1 ORDINANCE DEKALB COUNTY FIREWORKS CODE AMENDED CHAPTER 34, ARTICLE II Article II. Fireworks Sec Definitions. The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning. Fireworks means any explosive composition or any substance or combination of substances, or article prepared for the purpose of producing a visible or audible effect of a temporary exhibitional nature by explosion, combustion, deflagration or detonation, and shall include blank cartridges, toy cannons in which explosives are used, the type of balloons which require fire underneath to propel the same, firecrackers, torpedoes, sky rockets, Roman candles, sparklers, bombs or other fireworks of like construction and any fireworks containing any explosive compound; or any tablets or other device containing any explosive substance, or containing combustible substances producing visual effects. The term fireworks shall not include toy pistols, toy canes, toy guns, or other devices with paper or plastic caps containing twenty-five hundredths grains or less of explosive compound; provided, they are so constructed that the hand cannot come in contact with the cap when in place for the explosion. Public displays of fireworks means a supervised showing for profit or nonprofit of fireworks for the purpose of producing a visible or audible effect to be viewed or heard by three or more individuals. Every fireworks display shall be handled by a competent individual. Such competent individual shall be so designated on the permit by the official granting the permit. The fireworks display shall be so located, discharged or fired, as not to be hazardous to property or endanger any person. (Ord. No Section 8-2, ) State law reference Similar provisions, 425 ILCS 35/2. Sec Permit (a.) An application for the required permit shall be made in writing to the county clerk on forms provided by that office, at least 15 days in advance of the date of the display, and action shall be taken on such application within 48 hours after such application is made.

2 (b.) Included with the application shall be a diagram of the location of the fireworks display area. (c.) Such permit shall be issued only after inspection of the display site by the Chief of the Fire Department providing fire protection to the display area, or his/her designee. (d.) No permit granted by the county clerk shall be transferable. (e.) One copy of such permit shall be on file with the issuing officer, one copy shall be forwarded to the office of the state fire marshal, one copy shall be forwarded to the county sheriff s department, one copy shall be filed in the county board office and one copy shall be in the possession of the display supervisor. (f.) Permits may be granted to any group of three or more adult individuals who apply. The permit, if issued, shall contain the names of three adult applicants and shall be designated as licensees. (g.) No permit shall be required for supervised public displays by the county fair association, and those fireworks conducted by local government entities, such as cities, villages, state parks and fire districts. (h.) The applicants are required to post a bond in a sum not less than $1,000.00, which is conditioned on compliance with the state statutes, this article and the regulation of the state fire marshal. Such bond can be a personal bond without sureties. (i.) The county clerk shall collect a fee of $25.00 for the issuance of each permit. (Ord. No , Section 8-3, ) State law reference Permits 425 ILCS 35/2. (j.) The County may conduct a criminal background check of the applicant as a condition of issuing a permit. Section Insurance. A person desiring the required fireworks permit shall submit proof of liability insurance coverage in the amount of $1,000, ($1million), for aggregate bodily injury and $150, (One hundred fifty thousand dollars and no cents) for property damage for damages resulting from the fireworks display. (Ord. No , Section 8-4, ) Section Penalty. Any person who violates any portion of this article shall be punished as provided by section 5 of the Fireworks Use Act (425 ILCS 35/5). (Ord. 3 June 19,2006 MEMORANDUM To: Paul Miller Planning & Zoning From: John Farrell Assistant States Attorney Re: Revised Fireworks Ordinance Please be advised that a review of our County Ordinance compared to some recent changes in Illinois Revised Statutes revealed the necessity in making some minor proposed changes to our fireworks ordinance. Ray Bockman and I met, and Mary Supple recently sent you the proposal. The key change involves an increase in required insurance coverage. It is my opinion that these changes will bring us into total compliance with state requirements, and make our ordinance stronger as a result.. The County will install red and amber flashing beacons at the intersection of Glidden and Rich Roads for safety features. The cost to install these beacons has been estimated to be $17, with the County responsible for $14, DeKalb Road District will pay for the installation for this safety improvement. The County will use MFT funds as well as Matching funds to pay for this safety improvement. 