1 Minutes of the Regular Meeting of the Township Committee of the Township of Hillsborough, in the County of Somerset, State of New Jersey, held in the Municipal Complex at 7:30 p.m. on the above date. Upon call of the roll, the following Committee members were recorded present: Committeeman Anthony Ferrera, Committeeman Robert C. Wagner, Jr., Deputy Mayor Gloria McCauley and Mayor Frank DelCore. Also, in attendance were Township Attorney Albert E. Cruz, Township Administrator/Clerk Kevin P. Davis and Administrative Assistant Siobhan Weikel. Committeeman Suraci was absent. Following Roll Call and Salute to the Flag, Mayor DelCore advised that notice of this Regular Session was made in accordance with Section 5 of the Open Public Meetings Act, Chapter 231, Public Law 1975, by posting on the bulletin board at the Municipal Building and by mailing to the Township s official newspapers, a notice that this regular session would take place at the Hillsborough Municipal Building at 7:30 p.m. on September 28, REPORTS FROM COMMITTEE LIAISONS, AND RECEIPT OR REPORTS, PETITIONS OR COMMUNICATIONS Committeeman Ferrera Committeeman Ferrera reported on October 3, 2010 from 10:00 1:00 will be Family Fun Day for children in town with special needs. There will be free tickets for the first one hundred people who sign up. The event will be at Norz Hill Farm. Committeeman Ferrera said more information to sign up will be available this Friday in the Township s E-News. Committeeman Ferrera thanked Norz Hill Farm and the Knights of Columbus in Somerset County for hosting this event. Committeeman Ferrera reported October 15, 2010 is the Knights of Columbus Charity Ball from 7:00 p.m. to midnight, at the Bridgewater Elks. Tickets are $55.00, and additional information will be available in the Township s E-News. Committeeman Ferrera reported on October 3, 2010 is the Steeple Chase Run. This will be from 7:00 a.m. to 12:00 p.m. Committeeman Ferrera said to expect delays on Amsterdam Road and the surrounding areas. Committeeman Ferrera reported that we have had three fires recently in town. Committeeman Ferrera thanked all emergency services for another job well done. Committeeman Ferrera briefly discussed the Police Department s community notification system called Nixle. The Committeeman said this is something that Chief Kaminsky set up last year. Committeeman Ferrera stated Nixle is a valuable and convenient notification program where residents can be advised via text messages to phones or through s or both about traffic problems and other alerts in the Township. The alerts are even sent via Twitter if you have one of those accounts. Over 700 residents have already signed up for the free service and Committeeman Ferrera encouraged all Hillsborough residents to sign up for it.

2 Committeeman Ferrera said you can sign up via a link on the Township s website, the link is also included in the Mayor s e-newsletter, or you can go to hillsboroughpolice.org and find the Nixle link, or directly at nixle.com. Committeeman Ferrera explained as an example, if there is a roadway blocked for any reason; such as a tree or wires down, an accident, flooding, whatever event, you will receive a notice almost when it happens. This can help commuters make the alternate decisions on how to go to work before heading out in the morning or before heading home for the evening commute. In the past three months alone, there have been 40 Nixle alerts issued by the Hillsborough Police Department. Committeeman Ferrera explained Nixle also provides crime and public safety alerts, health and emergency advisories and community event notices; and if you don t want to be bothered by texts or s, you can simply go on nixle.com on your computer at home or work and type in Hillsborough, New Jersey. You will then see all the recent alerts. That certainly can be a big help for commuters and to keep residents apprised about public safety issues. Committeeman Ferrera said we are always trying to create convenience for residents here at the Township. Some examples are Saturday inspections by the Building Department for homeowners, evening hours for key offices, signing up for recreation and dog licenses via the internet. Committeeman Ferrera explained that Nixle is an extension of that philosophy of making government more convenient for residents. It can be a big help for commuters and to keep citizens apprised about public safety issues. Committeeman Ferrera encouraged all residents to take advantage of this free service provided by the Hillsborough Police Department. Committeeman Wagner Committeeman Wagner reminded all