CALL TO ORDER AND ROLL CALL The regular meeting was brought to order on February 19, 2019 at 7:00pm in the Commission Meeting Room of the Lincoln County Courthouse by Chairman Derousseau. 2. APPROVAL OF JANUARY 22, 2019 MINUTES Pashby motioned to approve the minutes and was seconded by Landeen. The motion passed unanimously (7-0). 3. APPROVAL OF AGENDA Klatt motioned to approve the agenda and was seconded by Pashby. The motion passed unanimously (7-0). 4. PUBLIC HEARINGS a. REZONE / RZNE : Request for review and recommendation for approval to the Board of County Commissioners of a Rezoning from the A-1 Agricultural District to the RR Rural Residential District. The property is legally described as Tract 2 of Peter s Addition in the Northwest quarter (NW1/4) of Section 33, Township 100 North, Range 51 West of the 5th Principal Meridian, Lincoln County, South Dakota. Applicant/Owner: Richard Peters Location: 500 ft south of 272 nd Street and 466 th Avenue Tea Staff Analysis: Description: To consider rezoning approximately acres from the A-1 Agricultural zoning district to the RR Rural Residential zoning district in accordance with Section of the 2009 Revised Zoning Ordinance for Lincoln County. Background: The subject property is currently vacant and utilized for agricultural uses. The subject acres was recently replatted from a larger tract that had a portion of the parcel rezoned to C Commercial in That portion of the property zoned C Commercial abuts the northern portion of the subject property and is currently vacant. The applicant submitted a concept plan with the application which proposes the construction of one single-family dwelling on the subject property. The applicant stated to staff that he intends to construct and own the single-family dwelling. Since the property does not have a building eligibility, the property needs to be zoned rural residential to allow the proposed use. Staff Recommendation: Staff recommends APPROVAL of the zoning change from A-1 Agricultural to RR Rural Residential for Tract 2 of Peter s Addition in the Northwest quarter (NW1/4) of Section 33, Township 100 North, Range 51 West of the 5th Principal Meridian, Lincoln County, South Dakota. If recommended for approval, the recommendation would include the following findings of fact: The amendment is in conformance with the Comprehensive Plan. The amendment is not in conflict with any other official controls. The amendment will not be detrimental to the health, safety or general welfare. Public Comment: Toby Brown presented a summary of the staff report. Albers asked if there were any eligibilities left in the quarter section, and if this would set precedent for building more homes. Toby noted that there isn t an eligibility available and that staff would not have recommended approval if it wasn t abutting rural residential land. Dick Peters noted that he plans to build a home for himself and work with the developer to the east for common access to the proposed subdivision. Derousseau asked for public comment, hearing none, he closed the floor to public comment. Discussion & Action: 1

3 Pashby motioned to recommend approval of the application and was seconded by Landeen. The motion passed unanimously (7-0). RZNE Recommended Approval b. CONDITIONAL USE PERMIT / USE : Request for review and approval of a Conditional Use Permit to allow retail with outside storage. The property is legally described as Tract 22 of Sky Haven Heights in the Northwest quarter (NW1/4) of Section 30, Township 100 North, Range 50 West of the 5th Principal Meridian, Lincoln County, South Dakota. Applicant/Owner: Todd Voss Location: Skylane Drive Sioux Falls Staff Analysis: Description: The applicant is proposing to utilize the property for retail with outdoor storage. The applicant stated that they propose to display prefabricated accessory storage type buildings. Background: The property is currently vacant. The property owner also owns the property to the north, and plans on accessing this property from the neighboring lot. A conditional use permit is required for retail sales in the C Commercial zoning district when outdoor storage is proposed. Staff Recommendation: Staff recommends APPROVAL of Conditional Use Permit USE to allow retail sales and trade with outdoor storage contingent upon the following conditions: 1. The approval is for the project as described per Conditional Use Permit USE to allow retail sales with outdoor storage in accordance to the site plan as approved by the City of Tea. 2. The property shall be kept in a clean and orderly manner at all times. 3. The property owner shall not deposit any snow or improperly direct water onto neighboring properties. 4. The height of structures, materials, and equipment on the property shall conform to FAA height regulations. 5. All parking and access areas shall be in constructed in conformance to Article 15 of the 2009 Revised Zoning Ordinance. 6. If at any time the use ceases to exist, or changes ownership, the owner shall notify County Planning Staff. 