9 COUNTY BOARD PROCEEDINGS July 19, 2006 The DeKalb County Board met in regular session at the Legislative Center on Wednesday, July 19, Chairman Tobias called the meeting to order and the Clerk called the roll. Those Members present were Mr. Whelan, Ms. Vary, Mrs. Turner, Ms. Tolene, Mr. Steimel, Mr. Slack, Mr. Rosemier, Mr. Osborne, Mr. Metzger, Mr. Lyle, Mrs. Leifheit, Ms. LaVigne, Mr. Haines, Mr. Gudmunson, Ms. Fullerton, Ms. Fauci, Mr. Faivre, Mrs. Dubin, Ms. De Fauw, Mr. Augsburger, Mr. Anderson, Mrs. Allen and Chairman Tobias. One Member, Mr. Sands was absent. Twenty-three Members were present and one Member were absent. The Chair asked Mr. Gudmunson to lead the pledge to the flag. FINANCE AND LAW AND JUSTICE JOINT COMMITTEE Resolution R : Public Safety Sales Tax Referendum Motion Mrs. Leifheit moved to approve a Resolution authorizing the DeKalb County Board to place the Public Safety Sales Tax Referendum on the November 7, 2006 Ballot. Mr. Whelan seconded the motion. Page 34

12 Motion to Amend Mr. Haines presented the following motion amending the Resolution: Four Proposed Amendments to Resolution R Amendment A: Delete 146 beds and 235" from Whereas #7. The amended #7: Whereas, notwithstanding full implementation of said alternatives, the jail is projected to fall short of the beds that will be needed by 2025; and Amendment B: Delete 146" and insert needed new in its place in Whereas 10 #. The amended #10: Whereas, the estimated capital cost of adding needed new beds to the jail is approximately $40 million; and Amendment C: Add one more Whereas. New Whereas: Whereas, the DeKalb County Board in recognition of the importance of maintaining adequate funding for those alternatives to incarceration does direct that any future shortfalls for jail construction shall not result in a disproportionate reduction in funding for the alternatives but shall be borne proportionately by the capital, operating and alternative portions of this project. Amendment D: Insert in Section 2 after...crime prevention, the words: alternatives to incarceration, building a new jail, The amended Section 2: Need for Public Safety Sales Tax. It is necessary and in the best interests of the Count that a public safety sales tax be imposed at the rate of one-half of one percent upon all persons engaged in the business of selling tangible personal property at retail in the County on gross Receipts from the sales made in the course of their business to be used for crime prevention, alternatives to incarceration, building a new jail, detention, and other public safety purposes. Mr. Rosemier seconded the amendment with wording to be building an addition to the jail in Amendment D. Ms. Fullerton requested individual votes on all four amendments. Amendment A Voice Vote All Members present voted yea. Motion passed unanimously. Amendment B Voice Vote All Members present voted yea. Motion passed unanimously. Amendment C Voice Vote All Members present voted yea. Motion passed unanimously. Amendment D with new wording re: addition to the jail. Voice Vote A majority of the members voted yea. Miller, AICP Planning Director DATE: June 14, 2006 SUBJECT: Building Code Update At its meeting of April 26, 2006, the Committee considered the recommendation of staff for updates to the County codes of regulations applicable to the construction of new buildings and structures in unincorporated DeKalb County. These updates are done every three or four years, and are necessary because the industry standards for minimum safety are improved each year and new construction technology and materials must be factored into the regulations and practices. The County last updated its adopted Building Codes in June of Toby Petrie, Chief Building Inspector, has prepared a list of recommended updated codes for adoption, along with amendments that reflect local practice (memorandum previously distributed). The Committee requested staff to seek the input of local building contractors on the proposed changes. Staff met with representatives of the DeKalb Builders Association on May 16, There was general agreement on the majority of changes being proposed, but some disagreement on the recommended Residential energy requirements (see attached). Representatives of the Builders Association have been invited to attend the June 28, 2006 meeting of the Committee to express their opinions and answer questions. The Committee is requested to review these recommendations, and forward a motion to the full County Board for adoption by ordinance. 