THE CORPORATION OF LOYALIST TOWNSHIP Eighteenth Session of Council - Monday, July 9, 2012 The Municipal Council for The Corporation of Loyalist Township met in regular session on Monday, July 9, 2012 at 6:15 p.m. in the Administration Building. PRESENT: Mayor Lowry, Deputy Mayor Bresee and Councillors Ashley, Daniliunas, Hegadorn, Ibey and Porter Comments are not verbatim ADOPTION OF AGENDA 2012.18.1 - Adoption of Agenda Moved by Councillor Ashley and seconded by Councillor Ibey that the agenda be adopted, as amended, to: 1. Add a personal matter to Closed Session. DISCLOSURE OF PECUNIARY INTEREST AND THE GENERAL NATURE THEREOF 202.18.2 - Disclosure of Pecuniary Interest and the General Nature Thereof Councillor Daniliunas declared a Conflict of Interest in both the Closed and Open Session meetings with regard to correspondence from Janice Teare. He left the room during the discussion in Closed Session and did not participate in the discussion or vote on the matter in Open Session. CLOSED SESSION 2012.18.3 - Closed Session Moved by Councillor Ashley and seconded by Deputy Mayor Bresee that Council proceed into Closed Session as permitted under the Municipal Act to consider: i) litigation or potential litigation ii) personal matters about identifiable individual, including municipal employees RISE AND REPORT 2012.18.4 - Rise and Report Moved by Deputy Mayor Bresee and seconded by Councillor Ashley that Council in Closed Session rise and report. Mayor Lowry reported that during the Closed Session portion of the meeting two legal matters and two personal matters were discussed. The following resolution was brought into Open Session: Moved by Councillor Ibey and seconded by Deputy Mayor Bresee that the correspondence from Janice Teare, June 12, 2012 and C.A.O.'s report, July 4, 2012 re: Code of Conduct be received and that Ms. Teare be advised that no action was taken with regard to her request. PRESENTATIONS 2012.18.5 - Cheque presentation by Carlos Benia, Loyalist Minor Soccer Association re: Donation toward the soccer field at the W.J. Henderson Recreation Centre Carlos Benia, Loyalist Minor Soccer Association presented a cheque for $15,000 as a second installment of the Club s $25,000 contribution towards the soccer field project at the W.J. Henderson Recreation Centre. A donation of $5,000 was presented in 2008 and the final installment of $5,000 will be delivered in 2013. MINUTES 2012.18.6 - Council Minutes - June 25, 2012 Moved by Councillor Hegadorn and seconded by Councillor Ashley that the minutes of the Seventeenth Session (regular), June 25, 2012 be received and adopted. DELEGATIONS 2012.18.7 - Delegations None REPORTS Finance Department 2012.18.8 - Supplementary Tax Billing - St. Lawrence Youth Association (Report #1) Moved by Councillor Ibey and seconded by Deputy Mayor Bresee that the Director of Finance's report, June 26, 2012 re: Supplementary Tax Billing - St. Lawrence Youth Assoc. (Report #1) be received for information. 2012.18.9 - Question and Answer None Engineering Department 2012.18.10 - Bayview Bog Five Year Study - Final Report Moved by Deputy Mayor Bresee and seconded by Councillor Ashley that the Project Coordinator's report, July 4, 2012 re: Bayview Bog Five Year Study - Final Report be received for information and that this report be forwarded to the Municipal Planning Department for The City of Kingston. 2012.18.11 - Question and Answer Councillor Ashley commented on the poor condition of Front Road since the recent pavement cuts for the culverts. The Director of Engineering Services, Mr. Thompson, advised that equipment should have been on site today to remove the bumps. Planning and Development Department 2012.18.12 - Heritage Committee Minutes - June 20, 2012 Moved by Councillor Daniliunas and seconded by Councillor Ibey that the Planner's report, July 4, 2012, re: Heritage Committee Minutes - June 20, 2012 be received. 2012.18.13 - Bath Community Revitalization Committee Minutes - March 15, April 19 & May 17, 2012 Moved by Councillor Daniliunas and seconded by Councillor Hegadorn that the Planner's report, July 4, 2012 re: Bath Community Revitalization Committee Report - March 15, April 19 & May 17, 2012 Meetings be received. 2012.18.14 - Question and Answer Councillor Daniliunas indicated that members of the Bath Community Market requested that someone be hired to manage the Sunday Market in Bath because volunteers do not have time to do this. He noted that the salary would be paid from revenue from the market. Moved by Councillor Daniliunas and seconded by Councillor Ashley that staff investigate the possibility of the Bath Community Revitalization Committee providing nominal remuneration for the Bath Market Coordinator to be funded by revenue from the market. Councillor Ashley expressed some concern about flooding in backyards near the development on County Road 6. The Director of Engineering Services will investigate. Recreation Department 2012.18.15 - Recreation and Property Advisory Committee Minutes - June 14, 2012 Moved by Councillor Hegadorn and seconded by Councillor Daniliunas that the Recreation Director's report, June 14, 2012 re: Recreation and Property Advisory Committee Minutes be received. 