3 Date: To: From: City Council Larry Bauman, City Manager Subject: Interview of Applicants to Fill City Council Position 3 SUMMARY: The resignation of Councilmember Zach Wilde has created a vacancy for Position 3. The City Council opened applications for this vacancy for three weeks, requiring all applications to be submitted by January 20, The City received a total of nineteen (19) applications. On January 24, the City Council selected seven (7) applicants to interview on January 31. The purpose of the January 31 special meeting is for the City Council to interview applicants and then to take action to appoint one applicant to fill vacant City Council Position 3. The vacancy will be filled until the next municipal election in November The person elected in November 2017 will take office immediately and will fill the remainder of the term until December 31, 2019 (RCW ). BACKGROUND: City Council position 3 has become vacant due to the December 14, 2016 resignation of Councilmember Zach Wilde. The vacancy and process to apply for this vacant Council position have been advertised in the Everett Herald, the Snohomish County Tribune, as well as on the City s website and its weekly newsletter. As a result of a three-week application period, nineteen (19) citizens submitted applications by January 20 to be considered for appointment. On January 24, 2017, the City Council conducted a special meeting to discuss applicants qualifications in executive session and then took action in public session to select applicants for interview. In order to not afford any applicants an advantage by being able to listen to the responses of other applicants during the interview process, all applicants will be asked to remain outside of the Council meeting room until they are asked to enter for their interview. Applicants will be called to interview alphabetically based on surname. At the beginning of the interview, each applicant will be asked to confirm his/her City residential address, status as a registered voter at time of application and whether they have been a City resident for at least one year. At its regular January 3, 2017, meeting, the City Council determined the following process for conducting interviews of applicants: 1. Interview each Councilmember developed one question and will ask that question of each candidate, and each candidate will be expected to respond to that question in three minutes or less. 2. Nomination selection of an applicant will begin with Councilmembers nominating and seconding motions to appoint specific applicants. More than one nomination may be made in this way prior to voting. 4 3. When all applicants have been nominated, written ballot votes will be taken with one vote per Councilmember. Each ballot must contain the name of the Councilmember voting and the name of the applicant being voted for. 4. The Mayor will count and publicly announce the ballots by announcing the name of the Councilmember and which nominee the vote was cast for. The City Clerk will tally and confirm the votes. 5. If there is no majority (for example, four or more votes with six Councilmembers voting) for any single nominee, Council will deliberate and repeat from point of nomination, step #2 above. 6. Once a majority has been reached, the Mayor will announce: It appears has been selected. 7. There may then be a motion to move to appoint and second and a voice vote by Council. The person selected will be sworn in at the beginning of the February 7 Council meeting. The essential state legal requirements to be eligible for appointment to fill a city council vacancy are that the individual appointed must be 18 years of age, a registered voter of the city at the time of application and have been a city resident for a period of at least one year (RCW 35A ). If the City Council were to not take timely action (90 days) to fill the vacancy for Position 3, the authority to take this action would fall first to the Snohomish County Council. If the County Council were to not take timely action, (180 days) the decision to fill the vacancy would then fall to the Governor of the state. BUDGETARY IMPACTS: None STRATEGIC PLAN REFERENCE: N/A.
