Johnson, Administrator of the United States Environmental Protection Agency, to issue a waiver, as requested by the State of California and required under section 209 (b) of the Clean Air Act, for the control of motor vehicle greenhouse gas emissions WHEREAS, The United States Environmental Protection Agency has declared that eighty-nine percent of New York residents live in a county where levels of ozone do not meet the National Ambient Air Quality Standard; and WHEREAS, The transportation sector in New York State is responsible for thirty-nine percent of the annual greenhouse gas emissions; and WHEREAS, New York State has adopted numerous mobile and stationary source emission control measures to control the emissions that lead to ozone formation, including adoption of the California Low Emission Vehicle programs; and WHEREAS, On December 22, 2005, New York State exercised its congressionally authorized right under section 177 of the Clean Air Act to adopt the California Vehicle Emission Standards for control of greenhouse gas emissions; and WHEREAS, The State of California had previously adopted regulations for the control of motor vehicle greenhouse gas emissions; and WHEREAS, In December of 2005, the State of California submitted a waiver request in accordance with section 209(b) of the Clean Air Act to the United States Environmental
6 -2- WHEREAS, The New York regulations require the automakers to comply with such regulations for model year 2009 vehicles they sell or lease or offer for sale or lease in New York State; now, therefore, be it RESOLVED, That this Legislative Body pause in its deliberations to urge the Administrator of the United States Environmental Protection Agency, The Honorable Stephen L. Johnson, to grant the waiver request for regulations concerning motor vehicle greenhouse gas emissions submitted by California in December of 2005; and be it further RESOLVED, That copies of this Resolution, suitably engrossed, be transmitted to President George W.
