19 THE CORPORATION OF THE TOWN OF BRADFORD WEST GWILLIMBURY BY-LAW APPOINTMENT OF BY-LAW ENFORCEMENT OFFICER - LYUBOMYR MARMUSH Being a By-Law of the Corporation of the Town of Bradford West Gwillimbury to appoint a BY-LAW ENFORCEMENT OFFICER. WHEREAS the Municipal Act, Statutes of Ontario 2001, Chapter 25, authorizes the Council of a municipality to appoint such officers as are deemed necessary for the purposes of the municipality; AND WHEREAS, the Council of the Corporation of the Town of Bradford West Gwillimbury, in fulfilling these duties, wishes to assign specific responsibility for the administration, enforcement and the regulations made thereunder of Municipal By-Law Enforcement matters; AND WHEREAS Section 15(1) of the Police Services Act, Revised Statutes of Ontario 1990, Chapter P.15, as amended, provides that a municipal council may appoint persons to enforce the By-Laws of the municipality; NOW THEREFORE the Council of the Corporation of the Town of Bradford West Gwillimbury ENACTS AS FOLLOWS: 1 GENERAL PROVISIONS 1.1 That L YUBOMYR MARMUSH is hereby appointed as By-Law Enforcement Officer for the purpose of enforcement of Municipal By-laws within the Town of Bradford West Gwillimbury effective May 2, That LYUBOMYR MARMUSH shall carry out the duties of By-Law Enforcement Officer in accordance with Provincial legislation and policies, and in accordance with the contract with the Town of Bradford West Gwillimbury. 2 CONFLICTING LEGISLATION 2.1 If this By-Law conflicts with the provisions of any Act, other than the Municipal Act, the provisions of the Municipal Act prevail to the extent of the conflict. 3 VALIDITY AND SEVERABILITY 3.1 It is hereby declared that notwithstanding any section, subsections, clause, paragraph or provision of the By-Law or parts thereof, may be declared by a court of competent jurisdiction to be invalid, unenforceable, illegal or beyond the powers of Council to enact, such section or sections or parts thereof shall be deemed to be severable and that all other sections or parts of this By-Law are separate and independent therefrom and enacted as such as a whole. WHEREAS Sandstorm Development Inc. has applied to the Town of Bradford West Gwillirnbury for site plan approval to permit the construction of Buildings H, K, L, and M on part of the lands located in Part of Lot 12, Concession 7, being Parts 6 to 12, inclusive, on Reference Plan 51R , Town of Bradford West Gwillimbury. AND WHEREAS the Town of Bradford West Gwillimbury is desirous of controlling certain aspects of development on the lands; AND WHEREAS the Town of Bradford West Gwillimbury has the authority to enter into this Agreement by the Planning Act; R.S.O. 1990, c. 24 THE CORPORATION OF THE TOWN OF BRADFORD WEST GWILLIMBURY BY-LAW AMENDMENTS - TRAFFIC REGULATION BY-LAW PROFESSOR DAY DRIVE I HOLLAND STREET WEST I SIMCOE ROAD TEMPORARY - NO PARKING SANTA CLAUS PARADE ROUTE Being a By-Law of the Corporation of the Town of Bradford West Gwillimbury to amend By-Law ; to regulate traffic; to prohibit the parking, standing or stopping of motor vehicles on the designated highways; and to prohibit parking on private or municipal property in the Town of Bradford West Gwillimbury. WHEREAS pursuant to the Municipal Act, 2001, Chapter 25, Section 11 (3) provides that a lower-tier municipality may pass By-Laws respecting matters within spheres of jurisdiction; AND WHEREAS pursuant to the Municipal Act, 2001, Chapter 25, Section 35 provides that a municipality may pass By-Laws removing and restricting the common law right of passage by the public over a highway; AND WHEREAS pursuant to the Highway Traffic Act, Statutes of Ontario 1990, and Ontario Regulations thereunder provides for the regulatory provisions for No Parking signage; AND WHEREAS pursuant to the Municipal Act, 2001, Chapter 25, Section 425, as amended, provides that municipalities may pass By-Laws for providing that any person who contravenes any By-Law passed under the authority of the Municipal Act, is