1 Mayor Hambleton opened a public hearing October 14, 2014 at 7:00 PM as advertised for the purpose of hearing comments on the proposal to lease city property (space on Water Tower for wireless communications equipment and antennae) to Minburn Telephone Company. He asked for written comments, there were none. He asked for oral comments, there being none he declared the hearing closed at 7:01 PM. The Dallas Center City Council met in regular session October 14, 2014 at 7:02 PM. Mayor Hambleton called the meeting to order and led the pledge of allegiance. Council members present included Heidi Williams, Terry Gibson Daniel Willrich and Ryan Kluss. Mike Kidd was not present. The agenda was amended to strike item 4i-renewal of Smokehouse liquor license and add an item after the consent agenda-approve payment of invoice to George Lawson. Motion by Williams, 2 nd by Willrich to approve the amended agenda. Motion passed 4-0. Motion by Williams, 2 nd by Kluss to approve consent agenda (approve minutes for September 9 th and October 8 th meetings, September Treasurer s Report, September Police, Fire/Rescue, Compliance and Water Reports, approve invoices for payment (review committee Kidd and Gibson), approve reappointment of Brian Osborne to the Board of Adjustment (term expires October 1, 2019), accept resignation of Dan Case from the Planning and Zoning Board effective October 1, 2014, accept resignation of Teena Case from the Library Board effective October 1, 2014, approve Mayor s appointment of Kerrin Andrle to the Library Board to complete Teena Case s term, term expires June 30, 2017, approve Trees Please grant application. Eric Wessels was present to discuss the impact of hog confinement facilities on Dallas Center and ask for the City s support in lobbying for a change in the law regarding facilities under 2500 head of hogs. Motion by Williams, 2 nd by Kluss to approve Resolution approving Lease Agreement with Minburn Telephone Company. Ayes-Williams, Kluss and Willrich. Nay-Gibson. Motion passed 3-1. Slaughter gave the public works report. No engineer s update on Stormwater Management plan. Engineer s update on Well Field Exploration project-motion by Gibson, 2 nd by Willrich authorizing the engineer to proceed with borings on the northern portion of Midwest Oil Seed property as well as in the Dallas County right-ofway along other properties. If necessary, borings may occur south of Hwy. 44. Motion passed 4-0. Motion by Gibson, 2 nd by Kluss to approve DC-G school district s request to waive the building permit fees for demolishing and rebuilding dugouts at the high school baseball field in the amount of $173. Motion passed 4-0. Motion by Williams, 2 nd by Kluss to approve Ordinance No. 476 adopting the 2012 International Building and 2012 International Residential Code, with amendments, second reading. Motion by Willrich, 2 nd by Kluss to waive the 3 rd reading of Ordinance 476, making it effective upon publication. Motion by Kluss, 2 nd by Gibson to approve Ordinance No. 477 adopting the 2012 International Fire Code, with amendments, second reading. Motion by Kluss, 2 nd by Williams to waive the 3 rd reading of Ordinance 477, making it effective upon publication. Motion by Williams, 2 nd by Kluss to approve Ordinance No. 478 adopting the 2012 International Property Maintenance Code, with amendments, second reading.

Motion by Kluss, 2 nd by Williams to approve Resolution approving annual financial report for FY14. Motion by Willrich, 2 nd by Kluss to approve Resolution approving the form of the amended Section 125 Cafeteria Plan (last approved by Resolution ). Gibson stepped out from 8:07-8:08 PM. Motion by Willrich, 2 nd by Williams to approve Resolution determining the necessity and setting a public hearing on a proposed amendment to the Dallas Center Urban Renewal Plan at 7:00 PM on November 11, Council had discussion on items to be included in Resolution for November meeting to authorize TIF indebtedness to be incurred. Council had discussion on street closing procedures for recurring and special events (this does not include liquor license approval and related street closings). City staff will review requests and have street closures put on the consent agenda. Council set 2015/2016 budget strategy discussion for Tuesday, November 25 th at 6:00 PM. Council reports-kluss informed the council that he attended the Walnut Creek watershed meeting on Monday, October 13 th. Mayor Hambleton reported that there will be a new cleaning vendor for City Hall/Memorial Hall and the library. Meeting adjourned at 8:28 PM.
