C. CONSENT AGENDA Discussion: A request was made to remove #R Approving Application to Acquire State Funding Through the Knowles-Nelson Stewardship Grant Program from the consent agenda. There were no objections. Action: MOTION BY ZRINY, SECOND BY PEEK, TO APPROVE AGENDA ITEMS 7 12 (a)a AS LISTED ON THE CONSENT AGENDA. MOTION CARRIED ON A ROLL VOTE, As part of the consent agenda, minutes of the June 15 and 20, 2017 meetings were approved. The bills and communications were referred to respective committees. The Clerk was authorized to issue orders, bills and claims from the last session through this session. The following claims were denied, Ordinance #O was enacted, and Resolution #R was adopted. 3 CLAIM Chad A. Erickson and Kelly J. Erickson On or about October 19, 2016 the undersigned, Chad A. Erickson and Kelly J. Erickson, of F1306 County Road N, Edgar, Marathon County, Wisconsin learned of injury and damage to their land and improvements at F1306 County Road N, Edgar, Marathon County, Wisconsin which are respectively their personal residence and their shop and office building. The damage to their residence and their shop and office building include the contamination of both water wells located upon those properties as the consequence of a nuisance maintained on nearby property owned by Marathon County and located at W4165 Hwy 97 N., Edgar, Marathon County, Wisconsin and commonly identified as Marathon County Highway Shop (2). Upon information and belief the County maintained an unenclosed and unprotected pile of road salt in violation of the Environmental Protection Rules as a public nuisance. The damage caused to the property is due to salt/chloride in two private wells located upon claimants properties, one a residence and the other a shop and business offices causing contamination to the groundwater in violation of public las NR Table 2 Environmental Standards. The levels of contamination in claimants wells are respectively as the shop and office building as much as 715.6(mg/L) or (mg/l) in excess of the limit and as to the residence as much as 771(mg/L) or 521(mg/L) in excess of the limits. This salt contamination was in direct violation of NR , Table 2, Public Welfare Groundwater Quality Standards. CHAD A. ERICKSON AND KELLY J. ERICKSON ATTACHMENT Memorandum dated July 14, 2017 from Corporation Counsel Regarding: Formal Disallowance of Salt Claims Marathon County has submitted these claims to the county s liability insurance carrier, Wisconsin Municipalities Mutual Insurance Company (WIMMIC). The insurance carrier has denied coverage due to an exclusion in the policy for environmental pollution. For the reasons set forth below, it is the recommendation of Marathon County Corporation Counsel to County Board to formally disallow claims. Formal disallowance will limit claimants time in which to bring suit to six months, pursuant to (1g), Wis. Stats. 1) While it is acknowledged that Marathon County stored road salt uncovered at the Stratford Highway shop, causation of the damages claimed and the validity of damages claimed are unproven. 2) The Wisconsin DNR ordered testing of wells, but has determined that no further remediation by Marathon County is necessary due to the: a. Nature of the pollutant (i.e. salt), b. Levels of sodium and chloride present at the site, c. Stability of test results. 3) Review of the claims reveals they are not in compliance with the requirements of , Wis. Stats.

