1 MINUTES OAK GROVE TOWN BOARD MEETING Monday, December 18, 2017 Town Chair Jerry Kosin called the meeting to order at 7:30 p.m. at the Town Hall. Officials present: chair J. Kosin; supervisors Gary Huppert, Dan Johnson, Debra McClure, and Gene Schommer; treasurer Jeremy Boles; clerk Andria Hayday. (Absent: None.) The town s attorney and numerous members of the public also attended. Minutes. MSC G. Schommer/D. Johnson to approve November minutes as presented; all ayes. Roundtable & Public Comments. Clerk noted a request for membership/support from WTA s Town Advocacy Council (formerly Urban Towns); general consensus to decline. Brief general discussion regarding a driveway/culvert to provide farm-equipment access to a property on 620th (spring project); G. Huppert will follow up. Building Inspector s Report. Reviewed; no formal action. (No damage bonds signed for release.) Treasurer s Report. Treasurer presented Dec. s written report with year-to-date summaries. Noted roughly 1,000 property-tax bills had been mailed, reflecting 1,754 real-estate parcels. No formal action. Bills. Deb McClure noted the $2,800 invoice for town hall/fire station sign is full price; half is due on completion in MOTION by Gene Schommer/Gary Huppert to approve bills as presented with one change, payment for Lebo Sign Works amended to $1,400; motion carried; all ayes. Request for Conditional Use Permit by the Prescott Sportsmans Club, agent Bill Hovel, allowing Private Outdoor Recreation (under Pierce County sec E) at Parcel No , with access from 620th Ave. (Proposed use includes bow and air gun range, hunting/trapping, club gatherings and fundraising events, hunter-education events, other activities.) Jerry Kosin noted the Plan Commission had recommended denial of the CUP, then opened the floor to public comment. Local residents opposed to the CUP spoke on issues of concern, including: Increased traffic and use of high-powered air guns; related safety issues. Proposed firearms-use may open the door to the property s use as a traditional shooting range, with an associated loss of local control and exemption from nuisance laws (under existing state law for shooting ranges). A resident noted that proposed hours of operation are vague and misleading as presented in the CUP application; when individual uses are combined, the range would be open 7 days a week with extended hours. Jerry Kosin read a resident s letter requesting that the CUP (if granted) require a survey of property lines, with a fence and/or visible markings installed to clarify boundaries; further, that the Club be required to provide advance notice and/or posting of Club events. Bill Hovel, agent for the Prescott Sportsmans [sic] Club, noted that he had provided expanded detail in the amended CUP application ( ); he would let it stand for consideration as-is. Discussion by board members followed. Dan Johnson referenced sections of the Comprehensive Plan that are contrary to the CUP, noting he represents the interests of Oak Grove citizens, the majority of whom oppose the proposal due to the negative impact of shooting and increased traffic. He added that the proposed turkey shoots were of specific concern, questioning their potential consequence relative to shooting-range laws. He asked that the town s attorney review the proposal and offer guidance.