veterans that the Township will hold our 2 nd annual Veterans Day ceremony on Thursday, November 11 th, which is Veterans Day, at 7 pm, at the Garden of Honor here at the Municipal Complex. We believe that recognizing the service of our Hillsborough veterans on the day set aside for that recognition is most important and well deserved for the men and women who have served our nation. Committeeman Wagner said we invite all veterans and their families to join us. There will be a reception in the municipal building following the ceremonies. The public is welcome to attend and observe the ceremonies. Committeeman Wagner reported the Planning Board helped the Township and the County takes a step toward the preservation of nearly 30 acres of land in the Sourland Mountains on September 16 th, when a subdivision of a property on Pschorn Lane was approved. The subdivision of the property will provide a 3 acre lot for the existing homestead and a second acre lot, which will be preserved by Somerset County, at no cost to the Township. We appreciate the cooperation of the property owners, Elizabeth Maxwell and Kurt Roth, and the County Freeholders financial support for the preservation of these nearly 30 acres. Committeeman Wagner said the area is contiguous to a Township preserved property on Montgomery Road, is a component of a County plan for the preservation of several adjacent properties in the area, and is part of the Township s and County s overall effort to preserve the environmentally sensitive Sourland Mountain region. It is great when we have the help and 2

3 cooperation of the County in preventing development and putting these properties safely away as open space. Deputy Mayor McCauley Deputy Mayor McCauley said she has a finance report tonight that is just not good news for next year. As many people have probably already seen in the news, the state has mandated that Hillsborough pay a $366,689 increase in pension payments in That represents a 20% increase over Deputy Mayor McCauley stated it is an increase of $219,816 for the Police pension program and $146,873 for the public employee pension program. Total amount to be paid in 2011 for police pensions will be $1,502,134 and the total for public employees will be $688,741. Deputy Mayor McCauley said we heard about all the help that Trenton may give to local governments and taxpayers and this is not defined as help. Deputy Mayor McCauley said the Township does not set the pension rates. The pension payment amounts are a state mandate. There is no way to reduce them by cutting something here or there next year. Even if you eliminate positions, have employee furloughs, layoff employees, have salary freezes; none of it will change the 2011 pension payment amount, because it is based on salary rates from two years ago and actuarial forecasts. This will, unfortunately, impact on the Township s overall budget next year and will make delivery of services that much more difficult. Deputy Mayor McCauley reported that the 2010 Census operations are winding down. The Census Bureau has reported that all census field operations that were being conducted out of Local Census Offices have been completed and those offices are closed. There are no longer census takers moving about neighborhoods. Anyone who is contacted by someone who claims to be from the census should immediately contact the Police Department. Deputy Mayor McCauley said individuals with census questions can call and will be directed to the proper department that is still operating in the Census Bureau. Deputy Mayor McCauley said we do not have an official report on Hillsborough yet, but she has been advised that there was an extremely high degree of census participation in our community and we thank everyone for helping to get the count right in Hillsborough in Deputy Mayor McCauley reported the Economic and Business Development Social will be held at 6:00 p.m. on October 20, 2010 at Roycebrook for all Hillsborough businesses. Businesses can register on the Township s website. Deputy Mayor McCauley reported Lieutenant Governor Kim Guadagno will be the guest speaker. Deputy Mayor McCauley reported she attended the John Basilone parade last Sunday in Raritan. The Deputy Mayor said it was very well attended. Committeeman Ferrera Committee Ferrera reported this past Wednesday was bag hunger day, and it was held to raise money for the food banks. Committeeman Ferrera thanked Keith Stanley from Shop Rite in Hillsborough. Committeeman Ferrera encouraged residents to donate to the local food banks. 3