Borchardt, of F1367 County Road N, Edgar, Marathon County, Wisconsin learned of injury and damage to their land and improvements at F1367 County Road N, Edgar, Marathon County, Wisconsin which is a farm residence and a farm business property. The damage to their residence and farm business included the contamination of both water wells located upon the premises. The house well being identified as Well A and barn well as Well B. The contamination located upon those properties and to the wells was a consequence of a nuisance maintained on nearby property owned by Marathon County and located at W4165 Hwy 97 N., Edgar, Marathon County, Wisconsin and commonly identified as Marathon County Highway Shop (2). Upon information and belief the County maintained an unenclosed and unprotected pile of road salt in violation of the Environmental Protection Rules as a public nuisance. REPORT AND ORDINANCE Town of Hewitt Rezone The Marathon County Land Conservation and Zoning Committee, having considered on July 5, 2017, the petition to amend the General Code of Ordinances for Marathon County Chapter 17 Zoning Code filed by Jonathan Shanak, Maralee Shanak, and Nicholas Shanak to rezone two pieces of property in the Town of Hewitt, first being to rezone from Heavy Industrial (H-I) to General Agriculture (GA); the following described lands: PIN# on property described as the S ½ of Govt Lot 24, located in Section 18, Township 30 North, Range 9 East; second property to rezone from Heavy Industrial (H-I) to Residential Estate (RE); the folloiwng

5 described lands: PIN # on property described as the N ¾ Govt Lot 1, except the east 2 rods, further excepting the property described in Certified Survey Map Vol.53 - Page 99 and further excepting the north feet and including the west feet of the south feet, located in Section 19, Township 30 North, Range 9 East, and having held public hearing thereon, pursuant to Section 59.69, Wisconsin Statutes, notice thereof having been given as provided by law, and being duly informed of the facts pertinent to the changes proposed and duly advised of the wishes of the people in the area affected, hereby recommends the petition be granted as applied for. LAND CONSERVATION AND ZONING COMMITTEE ORDINANCE #O WHEREAS, the Marathon County Board of Supervisors has heretofore been petitioned to amend the General Code of Ordinances for Marathon County Chapter 17 Zoning Code; and WHEREAS, the petition has been referred to the Marathon County Land Conservation and Zoning Committee for public hearing; and WHEREAS, the Marathon County Land Conservation and Zoning Committee, on due notice conducted a public hearing on the proposed amendment, and filed their recommendation with the Board; and WHEREAS, the proposed amendment has been given due consideration by the Board in open session; NOW, THEREFORE, the County Board of Supervisors of the County of Marathon does ordain as follows: The General Code or Ordinances for Marathon County Chapter 17 Zoning Code (and accompanying Zoning Map) is amended in the following respects: To rezone two pieces of property in the Town of Hewitt, first being PIN# on property described as the S ½ of Govt Lot 24, located in Section 18, Township 30 North, Range 9 East: Be rezoned from Heavy Industrial (H-I) to General Agriculture (GA). Second property PIN # on property described as the N ¾ Govt Lot 1, except the east 2 rods, further excepting the property described in Certified Survey Map Vol.53 Page 99 and further excepting the north feet and including the west feet of the south feet, located in Section 19, Township 30 North, Range 9 East: Be rezoned from Heavy Industrial (H-I) to Residential Estate (RE). Dated this 5th day of July, LAND CONSERVATION AND ZONING COMMITTEE RESOLUTION #R Change in Supervisory District Boundaries Resulting From Village of marathon City Annexation WHEREAS, the revised reapportionment statutes 59.10(4)(c) allow the County Board to consider changes in the boundaries of supervisory districts based on Annexations which occur after passage of the 10-year county reapportionment plan; and WHEREAS, duly annexed property described as lands located in the SE¼ of the NW¼, the SW¼ of the NE¼, the SE¼ of the NE¼, part of the NW¼ of the SE¼, the NE¼ of the SE¼, of Section 35, and the NW¼ of the SW¼, the NE¼ of the SW¼, the SE¼ of the SW¼, and part of the SW¼ of the NW¼, the SE¼ of the NW¼, the NW¼ of the SE¼, and the SW¼ of the SE¼, of Section 36, Township 29 North, Range 5 East, formerly in the Town of Rib Falls, Marathon County, Wisconsin should be include in Supervisory District #33, there being no electors residing therein; and WHEREAS, exact maps of the above-described parcel, along with a certified copy of the Village of Marathon City ordinance, have been duly filed with the Clerk of Marathon County; and WHEREAS, changes in said supervisory district boundaries are allowed by law, provided that the total number of supervisory districts is left unchanged; and

