MINUTES OF A REGULAR MEETING OF COUNCIL CITY OF GARFIELD HEIGHTS, OHIO Monday, January 24, 2011 MEETING CALLED TO ORDER AT 7:00 p.m. by President Frank Geraci, Jr. INVOCATION BY: Councilman Thomas Vaughn ROLL CALL: PRESENT: Council Members Dudley, Marincic, Nenadovich, Sarnowski, Mahoney, Suster, Vaughn (Note: The audio portion of the meeting was not recorded.) CLMN VAUGHN moved to waive the 72-Hour Rule regarding Resolution 08-2011. RESOLUTION NO. 08-2011 AN EMERGENCY RESOLUTION RATIFYING AN APPOINTMENT BY THE MAYOR OF BILL JOHNSON TO THE RECREATION BOARD OF THE CITY OF GARFIELD HEIGHTS, OHIO, FOR THE TERM EFFECTIVE JANUARY 1, 2011 AND ENDING DECEMBER 31, 2016. PRESIDENT GERACI asked for a Roll call. PRESIDENT GERACI said that Resolution 08-2011 would appear on the evening s agenda. CLWN SARNOWSKI moved to have Resolution 06-2011 taken out of order. RESOLUTION NO. 06-2011 A RESOLUTION HONORING MARY STAMLER FOR HER YEARS OF SERVICE AND DEDICATION TO THE CITY AS THE EXECUTIVE DIRECTOR OF THE GARFIELD HEIGHTS CHAMBER OF COMMERCE. PRESIDENT GERACI asked for a Roll call. CLWN SARNOWSKI asked to have Resolution 06-2011 read in its entirety. The Clerk read Resolution 06-2011 in its entirety.

PRESIDENT GERACI said that he would move on to the Reading and Disposal of the Minutes. READING AND DISPOSAL OF MINUTES: Moved by Clmn SUSTER to accept the minutes of the Regular Meeting of City Council of January 10, 2011 as submitted. The minutes were adopted with seven YES votes. WRITTEN COMMUNICATIONS TO COUNCIL: None. LEGISLATION OUT OF COMMITTEE: None. REPORTS OF THE MAYOR AND DIRECTORS: PRESIDENT GERACI said that we would now move on to the reports of the Mayor and his Directors. MAYOR VIC COLLOVA thanked Mr. Geraci and Council. He reported that City Engineer David Krock was looking into getting McCracken Road at Broadway Avenue repaired. There was a possibility that the County Sanitary Engineers would monitor the city s sewers. Things were looking up regarding the development of Bridge View. Regarding legislation, Ordinance 03-2011 updated the fees for Certificates of Occupancy in rental units, Ordinance 04-2011 was written to make the city safer, Resolution 06-2011 honored Mary Stamler for her years as service as Executive Director of the Garfield Heights Chamber of Commerce and Resolution 07-2011 renewed the Cuyahoga Regional Information System (CRIS) contract. PRESIDENT GERACI thanked the Mayor and asked if Council had any questions for him. CLMN DUDLEY asked what would happen to those who had recently paid their Certificate of Occupancy fee. MAYOR VIC COLLOVA responded that a spread sheet of rental units existed and no one would be required to pay the fee twice. PRESIDENT GERACI called upon City Law Director Mr. Riley. LAW DIRECTOR TIM RILEY thanked the Chairman and spoke briefly about Ordinance 04-2011, the nuisance ordinance. PRESIDENT GERACI thanked Mr. Riley and asked if there were any questions for him. There were none so he moved on to Service Director Mr. McLaughlin. SERVICE DIRECTOR TIM McLAUGHLIN thanked President Geraci. He reported that his staff had been mainly busy working on snow removal and patching streets. He mentioned that McCracken Road had been in poor condition for the last 10 years. PRESIDENT GERACI thanked Mr. McLaughlin and asked for questions.

