MINUTES TOWN OF SALEM REGULAR MEETING OF THE BOARD OF SUPERVISORS Monday, June 9, 2014 7:00 P.M. Chairman Diann Tesar called this Regular Meeting of the Town of Salem Board of Supervisors to order at 7:00p.m., with the following present: CHAIRMAN: BOARD OF SUPERVISORS: OTHERS: GUESTS: Diann Tesar Dennis Faber, Mike Culat, Ted Kmiec and Dan Campion Pat Casey, Attorney Scholze, Brad Zautcke, Mike Slover, Jack Rowland, Mike Murdock, Dave Shortess and Cindi Ernest. Mike Langel, Pat Leslie, Theron Milligan, Roland Buhler, John Roberts, Chris Skyrznecki, Susan Milligan, Darren Hillock, Julie Schroeder and Colleen Glaves. PLEDGE OF ALLEGIANCE Chairman Tesar led the Pledge of Allegiance. OPEN MEETING COMPLIANCE CHECK The agenda was posted prior to 4:00 p.m. on Wednesday, June 4, 2014 at the Town Hall Municipal Building, Salem Post Office, Camp Lake Post Office, Wilmot Post Office, and the Trevor Post Office. It was also posted on the Town s website. APPROVAL OF AGENDA SEQUENCE There was no change in the agenda sequence. CITIZENS COMMENTS John Roberts requested the status and the deadline for the incorporation committee interest applications. Chairman Tesar told Mr. Roberts that the application is online on the Town s website and at this time there is no deadline. The committee will possibly meet a couple of times a month and the Town would like 10-12 people on the committee. Roland Buhler asked for a follow up of the noise problems in hi neighborhood. Administrator Casey said that Kenosha County Board Supervisor, Kim Breunig, is the contact person. She indicated to the Town that she is interested in trying to resolve the problem. Chris Skyrznecki said that he doesn t want parking on the roads in the Town and sent a letter to leave the parking as it is. 1

Chairman Tesar said that the Town will be leaving the parking alone. If a resident will be having a party, they need to call the Town s Public Safety office so that they may accommodate the party. Public Safety Department Head Shortess said that a form will be added to the Town s website for residents to complete. Mr. Skyrznecki asked if there is any draft ordinance on ATV s. Chairman Tesar replied, No. Sue Milligan read a letter to the Board regarding ATV routes in the Town. She has lived in Valmar for 49 years and is strongly opposed to them. She has a petition of over 100 signatures against the routes. She expressed concerns of safety speed, children on bikes and stop sign issues. ATV manuals state that they are not for road use. Board Supervisor Culat visited her home and told her that more officers may be needed and also signs could be paid by clubs. She asked whether this would be budgeted. The letter Ms Milligan presented is on file in the Office of the Clerk. PRESENTATIONS, PETITIONS, COMMUNICATIONS, & OTHER AGENGY REPORTS 1.) A request to be placed on the agenda, by Bob Hauser, to temporarily close off 98 th Street for approximately four (4) hours for the shooting of a film was presented. Mr. Hauser was not in attendance and there were no details regarding the request, so this item was removed from the agenda. PLANNING & ZONING 1.) A request by Leonardo & Maria Hernandez, 27232 West Nippersink, Ingleside, IL 60041 (Owner), James Soehn, 11400 270th Ave., Trevor, WI 53179 (Agent), for approval of a temporary use to temporarily operate a food vending stand in the B-3 Highway Business District on Tax Parcel #66-4-120-263-0120, Southeast 1/4 Section 26, Township 1 North, Range 20 East, Town of Salem was presented. (Section VII. B. 12.36-5(a)5: which states that all temporary uses require the Board of Adjustments to hear and grant an application in any district) For informational purposes only this parcel is located on the west side of STH 83 (Antioch Road) approximately 300 feet north of intersection with 112th Street. The Planning & Zoning Commission recommended to allow for a 3-year Temporary Use Permit and was approved on a vote of 4-0. (Section III.G.12.13-3(j): which states that parking spaces and driveways shall be a minimum of 20 feet from the established highway right-of-way in the B-2 Community Business District. For informational purposes only this parcel is located on the northwest corner of 83rd Street and STH 83 (Antioch Road). The Planning & Zoning Commission recommended granting the variance on a vote of 4-0. 2

