The contributing EMN NCPs have provided, to the best of their knowledge, information that is up-to-date, objective and reliable. Note, however, that the information provided does not 1. Background Information On the 8th of April 2014, a hearing will take place at the Council of State, the Highest administrative court of the Netherlands. The Council of State would like to be informed, amongst other things, on the applicable fees for residence permits in other EU Member States. This information is requested in order for the Council of State to be able to determine whether or not the Dutch fees are exaggerated, or disproportionately high. In this regard, I kindly ask you to provide the following information: 1. Directive 2004/114 In your country, if a residence permit was applied for based on the study Directive, what were the applicable fees: 1 of 19

3 2. Responses Wider Dissemination? Austria No This EMN NCP has provided a response to the requesting EMN NCP. However, they have requested that it is not disseminated further. Belgium Yes Preliminary comments: In Belgium, applicable fees for residence permits are not differentiated according to: - whether the residence permit is applied for based on Directive 2004/114, Directive 2003/86 or Directive 2003/109 - the number of family members applying for a residence permit - whether it is a first issuance or renewal (extension of validity) of permit Given the above mentioned information, the information provided below is comprehensive rather than differentiated. Amounts notified below relate to manufacturing costs to produce residence permits. Beside manufacturing costs, municipalities, that issue residence permits, may apply local taxes. Municipal taxes are covered by municipal autonomy and therefore differ from one municipality to another. Amounts notified below are applicable as from 1 January On 1 January of each year, amounts are automatically revised based on the variation of the health index. Answer to all questions taken together: Amounts payable by municipalities for issuing the concerned residence permits are as follows: - Standard procedure: 15,20 Euros - Emergency procedure: 116,90 Euros Answer to question 3.e: Currently the residence permit issued to a long-term resident has a validity of 5 years. This duration should soon be increased to 10 years.