2012.18.16 - Cemeteries Committee Minutes - June 13, 2012 Moved by Councillor Hegadorn and seconded by Councillor Porter that the Recreation Director's report, June 13, 2012, re: Cemeteries Committee Minutes be received. Motion carried. 2012.18.17 - Question and Answer None C.A.O. s Department 2012.18.18 - Public Input on the Draft Strategic Plan Framework Moved by Councillor Ashley and seconded by Deputy Mayor Bresee that the Research Assistant's report, June 26, 2012 re: Public Input on the Draft Strategic Plan Framework be received and that the following be adopted: 1. That Council preserve and maintain its current vision statement; 2. That Council maintain its current goals and approve Staff's revisions to the strategic actions; and 3. That Council direct Staff to operationalize the proposed strategic actions and proceed with drafting the Strategic Plan, 2012-2015 for Council's consideration. Page 3 of 7
2012.18.19 - AMCTO's 74th Annual Conference and AGM Moved by Councillor Hegadorn and seconded by Councillor Daniliunas that the Research Assistant's report, June 21, 2012 re: AMCTO's 74 Annual Conference & AGM be received for information. 2012.18.20 - Administration Committee Minutes - June 25, 2012 Moved by Councillor Ibey and seconded by Deputy Mayor Bresee that the Minutes of Meeting No. 7 of the Administration Committee, June 25, 2012 be received and adopted. Motion carried. 2012.18.21 - Question and Answer Councillor Ashley advised that portions of the concrete boat ramp at Sand Beach on Amherst Island have washed out into the sand. The Recreation Director, Cindy Lawson, advised that the Township had no plans to repair this boat ramp but she will ask staff to investigate. Mayor Lowry thanked Murray Beckel, Director of Planning and Development Services for assisting The Fairfield-Gutzeit Society with the 1812 Discovery Centre. He also thanked Cindy Lawson, Recreation Director and her staff for their assistance with regard to the Bath Canada Day event. ANNOUNCEMENTS AND ENQUIRIES 2012.18.32 - Announcements and Enquiries Councillor Ibey expressed thanks to the organizing committees for the Bath Canada Day Committee and the 1812 Bicentennial Committee. Councillor Ashley requested that letters be sent to the committee members. He also requested that a thank you letter be sent to Topsy Farms for allowing visitors and re-enactors on their property as part of the re-enactment. Moved by Councillor Ibey and seconded by Deputy Mayor Bresee that letters be sent to the Bath Canada Day Committee members and to the Chair and Co-Chair of the 1812 Bicentennial Committee congratulating them on their successful events. Councillor Hegadorn advised that the Wilton Women's Institute will be holding a fundraiser by Bear Company Productions of "As you Like It" on July 14th at 7:30 p.m. at the Wilton Hall. He also noted that the Odessa Fair is this weekend. Deputy Mayor Bresee would like the Procurement By-law amended to reflect the possibility of an item being obtained for a $0 procurement amount and no cheque written or received. Moved by Deputy Mayor Bresee and seconded by Councillor Porter that the Director of Finance amend the Procurement By-law to identify $0 procurement even if a cheque is not received or issued. Deputy Mayor Bresee advised that recycling was still out on the west half of Amherstview after 6:00 p.m. tonight and requested that the Director of Engineering Services investigate. Councillor Porter noted that the Odessa Fair was being held this weekend and that she will be attending. Councillor Ashley thanked Township Council for its support of the Amherst Island and Bath Canada Day parades. MOTIONS OF CONGRATULATIONS AND CONDOLENCES 2012.18.33 - Motions of Congratulations and Condolences Condolences were sent to former Deputy Reeve Arnold Adams on the passing of his wife Marian. Councillor Hegadorn congratulated the Wilton Women's Institute on their 1st Annual Bruce Burt Memorial Tractor Parade on Canada Day. He noted that 15 tractors participated and there was a potluck following the event. The People's Choice Award was presented to Tim DeRose for his float. Councillor Hegadorn also noted that the County had revised their ATV By-law. Page 6 of 7
CONFIRMATORY BY-LAW 2012.18.34 - Confirmatory By-law Moved by Councillor Ashley and seconded by Councillor Hegadorn that By-law 2012-071, being a by-law to confirm the proceedings of Council at its meeting held on Monday, July 9, 2012 be adopted.
