1 Ordinance No.: Adopted: NOTICE THE COMMISSIONERS OF THE CITY OF REHOBOTH BEACH ON JANUARY 18, 2013, ADOPTED ORDINANCE NO WHICH READS AS FOLLOWS: AN ORDINANCE TO AMEND CHAPTER 102 OF THE MUNICIPAL CODE OF THE CITY OF REHOBOTH BEACH, DELAWARE, RELATING TO THE BUILDING CODE, ENERGY CONSERVATION CODE, EXISTING BUILDING CODE, FUEL GAS CODE, MECHANICAL CODE, PLUMBING CODE, PROPERTY MAINTENANCE CODE, AND RESIDENTIAL CODE WHEREAS, it has been determined that adoption of the 2012 edition of the International Building Code, regulating and governing the conditions and maintenance of all property, buildings and structures is in the best interests of the City of Rehoboth Beach; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use and the demolition of such structures in the City of Rehoboth Beach; providing for the issuance of permits and collection of fees therefor; and WHEREAS, it has been determined that adoption of the 2012 edition of the International Existing Building Code, regulating and governing the repair, alteration, change of occupancy, addition and relocation of existing buildings, including historic buildings, in the City of Rehoboth Beach is in the best interests of the City; by providing for the issuance of permits and collection of fees therefor; and WHEREAS, it has been determined that adoption of the 2012 edition of the International Energy Conservation Code, regulating and governing energy efficient building envelopes and installation of energy efficient mechanical, lighting and power systems in the City of Rehoboth Beach is in the best interests of the City; by providing for the issuance of permits and collection of fees therefor; and WHEREAS, it has been determined that adoption of the 2012 edition of the International Plumbing Code, regulating and governing the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of plumbing systems in the City of Rehoboth Beach is in the best interests of the City; by providing for the issuance of permits and collection of fees therefor; and WHEREAS, it has been determined that adoption of the 2012 edition of the International Property Maintenance Code, regulating and governing the conditions and maintenance of all property, buildings and structures is in the best interests of the City of Rehoboth Beach; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures in the City of Rehoboth Beach; providing for the issuance of permits and collection of fees therefor; and

2 WHEREAS, it has been determined that adoption of the 2012 edition of the International Fuel Gas Code, regulating and governing fuel gas systems and gas-fired appliances in the City of Rehoboth Beach is in the best interests of the City; by providing for the issuance of permits and collection of fees therefor; and WHEREAS, it has been determined that adoption of the 2012 edition of the International Mechanical Code, regulating and governing the design, construction, quality of materials, erection, installation, alteration, repair, location, relocation, replacement, addition to, use or maintenance of mechanical systems in the City of Rehoboth Beach is in the best interests of the City; by providing for the issuance of permits and collection of fees therefor; and WHEREAS, it has been determined that adoption of the 2012 edition of the International Residential Code, regulating and governing the construction, alteration, movement, enlargement, replacement, repair, equipment, location, removal and demolition of detached one- and two-family dwellings and multiple single-family dwellings (townhouses) not more than three stories in height with separate means of egress in the City of Rehoboth Beach is in the best interests of the City; by providing for the issuance of permits and collection of fees therefor. BE IT ORDAINED by the Commissioners of the City of Rehoboth Beach, in session met, a quorum pertaining at all times thereto, in the manner following to-wit: BUILDING CODE Section 1. Chapter 102 of the Municipal Code of the City of Rehoboth Beach, Delaware, 2001, be and the same is hereby further amended by deleting all articles contained therein in their entirety. Section 2. Chapter 102 of the Municipal Code of the City of Rehoboth Beach, Delaware, 2001, be and the same is hereby further amended by adding new Article I, titled Adoption of Building Code. Section 3. Chapter 102, Article I, Adoption of Building Code, of the Municipal Code of the City of Rehoboth Beach, Delaware, 2001, be and the same is hereby further amended by adding new Section as follows: Building Code Adopted The International Building Code, 2012 edition, including Appendix Chapters E, F, and J, as published by the International Code Council, be and is hereby adopted as the Building Code of the City of Rehoboth Beach, in the State of Delaware, and each and all regulations, provisions, penalties, conditions and terms of said Building Code are hereby referred to, adopted, and made part hereof, as if fully set out herein.

