3 Digital Forensics: The Intersection of Criminal Law and Information Technology A definition of Digital Forensics with practical examples followed by discussion of some of the current issues the field faces concentrating on the following emerging issues. 1) Cloud warrants What happens when evidence of an indictable offence is accessed from where a warrant is served, but stored internationally? How can that evidence be gathered? What guarantees of authenticity can be made? 11:30 am to 12:15 pm 2) Big Data seizure and storage If a local business has evidence stored amongst other data- legally or medically privileged, intellectual property- on physical local servers, what is the best way to gather that evidence? How can the expectations of the courts in relation to best evidence, timeliness and full disclosure be balanced against each other and new concerns about privacy and data security? 4 Keynote address Sentencing, Punishment and Indigenous People Professor Chris Cunneen 1:50 pm 2:50 pm The paper will look at recent developments in relation to sentencing Indigenous people such as the growth of Aboriginal sentencing courts and recent decisions including the High Court decision in Bugmy. The paper will also consider some alternative approaches which have developed in Canada in relation to sentencing, imprisonment and post-release.
