JO DAVIESS COUNTY BOARD MEETING MINUTES NOVEMBER 10, 2015 CALL TO ORDER: Chairperson of the Jo Daviess County Board, Ron Smith, called the meeting to order at 7:00 p.m. on Tuesday, at the Jo Daviess County Board Room, Jo Daviess County Courthouse, Galena, Illinois. ROLL CALL was answered as follows: Present-Gerald Bennett, Merri Berlage, William Bingham, Richard Dittmar, Robert Heuerman, Randy Jobgen, Steve McIntyre, John O Boyle, Brad Petersburg, Steve Rutz, Ron Smith, Terry Stoffregen, Martin Werner, RJ Winkelhake and Don Zillig. Present: 15. Absent-Brandon Behlke and Dan Hughes. Absent: 2. THE PLEDGE OF ALLEGIANCE was led by Chairperson Ron Smith. THE INVOCATION and thought for the day were given by Bill Bingham. AGENDA ITEM I CONSENT AGENDA The consent agenda was approved as attached following a motion made by Steve Rutz and seconded by Merri Berlage. Merri Berlage was appointed to the Northwestern Illinois Community Action Agency (NICAA) for a three-year term ending November 30, 2018 following approval of a motion made by Rick Dittmar and seconded by RJ Winkelhake. The motion carried by voice vote with an abstention recorded for Merri Berlage. AGENDA ITEM II CITIZENS COMMENTS Circuit Clerk Sharon Wand reported she contracted with a new collection agency and in the first 10 days they collected $3,283.42. AGENDA ITEM III UNFINISHED BUSINESS There was no unfinished business at this time. AGENDA ITEM IV NEW BUSINESS AND COMMITTEE REPORTS EXECUTIVE: The Executive Committee had no business to bring before the board. INFORMATION AND COMMUNICATIONS TECHNOLOGY: An intergovernmental agreement with Carroll County and Whiteside County for a 2016 cooperative multi-county digital orthophotography project was approved following a committee motion made by Gerald Bennett. Page 2 of 7 A one year contract with McDaniel s Marketing Agency for marketing and developing a new CVB logo not to exceed $115,700.00 was approved following a motion made by Merri Berlage and seconded by Randy Jobgen. A contract with McDaniel s Marketing Interactive to develop a new CVB interactive website not to exceed $110,500.00 was approved following a motion made by Merri Berlage and seconded by John O Boyle. FINANCE, TAX AND BUDGET: The following FY2015 line item transfer request in the amount of $2,600.00 was made by Steve Rutz and seconded by RJ Winkelhake. a) Transfer of $2,600.00 from 003-44151-702 Professional Service to 003-44151-705 Publishing. The motion carried by voice vote with a nay vote recorded for Merri Berlage. A motion to approve the following FY2015 line item transfer requests and associated claims in the amount of $35,449.68 was made by Steve Rutz and seconded by John O Boyle. a) Transfer of $3,955.64 from 001-41123-704 Telephone to 001-41123-604 Computer Supplies to pay associated claims to Illinois Bank & Trust in the amount of $3,622.48 and CDW-Government in the amount of $518.91. b) Transfer of $25,000.00 from 002-43141-901 Contingency to 002-43141-601 Maintenance Services to pay associated claims to Conmat in the amount of $18,169.76 and Fischer Excavating, Inc. in the amount of $6,428.70. c) Transfer of $1,522.00 from 002-43141-901 Contingency to 002-43141-701 Maintenance Service to pay an associated claim to The Workshop in the amount of $1,716.00. d) Transfer of $5,081.73 from 071-44163-905 Miscellaneous Operating Expense to 071-44163-990 Interfund Transfer to pay an associated claim to Jo Daviess County Treasurer in the amount of $3,121.83. e) Transfer of $1,872.00 from 002-43141-901 Contingency to 002-43141-701 Maintenance Services to pay an associated claim to The Workshop in the amount of $1,872.00 Steve Rutz, Terry Stoffregen, Martin Werner, RJ Winkelhake and Don Zillig. Ayes: 14. Nays: 0. Abstain- Ron Smith. Abstain: 1. Absent-Brandon Behlke and Dan Hughes. Absent: 2. Agenda item IV D. e. was removed from the agenda. This brings the total claims paid in November 2015 to $934,900.31 which includes two claims approved under G.7 Law Enforcement and Courts in an amount of $17,294.75. A resolution to dissolve the Public Health Emergency Response Grant Fund (Fund Number 067) was approved following a committee motion made by Steve Rutz.