3 Section 4. Chapter 102, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding new Article II, titled Modifications to Building Code. Section 5. Chapter 102, Article II, Modifications to Building Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding a new Section as follows: Amendment to Section Section of the Building Code of the City of Rehoboth Beach be and the same is amended by striking the phrase [NAME OF JURISDICTION] as such phrase appears therein and inserting in lieu thereof the phrase the City of Rehoboth Beach. Section 6. Chapter 102, Article II, Modifications to Building Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding a new Section as follows: Amendment to Section Section of the Building Code of the City of Rehoboth Beach be and the same is amended by striking the phrase one or more extensions of time, for periods not more than 180 days each as such phrase appears therein and inserting in lieu thereof the phrase up to two extensions of time, for periods not more than 180 days each, provided that the Commissioners may, for good cause shown, grant additional extensions. Section 7. Chapter 102, Article II, Modifications to Building Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding a new Section as follows: Amendment to Section 105. Section 105 of the Building Code of the City of Rehoboth Beach be and the same is amended by inserting new Sections and as follows: Storage of construction material. No applications for building permits for construction between May 15 and September 15 of any year shall be granted by the Building Official unless the storage of all materials for such construction shall be maintained on the site of construction in such a manner as not to interfere with pedestrian or vehicular traffic and adequate barriers and lighting are maintained Hours of construction. No construction shall be carried on between the hours of 5:00 p.m., prevailing time, and 8:00 a.m. of the following morning, prevailing time. No construction shall take place on any Saturday, Sunday or the following State of Delaware holidays: New Year's Day, Memorial Day, Independence Day, Labor Day, Thanksgiving Day, and Christmas Day, provided, however, that construction shall be permitted on

4 Saturdays (except where a Saturday falls on a holiday) between the hours of 9:00 a.m. and 5:00 p.m., from November 1 to April 30; further provided, however, that nothing contained herein shall prevent any homeowner from working within his own property boundaries, provided that such work is done by himself and is used exclusively by him or his family or guests. Such privilege does not convey the right to violate any of the provisions of the Building Code, nor is it to be construed as exempting any such property owner from obtaining a permit and paying the required fees therefor. Section 8. Chapter 102, Article II, Modifications to Building Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001, as amended be and is hereby further amended by adding a new Section as follows: Amendment to Section 112. Section 112 of the Building Code of the City of Rehoboth Beach be and the same is amended by deleting it in its entirety. Section 9. Chapter 102, Article II, Modifications to Building Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding a new Section as follows: Amendment to Section Section of the Building Code of the City of Rehoboth Beach be and the same is amended by inserting a new sentence at the end of Section as follows: Where terms are explicitly defined in the Municipal Code of the City of Rehoboth Beach, such definitions shall be controlling in all instances, unless inconsistent with the manifest intent of the Commissioners or the context clearly requires otherwise. Section 10. Chapter 102, Article II, Modifications to Building Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding a new Section as follows: Amendment to Chapter 6. Chapter 6 of the Building Code of the City of Rehoboth Beach be and the same is amended by inserting new Sections 604 and 605 as follows: SECTION 604 REGULATING CERTAIN BUILDINGS The following regulations shall apply to any building constructed or to any building altered by which the use of such building will change to any use other than a single-family dwelling subsequent to the adoption hereof:

5 All buildings having three stories or more above the ground shall include a stairway at each extreme of the building Fire standpipes are to be installed in stairwells of multifamily or public buildings having three stories or more above ground An interior hallway sprinkler system shall be installed in all multifamily or public buildings where standpipes are required Access doors to all dwelling units in multifamily dwellings shall be selfclosing All convalescent, rest or nursing homes or accommodations for the elderly shall have a sprinkler system and the plans of said sprinkler system shall be furnished to all fire and ambulance services Prior to any certificate of occupancy being issued by the Building Inspector, three copies of the sprinkler and/or standpipe system, with directions on how to return each system to an operational condition, shall be furnished to the Building Inspector of the City Raised metal floor numbers at least six inches in height shall be installed on all stairwell doors in multifamily or public buildings In all buildings, except single-family dwellings, in which there is an elevator or a bank of elevators, at least one elevator serving all floors shall have a minimum inside car platform of four feet three inches by six feet eight inches wide with a minimum clear opening width of 42 inches, unless otherwise designed to provide equivalent utility, to accommodate an ambulance stretcher in its horizontal position. This elevator shall be identified. All buildings, except singlefamily dwellings, exceeding three stories or exceeding 35 feet in height as defined in Chapter 270 of this Code shall be equipped with an elevator serving all floors, said elevator to be constructed and installed to have a minimum inside car platform of four feet three inches by six feet eight inches wide with a minimum clear opening width of 42 inches, unless otherwise designed to provide equivalent utility to accommodate an ambulance stretcher in its horizontal position All accessways from a common hall in a multifamily or public building shall be of sufficient size to accommodate a stretcher six feet six inches in length with access door to the common hall closed All standpipe fittings shall be eight inches from either side of the top of the outlet enclosure, if there is a top outlet enclosure All standpipe fittings, inlet or outlet, shall have National Standard Threads.

6 All multiple dwellings, as defined in Chapter 270, if constructed with air conditioning, shall be constructed with central air conditioning and shall not be constructed or serviced by individual units emplaced or installed in each unit. SECTION 605 BUILDINGS IN CERTAIN AREAS Commercial Buildings on Surf Avenue. All buildings hereafter constructed, erected, installed or located on lots designated as Surf Avenue Lots on the Zoning Map of the City of Rehoboth Beach from the north side of Philadelphia Street to the south side of Lake Avenue, excepting Lot F on the south side of Grenoble Place, shall be of fireproof materials (Type I), as defined in the Building Code of the City of Rehoboth Beach Buildings on Certain C-Commercial Lots and C-1 Commercial Lots. All buildings hereafter constructed, erected, installed or located on lots designated on the Zoning Map of the City of Rehoboth Beach as C-Commercial Lots and C-1 Commercial Lots situated between Second Street and the Atlantic Ocean shall be of fireproof materials (Type I) or fire resistive materials (Type II), depending upon what use is to be made of such buildings, as defined in the Building Code of the City of Rehoboth Beach Increasing Height of Existing Buildings. No existing building required by this chapter to be of fireproof or of fire resistive construction shall be increased in height unless such building is of a type of construction required for new buildings pursuant to the terms of this chapter Extension of Existing Buildings. No existing building required by this chapter to be of fireproof or fire resistive construction shall hereafter be extended on any side unless such extensions are of a type of construction required for new buildings pursuant to the terms of this chapter Building Permits. No building permit shall be issued by the Building Inspector of the City of Rehoboth Beach unless the building to be constructed, erected, installed or located on any lot as defined herein complies with the provisions of this chapter. Section 11. Chapter 102, Article II, Modifications to Building Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding a new Section as follows: Amendment to Section Section of the Building Code of the City of Rehoboth Beach be and the same is amended by striking the phrase "[NAME OF JURISDICTION]" as such phrase appears therein and inserting in lieu thereof the phrase "the City of Rehoboth Beach", and by further striking the phrase "[DATE OF ISSUANCE]" as such phrase appears therein and inserting in lieu thereof the phrase "January 6, 2005".

