Cape May Court House, NJ November 7, 2016 REGULAR MEETING FLAG SALUTE THIS MEETING IS BEING RECORDED: I hereby declare that notice has been given to the Herald Times, the Atlantic City Press and posted on the bulletin board of the Middle Township Municipal Building, stating the time and place of the following meeting, as required in P.L. 1975, Chapter 231 of the State of New Jersey. (Sunshine Law). The Township Committee met on the above date at 6:00 PM at the Middle Township Municipal Building. Members present were Mayor Clark, Deputy Mayor DeVico, Committeemember Donohue, Township Clerk Kimberly Krauss, Business Administrator Constance Mahon, Municipal Solicitor Frank Corrado, and Township Engineer Marc DeBlasio. 1. RESOLUTION AUTHORIZING CREATION OF LIEN ON PROPERTY On motion by WHEREAS, N.J.S.A. 40:48-2.13 authorizes the governing body of every municipality the power to make, enforce, amend and repeal ordinances requiring the owner or tenant of a dwelling or of lands lying within the municipality to provide for the removal or destruction of brush, weeds, debris, etc. constituting fire hazard or injurious to public health or safety and to provide for the imposition of penalties for the violation of any such ordinance; and WHEREAS, N.J.S.A.40:48-2.14 authorizes the municipality the right to place a lien against such dwelling or lands to provide for the cost of removing brush, weeds debris, etc.; and WHEREAS, the Township of Middle has adopted Ordinance No. 316-76 known as Article I of Chapter 193 of the Code of the Township of Middle Property Maintenance ; and WHEREAS, the Township of Middle has noticed the following property owners as indicated below and furthermore these violations had not been remedied; and WHEREAS, in absence of compliance by said owners, the Township of Middle commenced and completed abatement of these violations; and WHEREAS, the Code Enforcement Officer of the Township of Middle has certified the following cost as listed. NOW, THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, the governing body thereof, that it hereby impose a lien on the properties listed below as indicated. (a) WHEREAS, there is a need to purchase two (2) 2017 Ford F250 Pickup Trucks for use by the Township of Middle Public Works Department, and WHEREAS, through the State Contract Purchasing System, Contract #T-2100 Contract #88726, these items are available, and WHEREAS, the total amount of the purchase for two (2) 2017 Ford F250 Pickup Trucks is $70,390.00 ($35,195.00 each), and funds are available as evidenced by the Chief Financial Officer's Certification, and NOW THEREFORE BE IT RESOLVED by the Governing Body of the Township of Middle, State of New Jersey, County of Cape May that the appropriate officials are hereby authorized to purchase two (2) 2017 Ford F250 Pickup Trucks as indicated above. RESOLUTION RELEASE OF PERFORMANCE BOND FRED LANDFORD THE FAIRWAYS On motion by WHEREAS, $386,516.34, is being held as a performance guarantee for The Fairways for site improvements at Block 335.01, Lot 5.03, otherwise known as 600 Bayberry Drive, and WHEREAS, the Township Engineer for the project has conducted his inspection and certified that all improvements have been completed; and WHEREAS, the Land Use Administrator for the Township of Middle has recommended that the performance bond be released; and WHEREAS, the Land Use Law of the State of New Jersey (NJS 40:55D-1 et. seq.) requires such a release upon recommendation by the Township Engineer; and governing body thereof, that the bond in the amount of $386,516.34 is hereby released. 15. RESOLUTION SEWER ADJUSTMENT On motion by and passed on roll call, the following resolution was adopted. NOW, THEREFORE BE IT RESOLVED, by the Township Committee of the Township of Middle, County of Cape May, State of New Jersey that a bill adjustment due to the property listed below, which was billed for 2 sewer units and whereas the 2 nd unit is not completed at this time. RESOLUTION AUTHORIZING NON-FAIR AND OPEN CONTRACT (ITEMS A THROUGH B) On motion by (a) WHEREAS, the Township of Middle has a need to acquire three (3) Muffin Monster Pump Grinders as a non-fair and open contract pursuant to the provisions of N.J.S.A. 19:44A-20.4, and WHEREAS, the Purchasing Agent has determined and certified in writing that the total value of all services will exceed $17,500, and WHEREAS, the anticipated term of this contract is deemed to expire on December 31, 2016, and WHEREAS, JWC Environmental has submitted a proposal on August 9th indicating they will product and delivery services for $121,010.00, and WHEREAS, JWC Environmental has completed and submitted a Business Entity Disclosure Certification which certifies that JWC Environmental has not made any reportable contributions