7. The Planning Department reserves the right to enter and inspect the property at any time, after proper notice to the owner, to ensure that the property is in full compliance with the approved permit conditions and the Lincoln County Zoning Ordinance. If approved, the approval would include the following findings of fact: The Conditional Use Permit is generally in conformance with the Conditional Use Criteria in Section of the 2009 Revised Zoning Ordinance for Lincoln County. Public Comment: Toby presented a summary of the staff report. Klatt asked if the applicant owns the lot to the north where they would be accessing the lot. Toby confirmed that the applicant owns both parcels. Amy Olson, business partner of Todd Voss, was available for questions. Monty asked if it would be internetbased sales. Ms. Olson confirmed that most sales are through social media. Derousseau asked for public comment, hearing none, he closed the floor to public comment. Discussion & Action: Klatt motioned to approve the application with the recommended conditions and was seconded by Pashby. The motion passed unanimously (7-0). USE Approved 5. Comments from the audience None 7. REPORT OF LINCOLN COUNTY BOARD OF COMMISSIONERS REPRESENTATION Landeen noted the county has hired a consultant to develop a jail feasibility study. 8. 4 a. Setting public hearing dates. There will be no Planning Commission meeting in March, since no applications were recieved. b. Planning Commission Bylaws review. Namminga, Pashby, and Klatt met prior to this meeting and offered some suggested revisions. Staff will present a draft at the next Planning Commission meeting. c. Other new business. None. d. Election of Officers. Motion was made by Derousseau and seconded by Landeen to elect Monty Derousseau as chairman and Gary Pashby as vice-chairman. The motion passed unanimously (7-0). Motion was made by Pashby and seconded by Klatt to elect Ron Albers and Ron Larson as alternate commission members. The motion passed unanimously (7-0). 9. 6 Department of Planning and Zoning USE STAFF ANALYSIS CONDITIONAL USE PERMIT CRITERIA 1. The impact of the proposed use on adjacent properties shall be a major consideration. The proposed use should be generally compatible with adjacent properties and other properties in the district. The subject property is zoned RR Rural Residential. Per the 2009 Revised Zoning Ordinance for Lincoln County, In all Residential Districts, the total area of accessory buildings shall not exceed 1500 square feet unless a conditional use has been approved. There are no accessory buildings similar in size to the proposed building in the nearby vicinity. It is staff s opinion that the proposed use is compatible with surrounding property uses and any potential negative impacts on surrounding property can be mitigated through the conditions of approval. 2. Measures shall be taken to ensure that the proposed use does not alter the general character of the area or neighborhood. The subject property is part of the developed residential subdivision known as Schriever s Addition. The proposal is in conformance with the intent for accessory uses to occur in the area. It is staff s conclusion that the proposal is generally in conformance with the Lincoln County Comprehensive Plan. 3. The effects of noise, odor, traffic, air and water pollution, and other negative factors shall be eliminated or controlled through the use of screening, setbacks, and orientation. There shall be no substantial negative effects to noise, odor, or air and water by the proposed use. The proposed use of the accessory building is unlikely to have detrimental effects; therefore, there would be no relative gain to the public health, safety and welfare if this request were denied. The hardship imposed on the property owners if the CUP is denied would be that they would not be able to utilize the property for the proposed use they desire. Additionally, the proposed use is conditionally allowed in the rural residential district and, as proposed, will not conflict with the standards provided in the commercial district. It is staff s conclusion that adequate conditions can be included with the permit to minimize potential adverse impacts on adjoining property. 4. The conditional use is consistent with the applicable policies of the comprehensive plan. The proposed development would be consistent with the following general land use policies of The Lincoln County Comprehensive Plan: Land Use Goal: A.1 To provide for orderly, efficient and economical development. A.12 To provide ample opportunities for public participation at all stages of the planning and zoning process, including public hearings, rezoning notices and public awareness campaigns. Land Use Policy: B.2.2 The premature development of agricultural areas should be discouraged. 5. The conditional use shall, in all other respects, conform to the applicable regulations of the district in which it is located. If the requested land use application is approved, the proposal will comply with all provisions of the RR Rural Residential zoning district and all, if any, specific development standards of the 2009 Revised Zoning Ordinance for Lincoln County. 2