2 Gary Huppert questioned whether the proposed bow-hunting activities may also have future or unintended implications for the Town. Gene Schommer noted the County had denied the club s previous CUP request for a shooting range because it was not an appropriate use for the location and/or Oak Grove. Town attorney Ron Siler stated he would review the proposal and could offer advisement to the board at their January meeting. MOTION by Dan Johnson/Gary Huppert to table discussion until the January 15 board meeting, at which time the Town s counsel could offer an opinion; motion carried unanimously. January Town Caucus. MOTION by G. Huppert/D. McClure to schedule the Town Caucus for 7 p.m. on January 15; 2018 (preceding the board meeting} with an alternate time/date of Saturday, January 20, 11 a.m., should an alternate be needed due to severe weather; motion carried, all ayes. Election Inspectors. The clerk outlined state rules for poll-worker assignments and presented a list of proposed appointees with input by chief election inspector Kerry Reis. The local Democratic Party formally submitted one name to the chair in November. MOTION by Dan Johnson/Gene Schommer to approve the list as presented; motion carried unanimously. Fire/EMS. No formal action. (D. Johnson noted citizen-member appointments to the Fire/EMS board would be made later.) Service Contracts Animal Control and Shelter. Debra McClure noted modest increased rates for K. Pelnar, the animal control officer (transport). The board also reviewed proposed changes in the 2018 contract with Mally s Sunshine Kennels for sheltering strays, including spay/neuter costs. Debra recapped alternatives for sheltering strays; recommended contracting services from Mally s for at least 6 months. She noted the relationship between Mally s and Gregory s Gift of Hope, which continues to care for two strays found in the Town (at private cost). Dan Johnson requested changes to the liability language in the proposed 2018 contract, and asked that asterisked items be shifted above the signature line; D. McClure will follow up with Mally s. It was noted that Dec. bills included an annual shelter fee; the revised contract allows semi-annual payment. General consensus: hold payment until the shelter contract is completed, with discussion tabled until the January meeting. (No formal action.) Roadside Tree-cutting. J. Boles requested clarification of winter/early spring 2018 Town work assignments on behalf of CreekSide Services. Board members discussed ditch/roadside maintenance and prep work on 620th Ave., other areas. Gary H. noted work should be restricted to the right-ofway; the work assignment includes areas around all street signs on corners; work is to be completed by spring, weather permitting. (Discussion with general consensus; no formal action.) Code Book Updates. Clerk recapped progress on creating an editable Word file of the current Code Book (as necessary first step toward red-lining proposed updates for board review). Requested any re-typed sections that may be available from the prior plan commission s work sessions. No formal action. Meeting adjourned at 8:34 p.m. (MSC by G. Schommer/G. 4 Town of Oak Grove Planning Commission Meeting- December 14, 2017 Minutes 1. Call to order. The meeting was called to order by Chairman Jerry Kosin at 7:31 pm. Roll Call. Jerry Kosin, Gene Schommer, Jim Boles, Ben Huppert, Nate Green, Michelle Huber, and Mary Bolin all present. (Nate Green arrived about 30 seconds after roll call) 2. Minutes of Prior Meetings. Minutes for Nov. Planning Commission meeting reviewed Motion: Motion made by Ben Huppert to approve minutes for November meeting; second by Nate Green. Motion carried. 3. Public Comments: Items not on the current agenda may be briefly discussed or submitted as an item for future agenda. No formal action may be taken. Approximately 50 or so residents in attendance of meeting. No public comments. 4. Request by the Prescott Sportsmans Club, agent Bill Hovel, for a Conditional Use Permit allowing Private Outdoor Recreation (per Pierce County sec E) at Parcel No , located at the SE 1/4 of the NW 1/4, Sec. 6, T26N, 19W of Oak Grove, with access from 620th Ave. (Proposed use includes bow and air gun range, hunting/trapping, club gatherings and fundraising events, hunter education, and other activities.) a. Board Chair Jerry Kosin asked Bill to review updated, more detailed version two of proposed use. b. Bill Hovel read the version two proposal (which is 11 pages and available online or through Plan Commission secretary) He mentioned that it was uploaded to the Oak Grove website. He stated that the initial version was summarized and version two was more detailed. c. Jerry said he knows there was concern the last time about hunting and firearms. He asked if anyone wants to ask any questions about the hunting. d. A resident stated it is now legal to use rifles for deer hunting, 22 caliber can go more than a mile. It is now legal to use rifles for deer, would you be using rifles on that property? e. Bill stated I would say if it s legal to use through the DNR then yes. f. A resident stated My personal opinion, legal does not make it right. You are within shooting distance of two farms, residence who enjoy walking outdoors, horseback riding, enjoying the peaceful countryside, stuff like that. You are also 1

