Members Present: Board Members present were James Schwantes, David Wurm, Katrina Pleva, Dan Hubbell, and Ronald Schaub. Wurm arrived late at 7:07PM Others Present: George Wellman, Julie Krombeen, & Tim Cypher. Public Comment: None. Approve Agenda: Motion to approve agenda by Pleva, seconded by Schaub. Agenda approved. Approval of Consent Agenda: Motion by Hubbell to approve the consent agenda to approve the January 10, 2018 minutes, January 24, 2018 Work Session minutes & pay township invoices, seconded by Schaub. Ayes=4, No=0, Motion carried. Treasurer s Report: Township Chase Tax Fund Checking $1,813.07, Chase HI Yield Savings $10,124.58, Chase Business Savings $5,015.78, Chase Commercial Checking $226,347.37, and Fifth Third CD is $30, and Chemical Bank CD is $51,620.96, Honor Bank CD s are $25, & $35,129.45, with combined CD s of $142, The general fund balance is $386, Motion by Hubbell to accept the Treasurer s Report as presented, supported by Schaub. Ayes=4, No=0, Motion carried. Correspondence/Communication: Schwantes reported on the Michigan State Policy forfeiture report. Assessor s Report: Assessor was present. Board of Review organizational meeting will be March 6 th, 2018 at 9:00AM. Appeals to the Board of Review will be held Monday, March 12 th, 2018 from 2-5pm and 6-9pm and on Thursday, March 15 th, 2018 from 9-Noon & 1-4pm. All meetings will be held at the Solon Township Hall. Zoning Administrator (ZA) Report: 1 Land Use Permits & no Land Divisions were requested in January. Motion by Hubbell to renew Zoning Administrator Contract with Tim Cypher for 2 years to expire March 31, 2020, seconded by Pleva. Ayes=5, No=0, Motion carried. Planning Commission (PC) Activities/Comments: The regular PC meeting was held on January 22, 2018 at 7PM at the Solon Township Hall. The meeting completed the process to approve the Special Use Permit for a proposed WIFI tower by Cherry Capital Communications on the Schaub Farm on French Road. The ZBA then overturned the decision of the PC and denied the SUP. As of this board meeting no motion was filed in circuit court to contest the denial, but it is expected. Short term rentals were discussed and a consensus of the board is to not develop short term rental guidelines at this time since this is a grey area and it is not clear what the state legislature and taxing authorities will do. The next PC meeting will be held on February 26 th, 2018 at 6:30PM at the Solon Township Hall. Fire Department: The Cedar Area Fire & Rescue has identified the need to raise additional capital funds to replace trucks. Wurm was appointed to a subcommittee with Tim Stein to propose a millage which could be put PDF processed with CutePDF evaluation edition Page 1 of 2
4 Draft 2/21/2018 on the ballot for all four townships. Wurm reminded everyone that the wording in the 4 township agreement does not allow financial lenders to underwrite loans. Schwantes stated that the agreement did not allow for millage by the CAFR, but by the townships individually. With a good 5-year plan that includes truck replacement the townships would need to fund those purchases directly via payments to the CAFR. Schwantes submitted a letter in support of the CAFR dispose of the Brush truck and old tanker. Construction should be started on the new Chief office. The ambulance payments will be funded by the CAFR once the Hanni-Morenz fund is depleted. The CAFR Board will hold their next regular meeting Thursday, March 20 th, at 7PM at the Cedar Fire Hall. Board Unfinished Business: Township Hall Upgrade: Schwantes finalized the agreement with Easling Construction including a contractor s application of payment and breakdown so the project can be monitored prior to authorizing the payments. There will be a 10 day window to make payment following approval. Schwantes was going to question the completion date since no date is listed for completion. Motion by Hubbell to approve the contract with Easling Construction as presented, seconded by Pleva. Ayes=5, No=0, Motion carried. Road Policy: Motion by Pleva to adopt the updated Road Policy as presented, seconded by Hubbell. Ayes=5, No=0, Motion carried. Board consensus identified the next steps to work with the Leelanau