6 NOW, THEREFORE, BE IT RESOLVED that the County Board of Supervisors of the County of Marathon does ordain as follows: That the above-described duly annexed property, now within the Village of Marathon City is hereby include in the supervisory district enumerated above. BE IT FURTHER RESOLVED that the Marathon County Clerk is hereby directed to forward all notices required under Chapter 59, Wisconsin Statutes, to the Wisconsin Department of Administration, Municipal Boundary Review, for the purpose of advising that office of said boundary changes. Dated this 18 th day of July, 2017 COUNTY BOARD OF SUPERVISORS The above Claims were denied, Ordinance #O was enacted, and Resolution #R was adopted as part of the consent agenda. RESOLUTION #R Approving an Application to Acquire State Funding Through the Knowles- Nelson Stewardship Grant Program WHEREAS, the Human Resources, Finance and Property Committee, Environmental Resources Committee and the Forestry/Recreation Committee recommends approving an application to acquire funding through the Knowles-Nelson Stewardship Grant Program; and WHEREAS, the landowner of 120 acres in the E 1/2 NE and the NWNE of Section 29, Township 28 North, Range 7 East, Town of Rib Mountain, Marathon County, Wisconsin has indicated they are interested in selling the property and is willing to work with the County on a transaction; and WHEREAS, the County Board has the authority to acquire said property for the purpose of establishing County Forest land pursuant to SS Wis. Stats; and WHEREAS, said Stewardship Grant Program may provide funding up to 50% of the acquisition price; and WHEREAS, balance of funding is available from the Forestry Segregated Land Purchase and State Aid Accounts; and WHEREAS, acquisition of this property would perpetually provide forest products to our local economy, revenues to the County, outdoor recreation opportunities to the public, and improve property administration on the County Forest; and WHEREAS, the leadership of the Town of Rib Mountain supports the County acquiring the property; NOW, THEREFORE, the Board of Supervisors of the County of Marathon does hereby ordain and resolve that the County request grant funding available from the Wisconsin Department of Natural Resources under the Knowles-Nelson Stewardship Land Acquisition Grant Program HEREBY AUTHORIZES the proper County officials to act on behalf of Marathon County to submit an application to the State of Wisconsin for land acquisition grant funding; negotiate, and secure an appraisal on the above described property. BE IT FURTHER RESOLVED that Marathon County recognizes and acknowledges that if financial assistance is made available by the Wisconsin Department of Natural Resources, and the County accepts the financial assistance, the County will comply with State rules for the program and meet the financial obligations under the grant; BE IT FURTHER RESOLVED that the County Board will be notified if grant funding becomes available and then will consider authorization for the acquisition. 7 Discussion: Supervisor Schaefer stated opposition as the State/Federal governments have no money Supervisor Schlei explained the money is from the K-S grant program so no new federal or state dollars are used. Tom Lovlien, Forest Administrator, stated it is bonded money from state on a 10 year approved system, approved to Money has been appropriated for land purchases. Counties get 50% match to extend our forests. The County gets a return investment on the property. This resolution is only to apply for the grant and get an appraisal. If it is approved, an additional resolution will be brought forward to the Board. Action: MOTION BY LANGENHAHN, SECOND BY BUTTKE, TO ADOPT THE RESOLUTION. REPORT Recognition of 1 st and 2 nd Quarter Core Value Winners County Employee Quarterly Core Value Winners were recognized: Troy Torgerson for his actions which saved a person s life will be recognized at August meeting; Sharon Hernandez and Kristin Spiegel-Berg for their efforts after the March 22 nd community tragedy resulting in the death of a police officer. REPORT Partners for Progressive Agriculture Video and Discussion Samantha Straley presented a video to the Board on Partners for Progressive Agriculture. Chad Glaze gave a few words to promote agriculture and explained the great partnerships and partner growth. Showcased what they do. Appreciate the County s past support and on into the future. Their annual budget has grown every year. Mike Wildeck spoke briefly on their 2017 budget and that it is just over $85,000. The County s contribution has been $20,000. PPA 2009 prior to that, was a committee under NTC. Partner members are the major contributors for their budget. In January 2017 were able to hire a ¾ time employee Samantha Straley, her job entails, coordinator of meetings, event planner June dairy breakfast, bus tour of farms, all major events and marketing and communication s director. Marketing PPA in Marathon County is to give communities an understanding of agriculture. Support can be given by groups and individuals. They are seeking Ginseng farmers to be part of PPA. Strong supporter of the Ginseng Festival coming in September. Largest expense is personnel and then educational tours, big events, ag adventure tent at June Dairy Breakfast marketing and support of other ag events. Ag partners are also there for in-kind support not just financial support. Each year give a scholarship recently $1,000. Scholarships have been given since 1998.