4 Mayor DelCore Mayor DelCore reported last Friday, we were advised that the Nevada DEP had successfully completed their validation process with the mercury barrels that had been transported there at the end of August, and that all of the remaining mercury stockpile will be transferred out of the Hillsborough facility over the course of the next few months. Mayor DelCore read from a copy of the Nevada DEP authorization letter to the Defense Logistics Agency, or DLA, dated September 13, 2010 that was received yesterday. The NDEP BAPC, which is the Bureau of Air Pollution Control, is also hereby providing approval for the DLA and HWAD, that s the Hawthorne Army Depot, to commence transfer and storage of the balance of the mercury stockpile. Mayor DelCore stated in his three years on this Township Committee, those are the sweetest words he has read in any letter the Township has received. Mayor DelCore said all the hurdles have been cleared. All the mercury will be gone by the end of the year. The next mercury shipment has already been sent to the Army Depot in Nevada and more will follow. Mayor DelCore said we have stated previously, the dates and routes of the shipments are held for security reasons. Mayor DelCore expressed the Township's appreciation to Congressman Leonard Lance for his tenacious and successful work on this issue for our community. Mayor DelCore said as Deputy Mayor McCauley noted at the last meeting, there is plenty of credit to go around to all of the Mayors and members of the Township Committees over the years, who have played a role in lobbying to move the mercury stockpile since it was first discovered being stored here in The most important fact is; the mercury is being shipped out and will be gone by year's end. That is great news for the people of Hillsborough. APPOINTMENTS None at this time. PROCLAMATIONS Mayor DelCore said we are going to honor Bill Melenchuk for 60 years of volunteer service to Fire Company #2. Mayor DelCore said this is a truly unique record of dedication to our community. Proclamation honoring Bill Melenchuk, Fire Company #2, for 60 years of volunteer service WHEREAS, William Melenchuk, a member of Hillsborough Volunteer Fire Company No. 2, has served the Township of Hillsborough for 60 years in this role; and 4

5 WHEREAS, Mr. Melenchuk served on several building committees during his time with Fire Company No. 2, and was instrumental in helping the Fire Company receive generous donations for building materials from local suppliers and contractors for both the original hall, built in the 1950 s and the new building in the 1970 s; and WHEREAS, Mr. Melenchuk ran several drives to raise funds prior to the days of the Board of Fire Commissioners; and WHEREAS, Mr. Melenchuk volunteered countless hours of his time throughout his 60 years of service to Hillsborough Fire Company No. 2, by serving on the Board of Trustees in the late 1970 s and early 1980 s, as well as, serving on both the Membership and Fireman s Fair Committee; and WHEREAS, Mr. Melenchuk has continuously made sacrifices on behalf of the Township and the residents of Hillsborough in his commitment to the Fire Company during his 60 years of incomparable service. NOW, THEREFORE, BE IT PROCLAIMED that we, the Township Committee of the Township of Hillsborough, do hereby commend William Melenchuk for his truly exceptional service with Hillsborough Volunteer Fire Company No. 2, where he has displayed professionalism, dedication to duty and an unwavering commitment to the community, often at a risk to his own life. BE IT FURTHER PROCLAIMED that we, the Township Committee of the Township of Hillsborough thank Mr. Melenchuck for his sixty years of dedicated service and wish him the best of luck in all his future endeavors. Recognition of contributors to the Universal Playground Project Mayor DelCore reported when Committeeman Ferrera kicked off the fund raising drive for the universal playground last year, none of us would have forecast how successful the effort would be. The Township owes a great debt of gratitude to Jeff and Beth Baldwin for their volunteer work in submitting grant requests seeking support for the universal playground. Nearly all of the submissions were successful. The universal playground is designed to allow all children to have access to it and to enjoy it. Mayor DelCore said here in Hillsborough we have prided ourselves on our commitment to providing children with special needs with opportunities to interact with other children. This playground is another step forward in that effort. Mayor DelCore said thanks to the contributions that have been received and the successful grant work, the Township was able to approve a contract for the equipment at the last Township meeting, and later on this agenda we will consider approving a contract for the safety surface that is a key component of the project. Tonight we are going to recognize all those who have contributed to this point. The Mayor said contributions are still welcomed and needed for this project. Committeeman Ferrera reported while over $84,000 has been raised or committed to date, additional contributions are still needed and welcomed. Committeeman Ferrera expressed his appreciation to everyone and every group that has stepped forward to help with this project. Committeeman Ferrera said we do care about all our 5