7 Section 12. Chapter 102, Article II, Modifications to Building Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding a new Section as follows: Amendment to Section Section of the Building Code of the City of Rehoboth Beach be and the same is amended by striking the phrase "[DATE TO BE INSERTED BY THE JURISDICTION. NOTE: IT IS RECOMMENDED THAT THIS DATE COINCIDE WITH THE EFFECTIVE DATE OF BUILDING CODES WITHIN THE JURISDICTION]" as such phrase appears therein and inserting in lieu thereof the phrase "January 18, 2013". Section 13. Chapter 102, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding new Article III, titled "Building Code and Permit Processing Fees". Section 14. Chapter 102, Article III, Building Code Fees, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001, as amended be and is hereby further amended by adding a new Section as follows: Fee Schedules. A. Schedule A. For the construction, renovation, repair or alteration of buildings containing less than three dwelling units and all related appurtenances, the following permit fee shall apply: (1) Two percent of building/construction cost. (2) No fee shall be required for the permit if the cost is $500 or less. A permit is required. B. Schedule B. For the construction, renovation, repair or alteration of buildings containing three or more dwelling units, all commercial construction, renovation, repair or alteration and all related appurtenances, the following permit fee shall apply: (1) Three percent of building/construction cost. (2) No fee shall be required for the permit if the cost is $500 or less. A permit is required. C. Schedule C. (1) For the moving of any building or structure which has no more than one story and whose square footage is less than 750 square feet, on or over the streets of the City, the fee shall be $500, and there shall be a secured bond posted with the City in the amount of $2,500 in a form approved by the City Manager.

8 (2) For the moving of any building or structure over one story and or having a square footage of 750 square feet or more, on or over the streets of the City, the fee shall be $1,000 and a secured bond shall be posted with the City in the amount of $20,000 in a form approved by the City Manager. (3) The bond posted with the City as required by this schedule shall not be released until: (a) (b) (c) The City Building Department has inspected the location of the house moving for damage, such as to curb, sidewalk, streets, etc., and any damage has been satisfactorily repaired; The location where the house moving occurred has been cleaned up of all debris and trash; and A certificate of a licensed plumber has been provided to the City certifying that the water and sewer lines have been capped at the location of house moving. D. Schedule D. (1) For the demolition of any building or structure less than 750 square feet and with no connection to the City's water or sewer lines, the fee shall be $300. For the demolition of any building or structure less than 750 square feet and with connections to the City's water or sewer lines, the fee shall be $500. (2) For the demolition of any building or structure having a square footage of 750 square feet or more and/or having a connection to the City's water or sewer lines, the fee shall be $3,000. There shall also be a secured bond posted with the City in the amount of 20% of the cost of demolishing said building or structure with a minimum bond of $2,000, in a form approved by the City Manager. (3) The bond posted with the City as required by this schedule shall not be returned until: (a) (b) (c) The City Building Department has inspected the location of the demolition for damage such as to curb, sidewalk, streets, etc., and any damage has been satisfactorily repaired; A licensed plumber has provided a certificate to the City certifying that the City's water and sewer lines have been capped at the location of the demolition; and The location of the demolition has been cleaned of all debris and trash. E. Schedule E. For the erection of any sign, the fee per sign shall be as follows: (1) For real estate signs for the rent or sale of a dwelling or a structure and construction signs, the fee shall be $10. (2) For all other signs, the fee shall be $50. F. Schedule F.

