Carried CONTRARY TO THE MOTION: Director Bischoff Esler Sports Complex Commission Minutes (Voting - Electoral Areas D, E, F and Council) Ratification required by: CRD Res. D Moved Councillor Zacharias; Seconded Councillor Walters: That memorandum dated May 16, 2012 from Darron Campbell, Manager of Community Services regarding the Esler Sports Complex Commission meeting minutes held April 26, 2012, be received. Further, that the following recommendations from the Commission be endorsed: i) that the field maintenance support arrangements first established in 2011 be continued for 2012 and that the $50,000 in funding identified for this purpose in the 2012 Central Cariboo Recreation Leisure Services budget be directed to the groups for reimbursement of contractor expenses incurred. ii) that the capital projects proposed by each group for 2012 be endorsed including: construction of two new dugouts for the slo-pitch league, installation of a covered bleacher between the new fields for the Soccer Associations dugout, and clubhouse upgrades for the minor fastball league. iii) that the five-year Use and Occupancy Agreements for the Soccer Associations and the Williams Lake Slo-Pitch League be renewed with minor amendments to recognize the caretaker s trailer for the soccer field and include water metering requirements in the slo-pitch agreement. iv) that the Esler Recreation Advisory Commission appointments for each member group be renewed for Carried Unanimously Page 4 of Minutes of the Joint Committee Meeting of May 23, 2012

Further, that the proposed 2% increase for each year of the term be endorsed excluding the parking rates. 9 CITY OF WILLIAMS LAKE COUNCIL REPORT B1 DATE OF REPORT: May 17, 2012 DATE & TYPE OF MEETING: June 27, 2012 Joint Committee Meeting AUTHOR: Geoff Paynton, Director of Community Services SUBJECT: ALCOHOL CONSUMPTION IN THE CMRC FILE: SECTION 1: EXECUTIVE SUMMARY The illegal consumption of alcohol in the CMRC continues despite efforts to work directly with user groups to curb the issue. Improved communication with user groups, education of users about the law, upgraded signage and other measures have all been tried over the past few years. While some groups have been able to curb this behavior, some of the groups continue to blatantly defy the law in this regards. In order to ensure user groups take this issue seriously, the existing policy, with clear sanctions, will be strictly enforced in the season, once reconfirmed with Joint Committee. Enforcement of this policy will ensure that legal liability to the City and CRD is reduced as much as possible in this area. SECTION 2: BACKGROUND The consumption of alcohol in a public building is against the law without a special occasion license. Consumption of alcohol in the CMRC by user groups, mostly adult ice user groups, without a license has been an on-going issue for many years. The practice of having a few beers in the dressing room after a game has been practiced for decades and has become an accepted practice by most adult user groups. Although a formal policy existed it was never enforced in the manner outlined in that policy. Over the past few years this activity has been flagged by our insurers as a high risk, high liability issue that needs to be dealt with to the best of our ability or we risk significant legal exposure should a major incident happen as a result of alcohol consumed at the CMRC by a member of a user group. Strong efforts have been made to work with the ice user groups over the past few years to curb this activity through the development of self-policing programs, rather than harsh enforcement through punitive measures and although there has been some improvement there is still a significant amount of the activity occurring, and some groups still choose to ignore the law outright. Steps already taken, or in place; Self policing programs were discussed with each ice user group and all groups promised to implement them and impose penalties against offending teams. In each contract that is signed by an ice user it clearly states that alcohol is prohibited in the CMRC and that any group breaking this rule can/will have their rentals cancelled with no refund. Signage indicating alcohol is not allowed is clearly posted in each dressing room and other areas of the CMRC. Group representatives are advised verbally, and in writing, on a regular basis of the law against consumption of alcohol in a public place, and the possible actions that may occur against their groups. SECTION 3: DISCUSSION Given that the consumption of alcohol in the CMRC is against the law, Management of the CMRC are mandated to take all reasonable steps to ensure that this activity is not occurring in the CMRC. Should a major incident happen as a result of a user consuming alcohol at the CMRC before, during, or after an activity the legal liability issues for the City and CRD would be significant. Staff have been working with user groups for the past two years to try and stop this practice through selfpolicing, education, signage, and small policy changes but this has not been successful with all user groups. As no significant actions have been taken against offending groups some groups feel they do not have to, or need to, take it seriously. CMRC Management had hoped this less harsh method of gaining the cooperation of the user groups could be successful but clearly it has not in some cases. As a result, the existing policy for dealing with the illegal consumption of alcohol in the CMRC has been resent to, and discussed in person with, all user groups showing that it clearly outlines steps that will be taken against offending groups in the upcoming ice season. This policy will be strictly enforced starting in the 2012/2103 ice season, and includes significant penalties for offending groups. The attached policy includes a graduated penalty process that can be summarized in four steps; 1. First offence- Written warning outlining the infraction and clarifying next penalty steps 2. Second offence- One week cancellation of all bookings for entire league/group (no refund) 3. Third offence- Two week cancellation of all booking for entire league/group (no refund) 4. Fourth offence- Suspension of entire league/group pending review by Joint Committee All user groups will again be notified of the updated policy immediately upon reconfirmation by Joint Committee and it will be posted in all dressing rooms and in other high traffic areas of the facility throughout the season. Existing signage will be reviewed and upgraded where necessary to ensure the policy is impossible to miss for all users. All groups will also be personally contacted to ensure they have received, and understand, the policy and all groups will be required to return a signed copy of the Policy to the Complex prior to commencement of rental times. 