6 children here in Hillsborough and this universal playground is another demonstration of that caring. Committeeman Ferrera reported that we have had a great deal of help in raising these funds, however, special recognition is due to Jeff and Beth Baldwin for their volunteer work on the applications submitted to obtain the grants. They have been monumentally successful. Committeeman Ferrera said all of the contributors we will recognize help to continue the legacy of keeping Hillsborough one of the best places to live in America. Committeeman Ferrera thanked them all. Committeeman Ferrera said later on the agenda as the Mayor noted, the Committee will consider the approval of a contract for the special surface needed for the playground. Once that is approved there will be a playground build day for volunteers to help with the construction of the playground at AVM Park on Saturday, October 23 rd. Mayor DelCore thanked Rich Resavy, Director of Parks and Recreation and Ron Skobo, Chairman of the Parks and Recreation Commission, who have been instrumental in this process. Mayor DelCore and Committeeman Ferrera presented a Certificate of Appreciation to all contributors. APPROVAL OF MINUTES Approval of the September 14, 2010 Regular Session Minutes Upon motion by Committeeman Ferrera, seconded by Committeeman Wagner, the minutes of the September 14, 2010 Regular Session were approved upon the call of the roll. Yes Ferrera, Wagner, McCauley Abstain DelCore NEW BUSINESS Pipeline Safety discussion Mayor DelCore reported earlier this month a pipeline explosion in California claimed a number of lives, injured hundreds of people, and did extensive damage to a large area of residential housing. Because Hillsborough has a significant number of gas pipelines running through parts of our community, Mayor Delcore said he believes it is important for our residents to learn first- hand from the various pipeline companies about the steps that have been taken to protect our community. Mayor DelCore said he is pleased to report that all three companies have been very responsive to our request and are represented here this evening; Transcontinental, Buckeye, and Texas Eastern, which also includes Duke and Spectra Gas. Don Hargis, Spectra Energy, Russell Markowski, Williams Gas Pipeline, owner of Transcontinental Gas Pipe Line and Bob Cortopassi, Buckeye gave in-depth presentations on the pipelines that traverse through Hillsborough. Several representatives from the pipeline 6

7 companies explained how their companies operate; they spoke about the safety issues and the environmentally responsible transportation of fuel. The Township Committee, as well as, Hillsborough residents Terry McSweeney, James Haba and John Del Gigante voiced their concerns about the safety of our community. Representatives from all three companies addressed everyone s concerns. Mayor DelCore thanked all representatives from the pipeline companies PUBLIC COMMENT ON NEW BUSINESS AND MATTERS NOT ON THE AGENDA Randy Sixt, Orchard Drive, said he represents a large group of people that ride quads and dirt-bikes. Mr. Sixt asked the Township Committee for a piece of property in Hillsborough where they can legally ride. Mayor DelCore said there will be a meeting tomorrow night regarding the GSA property. Mayor DelCore said we are looking for a number of alternatives for that site and suggested Mr. Sixt attend this meeting. Liquor License discussion NEW BUSINESS Mayor DelCore reported as the Township looks toward 2011's budget and the new 2% tax cap, various avenues of revenue sources that are alternatives to property taxes must be examined. At the last meeting the Township's CFO discussed a plan to generate additional revenue from outstanding tax liens. Tonight, we are going to take a look at the sale of liquor licenses as another potential resource. Mayor Delcore said Gene Strupinsky, the Business Advocate, has done some research on this