8 .PROCLAMATION Leigh Yawkey Woodson Art Museum Received Nation s Highest Museum Honor WHEREAS, in September 1976, the Leigh Yawkey Woodson Art Museum opened its doors in an English Tudor-style home on a four-acre campus in a Wausau eastside neighborhood in Marathon County; and WHEREAS, the Museum s mission to enhance lives through art has brought hundreds of exhibitions to the community in addition to the highly competitive, annual juried, internationally acclaimed Birds in Art exhibition; and WHEREAS, the Woodson Art Museum is accredited by the American Alliance of Museums, celebrated for its full accessibility and commitment to free admission, and is the region s premier art museum; and WHEREAS, 2017 is distinguished as the year the Leigh Yawkey Woodson Art Museum received the National Medal from the Institute of Museum and Library Services, representing the nation s highest honor given to museums and libraries for service to their community; and WHEREAS, for twenty-three years, the National Medal has recognized and celebrated institutions that respond to societal needs in innovative ways, making a difference for individuals, families, and their communities; and WHEREAS, the Woodson Art Museum, the recipient of the 2017 National Medal for Museum Service has employed powerful programs and services that exceed levels of community outreach, often changing the lives of those who enter its doors. NOW THEREFORE, be it resolved, that the Marathon County Board of Supervisors proclaims August 3, 2017 as Leigh Yawkey Woodson Art Museum 2017 National Medal Community Celebration Day in Marathon County and extend our heartfelt congratulations to the Museum and share in the community s pride in this national honor. I encourage all citizens and guest to celebrate this prestigious award and visit the Woodson Art Museum often. Dated August 3, COUNTY BOARD OF SUPERVISORS Discussion: None. Action: MOTION BY MASZK, SECOND BY ROSENBERG, TO APPROVE THE PROCLAMATION. MOTION CARRIED ON A ROLL CALL VOTE, Follow Through: None stated; see proclamation. ORDINANCE #O To Create Sec. 2.05(XX) Regional Morgue Task Force WHEREAS, on April 19, 2016, the Board of Supervisors for the County of Marathon adopted Sec. 2.01(14) of the General Code of Ordinances for Marathon County establishing the mechanism for the creation of governance subgroups; and WHEREAS, on April 12 and June 14, 2017, the Marathon County Public Safety Committee met to discuss the need for formulating a plan for the Medical Examiner, Sheriff and other concerned stakeholders to move forward with respect to the study, feasibility analysis and planning required in order to create a regional morgue to be located in Marathon County; and WHEREAS, the Committee determined that a task force should be organized, pursuant to the structure set forth in the attached addendum, to make recommendations to the Public Safety Committee regarding the development and funding for a regional morgue. NOW, THEREFORE, BE IT ORDAINED AND RESOLVED by the Board of Supervisors of the County of Marathon that Sec. 2.05(XX) of the General Code of Ordinances is hereby created as provided in the attached. BE IT FURTHER ORDAINED AND RESOLVED that the task force shall sunset after final recommendations to the Executive Committee are made, but no later than August 31, BE IT FURTHER ORDAINED AND RESOLVED that expense reimbursement and travel for

9 task force members who represent Marathon County shall be subject to Rule 20 of the Marathon County Board Rules of Procedure/ BE IT FURTHER ORDAINED AND RESOLVED that said ordinance shall take effect upon passage and publication as required by law. Dated this 18 th day of July, 2017 Fiscal Impact: Expense reimbursements and travel of the task force members from Marathon County will be paid through the Marathon County Clerk s Office only if said expenses and travel are included in a budget submitted by the Public Safety Committee pursuant to Rule 20 of the Marathon County Board Rules of Procedure. PUBLIC SAFETY COMMITTEE ATTACHMENT Purpose: Study the needs for and to make a recommendation about the development of a regional morgue to serve the needs of Marathon County and other Counties in Northern Wisconsin. Marathon County and other Northern Counties are currently provided service by morgues in Fond du Lac, Milwaukee and Madison for autopsies conducted by Forensic Pathologists and travel time and service availability have become an issue. In addition to autopsies, facilities are needed for the storage of human corpses awaiting identification, autopsy and disposal by burial or