7 Department of Planning and Zoning USE RECOMMENDATIONS Recommendation: Staff recommends APPROVAL for Conditional Use Permit (USE ) to allow a 54 x 90 (4,860 sq. ft.) accessory building on Tract 22 of Schriever s Addition in the Northwest quarter (NW1/4) of Section 8, Township 99 North, Range 50 West of the 5th Principal Meridian, Lincoln County, South Dakota, contingent upon the following conditions: 1. This approval is for the project described per Conditional Use Permit (USE ) to allow construction of a 4,860 sq. ft. accessory building, except as modified with the conditions below. 2. This project shall conform to the conditions contained herein, all applicable regulations of the Lincoln County Zoning Ordinance and any other County, City, State and Federal Codes, ordinances, resolutions and laws that may apply. 3. Subject to staff approval, the property must be developed and maintained in substantial conformance with the site plan received February 21, The accessory structure may not be used for commercial purposes. 5. The accessory structure cannot be converted into living space. 6. The Planning Department or designated official(s) reserves the right to enter and inspect the property at any time, after proper notice to the owner, to ensure that the property is in full compliance with the conditional use permit conditions, all applicable regulations of the Lincoln County Zoning Ordinance and any other County, City, State and Federal Codes, ordinances, resolutions and laws that may apply. 10 Planning Commission & Board of Adjustment Bylaws Lincoln County, South Dakota Section 1. Authorization; Composition. Article I Organization These Bylaws are adopted pursuant to SDCL 11-2 for the Lincoln County Planning Commission, which shall consist of seven (7) members. The Commission shall include one (1) Lincoln County Commissioner; the remaining six (6) shall, from time to time, be appointed by the Lincoln County Board of County Commissioners in accordance with South Dakota Codified Laws for a term of three (3) years beginning February 1 st and ending January 30 th. One member shall be appointed from each district and one member, who is actively involved with livestock production, will be appointed at large. No member shall servebe appointed for more than two three consecutive four three-year terms. Members of the Lincoln County Planning Commission shall also be appointed to the Lincoln County Board of Adjustment. Section 2. Officers. The officers of the Planning Commission shall be a chairperson and vice-chairperson elected for one year terms at the second meeting of the Planning Commission in each calendar year. There shall be no term limits imposed on either the chairperson or vice-chairperson. The elected officers of the Planning Commission must be elected from the appointed Planning Commission members. Section 3. Chairperson. The chairperson shall be a voting member of the Planning Commission and shall: Call meetings of the Planning Commission; Preside at meetings and hearings; Act as spokesperson for the Planning Commission; Sign documents for the Planning Commission; Transmit reports and recommendations to the Lincoln County Board of County Commissioners; and Perform other duties approved by the Planning Commission. Section 4. Vice-Chairperson. The vice-chairperson shall exercise the duties of the chairperson in the absence, disability, or disqualification of the chairperson. In the absence of the chairperson and vice-chairperson, an acting chairperson shall be elected by the members present. Section 5. Secretary. The secretary of the Lincoln County Planning Commission shall be the Planning Director or his/her their duly authorized representative. The secretary shall be responsible for: Providing notice of all meetings with assistance from the County Auditor; Preparing each Planning Commission meeting agenda; Keeping minutes of all meetings and hearings; Revised

11 Maintaining Planning Commission records as public records; Attending to Planning Commission correspondence; and Performing other duties normally carried out by a secretary. Section 6. Alternates. The voting members named in Article I, Section 1 shall designate two (2) official alternates to attend any meeting of the Planning Commission in the absence of the voting member; said alternate shall exercise all voting rights of that voting member. Designation of alternates shall be made at the February Planning Commission meeting of each calendar year and shall be effective for the following calendar year. The chairperson shall announce at the beginning of any meeting for which member they are serving as alternate. Section 1. Time and Place. Article II Meetings One regular meeting per month is hereby established for the Planning Commission. Said meeting shall be held on the* third Monday of each month in the Lincoln County Court House, Commissioners room, and shall be open to the public. Meeting dates that conflict with Lincoln County Holidays will be rescheduled to the day after the holiday. Special meetings may be called by the chairperson upon twenty-four (24) hours notice, or upon the written request to the secretary by at least two members. Meetings shall be held at the place stated in the notices, and shall be open to the public. *Meeting dates that conflict with National Holidays will be rescheduled to the day after the holiday. Last sentence eliminated. Section 2. Agenda. A written agenda shall be furnished by the County Planning Director to each member of the Planning Commission. The agenda shall be posted at least five (5) days prior to each regular meeting, and at least twenty-four (24) hours prior to a special meeting. Items may be added to the agenda at a meeting by majority vote. The order of business for meetings shall be as follows: 1. Call to order and roll call. 2. Roll call and recognition of visitors. 