5 talking about inexperienced youth or kids, inexperience leads to mistakes, which leads to accidents. You are talking about 22 caliber that can go a mile, or even 45 caliber air rifles, I don t think that s a wise decision at that location. g. Bill replied Uh-huh h. Jerry stated The numbers of proposed hunters on that property at one time was five, I asked to cut it down to three i. Bill interrupted I figured four was just about right. j. Jerry stated You don t really have that much room there to hunt k. Bill stated Uh-huh l. Jerry stated I think maybe three would be better but it s not up to me to say m. Jerry asked Are we talking about just deer hunting or are we talking about rabbit or squirrel hunting because those seasons are a lot longer than deer. n. Bill stated Yes, anything the DNR allows o. A resident stated that he did not feel it was cool that the number of deer for the existing residents to hunt on their own property would go down significantly. 50 people all taking turns in that small location does not leave us many deer. I ve been hunting on my land almost my entire life. p. Jerry stated that there is probably only about 8 acres of area or maybe less that can be hunted on that land. q. Jerry stated that he has more of a problem with the other seasons; coyotes can be hunted year round for example, so really you could be hunting out there anytime, all year round. r. Bill stated Any changes that you want us to make, I assume will be on the recommendation, that s my understanding. s. Jerry said if there s a recommendation made tonight. t. Bill stated Right, that s what I mean. What more details do you need tonight for your recommendation? That s what I m trying to get to u. Jerry stated I don t know for sure about what other s think, but it sounds like they are not going to want people to be able to be out there hunting anytime, like I said there s some things that. v. Bill interrupted That s why you put in the recommendation saying that you don t want hunting there, or do you just decline it saying you don t want any of it? w. Jim Boles asked about the clubhouse, it says in five years they hope to have that built. x. Bill said Yes y. Jim stated So would you do classroom experience with students at the clubhouse? 2

6 z. Bill stated No, the classroom experience would still need to be done at the school, the outdoor experience would be there. aa. Jim stated So for the first few years there wouldn t be a lot going on there. bb. Bill stated maybe, not for classroom activities cc. A resident sated You re not saying there won t be, you re saying there might not be, you re still going to have people shooting out there in addition to having the kids shoot there and shooting during all of the different hunting seasons all throughout the year dd. Bill replied yes ee. A resident stated And you still want alcohol out there too? ff. Bill replied I assume gg. Inaudible discussion, Jerry stated One at a time hh. A resident brought up concern for traffic at the intersection on HWY 10 and 620 th Avenue, stating it s a very dangerous intersection and if any kind of business would be added to 620 th Avenue that something would need to be done to fix that. ii. Another resident stated that that would be bringing a lot of people out there, which means an awful lot of traffic. jj. Jerry stated that after thinking about it, he realized that really with the proposed use they would be able to hunt out there 365 days a year, so we would need to get that changed. kk. Bill stated Then you put that in your recommendation, you put that in your notes ll. Jerry stated Even deer hunting can extend quite a while mm. Bill stated Keep in mind we re only talking about 4 people at a time and 4 days during the week is all. nn. Mary Bolin stated You ve got regular meetings once a month generally between 7-10 pm, then general outdoor activities, what does the general mean? oo. Bill stated it could start at 6:30, could start at 7, I doubt it would stay that way. pp. Jerry stated I don t think you had a time on board and committee meetings qq. Bill stated I do have a time under the operational section rr. Jerry asked, if hunting was allowed, and you re thinking about up to 12 gauge? ss. Bill stated anything allowed by the DNR tt. Jerry asked So that s about anything? uu. Bill replied Yes, pretty much vv. Jerry had Bill read Section Two of his proposal ww. A resident asked a question about having the described activities, does that classify you as a shooting range? xx. Bill replied I don t know on that one yy. Another resident stated, I would like to address that because I m far more concerned about the turkey training, because the Wisconsin statute does define a sport s shooting range as an area that is used to shoot firearms. Because once you are established as a shooting range, which is what you are talking about-you are free from any zoning regulation, you are free of any lawsuits or liability of any nuisance, noise, accidents, etc.. What you are talking about fits right into that definition. An area designed and operated 3

