MORTON COUNTY COMMISSION REGULAR MEETING August 11, 2016 The Morton County Commission Regular Meeting was called to order on August 11, 2016 at 5:30 PM by Chairman Schulz at the Morton County Courthouse, 210 Second Avenue NW, Mandan, North Dakota. Others present were Commissioners Zachmeier, Boehm, Leingang and Strinden, Auditor Rhone, States Attorney Koppy and Assistant States Attorney Grosinger. Boehm moved and Leingang seconded to approve bills and payroll. All voting aye, motion carried. Brian Ritter, BMDA CEO, presented the 2017 BMDA Budget Request and gave a recap of the services provided by the BMDA. Strinden moved and Zachmeier seconded to approve the final plat of a short-form subdivision known as LM Subdivision and a zoning map amendment from Agricultural (A) District to Residential (R) District for approximately 4.68 acres in the SE ¼ of Section 35 Township 139N Range 82W, Morton County. All voting aye motion carried. Zachmeier moved and Boehm seconded to approve the final plat of a short-form subdivision known as Jamie Fast Subdivision and a zoning map amendment from Agricultural (A) District to Residential (R) District for approximately 2.13 acres in the SW ¼ of Section 6 Township 139N Range 84W, Morton County. All voting aye motion carried. Strinden moved and Boehm seconded to approve the petition to vacate the public right-of-way of 1st Avenue between Lot 1, Block 1 and Lot 6, Block 2 of Tool s 1st Addition to Gwyther, and north of North Street, as the petition process has adequately fulfilled the requirements of N.D.C.C. 24-07 for vacation of a highway. All voting aye, motion carried. Strinden moved and Zachmeier seconded to waive renewal fees twice for Temporary Use Permit #102. All voting aye, motion carried. Boehm moved and Leingang seconded to award the bid for Paving Project CNOC-3008(057) to Northern Improvement Co. in the amount of $593,812.44. All voting aye, motion carried. Boehm moved and Strinden seconded to approve abatement #4871. All voting aye, motion carried. Strinden moved and Leingang seconded to approve the Service & Comfort Animal Policy. All voting aye, motion carried. Zachmeier moved and Strinden seconded that the termination of Nick Kraft be upheld. All voting aye, motion carried. Zachmeier moved and Boehm seconded that Mr Kraft be notified that he has until end of business on August 18 th to notify the Auditor s office or Human Resources on his decision to continue his appeal on August 23rd. All voting aye, motion carried. The total of all county funds expended from July 26, 2016 through August 11, 2016, equals $1,068,456.35. A detailed list of funds expended by check is available for public inspection anytime during regular business hours at the Morton County Auditor s Office. EMERGENCY DECLARATION DAKOTA ACCESS PIPELINE CIVIL UNREST August 15, 2016 WHEREAS, the Morton County Board of Commissioners recognizes that due to the civil unrest occurring at the location of the Dakota Access Pipeline construction site which will require extraordinary manpower and other resource expenditures; and WHEREAS, the impact of civil unrest could threaten the health, well-being, and safety of responders and the public; and and WHEREAS, all available resources remain committed to protecting life and property; WHEREAS, the cost of response may be in excess of available budgeted resources; and NOW, THEREFORE, BE IT RESOLVED, that the Morton County Board of Commissioners declares an Emergency and implements its emergency plans and processes in response to anticipated ongoing civil unrest.
