THE SPEAKER (MATTHEW J. RYAN) PRESIDING PRAYER REV. GLEN BAYLY, Chaplain of the House of Representatives, offered the following prayer: As I lead us in prayer this morning, I am reading from a prayer that was prayed by Nehemiah, the cupbearer for King Artaxerxes of Persia, who became the Governor of Jerusalem, and I trust we would make this our individual prayer and corporate prayer for the people of Pennsylvania today. O Lord, God of heaven, the great and awesome God, who keeps his covenant of love with those who love him and obey his commands, let your ear be attentive and your eyes open to hear the prayer your servant is praying before you day and night for your servants, the people of Israel. I confess the sins we Israelites, including myself and my father s house, have committed against you. We have acted very wickedly toward you. We have not obeyed the commands, decrees and laws you gave your servant Moses. Remember the instruction you gave your servant Moses, saying, If you are unfaithful, I will scatter you among the nations, but if you return to me and obey my commands, then even if your exiled people are at the farthest horizon, I will gather them from there and bring them to the place I have chosen as a dwelling for my Name. They are your servants and your people, whom you redeemed by your great strength and your mighty hand. O Lord, let your ear be attentive to the prayer of this your servant and to the prayer of your servants who delight in revering your name. Give your servant success today by granting him favor in the presence of this man. Our gracious Heavenly Father, we do come before You today seeking Your blessing and Your presence in this session. We ask for wisdom from above. We ask, as Nehemiah prayed, for the forgiveness of our sins, and we ask You to guide us and fill us with Your love that each of us here might have love for our family, a great abiding love by Your Holy Spirit for our family members, for our friends, also for our neighbors, and even as You have commanded us, to love our enemies. We ask that Your love would overflow in our hearts in this day. Now guide this session. May each and every thing that is said and done be pleasing in Your sight. It is a throw; that is what we would call it in Ireland, but somebody else would give me the devil. There is some Irish in you; I know that. This was done recently, and it represents the various members I see some ex-members of the House Black Caucus. I see one Senator now, but other than that, these are members of the House Legislative Black Caucus. We are proud of their organization, and we are certainly proud of the good work that someone did, and are you prepared to tell us who this person is? Okay. All right. One of our most fundamental rights is the right to petition our government, and today we have special guests who, through a genuine grassroots movement, have collected 77,700 signatures to date, a number which keeps climbing. In fact, nearly 300 new signatures were added just yesterday. They traveled to our Capitol to visit with all of us, to be our guests, and I hope you will join me in welcoming them to bring their message. Their group s name is STOP, which is an acronym for Stop Taxing Our Properties, a sentiment I know many of our colleagues share. My introduction is not intended as a matter of debate but rather to ask your attention. STOP s proposal has been circulated at every one of your offices, and I hope you will join me in extending them every courtesy. They are with us in the back of the House today, seated behind the rail, and they are just a small representation. It is purely volunteer, without any overhead; it is without any real organization, except for the inspirational leadership of Bob Logue. And again, I thank you, Mr. Speaker, for the opportunity to recognize these very special travelers who are visiting us today and the work that they are undertaking. Thank you. The SPEAKER. So that we all realize that cutting property and eliminating property tax is a bipartisan, nonpartisan issue, let me just say that Bob Logue, who hails from Allegheny County, that was born in Allegheny County but was raised in Fayette County, along with his lovely wife, Etta Marie, are here with this group that has, as Representative Maher has stated, enlightened the people of western Pennsylvania as to the need to eliminate property taxes, and with these petitions, at 1:30 there is going to be a press conference in the rotunda, and we invite all those, Mr. Speaker, that wish to participate in the rotunda at 1:30 to please be there. So we ask that you take that into consideration when you convene your schedule. We will see you downstairs. Thank you, Mr. Speaker. ANTHONY S. CALABRIA PRESENTED The SPEAKER. The gentleman, Mr. Caltagirone. The House will come to order. Mr. Caltagirone. Mr. CALTAGIRONE. Thank you, Mr. Speaker. It is with a great deal of honor and humility that I would like to share the guest that I have worked with it was some years ago Anthony S. Calabria, for his many contributions to the victory in World War II. Mr. Calabria served as the confidant and personal aide secretary to Adm. Chester W. Nimitz, who was the commander in chief of the United States Navy in the Pacific during World War II. Through the duration of that war, all the war plans, the intrigue, the secret planning, decoding, he had access to all that information. He was the only enlisted man in the United States Navy who knew about the atomic bombs, before the admirals or anybody else, as early as mid-july 45, weeks before the destruction of Hiroshima and Nagasaki. Additionally, on September 2, 1945, during the signing of the peace treaty aboard the USS Missouri, Mr. Calabria arranged for the logistics of the signing throughout the entire ceremony with all the diplomatic dignitaries and military brass who was to sign, where they were to sign the peace agreement that ended World War II. He also did a tour of duty in Korea after World War II. And it is with a great deal of humility that I recognize a very close, personal friend and somebody that I have worked with for a number of years. He had to keep his lips quiet for over 20 years. He could not reveal any of the information that he had privilege to during World War II, and it is with a great deal of honor that I present to you and I present this House citation recognizing his efforts during World War II, Anthony S. Mr. MARSICO called up HR 644, PN 4240, entitled: A Resolution declaring the month of October 2002 as Pennsylvania Firearm Safety Month and encouraging organizations and the Department of Education to support and use the Eddie Eagle Gun Safety Program. Mr. Speaker, I am going to vote against HR 644, which declares Pennsylvania Firearm Safety Month and encourages organizations and the Department of Education to support and use the Eddie Eagle Gun Safety Program. I find it a little hypocritical for us to be approving a resolution encouraging the