for Ca... Poland Yes Permits: 1. Residence permit for a fixed period: 340 PLN - When Polish regulations require that a foreigner appears in person in front of Polish public authority: 85 PLN - When residence of a foreigner is required by the interest of the Republic of Poland: 85 PLN - When a foreigner probably is a victim of trafficking in human beings: 82 PLN Exemptions: - a foreigner is a victim of trafficking in human beings as defined by the Council s framework decision of 19 July 2002 on combating THB and fulfills all of the following conditions: a) is present on the territory of the Republic of Poland; b) cooperates with the organ competent in procedures related to combating THB; c) severed any contacts with persons suspected of committing misdeeds related to THB. - a foreigner benefits from temporary protection 2. 11 - Residence card - 50 PLN 3 Concessionary fees (50%) for replacement of the documents apply to: - foreigners in a difficult financial situation; - foreigners residing for the purpose of above-gymnasium education and higher education; - foreigners residing for the purpose of professional training or internship in the framework of the EU programs; - minors, below the age of 16 at the moment of submitting the application for document replacement Portugal Yes According to the Act that approves the legal framework of entry, permanence, exit and removal of foreigners into and out of national territory, it s only considered two kinds of residence permit, namely temporary residence permit and permanent residence permit (articles 75º and 76º). Therefore, the payments of fees respects to the kind of residence permit that is requested by the citizen, and not about its nature. Concerning the payment of fees and regarding the legal framework of Fees (Portaria n.º727/2007), for the reception and analyses of the request or for the renewal of the residence permit is 60. For each request for temporary residence permit or its renewal is 52. For each request for permanent residence permit is 165. These amounts are the same for the requests for the family members, because fees are charged individually, once the title is nominal. The exception is for the minors, that only pays half of these amounts. The payment of fees concerning the applying visas to entry in national territory is responsibility of the Ministry of Foreign Affairs. The legal framework about fees is contained in this annex. It s in Portuguese language, but we will send as soon as possible an English version. Slovenia Yes In the Republic of Slovenia the fee for obtaining temporary residence permits is 32 Euro (handling fee). In addition 5,5 Euro for sticker is charged, so total cost is 37,5 Euro. The fee for obtaining permanent residence permit is 74,5 Euro (handling fee) + 5,5 Euro for the sticker, so total cost is 80 Euro. Fees are the same regardless of purpose of stay. Third country national in possession of a valid residence permit can enter our country so no additional entry visa is required. Spain Yes This matter is governed by Chapter IV (Articles 44 to 49) of Organic Law 4/2000 of 11 January on the rights and freedoms of foreigners in Spain and their social integration, which is entitled On Administrative Fees for Administrative Authorisations and the Processing of Visa Applications. Article 48, paragraph 1 of the aforementioned Organic Law 4/2000 sets forth that the amount of fees for the granting of administrative authorisations and the issuance of documents shall be established by the competent departments Ministerial Order. Hence, Order PRE/3654/2007 of 14 December sets forth the amount of the fees for the granting of administrative authorisations, issuance of documents on immigration and alien affairs, or the processing of visas at borders, which are referred to by Organic Law 4/2000 and its Regulations. The amount of such fees appear in the Annexe of the aforementioned Ministerial Order (see table attached hereto) and these are increased at the beginning of each year by the amount laid down by the corresponding Annual General Budget Laws of the State (Leyes anuales de Presupuestos Generales del Estado). Pursuant to Articles 74 and 75 of Law 2/2008 on the General Budget of the State for the year 2009, the fixed amounts of such fees shall be increased up to the amount resulting from the application of a coefficient of 1.02 to the amount payable in of 14

The applicant must present a certificate which confirms marriage or relationship. Relatives of Swedish nationals must, however, pay a fee to apply for a visa.
