NOTICE OF REGULAR MEETING IN ACCORDANCE WITH SECTION 38-431.01 OF THE ARIZONA REVISED STATUTES OF THE STATE OF ARIZONA, NOTICE IS HEREBY GIVEN TO THE MEMBERS OF CITY COUNCIL AND TO THE GENERAL PUBLIC THAT THE MAYOR AND COUNCIL OF THE CITY OF SAN LUIS, ARIZONA WILL HOLD A REGULAR CITY COUNCIL MEETING AT 7:00 P.M., WEDNESDAY, MAY 14, 2014. CALL TO THE PUBLIC Ms. Floribella Redondo, Campesinos Sin Fronteras, thanked Mayor and Council for their continuous support to the agency and community. Mr. Ivan Gutierrez, Southwest Anti-Tobacco Coalition Coordinator, thanked Mayor and Council for working in conjunction with his organization to name the Moctezuma Park a smoke free park. DISCUSSION AND POSSIBLE ACTION ITEMS: Mayor G. Sanchez moved item #6 to be the first item on the agenda, there was no opposition from Council. 6. Discussion and possible action of approval of Resolution No. 1054. A Resolution of the Mayor and Council of the City of San Luis designating Moctezuma Park as a smoke free park. Mayor G. Sanchez presented a certificate of appreciation to Coral Alonso, Nadia Rangel, Jesus Venegas, Roberto Peralta, Jesus Venegas, Luis Solorio Manuele Ramirez, Melisa Piseno and Martin Perez for work done at the Moctezuma Park. MOTION: Council Member J. Harper/Council Member A. Luna-Carrasco to approve Resolution No. 1054. Motion passed unanimously. 1. Presentation by Gladys Wiggins, Director of the Yuma County Airport Authority. Ms. Gladys Wiggins, Yuma County Airport Authority Director, made a power point presentation which is in file with the complete agenda packet with the City Clerk. Council Member J. Harper commented that the City of San Luis considers Rolle Airfield the San Luis Airport. He asked what will be the possibilities to have it open to the public. Ms. Wiggins replied that it is open to the public; all they have to do is contact the airport operations to get their badge and flights with no issues.

Page 4 2. Any and all matters pertaining to the appointment of the City of San Luis residents to serve as a Commission Member of the City of San Luis Planning & Zoning Commission. Ms. Sharon Williams, Development Services Director, informed that there are five applicants for three openings. She mentioned that there a several cases coming up this summer and for this reason it is very important that appointment is done during this meeting or the upcoming meeting. She added that the term is for four (4) years and the person can be reappointed. Mayor G. Sanchez stated that it is very important to get people that are interested in becoming part of the Planning & Zoning Commission. MOTION: Council Member M.C. Ramos/M.A. Pinzon to accept the resignation of Case Van Been, Alejandro Meza, and Hipolito Reyes from the Planning & Zoning Commission and declare three (3) vacancies. Motion passed unanimously. Motion passed unanimously. 3. Discussion and possible action on any and all matters pertaining to the purchase of a Solid Waste truck for Public Works Department. Purchase entails the use of two vendors, Rush Truck Centers of AZ, Inc., for the chassis in the amount of $145,172.97 and Arizona Refuse Sales, LLC for the body and packing system in the amount of $97,930.28, for a total purchase of $243,103.25. Purchases are following a piggyback to City of Tucson contract. Mr. Eulogio Vera, Public Works Director, informed that this is budgeted item; Mr. John Starkey has worked very hard to accomplish this purchase this new Solid Waste truck. He stated that the City is in a need of this new truck. MOTION: Council Member M.A. Pinzon/Council Member A. Luna-Carrasco to authorize Public Works Department to purchase a Solid Waste truck using two (2) vendors, Arizona Refuse Sales, LLC and Rush Truck Centers of AZ, Inc., in the amount of $243,103.25. Public Hearing followed by discussion and possible action to recommend a Special Event Liquor License application to the Arizona Department of Liquor Licenses and Control to sell alcohol on the upcoming San Luis Police Athletic League Disorder by the Border Boxing Event on May 31, 2014. Open Public Hearing MOTION: Council Member J. Harper/Council Member M.A. Pinzon to open the public hearing. Mr. Ernesto Prieto, Police Department, informed that the San Luis Police Athletic League (SLPAL) Disorder by the Border boxing event is scheduled for May 31, 2014. He added that this will be the 5 th year that the SLPAL is doing this family event. He mentioned that there will be plenty of security during this event. Furthermore, he added that part of the funding will be for the boxing program and also funds are shared with the Youth Center. Council Member M.A. Pinzon commented that this is an excellent event. Mr. Marco Ramirez, Chairman for the FRONTERA Rotary Club of San Luis, informed that this year they have partnered with the Miss San Luis Scholarship Pageant to raise

Mr. Manuel Rojas, Off-road Expo Organizer, presented Mayor and Council with the poster for the event. He added that there will be people from out of town coming to this event. A Resolution of the City of San Luis declaring as a public record that certain document Development Impact Fee Ordinance as filed with the City Clerk. Mr. Glenn Gimbut, City Attorney, informed that items #7, 8, 9 and 10 are related. He mentioned that these items are regarding impact fees. He added that Resolution No. 1055 & 1056 are to declare as public records the Development Impact Fee Ordinance and the Land Use Assumptions, Infrastructure Improvements Plan and Development Fees. He mentioned that Council determined in a Council meeting that there was a certain level of impact fees that they wish to adopt. Furthermore, mentioned that it was a suggestion to eliminate the item Water/Utility impact fee. He added that in the document presented during this meeting that item has been eliminated. Mr. Gimbut stated that this item will need to be revisited every two (2) years. He explained that Resolution No. 1055 is to declare the documents as a public record, Resolution No. 1056 is to amend the Land Use Assumptions, Infrastructure Improvements Plan, and Development Fees, then Resolution No. 1057 is to adopt the development impact fees, amend the Infrastructure Improvement Plan. He informed that this amendment qualifies under state law as a minor amendment and there must be a seventy five (75) day waiting period before new fees can go into effect and minor amendments to an infrastructure improvement plan must have 30 day delay before it can go into effect. By state law our existing development impact fees must be replaced on or before August 1, 2014. Finally item #7 is to amend and adopt section 150.040 through 150.055 as the Development Impact Fee Ordinance. MOTION: Council Member A.