to a political or candidate committee in the Township of Middle in the previous one year, and that the contract will prohibit the JWC Environmental from making any reportable contributions through the term of the contract, and NOW THEREFORE, BE IT RESOLVED by the Governing Body of the Township of Middle, State of New Jersey, County of Cape May that the appropriate officials are hereby authorized BE IT FURTHER RESOLVED that the Business Disclosure Entity Certification and the Determination of Value be placed on file with this resolution, and JWC Environmental (b) WHEREAS, the Township of Middle has a need to install three (3) Muffin Monster Pump Grinders as a non-fair and open contract pursuant to the provisions of N.J.S.A. 19:44A-20.4, and

RESOLUTION AUTHORIZING ACCEPTANCE OF A GIFT ANZELONE ELECTRIC POLICE EMERGENCY OPERATIONS CENTER/ CONFERENCE ROOM On motion by WHEREAS, the Township of Middle is in the process of upgrading various components of the Police Department Emergency Operations Center/Conference room, and WHEREAS, the Anzelone Electric has donated their electrical services to the Township of Middle towards the above reference project, and WHEREAS, N.J.S.A. 40A:5-29 authorizes the acceptance bequests, legacies and gifts by local units, and WHEREAS, the Township of Middle has been offered a gift of electrical labor services valued at $, and WHEREAS, the Township Committee of the Township of Middle wishes to recognize that the acceptance of the aforesaid gift will benefit the taxpayers of the Township of Middle by defraying some of the costs associated with said project. RESOLUTION AUTHORIZING A SEWER EASEMENT BETWEEN MIDDLE TOWNSHIP AND THE MIDDLE TOWNSHIP BOARD OF EDUCATION On motion by and passed on roll call, the following resolution was adopted. WHEREAS, the Township of Middle maintains a sewer line that runs beneath the property, owned by the Middle Township Board of Education, on which Middle Township Elementary School #1 is located; and WHEREAS, a planned addition to Middle Township Elementary School will require a relocation of that sewer line; and WHEREAS, to enable Middle Township to maintain and service that sewer line, it is necessary that the Board of Education (as grantor) and the Township (as grantee) enter into an Easement Agreement affording the township access to maintain and service the sewer line; and WHEREAS, for a nominal consideration, the Board of Education is willing to grant, and the Township is willing to accept, such an easement; and WHEREAS, the Township Committee of the Township of Middle has determined that it is in the Township s best interest to enter into such an Easement Agreement, NOW, THEREFORE, on this 7 TH day of November 2016, be it RESOLVED by the Middle Township Committee as follows: 1. The averments of the preamble are incorporated herein by reference. 2. Middle Township is hereby authorized to enter into an Easement Agreement, in the form attached hereto, with the Middle Township Board of Education, affording the Township an easement by which to access the relocated sewer line on the property of Middle Township Elementary School #1. 3. RESOLUTION REDUCTION OF PERFORMANCE BOND RIO GRANDE 9 LLC. - On motion by WHEREAS, $680,373.75 is being held as a performance guarantee of Rio Grande 9 LLC for Block 1436.01, Lot 6, otherwise known as 3150 Route 9 South; and WHEREAS, the Engineer has conducted his inspection and determined that improvements having a value of $217,600.65 have been completed; and WHEREAS, it has been further recommended that the performance guarantee for the above stated project be reduced to $462,773.10; and governing body thereof, that the performance guarantee as listed above be and is hereby reduced. 26. RESOLUTION AUTHORIZING PURCHASE THROUGH THE CAPE MAY COUNTY CO-OP CONTRACT FOR ROCK SALT (BULK) On motion by and passed on roll call, the following resolution was adopted. RESOLUTION ACKNOWLEDGING INTERGOVERNMENTAL TRANSFER APPOINTMENT NEW HIRE On motion by and passed on roll call, the following resolution was adopted. WHEREAS, the Intergovernmental Transfer Program through New Jersey Civil Service Commission provides the opportunity for eligible New Jersey state and local government employees with permanent civil service status to transfer between local to local employment jurisdictions while maintaining their permanent status, and WHEREAS, this program promotes more efficient public service by allowing civil service jurisdictions to share talented and experienced individuals with other governmental sectors, and WHEREAS, all parties involved in the transfer (the transferring employee, the sending jurisdiction, the receiving jurisdiction, and the New Jersey Civil Service Commission) must agree to the transfer for it to be completed.