7 for the use and discharge of firearms. Once you get your foot in the door you are free to do all kinds of things. zz. Another resident stated: You re talking about shooting shotguns, how many people are you talking about having shooting at one time during these turkey shoots? aaa. Bill replied 10 to 25 depends on how many participants sign up. bbb. Another resident stated, it sounds like we re talking about the same thing as last year and it was already determined that that location was not good due to the floodplain there. ccc. Inaudible talking-jerry One at a time Jerry hit gavel. ddd. Gene Schommer I just want to say, you put stations in there, so I want everybody to understand, then you say no more than 5 shooting at a time, so if you ve got five stations, 5 people shooting, so you could have 25 people shooting at one time. eee. Bill replied we would only have one set of targets. We re not going to have a station at every building we re not going to do that. Well, most of the time on bows, you could have them all shoot at the same time. We would have one station for bows, one for guns. fff. A resident stated: I have looked at the hours of operation, and the days of operation and if you add them all up for each of the different activities, you basically have shooting going on almost all of the time. There s no summarized list showing at all together. It looks like this will be open every day of the week for several hours every day. ggg. Bill replied: The hours of operation will be between the hours of 7am and 10pm and 12am on weekends, limited to six times annually for the 12am events. hhh. The resident asked, so when will the range be open? iii. Bill replied: The range? The range will only be open two days a week. jjj. Jerry asked: Maybe a better question might be how many days a week will there be NO activity there? kkk. Bill replied: How many days? Depends on hunting season, there might not be any days with no activity going on there. lll. Jerry confirmed-so in other words, there could be something going on there all the time. mmm. Bill replied: There could be. nnn. A resident asked about plans for a pond, how many acres do you have out there? Are you planning on buying more land? ooo. Bill replied: Not at this time. ppp. A resident said: They ARE going to buy more land, I already heard this. qqq. Jerry stated: There s 50 acres next to that land, are you planning on buying that someday? rrr. Bill replied: Not right now, no. sss. Jerry stated, there s also the Town s Comprehensive Plan, Section nine, I don t know if you ve read that. Also the Special Events ordinance. ttt. Bill replied Yes. 4

8 uuu. Gene stated: A lot of this stuff sounds like it might fall under the Special events ordinance. vvv. Bill replied: Yes www. Gene stated: You re not going to be given anything special over someone building a home, just so you understand that, this is what it is. xxx. Bill: Yep yyy. Jerry stated: One of the things that we have in our Special Events Ordinance is that the noise has to be contained and I don t know how you re going to be able to do that if you re going to be doing all of that shooting. zzz. One resident stated: No matter how you look at this, this is still a shooting range and I don t want a shooting range in my backyard. aaaa. Gene: The disturbance is going to be there bbbb. Jerry stated: The DNR guidelines for you guys, not for the general public but for you guys is very wide open, so I don t know how we could make some changes to that. cccc. Jerry asked: For the C02 guns, are you going to have a caliber limit on them, because I understand they use them in Texas to shoot wild boars so there s got to be some that are pretty powerful. dddd. Bill: These are just going to be shooting at targets. eeee. Jerry: Well we ll have to have that in there, what caliber you re going to use. ffff. Jerry: Did anyone do any checking on the caliber of these air guns? gggg. A resident: They run up to 50 calibers last time I checked. hhhh. Bill to Jerry: You re going to put that in your comments. iiii. Mary Bolin: Do we need to write down all of these things when we make a recommendation or do we just approve or not approve? jjjj. Jerry: We need to sit down and talk about all of these things and decide what caliber of gun they are going to be allowed to use for practice or for training, how we want to change the DNR regulations to fit how Oak Grove does things. kkkk. A resident asked : If we take this all apart and say you can do this and you can do that who is going to police it? Who is going to be there to say you can t use that gun? llll. Jerry: That s a good point because the people who are up there at the county, those people