9 (1) For all residential construction, the following charges will be applicable for the review of building plans: (a) (b) (c) (d) For plan review of minor residential construction, such as decks, porches, and interior renovations, etc., the fee shall be $25. For the plan review of all major residential construction, such as additions, structural interior and exterior renovations, etc., the fee shall be $200. For the plan review of the new construction of one dwelling unit, the fee shall be $500. For the plan review regarding residential construction of more than one dwelling unit, the fee shall be $500 plus $10 per dwelling unit. (2) For the building plan review of all proposed commercial construction, the following charges shall be applicable: (a) (b) (c) For the plan review of minor commercial construction, such as decks, porches, interior renovations, etc., the fee shall be $150. For the plan review for major commercial construction, such as additions, structural interior and exterior renovations, etc., the fee shall be $300. For the plan review of all new construction not involving minor or major interior or exterior renovations, the fee shall be $1,000. G. Schedule G. (1) For the review of site plans for residential subdivisions the following fee shall apply: for minor subdivisions the fee shall be $200, for major subdivisions the fee shall be $400. (2) For the review of site plans for commercial subdivisions the following fee shall apply: for minor subdivision the fee shall be $400, and for major subdivisions the fee shall be $800. (3) For all other review of site plans for planning and zoning purposes for any other residential construction the fee shall be $100. (4) For all other review of site plans for planning and zoning purposes for any other commercial construction the fee shall be $600. H. Schedule H. At any time a builder schedules an inspection for footers, framing, energy and final inspection by a Building Official or his designee, and the Building Official or his designee arrives at the job site and is unable to complete the aforesaid inspections due to the stage of the construction not being ready for the inspection, there shall be a fee of $25 for each such failed inspection. I. Schedule I. A plumbing permit shall be obtained for all new plumbing and modifications to a rough-in in the City of Rehoboth Beach. The plumbing permit fee shall be $25 plus $5 per fixture.

10 Section 15. Chapter 102, Article III, Building Code and Permit Processing Fees, of the Municipal Code of the City of Rehoboth Beach, Delaware, 2001, as amended be and is hereby further amended by inserting new Section , titled Permit Processing Fees as follows: Permit Processing Fees. A permit of any type issued by the Building Official, or the Building Official's designee, under this Code shall be subject to a permit processing fee of $20. ENGERGY CONSERVATION CODE Section 16. Chapter 102, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001, as amended be and is hereby further amended by adding new Article IV, titled Adoption of Energy Conservation Code. Section 17. Chapter 102, Article IV, Adoption of Energy Conservation Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001, as amended be and is hereby further amended by adding new Section as follows: Energy Conservation Code Adopted. The International Energy Conservation Code, 2012 edition, as published by the International Code Council, be and is hereby adopted as the Energy Conservation Code of the City of Rehoboth Beach, in the State of Delaware, for regulating and governing energy efficient building envelopes and installation of energy efficient mechanical, lighting and power systems as herein provided; providing for the issuance of permits and collection of fees therefor, and each and all of the regulations, provisions, penalties, conditions and terms of said Energy Conservation Code are hereby referred to, adopted, and made a part hereof, as if fully set out herein. Section 18. Chapter 102, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001, as amended be and is hereby further amended by adding new Article V, titled Modifications to Energy Conservation Code. Section 19. Chapter 102, Article V, Modifications to Energy Conservation Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001, as amended be and is hereby further amended by adding a new Section as follows: Amendment to Sections C101.1 and R Sections C101.1 and R101.1 of the Energy Conservation Code of the City of Rehoboth Beach be and the same is amended by deleting the phrase "[NAME OF JURISDICTION]" as such phrase appears therein and inserting in lieu thereof the phrase "the City of Rehoboth Beach".

