DenDekker (D-Jackson Heights) and New York City Councilmember Daniel Dromm (D-Jackson Heights) today called for greater protections from invasive and erroneous parking violation tactics by New York City traffic enforcement agents. In September 2009, Assemblyman DenDekker first introduced Assembly Bill A9135. This bill requires that traffic agents or other law enforcement authority first verbally direct the operator to move the motor vehicle before issuing a parking violation summons. This legislation which I introduced into the State Assembly several months ago became a necessity once Traffic Agents were given hand-held scanning devices, Assemblyman DenDekker stated. These agents walk up to vehicles while the drivers are waiting for someone to pull out of a parking spot, scan the registration sticker, and issue a violation for double parking. In other cases, agents have acted more like Starsky and Hutch; they pull in front of the vehicle, blocking them in. They then jump out of their vehicle, scan the sticker, and issue summonses, leaving many motorists frightened as well as frustrated. During the past year, Assemblymember DenDekker and Councilmember Dromm have led the vanguard against predatory and invasive parking control measures in his Queen s Assembly District. In addition to introducing Assembly Bill A9135, Assemblyman DenDekker introduced Assembly Bill A9133 in September of 2009. This legislation seeks further protections for New York City residents and visitors by requiring the payment of $100 to any motorist who is erroneously issued a parking violation summons that is subsequently dismissed by a Hearing Officer or other competent authority. Time and time again, Assemblyman DenDekker said, motorists are put in double-jeopardy by the City s predatory parking control tactics. First, they are unfairly issued a violation summons; then they are required to take time off from work and other responsibilities to contest the erroneous summonses. The passage of these two legislative initiatives will not only put a dent in the City s invasive parking violations tactics, but will relieve City residents of some of the undue financial hardships that these haphazard practices cause. The law must be made clearer so that traffic enforcement agents understand that they should not be ticketing people for double parking while they are waiting to pull into a parking space, said New York City Council Member Daniel Dromm. When mistakes are made, the city should be forced to pay just as the city requires motorists to pay when they do something wrong. Stressing a common sense approach to parking enforcement practices in New York City, Assemblyman DenDekker indicated that there is a big difference between preventing double parking and the blocking of bus stops, and using parking enforcement laws as a way of generating revenue for the City. In 2008, for example, 14.7% of all issued parking violations were dismissed, and a staggering 17.1% of parking ticket appeals granted reversal. These figures not only indicate the aggressive degree to which parking violations are issued, Assemblyman DenDekker concluded, but the shocking degree to which they are erroneously and unfairly issued. After many months of hard work and disruption, the renovation of the market was complete. Associated invited family members, fellow supermarket owners, and friends citywide. The three business partners, Sam Callado, Fermin Gutierrez, and Aris Duran joined Father Jerry in front of the crowd. Sam acted as spokesman for his partners and thanked everyone for coming. He told of the many early problems the partners shared when they took over the store and all the labor and long hours they and their staff had put into it. Sam thanked Father Jerry for coming and invited the priest to give the blessing. In contrast to the momentary prayer most employed at such events, Father Jerry gave a heartfelt and lengthy blessing which included the holiness of work itself, which everyone seemed to appreciate, even those not of the Catholic faith. Father led everyone in the sign of the cross and gave words of encouragement, understanding and hope. The priest concluded with a blessing of the workers and all assembled by sprinkling a little bit of Holy Water in the name of Father, Son and Holy Spirit. Associated laid out a feast of food on the tables, in which everyone was offered to enjoy. We are grateful for such nice neighbors who do care and are such a strong part of this community.