CLMN VAUGHN thanked the Service Director for taking care of a water main break at East 139 th Street and York. In addition, he thanked him for the excellent and honest report he had delivered to the Finance Committee. PRESIDENT GERACI commended Mayor Collova and Mr. McLaughlin for their hard work. He then called upon Parks and Recreation Director Mr. Dobies. PARKS AND RECREATION DIRECTOR BOB DOBIES greeted the Council President and Council Members. He reported on the status of various recreational activities and said that Futsol sign ups would end on January 30, 2011. PRESIDENT GERACI thanked Mr. Dobies and asked if there were any questions for him. CLWN MARINCIC asked when the Recreation Board met. PARKS AND RECREATION DIRECTOR BOB DOBIES replied that it had not met and that he did not chair it. CLWN MAHONEY said that she chaired the board and they had not held any recent meetings. CLWN MARINCIC said that when she had served on the board former Recreation Director Jim Bukac had chaired it. PRESIDENT GERACI asked if there were any more questions. There were none so he called upon Mr. Ron Tomola. ACTING FINANCE DIRECTOR RON TOMOLA had no report. PRESIDENT GERACI thanked him and asked if there were any questions for Mr. Tomola. There were none so he called upon City Engineer, Mr. David Krock. CITY ENGINEER DAVID KROCK had no report. PRESIDENT GERACI thanked Mr. Krock and asked if there were any questions for him. CLMN VAUGHN said that McCracken Road and Rockside Roads were the two worse streets in the city and needed paving and asked whether the Rockside renovation could be moved up. CITY ENGINEER DAVID KROCK said he would look into it. (Clwn Marincic and Clmn Dudley also posed questions to Mr. Krock.) PRESIDENT GERACI asked if there were any other questions for Mr. Krock? There were none so he asked Economic Development Director Ms. Kuban for her report. ECONOMIC DEVELOPMENT DIRECTOR NOREEN KUBAN thanked the Council President and reported that money to help sick children was available from the Board of Health. PRESIDENT GERACI thanked Ms. Kuban and asked if there were any questions for her. CLWN MARINCIC complimented Ms. Kuban on her report to the Finance Committee.

PRESIDENT GERACI asked if there were any other questions for Ms. Kuban. There were none so he called upon Building Commissioner Mr. Wervey. BUILDING COMMISSIONER BILL WERVEY said that Ordinance 03-2011 would be good for the city. Furthermore he said that the current construction at Marymount Hospital and the soon to be built McDonald s at Garfield Mall would generate revenue. Finally the Commissioner said that City Engineer Mr. Krock was looking into traffic surveys. PRESIDENT GERACI thanked Mr. Wervey and asked if there were any questions for him? There were none so he moved on to David Schillero, a student from Garfield Heights High School. MR. SCHILLERO introduced himself by stating that he was a Senior, captain of both the football and track teams and a member of National Honor Society. He explained that the National Honor Society carried out projects and their next project concerned helping elementary age pupils better adapt to high school. He then presented the members of the Garfield Heights High School basketball team who shook hands with the Mayor, Directors and Council Members. MAYOR VIC COLLOVA thanked them for coming and encouraged them to attend Council Meetings. PRESIDENT GERACI complimented Mr. Schillero on his report and asked if there were any questions for him. (Clwn Marincic and Clwn Sarnowski posed questions at this time.) PRESIDENT GERACI thanked Mr. Schillero for his report and asked if there were any more questions for him. There were none. COMMENTS BY CITIZENS: PRESIDENT GERACI moved on to Comments from the Citizens on the night s agenda. The rules were this portion of the meeting was for residents comments on the night s legislation only. Comments were limited to five minutes. No one could speak more than five minutes. Residents were to raise their hands to be recognized. There were none. COMMITTEE REPORTS: None. PRESIDENT GERACI moved on to Ordinances and Resolutions. ORDINANCES AND RESOLUTIONS: ORDINANCE NO. 03-2011 AN ORDINANCE AMENDING CHAPTER 1413 OF THE CODIFIED ORDINANCES OF THE CITY OF GARFIELD HEIGHTS RELATIVE TO CERTIFICATES OF OCCUPANCY. Moved by SARNOWSKI to CONSIDER BY TITLE: Motion by SARNOWSKI to PASS FOR A SECOND READING: PRESIDENT GERACI said that passed for a second reading 7-0.

