2 ITEM #1: Discussion/Consideration of Ordinance 17-09, an Ordinance of the Town Council of the Town of Duck, North Carolina, Allowing the Sale of Alcoholic Beverages Before Noon on Sundays at Licensed Premises Adopt Ordinance On June 29, 2017, the North Carolina General Assembly enacted Senate Bill 155, entitled An Act to Make Various Changes to the Alcoholic Beverage Control Commissions Laws. This bill authorizes the sale of alcohol by ABC permit holders on Sundays beginning at 10:00 am if approved by the passage of a local ordinance. Previously, the sale of alcohol was not allowed before noon on Sundays. The Town of Duck, along with the other Towns in Dare County, and Dare County, have been requested by the Outer Banks Restaurant Association to pass an ordinance allowing the sale of alcoholic beverages on Sundays beginning at 10:00 am. The attached ordinance would permit the sale of alcoholic beverages on Sundays beginning at 10:00 am. The Towns of Kill Devil Hills, Kitty Hawk, Southern Shores and Manteo have enacted an ordinance similar to one proposed. The Town of Nags Head, Currituck County and Dare County are considering the passage of such an ordinance. Ordinance 17-09
3 AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF DUCK, NORTH CAROLINA, ALLOWING THE SALE OF ALCOHOLIC BEVERAGES BEFORE NOON ON SUNDAYS AT LICENSED PREMISES Ordinance No WHEREAS, on June 29, 2017, the North Carolina General Assembly enacted Senate 155, entitled An Act to Make Various Changes to the Alcoholic Beverage Control Commission Laws ; and WHEREAS, Section 4 of Ratified Senate Bill 155 authorizes city and county governments to adopt an ordinance to allow alcohol sales beginning at 10 a.m. on Sundays; and WHEREAS, Ratified Senate Bill 155 was signed into law by Governor Roy Cooper on the 30 th Day of June 2017, and became effective on that date (Session Law 2017, Chapter 87); and WHEREAS, by enacting Senate Bill 155, North Carolina joins 47 other States in allowing alcohol service before noon on Sunday; and WHEREAS, Sunday morning alcohol service will allow the hospitality community and retail merchants in the Town of Duck meet the needs of their customers, bring people into the commercial areas of the Town earlier in the day, and generate increased tax revenues. NOW, THEREFORE, BE IT ORDAINED BY the Town Council for the Town of Duck, North Carolina, that the Town of Duck Code of Ordinances be amended by adding Chapter 112: Sunday Sale of Alcoholic Beverages to Title XI: Business Regulations and further amended as follows: Section 1. Pursuant to the authority granted by S.L any establishment located in the corporate limits of the Town of Duck and holding an ABC permit issued pursuant to G.S. 18B is permitted to sell beverages allowed by its permit beginning at 10:00 a.m. on Sundays. Section 2. All laws and clauses of laws in conflict herewith are repealed to the extent of any such conflict. Section 3. The ordinance is effective upon its adoption. ATTEST: Mayor Town Clerk
