10 VETOED BILL PROCESS After a bill passes both houses of the Legislature, it is presented to the Governor for approval. Three options are available to the Governor: (1) sign the bill; (2) veto the bill; or (3) allow the bill to become law without his signature. The Governor has five days to sign or veto a bill that is presented to him more than five days before the end of the legislative session. When the Governor receives a bill five or fewer days before the session adjourns sine die, he has ten days after the session adjourns sine die to take action on the bill. If the Governor fails to sign or veto a bill within the time allowed under the Nevada Constitution, the bill becomes law without his signature. Sundays and the date of delivery are not counted when calculating the time allotted to the Governor for action. For a vetoed bill to become law, two-thirds of the members elected to each house must vote to override the Governor s veto. When the Governor vetoes a bill, the bill is returned to the house of origin along with the Governor s veto message or statement. If the house of origin sustains the Governor s veto, the bill dies. However, if the house of origin does not sustain the Governor s veto in other words, overrides the veto the bill is then sent to the second house for reconsideration. If the second house sustains the Governor s veto, the bill dies; if it overrides the Governor s veto, the bill becomes law. When a veto is overridden by both houses and the effective date is not specified in the measure, the bill becomes effective on the date the second house votes to override the Governor s veto. Governor Brian Sandoval vetoed 28 bills that were passed by the 76th Legislature; 19 of these bills originated in the Assembly. Nine Assembly bills were returned for reconsideration by the 2011 Legislature, and ten bills were vetoed after the session ended on June 6, Assembly Bills Nos. 135, 183, 253, 254, 309, 456, 501, 566, and 568 were read and, upon motion duly carried by the body, were placed on the Chief Clerk s desk; no further action can be taken on these bills by the current or any future session of the Legislature. Assembly Bills Nos. 136, 137, 152, 300, 301, 416, 433, 546, 550, and 578 will be returned to the 2013 Legislature for reconsideration. Of the vetoed bills returned to the Senate for reconsideration, the Senate took no action on Senate Bill No. 497 of the 76th (2011) Session; Senate Bill No. 3 of the 26 th Special Session; and Senate Bills Nos. 143, 376, and 396 of the 75th Session. No further action can be taken on these bills by the current or any future session of the Legislature. Senate Bills Nos. 115, 188, 207, 208, 254, 304, 360, and 418 will be returned to the 2013 Legislature for reconsideration. 13 JOINT STANDING RULE NO OF THE SENATE AND ASSEMBLY The Joint Standing Rules of the Senate and Assembly (Assembly Concurrent Resolution No. 1 [File No. 1, Statutes of Nevada 2011]) were adopted by both houses of the Nevada State Legislature on February 7, Rule No. 14.3, which provided certain deadlines for the enactment of bills, was amended on May 25, 2011, to extend the second house passage deadline to the 113th calendar day of the legislative session (Assembly Concurrent Resolution No. 11 [File No. 34, Statutes of Nevada 2011]). Unless a deadline was waived by the Speaker of the Assembly and the Majority Leader of the Senate pursuant to Rule No of the Joint Standing Rules, no further legislative action was allowed on a bill or joint resolution that failed to meet the established deadlines toward passage and enactment. The final standing committee to which a bill or joint resolution is referred in its House of origin may only take action on the bill or joint resolution on or before the 68th calendar day of the legislative session. 14 FISCAL NOTES Nevada Revised Statutes 218D.440 provides that fiscal notes are required on original bills and joint resolutions. Whenever an amendment is adopted that affects a bill or joint resolution in such a way that the fiscal note ceases to be valid, the presiding officer, at his or her discretion, can direct the Fiscal Analysis Division of the Legislative Counsel Bureau to obtain a new fiscal note showing the effect of the bill or joint resolution as amended. Not all fiscal notes are updated when an amendment invalidates the note. VOTE REQUIREMENTS Article 4, section 18 of the Nevada Constitution requires an affirmative vote of not fewer than two-thirds of the members elected to each house to pass a bill or joint resolution which creates, generates, or increases any public revenue in any form, including but not limited to taxes, fees, assessments, and rates, or changes in the computation bases for taxes, fees, assessments, and rates. Passage of all other measures requires a majority vote of all the members elected to each house.
