3 Congress Rules of Procedure 1. DATE AND VENUE The ETUC 12 th Statutory Congress will take place from 16 to 19 May 2011 in Athens. 2. AGENDA a) Ratification des affiliations et des statuts d observateur décidés par le Comité exécutif depuis le 11ème Congrès ; b) Examen et adoption du Rapport d activités ; c) Amendements aux Statuts ; d) Examen et adoption de la (des) Résolutions(s) et du Programme d actions ; e) Elections des membres du Comité exécutif, du Président, du Secrétaire général, des Secrétaires généraux adjoints, des Secrétaires confédéraux et des Commissaires aux comptes ; f) Propositions concernant la composition du Comité exécutif DÉLÉGATIONS a) The number of delegates from the national trade union confederations will be based on the payment of their membership fee for the year 2011 (first half of the year); and for the European trade union federations, on the basis of their declared membership in These Organizations may designate substitutes whose number will not exceed one third of that of their nominated delegates. b) The Women s Committee will appoint 10 delegates. c) Each Member Organization with observer status is entitled to be represented by 3 delegates with speaking rights. d) The Youth Committee, the FERPA and the Interregional Trade Union 1
4 Councils (IRTUC) are entitled to be represented by 10 delegates each with speaking rights for all and with two votes for each of these three delegations. e) EUROCADRES is entitled to be represented by 10 delegates with speaking rights for all. f) All Organizations must ensure that their delegations reflect the gender composition of their affiliates (Article 9c of the Constitution). g) Member Organizations are required, wherever possible, to include young people in their delegations and a report will be given to the Congress on this matter. 4. PRESIDENCY The Presidency will be comprised of the Steering Committee as well as of the Presidents and General Secretaries of the Greek affiliated organisations. The Congress will be chaired by the President assisted by two other members of the Presidency. The Presidency will beforehand consider the proposed amendments to the Action Programme and make recommendations to the Congress. The Presidency will consider any suggestion or complaint from delegates about the Congress. It may delegate that task to an ETUC officer. 5. DEBATES All agenda items will be introduced by the General Secretary and the members of the Secretariat, except for the elections which will be introduced by the President. a) Speaking rights Delegates with speaking rights may take the floor based upon a written request to the Presidency. Delegations will intervene only once during any single debate except if a personal matter is involved. b) Speaking Time The maximum speaking time for each delegate will be 4 minutes in each debate. 2
5 To ease the Congress proceedings, the Presidency can propose to limit the time allowed for each intervention. Due to time constraints, the Congress Presidency can propose to close the list of speakers or the discussion. In the first case, only the listed speakers and the member of the Secretariat in charge of the particular discussion item will have the floor. In the second case, only the member of the Secretariat in charge of the particular discussion item will have the floor. The member of the Secretariat in charge of the particular discussion item will have the opportunity to present his or her concluding remarks prior to the vote. c) Points of Order A delegate may raise a point of order at any time. The maximum speaking time allowed in this case is 3 minutes. The ongoing debate will be interrupted and the motion will be discussed with one speaker in favour and one against, each with a maximum speaking time of 2 minutes. The motion will then be put to a vote. d) Emergency Resolutions Emergency resolutions pertaining to important or urgent events which are not included in the Congress documents may be submitted to the Presidency by the affiliated organisations until 6 pm on 17 May. The Presidency will meet to study these emergency resolutions and decide whether it is appropriate to recommend them for discussion during the plenary session. For each of those emergency resolutions recommended for discussion in plenary, the proposer will be given 3 minutes of speaking time followed by a 15 minute debate and a vote. To ease the Congress proceedings, the Presidency can propose to limit the time allowed to these emergency resolutions. 3

VOTES a) Votes will be by a show of hands, but on request, a roll call vote can be held. b) When voting is by ballot, election agents will be appointed by the President to distribute the ballot papers, collect and count them and report the vote results c) The delegates voting rights are contingent upon payment by their organization of the membership fees due until and including the first half of the year d) Delegates of the European Trade Union Federations and of the Women s Committee (and the two voters of the Youth Committee, the FERPA and the IRTUCs respectively) will have the right to vote except on financial matters and on applications for affiliations. e) Amendments and proposals which obtain less than two-thirds but more than half of the votes will be referred to Executive Committee for consideration and decision. 7. ELECTIONS a) All mandates expire during the Congress. b) Nomination proposals for the position of General Secretary must be submitted by 15 November For the positions of President, Deputy General Secretaries, Confederal Secretaries and Auditors, the nominations proposals will have to be submitted by 1 March The General Secretary Designate will make proposals for the composition of the Secretariat. c) The vote for the election of the President, the General Secretary, the Deputy General Secretaries, the Confederal Secretaries and the Auditors will be by ballot. d) Proposals for the composition of the Executive Committee must be submitted before 31 March e) At the end of the Congress, the new Executive Committee will meet in order to elect the Steering Committee and the Vice Presidents. 8. AMENDMENTS TO THE CONSTITUTION Proposals for amendments to the Constitution are dealt-with under another item on the agenda. 4