guilty of an offence. AND WHEREAS pursuant to Section 101 of the Municipal Act, Statutes of Ontario 2001, Chapter 25, as amended provides that if a municipality passes a by-law for regulating or prohibiting the parking or leaving of a motor vehicle on land owned or occupied by the municipality or any of its local boards without the consent of the municipality or local board, as the case may be, it may provide for the removal and impounding or restraining and immobilizing of any vehicle, at the vehicle owner's expense, parked or left in contravention of the by-law and subsection 170 (15) of the Highway Traffic Act applies to the By-Law. AND WHEREAS pursuant to Section 170 (15) of the Highway Traffic Act, Statutes of Ontario 1990, as amended, provides a police officer, police cadet, municipal law enforcement officer or an officer appointed for the carrying out of the provisions of this Act, upon discovery of any vehicle parked or standing in contravention of subsection (12) or of a municipal by-law, may cause it to be moved or taken to and placed or stored in a suitable place and all costs and charges for removing, care and storage thereof, if any, are a lien upon the vehicle, which may be enforced in the manner provided by the Repair and Storage Liens Act. AND WHEREAS the Council of the Corporation of the Town of Bradford West Gwillimbury deems it necessary and expedient to prohibit parking along portions of Professor Day Drive, Holland Street West and Simcoe Road during the Santa Claus Parade; AND WHEREAS the Town of Bradford West Gwillimbury enacted By-Law , Traffic Regulation By-law on the 13 th day of June, 1994; AND WHEREAS the Town of Bradford West Gwillimbury enacted By-Laws , A, ,95-074,96-043,96-069,97-050,98-015, , , , , , , , , , , , , , , , , , and to amend By-Law ; AND WHEREAS Counci(deem it expedient and advisable in the public interest to enact this By-Law to regulate traffic and parking; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF BRADFORD WEST GWILLIMBURY HEREBY ENACTS AS FOLLOWS: 1 ADMINISTRATION 1.1 That Schedule "B" of By-Law be hereby amended by adding the following reference which identifies the parking prohibitions on portions of Professor Day Drive, Holland Street West and Simcoe Road as listed:

27 THE CORPORATION OF THE TOWN OF BRADFORD WEST GWILLIMBURY BY-LAW CONFIRMATION OF PROCEEDINGS BY-LAW May 3, 2011 Being a By-Law of The Corporation of the Town of Bradford West Gwillimbury to confirm the proceedings of Council at its meetings. WHEREAS Subsection 5(1) of the Municipal Act, 2001, Statutes of Ontario 2001, Chapter 25, as amended, provides that the powers of a municipal corporation are to be exercised by its Council; AND WHEREAS Subsection 5(3) of the Municipal Act, 2001, Statutes of Ontario 2001, Chapter 25, as amended, provides that the powers of every Council are to be exercised by By-Law; AND WHEREAS Section 8 of the Municipal Act, 2001, Statutes of Ontario, Chapter 25, as amended, provides that a municipality has the capacity, rights, powers and privileges of a natural person for the purpose of exercising its authority under the Municipal Act or any other Act; AND WHEREAS Section 19 of the Municipal Act, 2001, Statutes of Ontario, Chapter 25, as amended, provides that By-Laws and resolutions of a municipality may apply only within its boundaries, except as provided by under the Municipal Act. The jurisdiction of every Council is confined to the municipality that it represents and its powers shall be exercised by By-Law; AND WHEREAS Section 272 of the Municipal Act, 2001, Statutes of Ontario, Chapter 25, as amended, provides that a By-Law passed in good faith under the Municipal Act or any Act shall not be quashed or open to review in whole or in part by any court because of the unreasonableness or supposed unreasonableness of the By-Law; AND WHEREAS it is deemed expedient that the proceedings of the Council of the Corporation of the Town of Bradford West Gwillimbury be confirmed and adopted by By-Law.
