Cowlitz County Board of Commissioners Minutes October 4, 2011 Vol. 472 George Raiter, Chairman Michael A. Karnofski, Commissioner James Misner, Commissioner Vickie Musgrove, Clerk of the Board Commissioner Raiter called the regular meeting to order at 9:00 a.m. Commissioner Karnofski and Commissioner Misner were present. Approval of Minutes and Consent Agenda Commissioner Misner moved to approve the Minutes of September 6 and 27, 2011. The motion Commissioner Karnofski moved to approve the Consent Agenda of October 4, 2011. The motion Resolution No. 11-105 Proclaiming the month of October as Disability Employment Awareness Month in Cowlitz County Shannon McLain, Longview; representing the Disability Access Team; thanked the Board for considering the proclamation and collaborating with the community. Invited the Board to attend Pathways to Possibilities on October 6 at Expo Center. Also, talked about the other events planned for October. Commissioner Raiter stated his mother was deaf. So he knows how hard it is for disabled people to find jobs but when they are hired they are good employees. Read the proclamation. Commissioner Misner moved to adopt the proclamation. The motion Public Comment - Jeff Richter, Kalama; spoke about their meeting with legislators. Commissioner Raiter stated he would bring up at WSAC Legislative steering committee. Commissioner Karnofski stated they will be sending in a list of unfunded mandates. Cary Butler, Longview; asked how would they deal with the ordinance when it goes into effect. Would there be a workshop. Mike Wojtowicz answered there is a Building & Planning Advisory Committee next week and this will be a topic of discussion. Comprehensive Personal Services Agreement with Jarvis Appraisal Company, to perform appraisals, appraisal review, and true cost and project funding estimates for various projects as specified by the County Engineer or his designee effective until December 31, 2013, total compensation not to exceed $50,000 Commissioner Karnofski moved to approve the agreement with Jarvis Appraisal Company. The motion Resolution No. 11-106 Certifying the 2012 Budget for Consolidated Diking Improvement District No. 2 and Resolution No. 11-107 setting the Order and Levy Commissioner Misner moved to certify the budget and approve and execute the order and levy. Commissioners Minutes Vol. 472 Page 2 Supplement No. 2 to the Local Agency Agreement with Washington State Department of Transportation for Headquarters Road Slide Repair Project, Project No. 5807; obligates and transfers Federal funds for construction costs; total estimated cost is $223,800 Commissioner Karnofski moved to approve Supplement No. 2. The motion Memorandum of Understanding with the City of Castle Rock transfers $22,000 from the County Trails & Paths fund to complete Castle Rock Riverfront Trail North Extension Project cost Commissioner Misner moved to approve the Memorandum of Understanding with the City of Castle Rock. The motion Agreement with MDK Construction, Inc. for the Morgue Improvement Project, 2011 in the amount of $53,744.99 Commissioner Karnofski moved to approve the agreement with MDK Construction. The motion Resolution No. 11-108 confirming the appointment or designation of individuals for the applicable and required relationships with the Washington Counties Risk Pool Commissioner Misner moved to adopt the resolution confirming appointments. The motion Amendment to the Capital Agreement from the Washington State Department of Commerce Energy Office, providing funding under a program known as Energy Efficiency and Conservation Block Grants for Smaller Cities and Counties reduces the grant award to $135,000 and reduces the required match to $150,332, for a total grant of $574,983, with a match of $765,000 for a total project amount of $1,339,983 Commissioner Karnofski moved to approve amendment. The motion Amended Interlocal Agreements between the City of Kelso and Cowlitz County, extends the project completion date to February 28, 2013 and increases the project cost in the 2010 agreement to $1,280,000 and the estimated cost for the project in the 2011 agreement to $1,280M for the construction of the runway extension at the Southwest Washington Regional Airport Commissioner Misner moved to approve the amended interlocal agreements with City of Kelso. The motion Amendment No. 4 to the Agreement with Washington State Department of Ecology for the Coordinated Prevention Grant; increases the grant from a total budget of $85,440 to $151,889, an increase of $66,449. The state share amount increases by $49,837 from $64,080 to a total of $113,917 Commissioner Karnofski moved to approve Amendment No. 4 with Department of Ecology. The motion Agreement with Drug Abuse Prevention Center (DAPC) to conduct Cowlitz County Adult Drug Court Services and Treatment for the period beginning September 30, 2011 and ending on September 30, 2012, amount not to exceed $254,601 Commissioner Misner moved to approve agreement with Drug Abuse Prevention Center for Drug Court Services. Commissioners Minutes Vol. 472 Page 3 Agreement with Drug Abuse Prevention Center (DAPC) to adjust funds for the Cowlitz County Adult Drug Court Services and Treatment for the period beginning September 30, 2010 and ending on September 30, 2011 in an amount not to exceed $212,775.29 Commissioner Misner moved to approve the agreement with Drug Abuse Prevention Center to adjust funds for Adult Drug Court Services and Treatment. The motion Agreement with Toutle River Boys Ranch, Inc. dba Youth and Family LINK to provide services to promote recovery for youth who are seriously mentally ill and resiliency for children who