32. Approval of minutes. 43. Approval of agenda. 4. Opportunity for public comment not involving items on the agenda. 5. Scheduled public hearings (if any). 6. Other matters to be reviewed by the Planning Commission. 7. Open discussion for commission members for issues not on the agenda. a. Correspondence received. b. Quorum. A majority of the members of the Planning Commission shall constitute a quorum. A quorum shall be present before any business is conducted other than rescheduling the meeting. Section 4. Rules of Order. The Chairperson shall govern the conduct of meetings except as otherwise provided by these Bylaws. Section 5. Voting. A member must be present to vote. Each member shall vote on every question unless disqualified by law. The question of disqualification shall be decided by the member affected, who shall announce the reason for disqualification, give it to the chairperson in writing, have it placed in the minutes, and refrain from deliberating or voting on the questions. Section 6. Attendance. The secretary shall be responsible for maintaining an attendance record for each Planning Commission member and report those records annually to both the Planning Commission and the Lincoln County Board of County Commissioners. The meeting minutes shall show the members in attendance at each meeting. Section 7. Absences, Removals, Resignations and Vacancies. To be excused, members of the Planning Commission shall notify the Director when they intend to be absent from a meeting. Failure to make this notification prior to the meeting shall result in an unexcused absence. The Planning Commission shall recommend to the Lincoln County Board of County Commissioners the removal for cause of any member who is absent from three (3) consecutive meetings without adequate reason. Members of the Planning Commission may be removed by a majority vote of the Lincoln County Board of County Commissioners. Such a removal may be effectuated determined only after a hearing on the matter. Successors shall serve out the unexpired term of the member being replaced. A member may resign from the Planning Commission by sending a letter of resignation to the Chairperson of the Lincoln County Board of County Commissioners or chairperson of the Planning Commission. Vacancies shall be filled by the Chairperson of the Lincoln County Board of County Commissioners, with the approval of the Lincoln County Board of County Commissioners, within one month of resignation or removal of a Planning Commission member. Successors shall serve out the unexpired term of the member being replaced. Section 8. Conduct. Revised

13 Except for public hearings, no person shall speak at a Planning Commission meeting unless invited to do so by the Planning Commission. During the opportunity for public comment, each speaker will be limited to 5 minutes, and shall limit their comments to topics and items that are not included on the agenda. Any comments relating to items on the agenda shall be ruled out of order. Section 9. Communication with Public and Applicant Prior to the public hearing or Commission deliberation, no commission member shall lobby, or permit to be lobbied, on the merits of a pending case with the Applicant, other Commission members, or the general public. If a Commission member has discussed the pending case, the member shall disclose the facts relating to such discussion during the public hearing. Nothing in this section shall preclude the general communication of Commission members relating to the general conduct of a meeting or hearing, nor shall anything in this section forbid staff from discussing an upcoming meeting with members. Section 1. Notice. Article III Public Hearings The secretary shall give the notice required by statute or ordinance for all public hearings conducted by the Planning Commission. Members of the public desiring to be heard shall give written notice to the secretary prior to commencement of the hearing. Section 2. Procedure. All public hearings held by the Planning Commission must be held as part of a regular or special meeting of the Planning Commission. The following rules of procedure shall apply to public hearings held by the Planning Commission: 1. Chairperson opens the public hearing and announces the subject. 2. Chairperson summarizes the procedures/rules to be followed during the hearing. 3. Staff provides an overview of the application and key points a summary of the staff report. 4. Applicant presents the main points of the application. 5. Persons speaking in support of the application are recognized. 6. Persons speaking in opposition to the application are recognized. 7. Chairperson closes the public hearing and returns to the regular/special meeting. 8. Planning Commission begins deliberation and arrives at a decision. Note: To ensure everyone has the opportunity to speak, the chairperson may elect to limit the time permitted for each person to speak, except that the applicant may be permitted additional time as the chairperson allows. The chairperson may also elect to allow persons to speak only once, until all persons have had the opportunity to speak, at which time the chairperson, in Revised