cremation. Membership: the Task force shall be chaired by the Chair of the Marathon County Public Safety Committee and will include: 1. Marathon County Sheriff s Department- Captain Greg Bean (Investigations) 2. Sheriff regional county- Sheriff Mark Westen (Langlade County) a. Verbally agreed, waiting for confirmation 3. Medical Examiner or Coroner of a regional county- Scott Rifleman (Portage County) 4. Representative of one of the regional health care systems- Dr. Michael Clark (Saint Clare s) 5. Marathon County Emergency Management Director- Phil Rentmeester 6. Funeral Director- Greg Zoromski (Peterson Kraemer Funeral Home) 7. Representative of the Medical College of Wisconsin- Dr. Lisa Grill Dodson (Campus Dean) 8. Person with expertise in business planning- Jim Warsaw. Duties and Responsibilities: 1. Quantify the needs for autopsy facilities and staff to perform them. 2. Identify the need for the storage of human corpses under normal circumstances and in large scale emergencies. 3. Identify the partnerships needed to make a regional morgue work operationally and financially. 4. Oversee the development of a business plan for a regional morgue including a financial analysis, governance structure and the employment of medical staff. 5. Pull all of the information together and if the need exists, inform the Marathon County Board of the long term strategic goals and a shorter term tactical plan for bringing together the resources and support needed to develop a new cooperative venture. Other Organizational Relationships: The Task Force is expected to be in regular communication with the Marathon County Public Safety Committee, providing reports and getting direction from the Standing Committee. Additionally, the Task Force will need to be in regular communication with our contiguous Counties (Lincoln, Langlade, Portage, Wood, Shawano, Clark) the frequency of communications will depend upon the stage of plan development. Description of Timelines and Expectations: 1. Meetings will begin in August, Members will regularly attend and actively participate in monthly meetings for one to two hours at a time and place to be determined by the Task Force Chair. 3. 10 RESOLUTION #R Support for the Creation of a Nonpartisan Procedure for the Preparation of Legislative and Congressional Redistricting Plans (POSTPONED SEE DISCUSSION) WHEREAS, currently under the state constitution, the legislature is directed to redistrict legislative district according to the number of inhabitants at its next session following the decennial federal census by the majority party; and at the same intervals, the legislature also reapportions congressional districts pursuant to federal law; and WHEREAS, legislative and congressional redistricting plans enacted pursuant to this procedure are used to elect members of the legislature and members of Congress in the fall of the second year following the year of the census; and WHEREAS, historically legislative and congressional plans in Wisconsin have been subject to partisan influence that put the desire of politicians ahead of the electoral prerogative of the people; and WHEREAS, the 2011 process to draw the maps and fight litigation contesting those maps cost taxpayers nearly $1.9 million; and WHEREAS, a panel of federal district court judges has ruled that the redistricting that was done in Wisconsin in 2011 was unconstitutional; and WHEREAS, redistricting to achieve partisan gains is improper, whether it is done by Republicans or Democrats. NOW THEREFORE BE IT RESOLVED that the Marathon County Board of Supervisors supports the creation of a bipartisan procedure at the State level for the preparation of legislative and congressional redistricting plans, and BE IT FURTHER RESOLVED that the process promotes more accountability and transparency and prohibits the consideration of voting patterns, party information, and incumbents residence information or demographic information in drawing the maps, except as necessary to ensure minority participation as required by the U.S. Constitution. BE IT FURTHER RESOLVED that the County Clerk is directed to send a copy of this resolution to the Governor of the State of Wisconsin, the Wisconsin Counties Association, the Wisconsin Towns Association, the Wisconsin League of Municipalities, all members of the state legislature, and to each Wisconsin County. 