R.S.C. 1-6 DRAFT BY-LAW FOR DISCUSSION PURPOSES ONLY, PREPARED BY CHERKEWICH, YOST & HEFFERNAN WHEREAS s.8 l(l)(c), (o) and (r) and s.81(2) and (3) o f the Indan Act empower the Councl o f an Indan Band to make by-laws respectng the observance o f law and order, the preservaton, protecton and management o f fsh on the Shoal Lake Indan Reserve and to mpose a penalty for the contraventon thereof; and WHEREAS the Fsheres Act. R.S.C, and The Saskatchewan Fsheres Regulatons passed pursuant thereto, as well as other related federal and provncal laws, do not, n the opnon o f the Chef and Councl, approprately reflect or adequately provde for the Treaty rghts, local concerns and needs of the Shoal Lake Band. NOW, THEREFORE, the Band Councl o f the Shoal Lake Band o f Indans enacts as a by-law the followng:, v 1. NON-DANGEROUS FISHING PERMITTED " ; ' f- ', n.,..... Subject to any regulatons provdng otherwse, members o f the Shoal Lake Indan Band shall be permtted to engage n fshng upon or n the Shoal Lake Indan Band waters at any tme and by any means except by the use o f rockets, explosve materals, projectles, of shells. 1: :., 1 ;. USE OF MARKERS AND BUOYS»!. sps r ;? *\p; p? b Every person usng stakes, posts, buoys, or other materals placed for fshng purposes, n any water shall remove the same wthn, forty-eght (48) hours after befcsng to; use them. -fs* ;!.. 9. OBSTRUCTION OF NAVIGATION : One-thrd (1/3) of the wdth of any navgable lake, rver or stream shall always be left open, and no knd o f net or other fshng apparatus, logs' or any materal o f any knd shall be used or placed theren. jf 10. DESTRUCTION OF SPAWNING GROUNDS The eggs or fry o f fsh on any spawnng grounds n the Shoal Lake Indan Band waters shall not, at any tme, be destroyed. 11. DELETERIOUS SUBSTANCE N o person shall cause or knowngly permt to pass nto or put or knowngly permt to be put, lme, chemcal substances pr drugs, posonous matter, dead or decayng fsh or remnants thereof, rubbsh, or any other deleterous substance or thng, whether the same s of a lke character to the substances named n ths secton or not, n any water frequented by fsh, or that flows nto such water, snor n or on ce over such waters. 12. POLLUTION No,person engagng n farmng, ranchng, loggng, lumberng, land clearng or other operatons shall put or knowngly permt to be put any farm chemcals, anmal waste, or anmal by-products, slush, stumps or other debrs nto any water frequented by fsh or stream that flows nto such water, nor n or on the ce-over such water, or at a place from whch t s lkely to be carred nto such waters.!,,, m-}?. 13. FISH ADVISORY COMMITTEE The Band Councl may, n each year, appont a fsh advsory commttee consstng o f not more than eght (8) members who shall meet upon the request of the Band Councl and shl act n an advsory capacty to the Band Councl on matters of general nterest respectng the carryng out o f the provsons o f ths By-law or Regulatons. The members of the fsh advsory commttee shall receve such remuneraton as the Band Councl may determne. 14. AGREEMENTS The Band Councl may enter nto and carry out the terms o f an agreement wth any person, persons; corporaton, or government for the purposes of protectng, managng, conservng, or encouragng the propagaton of fsh or for the purpose o f encouragng programs to promote educaton or other conservaton-orented programs related to fsh or fshng. 15. SUSTENANCE FISHING I m Ir Notwthstandng anythng to the contrary n ths By-law or the Regulatons, the Chef and Councl or a fshery offcer authorzed by the Chejf and Councl may ssue a permt to a person who s not a Band member permttng lm to take such fsh as may be necessary for; the purposes o f provdng food for hm self and hs famly. 16. OBSTRUCTING FISHERY OFFICER No person shall obstruct, hnder, delay, or nterfere wth a fshery offcer n the dscharge o f hs duty. ; 18. POW ERS OF FISHERY OFFICERS \! A ll fshery offcers have the powers of peace offcers to enforce ths By-law and Regulatons and shall be enttled, whle performng ther dutes, to all tre protecton to whch peace offcers are enttled under the Canadan Crmnal Code and ts amendments.. Regulatons shall be effectve from the date stpulated n the BCR provdng for the sad Regulatons and shall apply to those waters o f the Shoal Lake Indan Band as may be specfed theren., Copes o f all regulatons passed pursuant to ths By-law shall be posted n the Band Offce of the Shoal Lake Indan Band and at two other conspcuous places on the Reserve. The BCR hay^authorze such addtonal postng or advertsng as the Band Councl n ts sole dscreton may determne. 20. INJURY TO BAND PROPERTY N o person shall njure or damage property belongng to the Shoal Lake Indan Band, andno person shall njure or remove any notce, sgn or sgn board erected, placed or mantaned by or on behalf o f the Band. 1. 21. Notwthstandng any other penalty provded for by ths By-law, a Band member, upon convcton for a volaton, shall automatcally, upon the convcton beng regstered and no appeal beng taken, lose hs rght to use the fsh resources o f the Shoal Lake Indan Band waters unless and untl that rght has been renstated upon applcaton by the member to the Band Councl. 22. 23. ENFORCEMENT. f ( ( Except nsofar as otherwse specfed n ths By-law or Regulatons,hereto, all penaltes and forfetures ncurred under ths By-law or Regulatons hereto, shall be recoverable and enforceable by summary proceedngs taken under the provsons o f the Crmnal Code o f Canada relatng to summary convctons. 24. PROHIBITION Where ths By-law or any regulatons passed pursuant hereto s contravened and a convcton entered, n addton to any other remedy and to any penalty mposed by the By-law, the Court n whch the convcton has been entered, and any Court o f competent jursdcton thereafter, may make an order prohbtng the contnuaton or repetton o f the offence by the person convcted. 26. INJUNCTIONS Where ths By-law, ts amendments or any regulatons passed pursuant hereto are contravened, n addton to any other remedy and to any penalty mposed by the, By-law, such contraventon maybe restraned on the applcaton of the Band Councl to the approprate Court. 27. TREATY Ths By-law s subject to the terms of Treaty No., and nothng n ths By-law or the Regulatons shall be construed to nterfere, restrct or otherwse mpar, ether drectly or ndrectly, any Treaty rghts or benefts accrung ether at law or equty to the Shoal Lake Indan Band or ts members.
