AGENDA COMMITTEE PULASKI COUNTY QUORUM COURT 5 th REGULAR PROCEEDINGS, 2016 PULASKI COUNTY ADMINISTRATION BUILDING, ROOM 410 LITTLE ROCK, ARKANSAS TUESDAY, MAY 10, 2016 6:00 P.M. Chairman Stowers called the meeting to order at 6:00 p.m. The invocation was led by Justice Reed. The pledge of allegiance was led by Justice McMullen. Justice R. Green made a motion to approve the minutes, which was seconded by Justice McCoy. The motion passed by unanimous voice vote. SPECIAL ORDER OF BUSINESS: Board of Equalization Candidates Mr. Tom Brown and Mr. Dwight Harshaw, candidates for the Board of Equalization, introduced themselves to the Quorum Court and shared why they would like to serve on the board. UNFINISHED BUSINESS: 16-I-26 BUDGET, PULASKI COUNTY ARKANSAS) TO ADD A DEPUTY PROSECUTING ATTORNEY POSITION TO THE PROSECUTING ATTORNEY S OFFICE AND TO ADD A DEPUTY PUBLIC DEFENDER POSITION TO THE PUBLIC DEFENDER S OFFICE. Honorable Elliott Justice Elliott made a motion to send the item to the full Quorum Court, which was seconded by Justice Massey. Mr. Larry Jegley, Prosecuting Attorney, and Mr. Bill Simpson, Public Defender, explained the item. Justice Elliott made a motion to table the item for 30 days to allow the Prosecuting Attorney and the Public Defender to try to work with the circuit judges to help resolve the issue. Justice Massey seconded the motion. The motion to table passed by a roll call vote. Vote to table for 30 days: 8-6 Ayes: Coney, Elliott, J. Green, Keith, Massey, Reed, Robinson and Stowers Nays: Blackwood, Denton, R. Green, Lewison, McCoy, and McMullen Non-voting: Medlock 1

Judge Mary Spencer McGowan, Ninth Division Circuit Court, said the circuit judges have to file an administrative plan with the Arkansas Supreme Court, so the Public Defender and Prosecuting Attorney cannot go back to the judges for two years. She further explained the administrative plan that was sent to the Supreme Court and also spoke in favor of the item. She said the circuit judges do not really consult with any other people when they are dividing their case load. Justice Denton made a motion to remove the item from the table in order to amend it. Justice Blackwood seconded the motion. The motion passed by a roll call vote. Vote to remove the item from the table: 10-3 Ayes: Blackwood, Coney, Denton, J. Green, R. Green, Lewison, Massey, McCoy, McMullen & Robinson Nays: Elliott, Reed & Stowers Non-voting: Keith & Medlock Justice Blackwood made a motion to amend the item to fund the positions for the remainder of year. She said this would be a temporary bridge until they can go to the state. Justice Denton seconded the motion. The motion passed by a roll call vote. Vote to amend the item: 11-1 McMullen, Robinson & Stowers Nays: Reed Justice Blackwood made a motion to send the item to the full Quorum Court with a do-pass recommendation as amended, which was seconded by Justice R. Green. The motion passed by a roll call vote. Vote to send to the full Quorum Court with a do-pass recommendation as amended: 11-1 NEW BUSINESS: Items for Consideration ORDINANCES Item # 16-I-35 Title AN ORDINANCE TO AMEND THE SUBDIVISION AND DEVELOPMENT CODE OF PULASKI COUNTY, ARKANSAS, DECLARING AN EMERGENCY AND FOR OTHER PURPOSES. Honorable Massey Justice Massey made a motion to send the item to the full Quorum Court with a do-pass recommendation, which was seconded by Justice R. Green. Mr. Van McClendon, Planning Director, explained the item. After some discussion, Justice R. Green called for immediate consideration. The second was not picked up on tape. 2

There were no objections. 16-I-41 APPROPRIATE GRANT FUNDS FOR THE PULASKI COUNTY DISTRICT COURT. Honorable Lewison Justice Lewison made a motion to send the item to the full Quorum Court with a do-pass recommendation, which was seconded by Justice Denton. The motion passed by a roll call vote. 16-I-36 APPROPRIATE DONATION FUNDS FOR THE YOUTH SERVICES DEPARTMENT. Sponsors: Honorable(s) R. Green, Blackwood, Denton, Lewison, Massey, McCoy, Robinson & Stowers recommendation, which was seconded by Justice Denton. The motion passed by a roll call vote. 16-I-37 APPROPRIATE GRANT FUNDS FOR THE COMMUNITY SERVICES DEPARTMENT. 3

The motion passed by a roll call vote. 16-I-38 BUDGET, PULASKI COUNTY, ARKANSAS) TO APPROPRIATE GENERAL FUND MONEY INTO THE CIRCUIT/COUNTY CLERK S BUDGET FOR THE CREATION OF AN ASSISTANT CIRCUIT COURT ADMINISTRATOR POSITION. Sponsors: Honorable(s) R. Green, Blackwood, Coney, Denton, Elliott, J. Green & Keith recommendation, which was seconded by Justice Elliott. Justice R. Green made a motion to amend the item with the proposed amendment, which would remove the appropriation figures since the Circuit Clerk already has the money in his budget to cover the cost of the new position. Justice Elliott seconded the motion. The motion to amend the item passed by a roll call vote. Vote to amend: 11-0-1 McMullen, Robinson & Stowers recommendation as amended, which was seconded by Justice Blackwood. Circuit/County Clerk Larry Crane explained the item. Vote to send to the full Quorum Court with a do-pass recommendation as amended: 11-0 McMullen, Reed & Stowers 16-I-40 AN ORDINANCE AUTHORIZING THE PULASKI COUNTY ROAD AND BRIDGE DEPARTMENT TO COLLECT CERTAIN PERMIT FEES AND ESTABLISH PENALTIES AND VIOLATIONS. Honorable Denton Justice Denton made a motion to send the item to the full Quorum Court with a do-pass recommendation, which was seconded by Justice R. Green. Mr. John Burton, Road and Bridge Director, explained the item and the proposed amendment. Justice Denton made a motion to amend the item to include the executive 4

order number in the ordinance. Justice Lewison seconded the motion. The motion to amend passed by a roll call vote. Vote to amend: 10-0-1 McMullen & Stowers Justice Denton made a motion to send the item to the full Quorum Court as amended, which was seconded by Justice Elliott. The motion passed by a roll call vote. Vote to send to the full Quorum Court with a do-pass recommendation as amended: 10-0-1 McMullen & Stowers ITEM FOR DISCUSSION: 1.) Quorum Court Travel- National Association of Counties Conference Mr. Justin Blagg, Quorum Court Coordinator, said as they discussed last time, there is enough money for six Quorum Court members to attend the NACo Annual Conference. He said those who would like to attend need to fill out their forms so that he can get them to the Purchasing Department. He said that will leave about $2,000 for Justice Elliott and one other person to attend the Association of Arkansas Counties Conference. Justice Denton made a motion to adjourn, which was seconded by Justice Elliott. The meeting was adjourned. 5