issue and is with us tonight to offer his report. Mr. Strupinsky stated the number of liquor licenses that a municipality is entitled to is based on population. There are two types of licenses; retail plenary consumption licenses and retail plenary distribution licenses. The basic difference is a consumption license is what you would use in a restaurant or bar, and a distribution license is a package goods license used in a liquor store. Mr. Strupinsky reported based on the most recent estimated population from the US Census Bureau, as of July 1, 2009 is 38,817 people. Mr. Strupinsky said that amounts to twelve consumption licenses and five distribution licenses. Mr. Strupinsky said municipalities can pass laws limiting the number of licensor s, and Hillsborough allows for twelve consumption licenses and four distribution licenses. Mr. Strupinsky reported currently there are eleven consumption licenses that are active, sold, and one inactive, which can be sold. Mr. Strupinsky reported we have sold three of the distribution licenses, and have one that can still be sold. Mr. Strupinsky explained the procedure for the sale of the above mentioned licenses. He explained that the bidding process requires submission of a bid, the submission of a completed application and a certification complying with the alcoholic beverage control laws. Mr. Jim Dyer, Branchburg, spoke of his interest in the distribution license. 7

8 PUBLIC HEARINGS None at this time INTRODUCTION OF NEW ORDINANCES Ordinance An Ordinance vacating all of the Township of Hillsborough s right, title and interest in and to that portion of Wilson Avenue situated between Harrison and Madison Streets, all of which are paper streets, in order to merge Block 139, Lot 1 with Block 128, Lot 1 on the Tax Map of the Township of Hillsborough. Further consideration of this ordinance and public hearing will be held on October 26, WHEREAS, there exists in the Township of Hillsborough, Somerset County, New Jersey, a road known as Wilson Avenue, as shown on the Official Tax Map of the Township of Hillsborough; and WHEREAS, a request was made to vacate that portion of Wilson Avenue between Harrison and Madison Streets, all of which are paper streets, in order to merge Block 139, Lot 1 with Block 128, Lot 1 on the Tax Map of the Township of Hillsborough; and WHEREAS, that portion of Wilson Avenue described in Metes and Bounds Description of a Portion of Wilson Avenue to be Vacated by the Township of Hillsborough, Somerset County, New Jersey, located at Madison Street, dated August 30, 2010, is attached as Exhibit A, and is being vacated, as shown on the Tax Map of the Township of Hillsborough, and as more fully described on a plan titled Right of Way Vacation Plan for a Portion of Wilson Avenue and Lot Merger Plan for Block 139, Lot 1 and Block 128, Lot 1, prepared by Christopher A. Melick, P.L.S., 602 Boozer Lane, Hillsborough, New Jersey 08844, dated July 20, 2010, last revised September 10, 2010, which is attached as Exhibit B; and WHEREAS, the merger of the vacated portion of Wilson Avenue with Block 128, Lot 1 and Block 139, Lot 1, as described in Metes and Bounds Description of Merged Lot 1, Block 128, Lot 1, Block 139 and the 8,000 square foot portion of Wilson Avenue that was Vacated by the Township of Hillsborough, Somerset County, New Jersey, dated July 20, 2010, is attached as Exhibit C and as more fully depicted on Exhibit B; and WHEREAS, the aforesaid portion of Wilson Avenue is to be vacated subject to certain requirements, obligations and restrictions as established by the Township Committee of the Township of Hillsborough; and WHEREAS, the Township Committee of the Township of Hillsborough does hereby determine that the portion of Wilson Avenue described herein on Exhibit A will no longer be needed for public purposes; and WHEREAS, N.J.S.A. 40:67-19 authorizes the Township to release and extinguish the public s rights, and the rights of the Township in a portion of Wilson Avenue. NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Hillsborough, Somerset County, New Jersey, as follows: 8