MOTION BY Supervisor Kmiec, second by Supervisor Faber to approve the variance request by Mohinder Singh, 748 West Gilbert Road, Palatine IL 60067 (Owner), Amir Singh, 748 West Gilbert Road, Palatine IL 60067 (Agent), for a variance to expand an existing paved area to be located 6' 10" (required setback 20 feet) from the right-of-way of STH 83 (Antioch Road) on Tax Key Parcel #65-4-120-104-1206, Southeast 1/4 Section 10, Township 1 North, Range 20 East, Town of Salem as presented. 3.) A request by Janice Labek & Richard Labek, 3342 N. Panama, Chicago IL 60634 (Owner), for a variance to construct a residential addition onto the east side of an existing non-conforming structure which is located 5.2 feet (required setback 25 feet) from the rear property line on Tax Parcel #65-4-120-114-1126, Southeast 1/4 Section 11, Township 1 North, Range 20 East, Town of Salem was presented. (Section V. A. 12.28-7: which states that non-conforming structures which encroach upon the yard requirements of this ordinance, but which met yard requirements of the applicable zoning ordinance at the time of construction, may be structurally enlarged or expanded if the existing structure is located at least fifty (50) percent of the minimum setback requirement and further provided that the alteration does not create a greater degree of encroachment on yard, height, parking, loading, or access requirements in the R-4 Urban Single-Family Residential District). For informational purposes only this parcel is located on the south side of 80th Place approximately 200 feet east of the intersection with 235th Avenue. The Planning & Zoning Commission recommended granting the variance on a vote of 4-0. MOTION BY Supervisor Faber, second by Supervisor Culat to take the recommendation of the Planning & Zoning Commission and approve the request by Janice Labek & Richard Labek, 3342 N. Panama, Chicago IL 60634 (Owner), for a variance to construct a residential addition onto the east side of an existing nonconforming structure which is located 5.2 feet (required setback 25 feet) from the rear property line on Tax Parcel #65-4-120-114-1126, Southeast 1/4 Section 11, Township 1 North, Range 20 East, Town of Salem as presented. PUBLIC SAFETY 1.) A request to place a DANGER buoy by the Ice House pilings located at (N42 32.188, W88 8.342 ) on Center Lake so a Waterway Marker Permit Application can be immediately submitted to Jason Roberts Recreational Safety Warden was presented. PARK COMMISSION 1.) A lease agreement with Center Lake Woods Property Owners Association for Center Lake Woods Park was presented. MOTION BY Supervisor Faber, second by Supervisor Campion to approve the lease agreement with Center Lake Woods Property Owners Association for Center Lake Woods Park with the correction on line #8 to change to Center Lake Woods Property Owners Association. 3

2.) The appointment/re-appointment to the Town of Salem Park Commission was presented. This is a seven year term expiring June 30, 2021. There were no applications or interest submitted this time and the position will be advertised further and put on July s agenda. SEWER UTILITY DEPARTMENT 1.) Resolution No. 14-06-09, a Resolution confirming and approving the Town of Salem Utility District Compliance Maintenance Annual Report for 2013 was presented. MOTION BY Supervisor Faber, second by Supervisor Campion to adopt Resolution No. 14-06-09, a Resolution confirming and approving the Town of Salem Utility District Compliance Maintenance Annual Report for 2013 as presented. STORM WATER 1.) Project Payment No.2, which includes Change Order No. 1, by Wanasek Corporation in the amount of $339,886.19 for the 2014 Drainage Improvement Project was presented. MOTION BY Supervisor Faber, second by Supervisor Campion to approve Project Payment No.2, which includes Change Order No. 1, by Wanasek Corporation in the amount of $339,886.19 for the 2014 Drainage Improvement Project as presented. ADMINISTRATOR S BUSINESS 1.) An Intergovernmental Agreement with the Village of Bristol for building inspection services was presented. Administrator Casey told the Board that this will be a test for six (6) months and should bring in approximately $9,000. Currently he is in talks with Kenosha County regarding county wide services. Supervisor Campion said the other municipality will have to provide insurance, vehicle and gas. MOTION BY Supervisor Faber, second by Supervisor Culat to approve the Intergovernmental Agreement with the Village of Bristol for building inspection services as presented. 2.) An Intergovernmental Agreement with the Village of Twin Lakes for building inspection services was presented. This is similar to the agreement approved for Bristol. Liquor license applications were filed with the Clerk for retail license to sell fermented malt beverages and intoxicating liquors, in accordance with the provisions of CHAPTER 125.04 of the Wisconsin State Statutes by the following, with approval contingent on background check clearance, payment of delinquent taxes, assessments, and all necessary fees. Clerk Ernest informed the Board that Shahid & Associates, Inc, DBA Trevor Mini Mart had just made application for a change in their agent and requested that Roxanne Jackson be approved as their agent. Chairman Tesar reported that Hooker Lake has just sprayed for weeds. Supervisor Faber (CCLRD, SEWRPC, P&Z Joint Liaison, Board of Review, Public Safety & Communication Committees) report. Supervisor Faber reported that CCLRD will be spraying on both Camp and Center Lakes on May 20 th and 21 st for Eurasian Milfoil. Board of Review met on May 21 st to address assessments. Even though values went down and the mil rate went up, most stayed the same with the exception of Echo Lane. 11

He reported on attending a joint WTA District meeting will be held on May 13 th. The Affordable Care Act was discussed along with its complicated record keeping. He also attended a seminar hosted by WTA in Milwaukee regarding TIFs. The main speaker was one of the Town s financial advisors from Ehlers. The TIFs are now available for Towns. There was also discussion of Charter Towns and reintroducing this and having the benefits without being a village. Supervisor Kmiec (Park Commission Joint Liaison, Administration, Public Safety, & Communication Committees) report. No report. Supervisor Campion (County & Voltz Lake Liaison, Administration, Communication & Public Works Committees) report. Supervisor Campion reported that the new County committees are selected. Voltz Lake treated their weeds in mid-may and some areas will need a higher treatment upon receiving DNR permission. The number of citations written in the Town last month were 38 with 27 of those citations being for speeding. People don t seem to care and it s a social issue even with the fines high. He will continue to monitor this. Chairman Tesar requested that the next committee meeting include chicken and bees ordinance, the train whistle concept if completed by then and possibly the personnel policy.
