DEVELOPMENT PLAN 2014-301 (DP-2014-301) and; TENTATIVE MAP 36801 (TPM-2014-453) AND DEVELOPMENT PLAN 2014-364 (DP-2014-364): Chair Taylor Berger reviewed the City Council Meeting Rules (decorum) and thanked the public for attending. Assistant City Attorney Gould advised the Commissioners of their options for conducting the public comment portion of the continued hearing. STAFF PRESENTATION City Associate Planner Paul Swancott presented the applicant s proposal to the Commission for the Mitchell Crossing Multi-Family Residential Community. City Planner Cynthia Kinser briefed the Council on the Mitchell Road alignment, reasons for split zoning and density change requests. The Commissioners discussed the information presented. COMMISSION QUESTION OF STAFF Ms. Kinser and City Traffic Engineer Brian Stephenson responded to the Commissioners questions. PUBLIC COMMENTS There were no public comments. Presentation by Applicant John Loper with Palm Tree Communities Consulting, on behalf of the applicant, provided the Commission with an update and a potential revised reduction of units in the plan. BJ Delzer, President of Melia Homes, requested that the Commission allow the reduction of units with a waiver and spoke about density. Mr. Belzer responded to the Commissioners comments. Carl Ballard, Principal with Kuntzman and Associates, the writers of the traffic study, presented the 2
Commissioners with answers to questions about the traffic study. Public speakers Chair Taylor Berger requested that the public be allowed to speak on all aspects relating to the continued public hearing since new information about previously discussed subjects was presented. Public Speakers in Opposition, continued Pamela Langley, a Murrieta resident living in Greer Ranch Rachelle Lopez, a Murrieta resident living in Murrieta Oaks Resident Shane Turay, a Murrieta resident Sue Dolin, a Murrieta resident living in Greer Ranch resident Greg Johnson, a Murrieta resident Michael Kreiner, a Murrieta resident Commission Secretary Sarah Manwaring requested permission on behalf of Michael and Maureen Kreiner to donate their three minutes of speaking time to Jacqueline Spencer, a Murrieta resident, who had already donated her time to a previous speaker for a total of six minutes. After Commissioner discussion and consensus the request was denied. Applicant response to comments Kassen Klein, representing Melia Homes, posed a rebuttal to public comments to the Commission. BJ Delzer, President of Melia Homes responded to public comments and accusations. He presented the Commissioners with a slide to re-review the project density. Questions of applicant or public speakers There were no questions. Closing comments by Staff City Planner Cynthia Kinser responded public concerns and comments. She addressed City noticing requirements, and communication with the Murrieta Valley Unified School District about development activities within the City. Ms. Kinser and City Traffic Engineer Brian Stephenson responded to the Commissioners comments. Commission Discussion and Action The Commissioners thanked the public and staff, and gave closing comments. Commissioner Kirshberg made a motion to deny the Planning Commission Staff Report recommendations. Hearing no second Chair Taylor Berger announced the motion would not be considered. Commissioner Casadonte made a motion to: 1. Adopt the Environmental Determination, and; 2. Adopt the Resolution to approve Tentative Tract Map 36801 (TTM-214-453) and Development Plan 2014-364 (DP-2014-364), based on the Findings and subject to the Conditions of Approval in Exhibits A and B, and; 3. Adopt the Resolution to approve Development Plan 2014-301 (DP-2014-301) based on the Findings and subject to the Conditions of Approval in Exhibit C. Commissioner Phillips seconded the motion. The motion Passed. The vote was: Ayes: Noes: Abstain: Absent: Casadonte, DeGrave, Phillips and Taylor Berger Kirshberg City Planner Cynthia Kinser announced that the matter was final unless appealed to the City Council within ten calendar days. CITY PLANNER COMMENTS City Planner Cynthia Kinser deferred her update on development projects within the City presentation to another meeting for the sake of time. Ms. Kinser also announced that a cell tower telecommunications focused workshop will take place at the March 17, 2015 City Council meeting and recommended that all Commissioners watch. 4
CITY ATTORNEY COMMENTS Assistant City Attorney R. Jacob Gould took responsibility for resolutions not being delivered to the Planning Commission timely and apologized to the Commission. PLANNING COMMISSION COMMENTS The Commissioners thanked the applicant, the public and staff. Commissioner Phillips asked the City Attorney for advice on time donation by public speakers and asked that the policy be reviewed. Commissioner DeGrave praised Chair Taylor Berger for her leadership. Commissioner Kirshberg made a motion to adjourn the meeting at 10:29 p.m. Commissioner DeGrave seconded the motion.