9 SECTION 1. Subject to the conditions set forth below, the rights of the public and the Township of Hillsborough in and to a portion of the roadway known as Wilson Avenue, as described by metes and bounds description attached as Exhibit A, and as depicted on a plan titled Right of Way Vacation Plan for a Portion of Wilson Avenue and Lot Merger Plan for Block 139, Lot 1 and Block 128, Lot 1, attached as Exhibit B, both prepared by Christopher A. Melick, P.L.S., 602 Boozer Lane, Hillsborough, New Jersey 08844, are hereby extinguished and vacated. SECTION 2. The land being vacated shall be merged with Block 128, Lot 1 and Block 139, Lot 1 and, after vacation to be known as Block 139, Lot 1.01, a Deed of Consolidation shall be prepared by the owner of the merged lot. The Deed of Consolidation shall specifically recite that the merged lot shall not be further subdivided. The Deed of Consolidation shall be presented to the Township Attorney for review and approval. After the Township Attorney reviews and approves of the Deed of Consolidation, the property owner shall record same and provide a recorded copy to the Township Clerk, Tax Assessor and Township Attorney. SECTION 3. The merged lot described in Section 2 above and on Exhibit C shall not be further subdivided. SECTION 4. Expressly reserved and excepted from this vacation are all of the rights and privileges now possessed by public utilities and cable television companies to maintain and repair their existing facilities adjacent to, over and under the street or public place to be vacated. SECTION 5. At least seven (7) days prior to the time fixed for the consideration of this Ordinance for final passage, a copy of this Ordinance, together with a notice of its introduction and the time and place when and where the Ordinance will be further considered for final passage, shall be mailed to every person whose land may be affected by this Ordinance so far as may be ascertained. Said notices shall be mailed by the Township Clerk in accordance with the provisions of N.J.S.A. 40:49-6. SECTION 6. The Township Clerk shall, within sixty (60) days of the effective date of this Ordinance, file a copy of this Ordinance certified by the Clerk under the seal of the Township, to be a true copy thereof, together with proof of publication thereof, in the office of the Clerk of the County of Somerset, in accordance with the provisions of N.J.S.A. 40: SECTION 7. The Mayor and Clerk are hereby authorized to sign a Quitclaim Deed conveying the vacated portion of Wilson Avenue to the owner of Block 139, Lot 1 and Block 128, Lot 1. SECTION 8. If any article, section, subsection, paragraph, phrase or sentence is, for any reason, held to be unconstitutional or invalid, said article, section, subsection, paragraph, phrase or sentence shall be deemed severable. SECTION 9. This Ordinance shall become effective upon the adoption and recording of this Ordinance with the Somerset County Clerk s Office. Mayor DelCore reported back in July, Mr. Anthony Giraldi appeared here to request consideration of a vacation of the paper street known as Wilson Avenue and the inclusion of the site to his property. At that time the Township indicated that he should proceed with the actions needed to affect the vacation. The Engineering Office has reviewed the proposed vacation and indicated that there is no plan or interest of the Township in improving Wilson Avenue in the future. Mayor DelCore said Mr. Cruz has worked with Mr. Giraldi's attorney and the Mayor asked Mr. Cruz to verify that all requirements for the vacation have been met. Mr. Cruz reported all requirements have been met. 9

10 Mayor DelCore said this ordinance authorizes the vacation of the Township right of way on the paper street Wilson Avenue, which, when completed, Mr. Giraldi will be responsible for the taxes on the addition to his property. Committeeman Ferrera moved that the aforesaid Ordinance be passed on first reading and that the Ordinance be further considered at a public hearing held on October 26, 2010 at 7:30 p.m. Said motion was seconded by Committeeman Wagner and unanimously approved upon call of the roll. CONSIDERATIONS Mayor DelCore offered the following resolutions: 1. Resolution awarding a Non Fair and Open contract to George Ely Associates, Inc. for the Universal Playground safety surface, in an amount not to exceed $34, WHEREAS, the Township Committee has decided to award a Non Fair and Open contract for the installation of the safety surfacing to George Ely Associates, Inc., with a square foot price of $8.30, in an amount not to exceed $34, pursuant to their proposal dated September 15, 2010; and WHEREAS, the amount of the contract is below the Township of Hillsborough s bid threshold of $36,000 and is therefore not required to publicly bid for this service (N.J.S.A. 40A:11-3 and 11-9), however, competitive quotes we sought as follows: 1. George Ely Associates, Inc $34, Surface America, Inc. $38, WHEREAS, funds are available and have been certified as such by the Chief Finance Officer said certification is attached to this resolution; and WHEREAS, George Ely Associates, Inc. has submitted the required Political Contribution Disclosure form and other forms as required by N.J.S.A. 19:44A NOW, THEREFORE BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey as follows: 1. The action of the Mayor and Township Administrator/Clerk to authorize and execute the agreement with George Ely Associates, Inc. for the installation of the safety surfacing, with a square foot price of $8.30, in an amount not to exceed $34, pursuant to their proposal dated September 15, This contract is awarded without competitive bidding as a Non Fair & Open Contract. 