only work during the day, limited hours, so that s another thing to think about. Who is going to be watching you guys? Sure on Monday morning we can call them. If this were ever to go through, we would need to trust you to do it right. I have had incidents with them when we have had to deal with issues with the compost sight mmmm. Bill interrupted: That s the city, that s not me. nnnn. Gene asked Mary Bolin if she had something she wanted to say. oooo. Mary: My understanding is that we have an application for a conditional use permit that we have to make our recommendation to the town board on. My understanding is we approve it as it is, or don t approve it as it is. It s not our job to go through each point, it s their job to do that. pppp. Jerry, that s right but he has to get some direction on how to more forward. 5

Bill: It s my understanding that based on the recommendation that the town board makes, there s a spot at the bottom that says based on suggestions or recommendations, so if there are suggestions or recommendations that you wanted added to this, they take that into account when they make their recommendation or decision. rrrr. Mary: So we make our recommendation to approve or deny it.. ssss. Bill interrupts: You can say we re only going to approve it if these conditions are made. When I talked to the county they said to write down everything I want to do on that property, then the town will make their recommendations of what they want changed or added. tttt. Jerry: We ll have to have at least one or two more meetings just to find out what we want in there. One of them is deed restriction. You don t have anything in there about deed restriction and we talked about that at the last meeting. uuuu. Bill: What s the deed restriction? vvvv. Jerry: There would never be any gun range or shooting range on that property. wwww. Bill: You can put that in your comments to the county. This is a conditional use permit, not things we want to do or not do on the property. So if there are things you want or don t want us to do, that should come on your suggestion. xxxx. Jerry: Well that was our suggestion. yyyy. Bill interrupts (inaudible) zzzz. Jerry: We won t make a recommendation tonight unless we know you re going to go with a deed restriction. aaaaa. Bill, you would push it through.. bbbbb. Gene: You re getting carried away, excuse me but we can just say no too. ccccc. Mary: That was my understanding ddddd. Gene: With my experience with the sand mining, we did say no and when it went through the county, they said yes. If that happens again I think there would be a lawsuit. We shouldn t be overruled anyway, this is your area and my area and that s what it is today. eeeee. Mary: Yes, that was my understanding fffff. Jerry: I guess we ll be talking about this for more than tonight. ggggg. Gene: Should we let Bill finish? hhhhh. Bill reads next section of proposal. iiiii. Jerry: For the 12am time, what are you proposing you re doing there at that time? jjjjj. Bill: Camp fires kkkkk. A resident: What about these five pavilions? What will they be sued for? lllll. Bill: Maybe bat houses or houses, something for the kids to do at some point down the road. One could be for bow range, another one could be for an air soft range, another one could be a place we have for a garden for members, fun things whatever you wanted, apples. We could sell them someday, whether we sell them there or if we ever put in a pond it would be nice to put in two duck blinds down there. 6

10 mmmmm. Resident: What about out buildings? nnnnn. Bill: No, just the buildings we talked about then the clubhouse. ooooo. Michelle Huber: You mentioned two parking lots last time? ppppp. Bill: yes, the future, someday have a parking lot up by the clubhouse, then another one down closer to the compost sight. qqqqq. Resident: So you re talking about a clubhouse, these five pavilions, two parking lots and a pond, you re kind of running out of space aren t you? rrrrr. Bill: Maybe sssss. Resident: I didn t hear anything about a well or septic system, you re going to have all of these big meetings, are you going to rely on a porta potty on a day like today with sub zero temps? ttttt. Bill: For the conditional use permit we wanted to the county can t give an example of how it should be filled out because it s brand new, I thought I wanted to present to them what our long term goals are, I put the buildings on there to give them a flavor of what we re thinking long term. Once we start constructing a building them we have to get the permits and stuff for the wells and septic. uuuuu. Resident: Considering you re right on a floodplain there, where is your septic going to be? I mean how far away from a flood plain does a septic system have to be? vvvvv. Bill: Most of the regulations are that s it s flat, on a certain percent grade on your property, you have a contractor on it. wwwww. Jerry read a letter from resident Krista Claude with concerns about Sportsman s club posting events in advance on Facebook page to let people