11 RESOLUTION #R Amendment of 2017 Budget to Create 1.0 FTE Deputy Medical Examiner Position (PCN7004) in Medical Examiner s Office and Provide Funding Via Transfer from the 2017 Contingency Fund WHEREAS, the Medical Examiner has identified an immediate need to create an additional full-time (1.0 FTE) Deputy Medical Examiner position to assist with the steady increase in caseloads; and WHEREAS, without this position, the Medical Examiner s Office will be forced to provide subpar customer service to families and the community due to an unmanageable caseload that is steadily increasing in both number and complexity; and WHEREAS, the growing back-log of incomplete death investigations has caused the Medical Examiner s Office to reduce participation in other initiatives and services countywide and has also resulted in excessive overtime; and WHEREAS, the overtime is not cost effective and is causing high turnover of staff; and WHEREAS, the Public Safety Committee met on June 14, 2017 and voted to recommend the creation of a full time Deputy Medical Examiner position; and WHEREAS, the Medical Examiner has indicated that if the position is created effective 10/01/2017, the department will need approximately $24,536 from contingency to fund the position for the remainder of 2017, and approximately $85,505-$98,146 will be needed to fund this position in 2018 using 90% County tax levy and 10% revenues from increase in cremation authorizations projected for WHEREAS, there is currently an unencumbered balance in the 2017 Contingency Fund of $205,693; and WHEREAS, the Human Resources, Finance and Property Committee met on June 26, 2017 and voted to recommend the creation of a full time Deputy Medical Examiner position and transfer of an amount of up to $24,536 from the 2017 Contingency Fund to the Medical Examiner s Office to cover the costs for the remainder of 2017; and WHEREAS, the transfer shall be from the 2017 Contingency Fund to the Medical Examiner full-time Salary for $24,536; and WHEREAS, 65.90(5)(a), Wis. Stats., dictates that appropriations in the Marathon County budget may not be modified unless authorized by a vote of two-thirds of the entire membership of the County Board of Supervisors. NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors of the County of Marathon: 1. To create an additional 1.0 FTE Deputy Medical Examiner position in the Medical Examiner s Office effective 10/01/2017; 2. Resolving To approve a 2017 contingency fund transfer up to $24,536 for the remainder of 2017 (pro-rated to the date of implementation) in order to fund said position. BE IT FURTHER that the Marathon County Clerk is hereby authorized to issue checks pursuant to this resolution and the County Treasurer to honor said checks. 12 RESOLUTION #R Amendment of 2017 Budget to Create Nine (9) Half-Time (.5 FTE) Court Security Deputy Positions as part of the Courthouse Security Plan and Provide Funding Via Transfer from the 2017 Contingency Fund WHEREAS, on April 12, 2017, the Marathon County Public Safety Committee authorized the Sheriff, Administration and Facilities and Capital Management Departments to develop both immediate and long-term plans for enhanced security at Marathon County Courthouse; and WHEREAS, Sheriff s Department staff have determined, with the assistance of Federal Marshalls, that the most effective method of preventing unauthorized weapons from entering the courthouse complex is to limit entry points and create check points where all persons will be screened for weapons upon entering the building; and WHEREAS, additional security personnel will be required in the courthouse to manage the entry and check points; and WHEREAS, the Public Safety Committee will meet on July 12, 2017 to discuss and vote on whether to recommend immediate implementation of the use of up to nine half-time (.5 FTE) Court Security Deputies to provide additional courthouse security. WHEREAS, there is currently an unencumbered balance in the 2017 Contingency Fund of $358,693; and WHEREAS, the Human Resources, Finance and Property Committee will meet on July 17, 2017 to discuss and vote on whether to recommend creation of nine (9) half-time Courthouse Security Deputy positions and transfer of an amount of up to $153,000 from the Contingency fund to the Sheriff s Department to cover the costs for the remainder of 2017; and WHEREAS, the transfer shall be from the 2017 Contingency fund to the Sheriff s Department Court Security Permanent half-time wages for up to $153,000. WHEREAS, 65.90(5)(a), Wis. Stats., dictates that appropriations in the Marathon County budget may not be modified unless authorized by a vote of two-thirds of the entire membership of the County Board of Supervisors. NOW, THEREFORE, BE IT ORDAINED AND RESOLVED by the Board of Supervisors of Marathon County: A.
