3 KRATKO OBRAZLOŽENJE On two occasions Parliament has rejected Commission proposals for a ports package seeking to regulate access to and the operation of major ports in the Member States. The earlier proposals were rejected on the grounds that on crucial points they were too far-reaching and because they would create serious problems with safety and the organisation of trade unions. In its new proposal the Commission has taken some of this criticism on board. General considerations The rapporteur agrees in principle on the wish for transparency concerning the financing of ports, but does not think that it should be a priority for the regulation to focus on market access. The Commission s impact assessment has not shown that increased market access would lead to growth and more jobs in the industry or enhance the quality of port services. On the contrary, the Commission s proposal on increased market access raises a number of concerns as regards workers safety and rights. The rapporteur therefore takes the view that it is important to send a clear signal about the need for better training and safety conditions for workers with a view to reducing accidents at work in ports, and that the Member States, together with the social partners, must take the initiative to substantially reduce casual and precarious work in the industry. The rapporteur therefore wishes to alter the focus of the regulation, so that market access is written out in favour of an increased focus on transparency. Specific worker protection issues From the workers point of view there are a number of issues that need to be clarified or amended, so that the regulation does not place them in a worse position, either as individuals or in relation to their collective rights. In this proposal it is reasonable to ask whether the requirement for market access could potentially conflict with safety and workers rights. This problem arises, for example, in connection with the obligation to have more than one operator in the same port. It is of course unacceptable for workers safety, or the fundamental right to demand proper conditions for employees, to be called into question. It is therefore proposed to insist that no obligation concerning market access or transparency may impede the right to demand proper training of workers, to consider the environment or to require collective agreements. This means that the Member States must have the right to restrict the number of service providers by reference to the above considerations. It must be possible to make key demands in these areas. Work at and in ports is dangerous and requires the correct qualifications to avoid accidents with severe human consequences. The Member States must therefore have the right to set minimum requirements concerning the training of workers such that they have the necessary qualifications, and to insist on their social and trade union rights. Within this framework, however, it must also still be possible to demand the maintenance of professional PA\ doc 3/14 PE v01-00
4 qualifications, so that workers are always as well prepared as possible to uphold a high level of safety at work. These minimum requirements should have absolute validity, and it should not be possible to circumvent them by reference to other parts of the regulation. Member States should also have full rights to carry out checks to ensure that the minimum requirements are met. The Member States should also have the right to impose public service obligations to secure workers social and labour rights and ensure safety in the port. In this connection the rapporteur takes the view that it is crucial that this right should not be restricted by the EU, since it is the Member States that are best able to strike the correct balance between the need for flexibility and growth on the one hand and the interests of workers on the other. Furthermore, the rapporteur wishes to stress that collective negotiations, including collective action such as strikes and blockades, are a fundamental right in a vast majority of Member States, as is explicitly stated to in Article 28 of the Charter of Fundamental Rights of the European Union. The regulation must respect this, and therefore collective action must not be regarded as an emergency which justifies the use of emergency measures. In the event of a change of employer, workers should be given the best possible protection at all times. Where a service task is transferred to a new service provider a dialogue must immediately be opened with the social partners to ensure the best possible transition for workers, and the application of Directive 2001/23/EC must be compulsory. Finally it needs to be stressed that, where a port is expanded or the number of service providers changes, it is crucial that trade unions, environmental organisations and local interest associations should also be involved as relevant stakeholders. It can be of major importance to workers in the port, to the local area and to the environment if a significant change occurs in the provision of services. This, of course, is why it needs to be ensured that these voices are also heard. This means that they should be involved in the process in good time and in an open and fair way, for example by being given access to relevant information, and that serious