DAY 7 EVENING SESSION MINUTES CHEMUNG COUNTY SPECIAL MEETING May 29, 2018 Legislature was called to order by the Chairman of the Chemung County Legislature at 7:30 p.m. The following members were present when the Clerk called roll: Pastrick _x Manchester _x_ Sweet _x Brennan _x Miller _x Hyland _x Milliken _x Woodard _x Fairchild _x_ Chalk _x Jackson _x Collins _x Madl _x Draxler _x Strange _x The Chairman explained that the purpose of the special meeting was to adopt time sensitive resolutions on behalf of the Elmira Corning Regional Airport. RESOLUTION NO. 18-289 Resolution rescinding Resolution No. 18-230 relative to the Elmira Corning Regional Airport (Resolution awarding bid to Streeter Associates, Inc. on behalf of the Elmira Corning Regional Airport RFB-2019 Terminal Revitalization Construction Phase III) By: Manchester Seconded by: Sweet

WHEREAS, the Director of Aviation submitted a Chemung County Route Slip ( Route Slip ) to this Legislature pursuant to which he requested this Legislature award the bid for the Terminal Revitalization Construction Phase III (RFB- 2019) (the Project ) to Streeter Associates, Inc.( Streeter ), the sole bidder, with the caveat that the award was conditional upon the final review and recommendation of the Project s construction manager and engineer; and WHEREAS, the Route Slip was presented to the Aviation Committee of this Legislature for consideration at its regular meeting at which time the Director of Aviation presented the bid to the Aviation Committee and advised the Aviation Committee that the bid was significantly higher than the engineer s estimate and that the Project s engineer and construction manager are reviewing the bid and discussing Streeter s bid and will present their reports to the Director of Aviation; and WHEREAS, the Aviation Committee referred the Route Slip to the full Legislature for its consideration with the Aviation Committee s recommendation that the bid for the Project be awarded based upon the content of the Route Slip and the presentation by the Director of Aviation; and WHEREAS, the full Legislature, at its regularly scheduled meeting held April 9, 2018, reviewed the Aviation Committee s recommendation and based upon the Route Slip, the Aviation Committee s meeting and its recommendation and having received no report from either the Project s engineer or the construction manager that recommended that the County of Chemung award the contract to Streeter Associates, Inc. pursuant to Resolution No 18-230; and WHEREAS, the Director of Aviation has submitted a Chemung County Route Slip to this Legislature requesting that Resolution No. 18-230 awarding the bid to Streeter Associates, Inc. be rescinded based upon an engineers and construction manager s report received by the County subsequent to the passage of Resolution No. 18-230; and WHEREAS, the Project s construction manager and engineer have advised this Legislature that the bid submitted by Streeter was in excess of their estimates for Phase III of the Project; and WHEREAS, the construction manager and the engineer have recommended that the bid received pursuant to RFB- 2019 be rejected; and WHEREAS, the bid received in response to RFB-2019 was rejected on May 14, 2018 pursuant to Resolution No. 18-271, which resolution remains in full force and effect; now, therefore, be it RESOLVED, that Resolution No 18-230 be and hereby is rescinded.

RESOLUTION NO. 18-290 Resolution awarding bid to Nova Sign Group on behalf of the Elmira Corning Regional Airport (RFB-2041 Terminal Revitalization Construction - Phase III - Terminal Signage) By: Manchester Seconded by: Sweet WHEREAS, sealed bids, pursuant to RFB-2041, were received and opened on May 15, 2018 on behalf of the Elmira Corning Regional Airport for the Terminal Revitalization Construction Phase III Terminal Signage (the Project ); and WHEREAS, the Director of Aviation and McFarland Johnson, the Project s engineer, and Welliver, the Project s construction manager, have recommended the acceptance of the lowest responsible bid meeting all bid specifications for the Project; and WHEREAS, the County Executive and the Aviation Committee have reviewed the bid specifications, the bids submitted, and the recommendations of the Director of Aviation, McFarland Johnson, and Welliver, and they all recommend the Chemung County Legislature award the bid to Nova Sign Group ( Nova ), the lowest responsible bidder meeting all bid specifications for the Project; now, therefore, be it RESOLVED, that the Chemung County Legislature does hereby find that Nova is the lowest, responsible bidder meeting all bid specifications for the Project; and, be it further RESOLVED, that the County Executive is hereby authorized and directed to enter into an agreement with Nova for the Project at a total cost of $194,975 ($171,975 base bid plus $23,000 Alternate 1) as more specifically set forth in the bid submitted by Nova; and, be it further RESOLVED, that the terms and conditions of the agreement between the County of Chemung and Nova shall be subject to the review and approval of the County Attorney; and, be it further RESOLVED, that the agreement shall not be renewed, the initial term thereof extended, or the agreement amended without express consent by Resolution of this Legislature.

MOTION By: Sweet Seconded by: Pastrick MOVED, that this Chemung County Legislature be adjourned until Monday, June 11, 2018 at 7:00 p.m. in the Legislative Chambers, 5th floor, Hazlett Building, 203 Lake Street, Elmira, New York. CARRIED.