12 ATTACHMENT "A" (1 Page) CMRC - User Group Alcohol Policy Given that the drinking in a public building without a special occasion license is an illegal activity and that the prohibition of alcohol in the CMRC is clearly spelled out in the rental contract that is required to signed before any rental, all renters must abide by this rule or they will be subject to the following repercussions; First Offence - Written warning outlining infraction(s). Group will be required to submit a plan, within 48 hours of notification, to Director of Community Services (DCS), for how they intend to deal with the issue. Plan must be approved by DCS. Second offence - Immediate cancellation of next seven (7) days of ice rentals (no refund). Group will be required to submit a plan, to Director of Community Services, for how they intend to deal with the issue prior to resuming rentals. Plan must be approved by DCS Third offence - Immediate cancellation of next fourteen (14) days of ice rentals (no refund). Group will be required to submit a plan, to Director of Community Services, for how they intend to deal with the issue prior to resuming rentals. Plan must be approved by DCS Fourth Offence - Immediate suspension of entire league/group rentals until review by Joint Committee. No refund for the first fourteen (14) days of rentals following incident. **Blatant breaches of this provincial law by any groups (such as drinking on the ice, benches or stands) will result in immediate advancement to Third offence level. CMRC Staff who witness any evidence of illegal drinking in the CMRC are required to report it. This evidence includes, but is not limited to; Beer cans or alcohol containers in the garbage or any other part of the assigned areas. Participants seen carrying in, or out, alcohol, including ice coolers. Witness of consumption of alcohol. Any activity that happens in the dressing rooms during the time that it is assigned to a group is that group s responsibility. If, for any reason, a group does not use the dressing assigned to them, it is that group s responsibility to report this to a staff person within 24 hours or they will be held responsible for whatever occurs in that dressing room. 13 CITY OF WILLIAMS LAKE COUNCIL REPORT B2 DATE OF REPORT: June 19, 2012 DATE & TYPE OF MEETING: June 27, 2012 Joint Committee Meeting AUTHOR: Geoff Paynton, Director of Community Services SUBJECT: PARKING RENTAL RATES AT THE CMRC FILE: SECTION 1: EXECUTIVE SUMMARY During the May 2012 discussion of the proposed Fees and Charges Bylaw, Joint Committee asked for further information on rental parking rates at the CMRC, specifically a comparison with Downtown rental parking rates. CMRC Rates Monthly Annual Rate (p/m) Resident Discount Rate- $18.48 p/m $15.14 p/m Non-Resident Standard Rate- $24.63 p/m $20.14 p/m Downtown Parking Rate- $20.00 p/m Research also shows that the Downtown rental parking rates have not changed for many years and remain at $20 plus HST per month. The current proposed CMRC rates are also slated to increase 2% per year over the next three years. Based on these findings it is recommended that the rates be approved as presented in the proposed Fees and Charges Bylaw. SECTION 2: BACKGROUND None. SECTION 3: DISCUSSION One item worthy of note in this analysis is that the CMRC rental parking lot has several interruptions a year where the parking lot is not usable for renters. Events such as the Indoor Rodeo and other large events that occur during the week prevent rental users from access in the lots during these days. These interruptions are the reason that users who buy an annual rental are given a small discount. Downtown parking lots would likely not have these interruptions. 15 CITY OF WILLIAMS LAKE COUNCIL REPORT B3 DATE OF REPORT: June 18, 2012 DATE & TYPE OF MEETING: June 27, 2012 Joint Committee Meeting AUTHOR: Geoff Paynton, Director of Community Services SUBJECT: POOL TASK FORCE UPDATE FILE: (NEW FILE) SECTION 1: EXECUTIVE SUMMARY Since the last update to Joint Committee in May work on the Pool Feasibility Study has been moving forward. Over the past month the consultants (PERC) working on the project have been in Williams Lake, met with the Pool Task Force (PTF), and presented several pool concepts to the public for feedback at various venues around Williams Lake, as well as online. These initial concepts were developed based on the information gathered in their first visit to Williams Lake and interviews with stakeholder groups and individuals. From the feedback gathered from this round of consultation PERC will develop one or two preferred concepts which will move forward to the next round of public discussion. These new concepts will be brought back for further community consultation in September. SECTION 2: BACKGROUND During the public consultations that occurred during PERC s most recent visit to Williams Lake on June 8 th and 9 th input opportunities were provided at numerous locations At the seven locations, a total of 188 people provided feedback: a. Open House- City Hall 1 The information was also made available on-line on the CITY, CRD and Complex web-sites and heavily promoted through Facebook, Twitter and the local media, including City Page. Citizens were encouraged to provide feedback through all of these avenues. The information gathered is currently being compiled by PERC and will form the basis for one or two new concepts which will be brought forward for further public consultation. 16 Pool Task Force Update Page 2 1. PERC will review all input and work on rough new concepts for discussion with the PTF. 2. The PTF will meet to discuss a new fourth (and/or fifth) concept with PERC participating in the discussion by phone on June 26th; 3. At that meeting PERC will take direction from the Pool Task Force about their comfort level with the new concept(s); 4. Subsequent to the PTF meeting PERC will draft a report which outlines a recommended concept(s) and provides the financial details associated with it; 5. This new concept(s) will be sent to the Joint Committee in advance of its September meeting and in advance of the third round of public process to discuss the draft recommended concept(s); 6. Near the end of September the consultants will come back to Williams Lake to discuss the draft recommended concept(s) with the community in the final round of public process; 7. (ONGOING) ii) that the capital projects proposed by each group for 2012 be endorsed including: construction of two new dugouts for the slo-pitch league, installation of a covered bleacher between the new fields for the Soccer Associations dugout, and clubhouse upgrades for the minor fastball league. iii) that the five-year Use and Occupancy Agreements for the Soccer Associations and the Williams Lake Slo-Pitch League be renewed with minor amendments to recognize the caretaker s trailer for the soccer field and include water metering requirements in the slo-pitch agreement.