14 his/her discretion, may permit additional comments. Public hearings are limited to 30 minutes of public comments, at which time the commission may motion to table the item until a later date. All comments by the public and members of the Planning Commission shall be directed to the chairperson. All comments shall be related to the land use request; unrelated comments shall be ruled out of order. Section 1. Minutes. Article IV Records The secretary shall record all meetings and hearings of the Planning Commission. The secretary shall prepare minutes of each meeting for approval by the Planning Commission at the next regular meeting. The minutes shall contain a brief synopsis of the meeting, including a complete restatement of all motions and records of votes, conditions or recommendations made on any action and record of attendance. Minutes shall be maintained as public records. Section 2. Reports. The secretary shall assist in the preparation and forwarding of all reports and recommendations of the Planning Commission in appropriate form. Copies of all notices, correspondence, reports and forms shall be maintained as public records. Section 3. Attendance. The minutes shall show the members in attendance at each meeting and the reason for absence submitted by any member. The Planning Commission shall recommend to the Lincoln County Board of County Commissioners the removal for cause of any member who is absent from three (3) consecutive meetings without adequate reason. Section 1. Zoning Amendments. Article V Duties of the Commission Proposed zoning text and district amendments shall be considered and recommendations shall be forwarded to the Lincoln County Board of County Commissioners within thirty (30) days after receipt of the proposed amendments, unless additional time is given by the Lincoln County Board of County Commissioners. When so authorized, the Planning Commission shall conduct any required hearing prior to making a recommendation. Section 2. Comprehensive Plan. All zoning and land development regulation amendments shall be reviewed first for conformity with the comprehensive plan. Conflicts with the comprehensive plan shall be noted in any report to the Lincoln County Board of County Commissioners on a proposed amendment. The elements of the comprehensive plan shall be reviewed and updated on a regular, ongoing basis by the Planning Commission with concurrence from the Lincoln County Board of County Commissioners. Section 3. Reconsideration. Revised

15 The Planning Commission may reconsider any review when so requested by the Lincoln County Board of County Commissioners, or when an applicant brings to the attention of the Planning Commission new facts, a mistake of fact in the original review, correction of clerical error, or matters not the fault of the applicant which affect the result of the review. Section 4. Educational Opportunities. Members of the Planning Commission are encouraged to attend training sessions, conferences or meetings as needed to properly fulfill their duties and for which appropriations of funds have been approved by the Lincoln County Board of County Commissioners. Section 5. Other Duties. The Planning Commission shall be responsible for those duties as may be lawfully required by specific statute references in SDCL 11-2 and for those duties specified in the Lincoln County Zoning Ordinance. Section 1. Budget. Article VI Finances The Planning Commission shall submit written recommendations to the governing body for funding in the annual budget. The recommendations shall include an explanation and justification for proposed expenditures. Section 2. Expenditures. Budgeted funds shall be expended only for approved purposes in accordance with financial policies and procedures set by the Lincoln County Board of County Commissioners, including procurement rules. Upon adoption of a budget by the Lincoln County Board of County Commissioners, the Planning Commission may adopt an authorization for specified expenditures by designated Planning Commission members within the limits provided. Section 3. Personnel. The Planning Commission shall employ such staff and consultants as may be authorized and funded by budget or make recommendations for staff members to be employed by the County. Consultants shall be engaged by majority vote of the Planning Commission after review of proposals invited by public notice and mail, and personal interviews with applicants by the Planning Commission. Final approval for such actions must be given by the Lincoln County Board of County Commissioners. Section 1. Adoption.
