The following were PRESENT: Stuart Yetter, Jr., Supervisor Donald Thomas, Councilman Joseph Tomazin, Jr., Councilman Ronald Graham, Councilman Daniel Cheresnowski, Councilman Also Present: Karen McMullen; Levene, Gouldin & Thompson, Attorney to the Town, Charles Meade; Highway Superintendent, Charlie Morgan, Del Mock, Hans Peeters; Planning Board Chairman, Johnny Neuwerk, John Neuwerk, Kenny Williams, John C. Houston, Andrew Hellman, Martin Hellman, Andrew Lewis, Carl Brink, Ann Beebe and Tom Larson; Code. Supervisor Yetter called the meeting to order at 7:00 P.M. Supervisor Yetter led all in the Pledge of Allegiance. Approval of Board Meeting Minutes for October 15, 2013 and November 6, Resolution # Approval of Town Board Meeting Minutes On a motion offered by Councilman Graham and seconded by Councilman Tomazin, the Town Board approved the Meeting Minutes for October 15, 2013 and November 6, 2013 as submitted. Daniel Cheresnowski - AYE Privilege of the Floor Questions were asked about where we are with gas drilling. The Board s stand is that they are waiting for the State s approval. There has been no change from the Board s original position which is to not oppose gas drilling or affirm it. The Board is not against gas drilling. There is nothing the Board can do to speed the State s decision. Johnny Neuwerk, John Neuwerk, Kenny Williams, John C. Houston, Andrew Hellman, Martin Hellman, Andrew Lewis, Carl Brink, and Ann Beebe wanted to know about the resolution that was presented to the Board at an earlier meeting concerning the Board s affirmation of gas drilling. The Board s stand is to wait for the State s decision. The Board will not oppose gas drilling and they are not affirming it. Carl Brink clarified a question from earlier minutes concerning a trailer not being a FEMA trailer. Carl Brink questions the Board s representation of the people. The majority of the people, who did sign petitions for gas drilling, far outweighed those who signed against it. He asked for affirmation that the Board would side with the people who are for gas drilling. The Board said if the State says it is safe, the Board will back the State s decision. 1

2 Kenny Williams wants the Board to sign the pro-gas coalitions letter to the State. Supervisor Yetter said he is not happy that the State has not given a decision as of yet. The Planning Board is working on a lighting ordinance and a road ordinance. We already have a noise ordinance. These ordinances are to protect all of the people in the town. We are not against gas drilling. There is nothing this Board can do until the State makes a decision and we are preparing to deal with the decision that is handed down. The question was asked if it was too late to send the letter to the State. The Board said they didn t think it would help. There was discussion about the fore mentioned FEMA trailer. John C. Houston discussed a house that is falling down on his property and how he doesn t believe the Town should charge $10.00 for a demolition permit. He doesn t believe people should be charged for improving the looks of their property. The Board is willing to look at the removal of the fee. There was discussion about codes and fees, and asbestos. There was discussion about a roadway on or near the Brink property. Privilege of Floor was closed. Highway Superintendent s Report Highway Report November 19, 2013 #1 Gas Price: $3.01 gal. Diesel Price: $3.17 gal. #2. Ditches Re-cleaned / Bailey Hollow, (off from Davis Hollow) Dalton Hill and Lamb Rd. #3. Pipe Re-placed on Allison Hill. Pipes cleaned on Bailey Hollow and Lane. #4. Edges and Ditches Cleaned with Grader and Athey on Ketchumville Rd, North and South Ketchumville Rd, Pump Hill, Greenwood, Dalton Hill and Howard Hill Rd. #5. We started changing the box on #84 Monday with an Airflow- Flow and Dump Box. We will have it done this week. #6. Friday all the winter Equipment will be on and ready. #7. The 4 inch minus is in but no bill yet. They Robinson s and we hauled. Total, 1,000 ton. #8. Last Monday our Employees Assisted the Electrician in hooking up the Generator lines to the office building. The gas line will be later, I hope before the ground freezes. New Business Supervisor s Financial Report Supervisor Yetter said everything is looking good. We have two budget transfers this evening. We are short $ in State Retirement and short $1, in Snow Removal C.E. Revenues are looking okay. 2

3 Resolution # Budget Transfers On a motion offered by Councilman Tomazin and seconded by Councilman Cheresnowski, the Board authorized the following budget transfers: $1, from DA Medical Insurance $1, to DA Snow Removal C.E. $ from DB Medical Insurance $ to DB State Retirement Resolution # Supervisor s Financial Report On a motion offered by Councilman Cheresnowski and seconded by Councilman Graham the Town Board accepted the Supervisor s Financial Report for October 2013 as submitted. Department and Council Reports Code Enforcement Tom Larson discussed with the Board the following items: Noise feud on 38B Two houses are completely finished Siding, garages, bars and mobile home The Code Enforcement Report was submitted and is on file in the Clerk s Office. Justice Report Justice John Schaffer reported for the month of October 2013, the following cases were disposed: 31 Traffic Tickets; 2 Criminal charges; 0 Dog Cases; 1 Civil Cases; 1 Econ Cases and 0 Town Law Cases. A total of $3, was sent to the NYS Comptroller s Office. Justice Todd Smith reported for the month of October 2013, the following cases were disposed: 12 Traffic Tickets; 0 Criminal Charges; 0 Dog Cases; 0 Civil Case; 0 Econ Cases; 0 Town Law Cases. A total of $1, was sent to the NYS Comptroller s Office. The Justice Report was submitted and is on file in the Clerk s Office. 3

4 Planning Board Hans Peeters said he would us the compiled data from 2007 for the Comprehensive Plan. Casey is a great member. Mr. Peeters said he did not attend any SEQRA seminars. The Clerk said she had received an for another seminar. Mr. Peeters and Karen McMullen asked the Clerk to forward the , and she agreed to send it to them. Dog Control Karen McMullen told the Board she had received confirmation from the Dog Control Officer that Cheryl Jones dogs had been micro chipped and spayed or neutered. She believes the Town s involvement is over for this case. Supervisor Yetter said there may be more to this case. Council Members & Committees The generator project is underway. Everything is done except the gas line. There was discussion about the generator. Dan Peabody would like the Town to sign off on his HUD lien. The Board said to have a form made up and we will sign. Executive Session Resolution # Enter Executive Session On a motion offered by Councilman Graham and seconded by Councilman Cheresnowski, the Town Board entered Executive Session at 8:08 P.M. Supervisor Yetter, Jr. AYE Resolution # Exit Executive Session On a motion offered by Councilman Graham and seconded by Councilman Tomazin, the Town Board exited Executive Session at 8:16 P.M. Supervisor Yetter, Jr. AYE The purpose of this Executive Session was to discuss the Highway Employee Union Contract. 4

5 It was decided the December End of the Year meeting will be Monday 30, 2013 at 6:30 PM. The Clerk will put a legal notice in the Courier. Resolution # General Bills On a motion, offered by Councilman Thomas and seconded by Councilman Cheresnowski, the Town Board authorizes the payment of General Vouchers # # inclusive, in the amount of $36, Resolution # Highway Bills On a motion offered by Councilman Tomazin and seconded by Councilman Graham, the Town Board authorizes the payment of Highway Vouchers, H175-H188 inclusive, in the amount of $77, There was a motion to adjourn the meeting at 8:29 P.M., offered by Councilman Tomazin and seconded by Councilman Graham.