know about them, and is also concerned about increased traffic to and from the property. xxxxx. Jerry: Since she is not here, she does not realize there could be stuff going on every day. Her letter also says she requests they survey property and indicate exact property lines with a fence line to keep participants within the property lines. yyyyy. Resident: Do you expect memberships to grow? zzzzz. Bill: Right now we have plateaued, right now were staying about the same. I woud say we re at about 50. aaaaaa. Michelle Huber: DNR Best Practices for Shooting ranges requires a safety officer to be present during any live shooting. bbbbbb. Bill: We ll have members present at all times. cccccc. Michelle: Are they safety officers? dddddd. Bill: Members present at all times. Safety officers-no, I don t have that available. eeeeee. Resident: Inaudible ffffff. Bill: I m not sure, I m not well versed in hunter safety. gggggg. Resident: So what you re proposing is that the kids would come to you for hunter safety instead of going where they go now. hhhhhh. Bill: Inaudible iiiiii. Resident: So they will be able to shoot anything at all? jjjjjj. Bill: Correct 7

11 kkkkkk. Resident: If you have this hunter s training, non-members will be shooting there. llllll. Bill: Right now I don t have it in this permit but it will depend on the recommendation. mmmmmm. Plan Com. Member (Jim Boles?) When I was a kid, I took my 22 on the school bus, we did hunter s safety in the back, took it to school with me and we all took turns shooting. (some of this was inaudible, please correct) nnnnnn. Jerry: I think the other night things were going pretty good (at the last meeting) until you started talking about shooting, then things went sour. So we started talking about the deed restriction. I think you said no. It that still your answer on the deed restriction? oooooo. Bill: Uh-huh pppppp. Resident: What does that mean? qqqqqq. Jerry: The deed restriction would be that there was no gun range, trap range, or shooting range of any kind on that property. rrrrrr. Resident: Clearly the goal for them is they want shooting on this property. ssssss. Resident: If they don t agree to put that on the deed then none of us here are going to agree to anything they propose. tttttt. Resident: We have been very clear with you that we do not want you there! Yet here we are again! uuuuuu. Bill: Uh-huh vvvvvv. Resident: We are telling you that this is annoying. wwwwww. Bill: I don t understand what you are trying to get to. xxxxxx. Resident: We have always been very clear to you from the beginning of this that we do not want it, yet here we are missing our children s Christmas concert at the school because we have to fight this shooting range! yyyyyy. Resident: Breaking up our vacation to tell you the same thing! zzzzzz. Resident: Our opinions have not changed! We don t want any shooting on the property that you bought, yet you keep saying well we ll just do this little bit, the definition of a shooting range is a facility that an area designed and operated for the use and discharge of firearms, what you are asking for is a gun range! AND once you have a gun range, I m pretty sure you re planning on expanding it! That s my opinion. You have said you don t want the property unless shooting is included in that. None of us here wants shooting on that property! Which is why I said we are being very annoyed by having to come here tonight, once again to give you an opinion that you already know! How can you just sit there and shake your head? I just don t get it. You know nobody wants you there! aaaaaaa. Bill: Uh-huh bbbbbbb. Resident: You keep expecting us to not show up we re gonna keep showing up! ccccccc. Resident: I m really upset that I m missing my son s Christmas concert tonight. ddddddd. Jerry: What you re saying is that you don t want any shooting there. 8

Mary Bolin: In looking at this, they are looking at picnics or planting, gardening things like that. They should maybe reconsider the Conditional Use Permit because some of these things sound more like a special event. Not a conditional use permit, I just don t see that. It says here in the Comprehensive Plan that we consider conditional use permits Only when the proposed use will not conflict with or negatively impact the use and enjoyment of nearby or surrounding properties and land uses, and they are all saying they don t want it so I don t see how we could approve this the way it is, but if they want to come back and do a Special Events permit, that seems more appropriate. That would make sense to me. lllllll. Jerry: They would have to decide what the special event would be. That stuff is all covered in our comp plan too. mmmmmmm. Gene: Looking at the Special Events Ordinance, they have to come 60 days prior to the event and apply to get approval from the board. A lot of the things in her, I would say 99.9% is going to fall into this Special Events Ordinance. It was designed to address specific things, traffic control is one, parking is one, it s all in