use of a program that, while it may well be admirable and a useful program, we should not have it in our schools. It is a bit hypocritical that we should be encouraging the Department of Education to conduct a gun safety program that is conducted by an organization that promotes the use of guns, the availability of guns, the access of guns throughout this State and throughout the nation. I have seen and some of you may have caught a recent documentary I am not sure which program, 20/20, 48 Hours, or one of those on TV, where they followed this program, the Eddie Eagle Safety Program, and where they had kids that were taught by their parents and repeatedly told not to touch a gun, to alert a parent, to take the necessary precautions, and then those children, unbeknownst to them, were put into a little test site where a weapon was discovered. And the kids, despite the fact that they had just told their parents that they are going to do all the right things, they are going to alert the adults in those instances, were just overcome with curiosity, and they not only touched the gun, they mimicked shooting the gun, and we should not have the organization that is promoting the guns teaching the safety of the guns in the classroom. I think that that is hypocritical. I do not think we ought to be using this program in our schools, and for that reason I am going to oppose the resolution, and I ask other members to think about that and to consider, consider what this organization means and do we really want them in our schools talking about guns to kids even if it is a safety program. Believe me, it does not work. Thank you, Mr. Speaker. The SPEAKER. The gentleman, Mr. Hutchinson. Mr. HUTCHINSON. Thank you, Mr. Speaker. I rise to support this resolution. Mr. Speaker, I come from a position as a parent of two children who have been participants in the Eddie Eagle Safety Program, and I can tell you it is a very thorough and enlightening and important program to teach our children the facts and the safety, the safe ways to handle firearms, or if you see one and find one. I think it behooves us as a State to take advantage of these quality programs that are offered in our schools and to teach our children how to respect guns. And so I rise to support this resolution and ask my colleagues to support it also. Thank you. POINT OF ORDER The SPEAKER. The gentleman, Mr. Vitali. Mr. VITALI. Point of order, Mr. Speaker. It is my understanding this is being run pursuant to House rule 35, which deals with noncontroversial resolutions. I am wondering, since it clearly is controversial, should this be run at this time or is it in fact out of order? The SPEAKER. The decision that it was a noncontroversial resolution was made when it was introduced. I think if, after that introduction, someone found it to be controversial, it should have been called to the attention of us. Now, if you wish this held over in order to garner strength against it or for it, I do not have a big problem with that, but nothing is gained by changing it from a rule 35 to a non-rule 35, except that it would go to the Rules Committee, and if you wish, you can move it to be recommitted to Rules now. I do not know whether you will get it, but you can make that motion. Mr. VITALI. No. According to the rules, there is no recourse at this point, as we sit here, to rule this a controversial resolution and then take it off the calendar. I guess that is my question. I do not have a The SPEAKER. There is no recourse except the recourse I have told you about, and that is that it be recommitted to the Rules Committee, where it would go had it been thought to have been a controversial measure. I would like to just mention that this resolution, if I could, was passed in previous legislative sessions and that at that time there was not any controversy with the language or the intent, and it was passed unanimously, I believe. Mr. Speaker, I do not imagine that you are going to allow me much latitude, but I think you would be disappointed in me if I did not stand here at this moment and ask, why are we here? You know, I just read where Blue Cross and Blue Shield are going to raise the rates on Medicare prescriptions and policies in western Pennsylvania to 190,000 of our citizens. I further read that going out toward the east, another 100,000 are going to have to pay more money, and we should be here worrying about those people that will not have coverage. We should be here trying to help those people that do not have jobs. We should be here speaking about what the people tell us. We should not be here concerned about whether or not there is going to be gun control, because there is not going to be any gun control, because that type of legislation is done by you and me, Mr. Speaker, the legislators, and we are not about to go in that direction. Now, the Speaker and the majority leader and the minority leader and all of us should not be wasting time on this frivolous type of activity and then scaring people into believing something is going to happen that is not. We should be here spending this time trying to help those constituents that call us weekly and tell us they are out of work; they cannot get their unemployment; jobs are pulling out of Pennsylvania. That is what Republicans and Democrats ought to be like, because, Mr. Speaker, there is not a darn bit of difference between an individual that is sick, whether he is a Republican or Democrat, and there is not a darn bit of difference if you wake up in the

9 2002 LEGISLATIVE JOURNAL HOUSE 1731 morning, whether you are a Republican or Democrat, and you lose your job, and there is not one bit of difference if you get up in the morning and you have got a family member with a debilitation that cannot be cured. I do not know why we waste all this time arguing about things that are not going to happen. We ought to be arguing about things that we want to make happen. Republicans and Democrats alike, we ought to be worrying about those people that we are going to ask to send us back. Let us vote for this resolution and get to the next point of business. We did one on HR 635, which the Speaker had a very, very important part in. It was the national Legislators Back to School Week. NCSL (National Conference of State Legislatures), which probably all of us are members of, was encouraging legislators to go back to school at the beginning of the school year, and I just wanted to thank the members who participated last week, Back to School Week. I know I was in one of my schools, and I am sure most of us took part in this activity. So it was a good chance for us to get back to school during the first couple weeks of school, and I know we all try throughout the school year to participate in school activities. But NCSL, the Speaker, really encouraged us to get involved in that week last week, and I just want to say thank you to the members who went back to school last week. Thank you, Mr. Speaker.