Page 3 of 7 A resolution for a deed of conveyance of the County s interest in parcel 05-504-490-00 in Dunleith Township to Dennis White was approved following a committee motion made by Steve Rutz. DEVELOPMENT AND PLANNING: This committee had no business to bring before the board. PUBLIC WORKS: The revised Jo Daviess County Flood Prevention Ordinance was approved following a committee motion made by Randy Jobgen. A petition from Woodbine Township for County aid for a culvert project on Gras Road at an estimated cost of $10,000.00 (50% Township, 50% County) to be paid from line item 011-43145-890 was approved following a committee motion made by Randy Jobgen. The motion carried by voice vote with an abstention by Rick Dittmar. A petition from Scales Mound Township for County aid for a culvert project on Holland Road at an estimated cost of $200,000.00 (80% State, 10% Township, 10% County) to be paid from line item 011-43145-890 was approved following a committee motion made by Randy Jobgen. A petition from Derinda Township for County aid for a culvert project on Plosch Road at an estimated cost of $5,000.00 (50% Township, 50% County) to be paid from line item 011-43145-890 was approved following a committee motion made by Randy Jobgen. LAW ENFORCEMENT AND COURTS: A recommendation to award contracts to Barker Performance Automotive, Warren, IL for oil changes at $18.00, Synthetic $26.00, Labor Rate $40.00 per hour; Palmer Automotive, Elizabeth, IL, for oil changes $19.95, Synthetic $30.95, Labor Rate $48.00 per hour; and Leibold s Auto Center, Galena, IL, Oil Changes $16.00, Synthetic $32.00, Labor Rate $50.00 per hour was approved following a committee motion made by RJ Winkelhake. A recommendation to award a contract for FY2016 starting December 1, 2015 and ending November 30, 2016 for cleaning/janitorial services for the Jo Daviess County Courthouse to George A. Cederberg of Cuba City, Wisconsin in an amount of $21,000.00 with monthly payments of $1,750.00, with an option for a second year extended contract in the amount of $21,630.00 with monthly payments of $1,802.50 was approved following a committee motion made by RJ Winkelhake.

Page 4 of 7 A recommendation to award a contract to Barkau Automotive, Stockton, IL, for the purchase of a 2016 Dodge Charger AWD Police Pursuit squad car with police package at a cost of $25,983.19 was approved following a committee motion made by RJ Winkelhake. A recommendation to approve an agreement for FY2016 for Enhanced 911 Emergency Dispatch Services between the County of Jo Daviess, the Sheriff of Jo Daviess County and the Jo Daviess County Emergency Telephone System Board was approved following a committee motion made by RJ Winkelhake. A contract for Inmate Food Service at the Jo Daviess County Jail to Dillon s HM, Lunch $6.00, Lunch with Beverage N/A. was approved following a committee motion made by RJ Winkelhake. A resolution to approve Change Order #1 for the Jo Daviess County Courthouse Exterior Improvements Project was approved following a committee motion made by RJ Winkelhake. A resolution to approve the purchase of a copy machine and ten tasers for a total amount of $17,294.75 for the Sheriff s Department and to pay for them from the FY2015 Court Security budget was approved following a committee motion made by RJ Winkelhake. SOCIAL AND ENVIRONMENTAL: This committee had no business to bring before the board. PLANNING COMMISSION/ZONING BOARD OF APPEALS: An application by Bahl Water, (address: 17500 John Deere Rd., Dubuque IA 52001), Thomas and Karen Jaeger, owners, (address: 17500 John Deere Rd., Dubuque IA 52001), requesting a Special Use Permit for a Utility Major to allow for the operation and expansion of a water treatment & storage system serving Pioneer Acres; in addition, under the Special Use Permit an allowance for building setbacks and separation requirements review and approval as part of the Special Use Permit as established in Article 8, Section 3H-7, A, 8. located in the RP Planned Residential District, at 25 Remington Park Circle, East Dubuque was approved following a motion made by Merri Berlage and seconded by Steve Rutz. Text amendments to the Jo Daviess County Zoning Ordinance consisting of changes to: 8-4C-2, A, 5: Scope 8-5A-6: Use Table Adding the following: Wholesale Greenhouse

A recommendation to deny an application by Jo Daviess County Board, (330 N. Bench St., Galena IL 61036), requesting a text amendment to the Jo Daviess County Zoning Ordinance consisting of changes to: 8-5A-6: Use Table Amusement Activities of Public Interest Type 1 8-5B-37: Temporary Uses Amusement Activities of Public Interest Type 2 8-7: Definitions Amusement Activities of Public Interest Type 1 Amusement Activities of Public Interest Type 2 was approved following a motion made by Steve Rutz and seconded by John O Boyle. The motion carried by roll call vote: Ayes-Merri Berlage, William Bingham, Robert Heuerman, Randy Jobgen, Steve McIntyre, Brad Petersburg, Steve Rutz, Ron Smith, Terry Stoffregen, Martin Werner, and Don Zillig. Ayes: 11. Nays-Gerald Bennett, Richard Dittmar, John O Boyle and RJ Winkelhake. Nays: 4. Absent-Brandon Behlke and Dan Hughes. Absent: 2. LEGISLATIVE: This committee had no business to bring before the board. OTHER COMMITTEES AND BOARDS: Board members appointed to other special committees updated the board with actions involving those committees. AGENDA ITEM V BOARD MEMBER CONCERNS There were no concerns at this time. AGENDA ITEM VI CITIZENS COMMENTS Gary Diedrick reported Center Grove Methodist Church in Dubuque, Iowa will be receiving 42,000 pounds of potatoes in 10 pound bags. Gary is picking up 2,000 pounds on Tuesday and will distribute potatoes to area food panties. Gary asked to be contacted if anyone knows of an organization or an individual that would be interested in receiving potatoes.

AGENDA ITEM VIII - POSSIBLE ACTION AS A RESULT OF CLOSED SESSION No action was needed since the board did not enter closed session. AGENDA ITEM IX - ADJOURNMENT The meeting adjourned following a motion made by Steve McIntyre and seconded by John O Boyle. The motion to adjourn carried by voice vote.