there. nnnnnnn. Jerry: Well I don t know as a committee how you want to handle this but I m not prepared to fill out a CUP on this tonight because there s going to be pages of stuff, and this committee is going to have to sit down and decide what they want to put in there. I m not prepared to say no or yes, but here s all of the things we don t want. ooooooo. Michelle Huber: Isn t what Mary read, chapter 9 goal one of the Comprehensive Plan, isn t that a good answer in itself? I mean would that be acceptable to the board? I don t know, I m just asking. ddddddddd. Jerry: Mary, I hate to argue with you, but I think what s going to happen is they are going to ask which one of these do you not want. At some point along the way, we re going to have to decide which one of these bullet points there s a problem. What the people have a problem with, not us. Jerry: Well that s the one from the other night. We need to go through the comp. plan, and the special events and we sit down and have a discussion about it. iiiiiiiii. Gene: It makes sense Jerry, but take the shooting out, you can teach the kids classroom stuff, but as long as there s shooting Last year when you proposed this, I asked people who said they wanted this, ok, we ll put it right behind your house, then they said no way. It s understandable with the noise and disruption. You can do what you want, but if Mary says we re going to say no because we re not going to allow shooting, make that recommendation to the board, then we ll have to sit up there and do something, but I don t know what we ll gain by going over all of these again. We should not be like some of the politicians out there, common sense tells me, I can see why you don t want it. Jerry, you re right we re going to have to have something on paper that explains to the county. mmmmmmmmm. Mary: I ve been thinking that if I made motion that we deny the request for this CUP. The reason is we do not want any shooting, that s not an option, and that they can apply for a special event permit for any activities that they want to try to organize. nnnnnnnnn. Nate Green: So just to clarify, do you mean no guns at all? ooooooooo. Mary: No shooting, no guns, no bows and arrows, nothing. ppppppppp. Resident: I think we need to talk about the traffic concern then. qqqqqqqqq. Jim Boles: Well if you have a clubhouse you re going to have the traffic. rrrrrrrrr. Ben Huppert: Even without the guns, you re still going to have the same traffic potentially. sssssssss. (inaudible discussion) ttttttttt. Resident: I live right on the corner where they would be turning and that s a very bad intersection, I turn there everyday going to and from work and there have been lots of accidents there, but I also want to say that what they are trying to propose is a shooting range facility and anything that they can do to get their foot in the door, once they do that and get established, they are immune to any kind of control with the shooting range protection act. To me, that s the thing I m most concerned about. uuuuuuuuu. Jerry: here s how I feel about it, I don t think we should make a recommendation tonight. I think everyone should look through this, unless you feel confident, maybe there s more than guns that you have a problem with, and if we just say guns, or shooting, this document will go to the county, and if it just says no guns or shooting then the rest of this is going to be o.k. d. If we make a recommendation to the board that we ok this thing. vvvvvvvvv. Mary: No I m saying we do NOT recommend this thing. I m saying we recommend this be denied. I think I m going to make a motion and you can second it or not. 12

The reason is we do not want any shooting, we don t want any of the public or private events that they are proposing, it would negatively impact the surrounding residents and property owners and it would be contradictory to the comprehensive plan. Officials present: chair Jerry Kosin; supervisors Gary Huppert (roads), Dan Johnson (fire/ems), Debra McClure, and Gene Schommer; treasurer Jeremy Boles; clerk Andria Hayday. (Absent: None.) Plan commission member M. Huber and members of the public also attended. Minutes. MSC by G. Schommer/D. McClure to approve October minutes as presented; all in favor. Roundtable & Public Comments. G. Kosin noted issues caused by extended parking on cul-de-sac in Diamond Bluff Estates. Upcoming county roads meeting was briefly discussed; G. Huppert may draft a projects list. D. Johnson: Prescott Area Fire & EMS will contribute $500 toward town hall/fire station sign. River Falls former EMS director has accepted new position with city; interim director has been named there is no resulting change in service or commitment to Prescott Area Fire & EMS. Clerk distributed Town brochure for posting to town website, requested feedback. G. Schommer noted two items for future agenda: landowner request for a field approach on 620th (farm neighboring Zirul property); field use/planting plan for town hall acreage. General discussion of town hall signage