11 Section 20. Chapter 102, Article V, Modifications to Energy Conservation Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001, as amended be and is hereby further amended by adding a new Section as follows: Amendment to Sections C108.4 and R Sections C108.4 and R108.4 of the Energy Conservation Code of the City of Rehoboth Beach be and the same is amended by deleting the phrase shall be liable to a fine of not less than [AMOUNT] dollars or more than [AMOUNT] dollars as such phrase appears therein and inserting in lieu thereof the phrase shall be liable to a fine of not less than $100 dollars or more than $500 dollars. EXISTING BUILDING CODE Section 21. Chapter 102, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding new Article VI, titled "Adoption of Existing Building Code". Section 22. Chapter 102, Article VI, Adoption of Existing Building Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding new Section as follows: Existing Building Code Adopted. The International Existing Building Code, 2012 edition, including Appendix Chapters A and B, as published by the International Code Council, be and is hereby adopted as the Existing Building Code of the City of Rehoboth Beach, in the State of Delaware, and each and all regulations, provisions, penalties, conditions and terms of said Existing Building Code are hereby referred to, adopted, and made part hereof, as if fully set out herein. Section 23. Chapter 102, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding new Article VII, titled "Modifications to Existing Building Code". Section 24. Chapter 102, Article VII, Modifications to Existing Building Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding a new Section as follows: Amendment to Section Section of the Existing Building Code of the City of Rehoboth Beach be and the same is amended by deleting the phrase "[NAME OF JURISDICTION]" as such phrase appears therein and inserting in lieu thereof the phrase "the City of Rehoboth Beach".

12 Section 25. Chapter 102, Article VII, Modifications to Existing Building Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001, as amended be and is hereby further amended by adding a new Section as follows: Amendment to Section 112. Section 112 of the Existing Building Code of the City of Rehoboth Beach be and the same is amended by deleting it in its entirety. Section 26. Chapter 102, Article VII, Modifications to Existing Building Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding a new Section as follows: Amendment to Section Section of the Existing Building Code of the City of Rehoboth Beach be and the same is amended by deleting the phrase "Structures existing prior to [DATE TO BE INSERTED BY THE JURISDICTION]" as such phrase appears therein and inserting in lieu thereof the phrase "Structures existing prior to January 18, 2013". FUEL GAS CODE Section 27. Chapter 102, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001, as amended be and is hereby further amended by adding new Article VIII, titled "Adoption of Fuel Gas Code". Section 28. Chapter 102, Article VIII, Adoption of Fuel Gas Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding new Section as follows: Fuel Gas Code Adopted. The International Fuel Gas Code, 2012 edition, including Appendix Chapters A through D, as published by the International Code Council, be and is hereby adopted as the Fuel Gas Code of the City of Rehoboth Beach, in the State of Delaware, and each and all regulations, provisions, penalties, conditions and terms of said Fuel Gas Code are hereby referred to, adopted, and made part hereof, as if fully set out herein. Section 29. Chapter 102, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding new Article IX, titled "Modifications to Fuel Gas Code". Section 30. Chapter 102, Article IX, Modifications to Fuel Gas Code, the Municipal Code of the City of Rehoboth Beach, Delaware, 2001 as amended be and is hereby further amended by adding a new Section as follows:

13 Amendment to Section Section of the Fuel Gas Code of the City of Rehoboth Beach be and the same is amended by deleting the phrase "[NAME OF JURISDICTION]" as such phrase appears therein and inserting in lieu thereof the phrase "the City of Rehoboth Beach". Section 31. The operation of the aforesaid pile drivers during periods when it is prohibited is permitted in emergency situations only if the Mayor and City Manager find that a bona fide emergency exists. Any person who shall violate a provision of this Code, or fail to comply therewith, or with any of the requirements thereof, where no specific penalty is provided therefor, the violation of any such provision of this Chapter shall be punishable by a fine of not less than $50 nor more than $150, such fine to be in the discretion of the court, and such violator shall pay the costs of prosecution. Each day that a violation continues after due notice has been served shall be deemed a separate offense. Section 66. Whenever the City Manager has affected the removal of any unregulated growth or has paid for its removal pursuant to the provisions of this Division, the actual cost thereof, together with additional charge of 20% of the actual charge to defray administrative expenses, plus accrued interest at the rate of 6% per annum from the date of completion of the work, if not paid by the owner or occupier prior thereto, shall be charged to the owner or occupier of such property on the next regular tax bill by the city. Such charge shall be due and payable by the owner at the time of payment of such tax bill.
