Stubbs, on Tuesday, May 18, 2010, at 9:03 a.m., at the Thomas C. Kelly Administration Building, in the DRC Conference Room, DeLand, Florida. Roll was called by Sherri LaRose. All members were present or represented. APPROVAL OF AGENDA Chair Stubbs opened the floor for approval of the agenda for the May 18, 2010, DRC meeting and there were no changes. Page 1
APPROVAL OF MINUTES Chair Stubbs called for a motion to approve the minutes from the DRC meeting of May 4, 2010. Member Recktenwald MOVED for APPROVAL of the DRC minutes from May 4, 2010. OLD BUSINESS 9:04 A.M. A. Dean Unrecorded #5 Appeal 2010-S-EXM-0105 Parcel #s: 8447-02-06-1980 & 8447-02-06-2350 RSN #: 565679 Project Representatives: Mr. Glenn D. Storch, Esquire - Storch, Morris, Harris, LLC Mr. James Dean Owner Appeal the County Development Engineer's determination that Lots 198 and 235, in Cape Atlantic Estates Section F Unrecorded Subdivision #221, do not meet the vesting criteria pursuant to Section 72-537(a)(4)(a) of the Land Development Code of Volusia County, Florida. This project was continued at the DRC meetings of March 16, 2010 and May 4, 2010. Mr. Robert L. Hart, of Hart, Land & Cattle, Inc., joined the meeting. Member Recktenwald MOVED for APPROVAL of the Appeal and OVERTURN the County Development Engineer s determination to allow the combination of Lots 198 and 235, in the Cape Atlantic Estates Section F Unrecorded Subdivision #221, based on substantial improvements on the property. The DRC approval included the request to provide a one (1)-foot non-vehicular access easement, if possible. Page 2

Engineering Mr. Frank Severino H H & H Properties, LLC Request for approval of the Subdivision Preliminary Plat application. This project was continued at the DRC meetings of March 2, 2010 and May 4, 2010. Member Recktenwald MOVED for APPROVAL of the Preliminary Plat application with the conditions stated in the consolidated report and the attached Technical Review Committee comments, with the following waiver or modifications: 1. A waiver from Section 72-840(b)(4)(g) of the Land Development Code of Volusia County, Florida, is approved to allow 100% tree clearing of the approved lots within a subdivision during one calendar year. 2. A minimum of 40% specimen tree preservation must be provided for the site. Specimen trees with significant drip line encroachment must be resolved as they cannot be counted toward this preservation requirement. 3. 30% tree replacement must be provided for the difference in the number of trees provided and the 43 trees that are required for the site. 4. The DRC action of October 7, 2008, in regard to the wetland impacts shall remain in full force, with the exception to the aforementioned relief to specimen trees, as follows: a. A Wetland Alteration Permit was submitted on January 12, 2010, and is currently under review. b. Mitigation fees for the 25 foot wetland buffer area must be paid in its entirety. Page 3

Parker Mynchenberg & Assoc. Request for approval of the Subdivision Final Plat application. Member Recktenwald MOVED for APPROVAL of the Subdivision Final Plat application with the conditions stated in the consolidated report and the attached Technical Review Committee comments, with the following waivers or modifications: 1. The submission of revised construction plans demonstrating the infrastructure necessary to support the individual phase development is required. It was noted that the Subdivision Preliminary Plat Development Order was granted an extension under Senate Bill 360, on July 30, 2009, with a valid period through January 11, 2012. Page 4
ADDITIONAL BUSINESS 10:08 A.M. A. MBA Business Center Use Permit Appeal 2009-P-USE-0289 Parcel #: 3136-04-00-0001 RSN #: 665925 Project Representative: Mr. Parker Mynchenberg, P.E. Parker Mynchenberg & Assoc. Appeal the County Development Engineer's determination that the commercial driveway does not meet the corner clearance criteria pursuant to Section 72-619(b)(1)(b) of the Land Development Code of Volusia County, Florida. Member Recktenwald MOVED for APPROVAL of the Appeal and OVERTURN the County Development Engineer's determination to allow the exit-only commercial driveway. The DRC took the following additional action: 1. All regulatory signage and pavement markings must be installed and inspected by Traffic Engineering. 2. A Tree Removal Permit is required to relocate the trees within the sight visibility triangle of US Hwy 1 and Destiny Drive. None.