spring installation, exact post position TBD. Public comments: None. Building Inspector s Report. Reviewed; no formal action. One damage bond submitted for release. MSC by McClure/Huppert to approve release of the Oestreicher construction damage bond; all ayes. Treasurer s Report. Treasurer presented monthly figures and projected year-end amounts. Brief discussion of snowplowing costs for town roads (estimated $2K per minor snow event, up $8K or more for severe/heavy events). No formal action. Bills. Discussion: General consensus that the CenturyLink bill should be routinely paid via debit card to sync with bill cycles. MSC to approve this month s bills as presented with addition of $50 reimbursement to D. McClure for a workshop refund (WTA already refunded the town); all ayes; motion carried Budget. MOTION by Deb McClure/Gary Huppert to adopt the proposed 2018 budget as presented at the budget hearing, with an adjustment to decrease general expenditures by $1,000 and add the same amount to computer expenditures in working/detailed budget; all ayes. Lewis Driveway Variance. Discussion: Request by John and Monica Lewis to waive OG code sec (whereby private roads or accesses that service 3 or more residences must meet Town road standards) for a proposed home at parcel (Lot 2), with existing shared driveway off 485th. Chair noted the Plan Commission s recommendation to approve the variance with stipulations. Neighbor/Lot 2 owner/seller M. Jonikas spoke in favor of the variance and presented supporting documents. Dan Johnson noted fire truck/ems will have safe access via existing driveway (requested tree limb be trimmed). It was noted that the proposed third home/lot 2 is near the shared drive s onset and would not impact turnaround at the end. MOTION by Gene Schommer/D. Johnson to grant the waiver of Oak Grove Code Section to John and Monica Lewis, allowing them to build on Lot 2, with the condition that landowners have a recorded maintenance agreement for the shared driveway; motion carried, all ayes. 609th Avenue Snowplowing. Board discussed access/turnaround issues resulting from alterations to the right-of-way by homeowner Lareine Jechort. County snowplows can no longer service this road for the Town. Ms. Jechort described drainage problems that prompted her changes. Option of returning the roadway to its original conditions at homeowner expense was briefly discussed. Chair explained the immediate need for snowplowing arrangements, and stated a private contractor had agreed to plow 609th for a $50 flat charge per visit; of which $15 would paid by the homeowner (usual/prior cost for county plowing estimated at $35). The Town will bill Ms. Jechort for her portion. Ms. Jechort indicated

19 agreement. MOTION by Gary Huppert/Dan Johnson that Lareine Jechort has agreed to pay $15 for each plow of 609th Ave. during the winter season; motion carried, all ayes. 609th Ave. Request to Vacate. Homeowner L. Jechort expressed interest in having 609th vacated by the Town (made private), as hers is the only residence currently accessed via the roadway. Board members noted that vacating the road was not assured and would be a lengthy process involving attorney fees, public input, and the participation of other landowners whose parcels border 609th. (Several of those landowners were also present.) Chair noted associated costs would be borne by the requestor. Ms. Jechort stated she would investigate further before asking the Town to proceed. No formal action was taken. Prescott Sportsmans Club CUP (620th Ave). Brief discussion; no formal action. (CUP request is slated for further consideration by the plan commission in December.) Chair noted that Oak Grove s special events ordinance may come into play for the club s proposed fundraising events. 1090th St. Improvements. Gary Huppert recapped survey/design reports by CBS Squared: Estimated costs to re-engineer the curve are prohibitive. Other improvements for safety and increased visibility at the curve/intersection with 550th Ave. were discussed (including ditch work, tree removal, relocation/removal of fence in right-of-way). Gary H. also presented letter with county estimate for 36- inch culvert; Bridge Aids may fund the project, earliest work would be next spring. No formal action. Brush Truck. Dan Johnson outlined the fire/ems association s request for a new brush truck: under current agreement with municipalities, this expenditure by the association requires approval by two of three Towns served. MOTION by Gene Schommer/Gary Huppert to acknowledge and approve the $75,000 brush truck purchase by the Prescott Area Fire and EMS Association; motion carried, all ayes. Tax Collection Bond. Discussion of statutory change requiring a higher amount for this year s municipal tax collection bond, and the alternative, i.e., to pass an ordinance waiving the surety bond requirement (with Town self-insuring). MOTION by Debra McClure/Dan Johnson to authorize the Treasurer to spend up to $500 to secure the tax collection bond; motion carried/all ayes.