County Road Commission to get pricing on the 5 road projects proposed in accordance with the policy to see where these projects might fit with the financial and the scheduling requirements of the LCRC. The projects are Amore Road, Cedarview Road, the Chalet Roads, and Schomberg Road between Honhke & Bodus and between Bodus & Fabiszak. Fire Millage: Board members reviewed the ideas to keep the millage at 1.00 Mills, increase it to 1.25 Mills or fully funding the CAFR at 1.50 Mills (ie not spending General Fund money). Board members plan to decide at the March meeting on the proposed mills to be placed on the August 2018 ballot for township voters to approve. Salary Resolutions: Board members are looking to propose a cost of living increase with a 2% salary increase. Salary Resolution was offered by Wurm for supervisor from $10,000 to $10,200, seconded by Pleva. Roll Call Vote: Wurm=Yes, Pleva=Yes, Schaub=Yes, Hubbell=Yes (Schwantes abstained) Ayes=4, No=0, Resolution passed. Salary Resolution was offered by Hubbell for clerk from $15,500 to $15,800, seconded by Schwantes. Roll Call Vote: Hubbell=Yes, Schaub=Yes, Pleva=Yes, Schwantes=Yes (Wurm abstained) Ayes=4, No=0, Resolution passed. Salary Resolution was offered by Schaub for treasurer from $15,500 to $15,800, seconded by Hubbell. Roll Call Vote: Schaub=Yes, Schwantes=Yes, Wurm=Yes, Hubbell=Yes (Pleva abstained) Ayes=4, No=0, Resolution passed Budget: A draft budget was reviewed. We will hold a public hearing at our regular March meeting on the budget prior to the annual meeting to get input prior to finalizing it and presenting it at the annual meeting. Wurm & Pleva will work to present a Balance Sheet. Board New Business: None County Commissioner Report: Patricia Soutas-Little was feeling under the weather and not able to attend. Next Regular Township Board Meeting: The next regular township board meeting will be held Wednesday, March 14 th, 2018 at 7PM at the Solon Township Hall. Members Present: Board Members present were James Schwantes, David Wurm, Katrina Pleva, Dan Hubbell, and Ronald Schaub. Others Present: Bill Walters, Jim Farese, Justin Maylone, Tim Maylone, Tim Cypher, Tim Johnson, Chris Bzdok, Doug Matthies, & Glen LaCross. Schwantes stated that this meeting was not a public hearing but rather a meeting to allow legal counsel to deliver his statements and recommendations to the board. A conflict of interest with board trustee Ron Shaub was recognized since the proposed property is being leased to Cherry Capital Connections by Schaub on French Road. He will abstain from discussions &voting on this matter. Approve Agenda: Motion to approve agenda by Hubbell, seconded by Schwantes. Agenda approved. Chris Bzdok gave a brief overview of his understanding of the matters and proceeded with a recommendation to create a consent judgment of settlement with Cherry Capital Connections and propose the conditions necessary to be able to satisfy the aggrieved neighbor. Motion by Hubbell to authorize our counsel to pursue settlement of the appeal with conditions as set forth by the planning commission in its decision coupled with such conditions as outlined by the ZBA in its decision. Counsel is authorized to accept service and consult with the Supervisor, the Chair of the Planning Commission and the Zoning Administrator to finalize conditions. Any settlement is to be brought back to the board for their approval, seconded by Pleva. Board member discussion favored pursuing settlement of the appeal. Wurm asked what the timeline is for this to be completed. Bzdok responded that, though he couldn t say for certain, he would expect it to take days for this to be completed and a consent judgment filed with circuit court to allow Cherry Capital Connections to proceed. Call of the Vote by Supervisor: Ayes=4, No=0, (Schaub abstained). Motion passed Public Comment: Doug Matthies stated that his father Dan Matthies and their legal counsel was not able to be present. Doug stated that Centerville Township should stand by their ordinance. He stated that his legal counsel will advise him based on the conditions of this settlement as what further actions will be taken as part of this decision. Adjourn: Meeting adjourned at 5:52PM.