consideration should be given to any concerns they may have. Subsidiarity principle The Member States have organised their ports in widely differing ways, both in operational terms and regarding the size of role played by the public authorities. It is therefore vital that this regulation does not alter the Member States right to freely decide how they wish to organise their ports. Transparency should only aim to ensure that all parties are able to know what is going on, and should never mean that Member States are forced to alter their fundamental systems. It is absolutely crucial to show respect for the Member States diversity and the opportunity to realise growth potential in the various ports and thus create more high-quality jobs. Ako država članica ne povjeri donošenje odluke o ograničavanju broja pružatelja lučkih usluga takvom tijelu, broj pružatelja usluga neće biti manji od dva. 4. 10 Apart from being essential infrastructure and a potential for growth and job creation, ports are a dangerous work place. Therefore, it is important to ensure that Member States have the right to define the appropriate balance between growth and competition on the one hand and the protection of health and safety and social and labour rights on the other hand. The right of collective bargaining and action is recognised in the constitution or law of most member states. Furthermore, the right to strike is explicitly recognised in article 28 of the Charter of Fundamental Rights of the European Union. Hence, the right should be fully respected by this regulation. Ne dovodeći u pitanje nacionalno zakonodavstvo i zakonodavstvo Unije, uključujući kolektivne ugovore između socijalnih partnera na razini Unije, nacionalnoj, regionalnoj ili lokalnoj razini, država članica traži da dodijeljeni pružatelj lučkih usluga, imenovan u skladu s postupkom uspostavljenim člankom 7., u slučaju kada pružatelj nije trenutačni pružatelj lučkih usluga, poštuje prava u pogledu informiranja i savjetovanja radnika te da radnicima koji su prethodno zaposleni kod trenutačnog pružatelja usluga, bilo da svoje dužnosti u okviru predmetnih usluga obavljaju na plovilima ili na kopnu, dodijeli prava koja bi imali da je postojao prijenos u smislu Direktive 2001/23/EZ. Member States must ensure an adequate level of social protection, therefore, the application of Directive 2001/23/EC should be compulsory. Amandman 16 Članak 10. stavak Kada upravljačka tijela luke od pružatelja lučkih usluga zahtijevaju primjenu određenih socijalnih standarda u pogledu pružanja odgovarajućih lučkih usluga, u dokumentaciji za nadmetanje i ugovorima o pružanju lučkih usluga navodi se dotično osoblje i daju transparentne pojedinosti njihovih ugovornih prava te uvjeti pod kojima se zaposlenici mogu dovesti u vezu s lučkim uslugama. 3. Upravljačka tijela luke od svih pružatelja lučkih usluga zahtijevaju primjenu svih socijalnih standarda i standarda radnog prava u skladu sa zakonodavstvom Unije ili nacionalnim zakonodavstvom, uključujući i primjenjive kolektivne ugovore. U tu svrhu, u dokumentaciji za nadmetanje i ugovorima o pružanju lučkih usluga navodi se dotično osoblje i daju transparentne pojedinosti njihovih ugovornih prava te uvjeti pod kojima se PA\ doc 11/14 PE v01-00
12 zaposlenici mogu dovesti u vezu s lučkim uslugama. Amandman 17 Članak 10. stavak 3.a (novi) 3a. Organizacijom rada osigurava se zaštita i nastavak zapošljavanja u skladu s pravilima država članica i primjenjivim kolektivnim ugovorima te u skladu s konvencijom br. 137 Međunarodne organizacije rada. Države članice u punoj suradnji sa socijalnim partnerima poduzimaju mjere kako bi osigurale ravnotežu između fluktuacije u potražnji za radom u lukama i nastavka i zaštite zapošljavanja. Fluctuation of demand is high in the sector, hence casual and precarious forms of employment are common. With a view to ensuring quality jobs in the sector, a reference to ILO convention No 137 on the Social Repercussions of the New Methods of Cargo Handling in Docks, should be included. Amandman 18 Članak 10.a (novi) Članak 10.a Zaštita zdravlja i sigurnosti zaposlenika 1. Poslodavac se mora pobrinuti za to da njegovi zaposlenici imaju odgovarajuću razinu znanja kako bi sigurno i bez opasnosti obavljali svoje dužnosti u cilju PE v /14 PA\ doc
13 sprječavanja nesreća i osiguravanja visoke razine zdravlja i sigurnosti svih radnika. Države članice odgovorne su za provedbu navedenog načela. 2. Ne dovodeći u pitanje zakonodavstvo Unije i nacionalno zakonodavstvo i potpuno poštujući autonomiju socijalnog dijaloga Sektorski odbor za socijalni dijalog za luke koji djeluje na razini EU-a ima ovlasti za razradu smjernica za obučavanje i sprječavanja nesreća te za njihovo redovito ažuriranje. 3. Ne dovodeći u pitanje nacionalno zakonodavstvo i primjenjive kolektivne ugovore poslodavac se mora pobrinuti o tome da organizacija radnog vremena bude takva da se zaštiti zdravlje i sigurnost zaposlenika te u skladu s Direktivom 2003/88/EZ. Ports are a dangerous work place. Hence, it is important to ensure that workers are provided with adequate training continuously and that working time arrangements do not jeopardise the health and safety of workers. Therefore, it is appropriate to include a reference to Directive 2003/88/EC as a set of minimum rules. Amandman 19 Članak 11. stavak 1.
