CALL TO ORDER ROLL CALL MINUTES: Regular Meeting of May 4, 2017 NEW BUSINESS: Case # Stephenson Highway REQUEST: A Temporary Use in the M-1 District is requested under Zoning Ordinance Section (3)b to allow temporary storage of new automobiles (max. 134 units) for a period of six (6) months. The applicant is Larry Burr - Matthews Hargreaves Chevrolet. Property is located at Stephenson Highway. ADJOURNMENT

2 Zoning Board of Appeals Regular Meeting Madison Heights, Michigan May 4, 2017 A Regular Meeting of the Madison Heights Zoning Board of Appeals was called to order by Chairwoman L. Corbett on May 4, 2017 at 7:31 p.m. in the Municipal Building at 300 West Thirteen Mile Road, Madison Heights, Michigan. Present: Chairwoman L. Corbett, Vice Chairman Oglesby and members: R. Corbett, Hohner, Holder, Kehoe, Kimble (Alt. #1), Kirchoff, Tecker, Building Official Frank Haywood, Assistant City Attorney Grochowski and Clerk of the Board Sanchez. Absent: Yemec (excused), Bauer (Alt. #2) Member(s) Excused. Motion by Ms. Kehoe, seconded by Mr. Oglesby, to excuse Ms. Yemec from tonight s meeting, as she is unable to attend. Yeas: R. Corbett, Hohner, Holder, Kehoe, Kimble, Kirchoff, Oglesby, Tecker, L. Corbett Nays: None Absent: Yemec Motion Carried Minutes. Motion by Ms. Holder seconded by Mr. Kimble, to adopt the minutes of the Regular Meeting held on October 4, 2016 as printed. Yeas: Holder, Kimble, Kirchoff, Oglesby, Tecker, R. Corbett, L. Corbett Nays: None Abstain: Hohner, Kehoe Absent: Yemec Motion Carried ZBA

3 Election of Chairperson. Chairwoman Corbett called for nomination for the position of Chairperson of the Board. Motion by Ms. Kehoe, seconded by Mr. Kimble, to nominate Linda Corbett as Chairwoman for a one-year term to expire on February 1, There being no further nominations, the vote was called. Yeas: Nays: Absent: Hohner, Holder, Kehoe, Kimble, Kirchoff, Oglesby, Tecker, R. Corbett, L. Corbett None Yemec Motion Carried Nomination of Vice Chair. Chairwoman Corbett called for nomination for the position of Vice- Chairperson of the Board. Motion by Ms. Holder, seconded by Mr. Hohner, to nominate Clifford Oglesby as Vice Chairperson of the Board for a one-year term to expire on February 1, There being no further nominations, the vote was called. Yeas: Nays: Absent: Holder, Kehoe, Kimble, Kirchoff, Oglesby, Tecker, R. Corbett, Hohner, L. Corbett None Yemec Motion Carried Rear Yard Setback 108 E. Kalama. Application #17-01 Chairwoman Corbett opened the public hearing at 7:35 p.m. to hear comment, if any, on application #17-01 Kristin Frankin, 108 E. Kalama, Madison Heights stated she would like add a sunroom to the back of the house and she would like to include a swim spa in the sunroom. She stated this would be an improvement for her health, the property, and to the neighborhood. Ms. Franklin ZBA

4 indicated that she does not have a garage as most of the other homes in the area do and this addition would be in place of a garage. Ms. Franklin provided the board with a photo of what the sunroom would look like along with signed letters from her neighbors indicating that they do not have any issues with the addition to her home. Additionally, she stated that the homes on either side of her are rental homes and she has spoken to the landlords of both properties and neither has an issue with the addition, and both landlords have indicated they would be happy to see the improvement to the property. There being no further comments, the public hearing was closed. Motion by Mr. Corbett, Seconded by Mr. Kimble, WHEREAS, an application has been filed by Kristin Franklin, the Petitioner and homeowner of 108 E. Kalama is requesting a variance from Section of the Zoning Ordinance to allow expansion of a structure (existing home) to extend 12 into the required 35 rear yard setback; and WHEREAS, a notice of public hearing was published in the Madison Park News on April 19, 2017 and 246 notices were mailed to property owners within 500 feet of the aforementioned property; and WHEREAS, a report has been received from the Community Development Department stating that: RELEVANT INFORMATION 1. The applicant is the property owner. 2. The proposal is to add a sunroom, which would encroach 12 into the required rear yard. In other words, the setback from the rear property line will be 23. where 35 is required. SITE PLAN COMMITTEE ACTION Staff notes that the proposal is to enclose an 8 x 14 swim spa. An inground pool could occupy the majority of the rear yard, and could include an attached or detached cabana-like structure larger than proposed. Therefore, staff has no objections to the proposal, subject to a condition that no additional accessory structures be constructed ZBA

5 There being no further comments, the public hearing was closed. NOW, THEREFORE, BE IT RESOLVED, that the Madison Heights Zoning Board of Appeals approves a variance from Section of the Zoning Ordinance to allow expansion of a structure (existing home) to extend 12 into the required 35 rear yard setback as requested; as it will enhance the homes usefulness, the economic value of the property and is harmonious with the neighborhood; with a condition that no additional accessory structures be constructed. Yeas: Kehoe, Kimble, Kirchoff, Oglesby, Tecker, R. Corbett, Hohner, Holder, L. Corbett Nays: None Absent: Yemec Motion Carried Adjournment. 10 MEMORANDUM To: From: Zoning Board of Appeals Frank Haywood Building Official Community Development Department Date: July 19, 2017 Subject: Application #17-02, Stephenson REQUEST One variance is being requested to allow the storage of the temporary storage of new vehicles for a period of six months. A variance from Section (2) is requested to allow storage at a property currently zoned M-1, which does not allow outside storage. Property is located at Stephenson. RELEVANT INFORMATION 1. The applicant is not the property owner, but rather a potential tenant. 2. The proposal is to allow the storage of new vehicles for a period of six months. None. PREVIOUS ACTIONS SITE PLAN COMMITTEE ACTION The Site Plan Committee has reviewed this request. The Committee has the following three recommendations to be placed if the ZBA were to approve the request. 1. There to be no Parking with-in the required front yard setback. 2. The approval to cease at a date six months from the approval date. 3. The approval to become void upon the issuance of a Certificate of Occupancy to the Building on site.