are seriously emotionally disturbed, in accordance with the Federal Mental Block Grant requirements; maximum contract amount not to exceed $32,929 during the period October 1, 2011 through September 30, 2012- Commissioner Karnofski moved to approve the agreement with Toutle River Boys Ranch dba Youth and Family LINK. The motion Agreement Modification with Toutle River Ranch, Inc. dba Youth and Family Link to increase contractual amount not to exceed $2,070,266 for the period beginning January 1, 2010 through September 30, 2011 Commissioner Karnofski moved to approve the modification. The motion Agreement No. 1163-35232 with Washington State Health Care Authority to provide funding for Medicaid Outreach to potential Medicaid eligible clients, effective July 1, 2011 through September 30, 2014. This funding was previously received from State of Washington Department of Social and Health Services. This contract terminates and supersedes the contract with State of Washington Department of Social and Health Services Commissioner Misner moved to approve the agreement with Washington Health Care Authority. The motion Letter of Understanding with the Cowlitz County Assessor continuing to assign the mapping responsibilities to the Geographic Information Systems (GIS) Department through November 30, 2015 Commissioner Karnofski moved to approve the Letter of Understanding. The motion Public Hearing Approved - Shoreline Management Substantial Development/ Conditional Use Permit No. SL 11-0931 submitted by the Port of Longview to perform deepening and maintenance dredging at Berths 1 through 9, and incidental fender pile replacement at Berths 1 through 7 within the Columbia River shoreline Nine thirty was time set for the public hearing. Commissioner Raiter outlined the format of the hearing. Ron Melin and Phil Rupp, Building & Planning; were sworn in. Ron presented the staff report. Noted they propose to deepen berths 1-9. They will also perform incidental fender pile replacement at berths 1-7. The application is consistent with Shoreline Master Program and Comp Plan. Staff recommends approval subject to 11 conditions. Commissioner Raiter opened the public testimony portion of the hearing. Lisa Hendrikson, Port of Longview; was sworn in; thanked Ron for getting this ready as quickly as possible. Stated they concurred with the conditions. Commissioner Raiter asked about in-water disposal?

Commissioners Minutes Vol. 472 Page 4 Lisa answered it was based on Corps matrix. Based on current velocity and depths there isn t a lot of plume. This is directed by agencies. Permits for this year directed this would be the fastest way to do with no mitigation. Rick Von Rock, Kelso; sworn in; asked what was the current depth? Bill Burton, Port of Longview; was sworn in; stated they would be dredging to depth of 42-feet. Current survey shows depths of 42 45 feet, but there are sand waves. Stated they are not taking a lot in berths 8-9, but berths 1-7 there is a great variance. This year will be removing about 18,000 cubic yards. Commissioner Raiter asked if they are removing native. Bill answered they would be removing some historic sediment. New ships are larger and have deeper draft. Rick asked about a projection for when dredging would be needed again. Norm Kreibel, Port of Longview; sworn in; commented that in the last 18 years have dredged three times. About every 5-6 years. Commissioner Raiter closed the hearing. Commissioner Misner moved to approve Shoreline Management Substantial Development/ Conditional Use Permit No. SL 11-0931 submitted by the Port of Longview to perform deepening and maintenance dredging at Berths 1 through 9, and incidental fender pile replacement at Berths 1 through 7 within the Columbia River shoreline based on staff report, findings and conclusions, testimony and subject to the eleven (11) conditions in the staff report. The motion Consent Agenda Call for Hearing Resolution No. 11-109 Call for Public Hearing - Proposed Amendment to the 2011 Cowlitz County Budget to account for monies received and expenditures made related to the Mental Health Medicaid PIHP program; Hearing to be held October 18, 2011 at 9:30 a.m. Agreements Perpetual Road and Utility Easement from Gina Andrews, Trustee and Personal Representative of the Mark F. Andrews Marital Trust, for the West Side Highway Slide Repair Project, Project No. 1781; cost $885.35.

Correspondence Affidavit of Posting Resume; of the Commissioners' Proceedings for the month of August, 2011. Letter dated September 9, 2011 to Luis Rodgiguez, P.E. Chief, Engineering Management Branch, Federal Insurance and Mitigation Administration; from the BOCC requesting an extension of the review period to November 1, 2011 to review the Digital Flood Insurance Rate Map (DFIRM) and Flood Insurance Study (FIS) Reports for Cowlitz County. Letter dated September 27, 2011 to Honorable Ronald B. Leighton from the BOCC requesting consideration in expediting the resolution of "EGT, LLC, v Port of Longview". Letter dated September 5, 2011 to the BOCC from Gary Boldt, President, Clark-Cowlitz Farm Bureau; requesting the county consider opting in to the Voluntary Stewardship Program (VSP) created under ESHB 1886 during the 2011 Legislative session. Letter dated September 27, 2011 to Gary Bolt from the BOCC stating the county will be moving ahead with the necessary steps to position the County and stakeholders for taking advantage of the "Opt In" alternative thereby facilitating the development of voluntary stewardship programs. Letters dated October 4, 2011 to Barry Verrill, Howard Rogers and Dawn Smith appointing them to serve on the Tourism Board of Directors.