35 DRAFT HIGHWAY COMMITTEE July 6, 2006 The regular monthly meeting of the Highway Committee of the DeKalb County Board met on Thursday, July 6, 2006 at 6:00pm in the Conference Room of the DeKalb County Highway Department, DeKalb, Illinois. Chair LaVigne called the meeting to order at 6:00pm. Committee members present were, Mr. Anderson, Vice Chair Faivre, Ms. Fauci, Mr. Gudmunson, Mr. Osborne and Mr. Whelan. Also present were County Engineer William Lorence and Wayne Davey, Highway Department Support Services Manager. APPROVAL OF MINUTES: Motion made by Mr. Whelan and seconded by Ms. Fauci to approve the minutes of the regular June 1, 2006 meeting. Discussion followed to amend the minutes to read as follows: Under Public Comment, second paragraph, third sentence from the end, insert a period after the word tile and delete the remainder of the sentence. The motion to approve the minutes as amended carried unanimously. APPROVAL OF AGENDA: Motion made by Vice Chair Faivre to approve the agenda and Mr. Anderson seconded this motion. The motion carried unanimously to approve the agenda as presented. PUBLIC COMMENT: None MFT RESOLUTION FOR FLASHING BEACONS AT GLIDDEN AND RICH ROADS UNDER SECTION TL Mr. Lorence explained that the Committee directed that additional safety features be considered for the intersection of Glidden and Rich Roads. One of the safety features to be considered was the installation of red and amber flashing beacons. The cost to install these beacons has been estimated to be $17, with the County responsible for $14, DeKalb Road District has agreed to pay for the installation of one amber beacon. The County will use MFT funds as well as Matching funds to pay for this safety improvement. The amount of MFT funds being requested is $7, A motion was made by Vice Chair Faivre and seconded by Mr. Osborne to forward the proposed resolution to the full County Board recommending approval. The motion carried unanimously.

36 CHAIR S COMMENTS: Chair LaVigne inquired if the Committee members had received information on the Enbridge Pipeline project proposed for DeKalb County. All members had received their information and Mr. Lorence indicated he had finally received some information. Enbridge now has a surveyor involved and is speaking to land owners concerning this project. The County has not received any formal notification or proposal from Enbridge. Enbridge is under the impression that under the Interstate Commerce Act it does not have to have any permission from the County to install their pipeline. The State s Attorney s Office is currently working on this issue. COUNTY ENGINEER S COMMENTS: Mr. Lorence provided his progress report to the Committee. Those projects noted in red are the ones that have been updated since the Committee s last report. Our Malta Road project has been awarded and there seems to be a problem locating the actual Contract at IDOT. The Bethany Road extension is complete and open to the public. Peace Road widening is scheduled for a July 11, 2006 letting and it would appear that the County will receive no Federal funds for this project, at least not this year. All the right-of-way for Glidden Road (south of Il Route 64) has now been either purchased or agreed to. The bridge on Brickville Road is still waiting for NiCor to relocate a gas line in the area. It would appear that this bridge would not be completed prior to commencement of the school year. Mr. Lorence explained that the Peace Road project has been scheduled for letting on July 11, 2006 at 10:00am in the conference room of the Highway Department. There has been considerable interest in this project. The County has had to revise our initial estimate for this project due to the fact that asphalt prices were increasing $8.00 per ton for all binder mixes and $10.00 per ton for all surface mixes after August 1, This has resulted in an additional $300, to be added to our estimate for binder only. The surface course will be laid next year. The Committee will meet at 7:00pm pm July 19, 2006 prior to the regular County Board meeting to review the bids and make an award recommendation. An MFT resolution will also be presented at that time. The Agreement with Dyn Sycamore Commercial, LLC (First Rockford Group) for their portion of construction and traffic signals on Peace Road has been executed and is on file. Dyn Sycamore Commercial agreed to all points that the County required of them for this project. ADDITIONAL COMMENTS: Mr. Anderson inquired into the land acquisition for Glidden Road north of IL Route 64. Mr. Lorence explained that the County currently has 60 feet and will be going to 100 feet, which would involve 20 additional feet of right-of-way on both sides of the road.

37 Ms. Fauci inquired if a walkway would be installed allowing citizens to cross Illinois 23 at the new Hospital. Mr. Lorence indicated he knew nothing about it and Ms. Fauci should contact Mr. Brady from the City of Sycamore for information. Mr. Whelan stated there was a bad accident at the intersection of Freed and Peace Road recently when someone ran the stop sign. He inquired if the County would be doing anything to improve safety at that intersection. Mr. Lorence indicated nothing was planned as that was the first accident there all year and it resulted in a driver running the stopping sign. ADJOURNMENT: Chair LaVigne inquired if there was anything else that needed to be brought before the Committee and hearing none asked for a motion to adjourn. A motion was made by Mr. Whelan to adjourn and Ms. Fauci seconded this motion.
