Conference Meeting July 17, 2018 The Township Council of the Township of West Orange met in the Council Chambers, Municipal Building, 66 Main Street, West Orange, New Jersey at 6:35 p.m., Karen Carnevale, Municipal Clerk read the following statement: This is to inform the general public that this meeting is being held in compliance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975. The annual notice was emailed to the Star Ledger and filed in the Township Clerk s office on October 25, 2017 and published in the West Orange Chronicle on November 2, 2017. Roll Call: Present: Councilwoman Casalino, Councilman Cirilo, Councilman Guarino, Councilman Krakoviak, and Council President McCartney. Joni Noble McDonnell, Esq., Inglesino, Webster, Wyciskala & Taylor, LLC, on behalf of the Joint Meeting of Essex and Union Counties along with CME Associates, Nolan Towers, Consulting Engineer to the Joint Meeting and Joseph Bonaccorso, Consultant, Julie Ehlers, Powell Capital Markets, Financial Advisor to the Joint Meeting and Everett Johnson, Esq., Wilentz, Goldman and Spitzer, Bond Counsel for the Joint Meeting presented plans and cost allocations for two (2) projects, Capital Improvements Plan Projects and Flood Mitigation Facilities Project that the Joint Meeting will be undertaking in the near future. These projects will require each of the member municipalities to obtain funding from the New Jersey Infrastructure Bank. One of the projects also includes funding from the Federal Emergency Management Agency. Mr. Sayers gave a brief update on the redevelopment area. Subject to Federal Clearance of the Contractor by the Essex County Division of Housing and Community Development (Lepore) j. 176-18 Resolution Authorizing Change Order No. 1 for the Contract 2017 Street Improvements Phase IV with Reggio Construction, Inc., 1575 West Street, Fort Lee, New Jersey 07024 in the Amount of $189,356.00 which Represents a 9.21 percent Increase in the Original Contract (Lepore) k. 178-18 Resolution Authorizing the Submission of an Application to the NJ DOT s: Transportation Alternatives Set-Aside Program 2018 for the Pleasantdale Pedestrian Transportation Improvement Project (Millenium) 2

On motion made by Councilman Cirilo and seconded by Councilman Guarino, the consent agenda was approved. Resolution(s) Removed from the Consent Agenda Resolution 177-18 Resolution Authorizing Change Order No. 1 and Final for the Contract 23 Maple Avenue Storm Sewer Replacement with Stanziale Construction, Inc., P.O. Box 2597, Bloomfield, New Jersey 07003 in the Amount of $10,360.00 which Represents a 12.56 Percent Increase in the Original Contract of $82,490.00 (Lepore) On motion made by Council President McCartney and seconded by Councilwoman Casalino, the above Councilwoman Casalino, Councilman Cirilo, Councilman Guarino, Council President voting Aye. Councilman Krakoviak voting Nay. Resolution 179-18 At this time Council President McCartney recused herself from this matter. On motion made by Councilman Cirilo and seconded by Councilman Guarino, Councilwoman Casalino was nominated and approved to act as Council President for this item. Councilwoman Casalino, Councilman Cirilo, Councilman Guarino and Councilman Krakoviak voting Aye. A power point presentation was given by Theresa DeNova, Health Officer explaining the Refuse and Recycling service contract for the Township and the Solid Waste and Recycling collection and disposal for the Board of Education. Wayne DeFeo, DeFeo Associates further explained to the Council why recycling has changed over time. 179-18 Resolution Authorizing the Award of the Township Refuse and Recycling Collection Contract Effective September 10, 2018 for OPTION #1 ITEMS #1, #2 AND #3, OPTION #4 and OPTION #5 to Suburban Disposal, Inc., 54 Montesano Road, Fairfield, NJ 07004 for a Period of (5) Five Years; and OPTION #6 West Orange Public Schools and School Facilities Solid Waste and Recycling Collection and Disposal Contract Effective November 1, 2018 Awarded to Interstate Waste Services of New Jersey, Inc., 300 Frank W. Burr Road, Suite 39, Teaneck, NJ 07666 for a Period of (5) Five Years (Legal-Kayser, DeNova) On motion made by Councilman Guarino and seconded by Councilwoman Casalino, the above referenced resolution was approved. Councilwoman Casalino, Councilman Cirilo, Councilman Guarino voting Aye. Councilman Krakoviak voting Nay. Ordinances on Second and Final Reading Ordinance 2546-18 a. On motion made by Councilwoman Casalino and seconded by Council President McCartney, An Ordinance Amending Chapter 20, Sections 4.2 of the Revised General Ordinances of the Township of West Orange (Exceptions to Obstruction of Streets and Sidewalks) was taken up on second and final reading. 3

All members voting Aye. The Council President stated that this is the scheduled time for the public hearing and asked the Clerk to read the ordinance by title only. The Council President asked if there was anyone who wished to be heard. There was no one else who wished to be heard and the public hearing was closed. On motion made by Councilman Guarino and seconded by Councilwoman Casalino, the above - mentioned ordinance was approved on second and final reading. All members voting Aye. Ordinance(s) on First Reading Ordinance 2547-18 On motion made by Councilwoman Casalino and seconded by Councilman Cirilo, An Ordinance Creating a Reclassification and Salary Schedule of Certain Township of West Orange Employees Setting Forth Their Titles, Classification and Salary Ranges and Adopting a Salary Guide and Establishing Employee s Status as a Township Employee and Under the Guidelines of the New Jersey Department of Personnel was taken up on second and final reading. All members voting Aye. Pending Matters/New Matters/Council Discussion The Council had a brief discussion about Article III- Rules of Council. At 10:17 p.m., on motion made by Councilman Guarino and seconded by Council President McCartney, the public meeting was adjourned and the Council entered into an ABC Hearing. All members present voting Aye.