ORDINANCE NO. 04-2011 AN EMERGENCY ORDINANCE ADOPTING CHAPTER 555 OF THE CODIFIED ORDINANCES OF THE CITY OF GARFIELD HEIGHTS RELATIVE TO CRIMINAL ACTIVITY NUISANCES. Moved by MAHONEY to CONSIDER BY TITLE: Motion to WAIVE RULE 24: RESOLUTION NO. 05-2011 AN EMERGENCY RESOLUTION RATIFYING AN APPOINTMENT BY THE MAYOR OF STEVEN GREEN TO THE RECREATION BOARD OF THE CITY OF GARFIELD HEIGHTS, OHIO, FOR THE TERM EFFECTIVE JANUARY 1, 2011 AND ENDING DECEMBER 31, 2016. Moved by MAHONEY to CONSIDER BY TITLE: RESOLUTION NO. 07-2011 A RESOLUTION AUTHORIZING THE MAYOR TO EXECUTE AGREEMENTS BY AND BETWEEN THE BOARD OF COUNTY COMMISSIONERS, THE CUYAHOGA REGIONAL INFORMATION SYSTEM BOARD OF ADVISORS, THE CITY OF GARFIELD HEIGHTS LAW DIRECTOR AND THE CITY OF GARFIELD HEIGHTS POLICE DEPARTMENT. RESOLUTION NO. 08-2011 AN EMERGENCY RESOLUTION RATIFYING AN APPOINTMENT BY THE MAYOR OF BILL JOHNSON TO THE RECREATION BOARD OF THE CITY OF GARFIELD HEIGHTS, OHIO, FOR THE TERM EFFECTIVE JANUARY 1, 2011 AND ENDING DECEMBER 31, 2016. Moved by VAUGHN to CONSIDER BY TITLE: COMMENTS BY CITIZENS: PRESIDENT GERACI said he would now move on to Comments By Citizens. The rules were you could not bring up anything of a first nature. You must have previously brought the problem to a Councilperson or a City Hall department. You were limited to speak only once for five minutes. You must raise your hand to be recognized. David Mays of 8250 Green Drive expressed concern over the unpaid rubbish fee bills and asked what was being done about that. CLMN SUSTER replied that under the current legislation there was no way to fine residents who did not pay the rubbish fee. MAYOR VIC COLLOVA said that he agreed that people ought to pay their bill on time, but he assured Mr. Mays that those that were not paying it would eventually be made to do so. MR. MAYS said that he felt that was not fair to the residents who paid and it was a shame. PRESIDENT GERACI thanked Mr. Mays and said he would move on to Miscellaneous, beginning with Clmn Dudley. MISCELLANEOUS BUSINESS: CLMN DUDLEY announced that the Family Life Center on Dressler Avenue would be presenting its Annual Black History Program on Thursday, February 24, 2011 at 6:00 p.m. Everyone was welcome to attend. He expressed his deep thanks to the Jackson and Crayton families for always volunteering to pass out information. CLWN MARINCIC asked questions about the Recreation Board to which Acting Finance Director Tomola responded. CLMN NENADOVICH thanked the Directors (especially the Service and Parks and Recreation Directors) for seeking ways to save money. CLWN SARNOWSKI asked Mr. Tomola whether he was still the Interim Finance Director.

ACTING FINANCE DIRECTOR RON TOMOLA responded that Yes, he was still the Interim Finance Director. CLWN SARNOWSKI announced that Alan Sluka, School Board Treasurer, would speak at the next Ward 4 Block Watch Meeting. The Councilwoman then congratulated Clwn Mahoney for winning a trip to California by winning a Glee contest. CLMN SUSTER welcomed back Reporter Pat Salemi. He announced that the Finance Committee Meetings were underway and he planned to hold meetings to discuss possible Charter changes in the near future. CLWN MAHONEY thanked the Members of Council for passing Ordinance 04-2011. The Councilwoman also expressed thanks to Chief Murphy for his many years of service to the city. CLMN VAUGHN welcomed Captain Sackett to his position as Interim Chief of Police. The Councilman announced that the next Ward 7 Block Watch Meeting would be held on Thursday, January 27, 2011 at St. Monica s Church. Clmn Vaughn then moved to adjourn the meeting. PRESIDENT GERACI asked for a roll call on the adjournment. PRESIDENT GERACI declared that the meeting stood adjourned.