3. The Mayor and Township Administrator/Clerk are hereby authorized to execute the Township s standard form of agreement for Goods and Services and any modifications thereto and related constituent documents as may be found acceptable by the Township Committee. Mayor DelCore reported George Ely Associates submitted the lowest of two quotes for the safety surface material and installation for the universal playground at AVM Park. The safety surface is a key component because it makes the site accessible to both ambulatory and non-ambulatory children. 10

11 Mayor DelCore said this project is being funded through contributions and grants, thanks in large measure to the people we recognized earlier. Mayor DelCore again thanked the contributors. Mayor DelCore said this approval, along with the equipment approval from the last meeting, means that the construction of the playground can now begin. Once the playground is completed, all children will have access to it and all will benefit. Committeman Ferrera stated there will be a playground build day on Saturday, October 23, 2010, and all volunteers are welcome. There will be additional information on the Township s website, through the Mayor s E-Newsletter and on TV 25. Committeeman Ferrera again thanked all the contributors, as well as, the Township Committee for working together to bring this project to fruition. Deputy Mayor McCauley also thanked all of the contributors. Upon motion by Committeeman Ferrera seconded by Deputy Mayor McCauley, the aforesaid resolution was unanimously approved upon call of the roll. 2. Resolution awarding a contract for the 2010 Sidewalk and Curbing Replacement to A. Takton Concrete Corporation, in an amount not to exceed $114, WHEREAS, the Township Engineer has determined that there is a need for sidewalk and curb replacement; and WHEREAS, sealed bids were opened and read on September 9, 2010 at 10:00 a.m., which was the time and place provided for in the Notice to Bidders entitled 2010 Sidewalk and Curbing Replacement ; and WHEREAS, three (3) bids were received from the following: Bidder Total Amount A. Takton Concrete Corp. $114, J. C. Concrete Company $155, Mucinaf LLC $266, WHEREAS, Township Attorney Albert E. Cruz, Esq. has reviewed the bid and has provided his comments with respect to the same. WHEREAS, funds are available and have been certified as such by the Chief Finance Officer, said certification is attached to this resolution. NOW, THEREFORE BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey, that the Mayor and the Township Administrator/Clerk are hereby authorized to execute a Construction Contract with A. Takton Concrete Corp. in an amount not to exceed $114, Mayor DelCore reported A. Takton Concrete submitted the lowest of three bids for the annual sidewalk and curbing replacement program funded through developer offsite funds in the capital budget. 11

12 Committeeman Wagner questioned if the Township is working with the High School. Mr. Davis explained this is an agreement the Township made with the school district when the school budget was reduced. Paul Drake, Balmoral Court, said he has always supported sidewalks and is glad to see we are spending money from the sidewalk fund to build sidewalks in Hillsborough. Mr. Drake said he also believes it is good that we partnered with the high school, to use the dollars that are in the sidewalk fund to help the high school. Mr. Drake questioned where the rest of the improvements in town will be made. Mr. Davis said the Engineering Department has a list. Mr. Drake also questioned the installation of a sidewalk on Triangle Road near Wawa. Mr. Cruz explained that the Township has a limited amount of funds. Mr. Cruz said he has been working with the property owners to see if they would be willing to donate the easements that are necessary for the sidewalk. Mr. Cruz reported that some property owners have graciously donated the easements, but we do not have all yet. Mr. Cruz further explained the Township s recourse if all the property owners do not donate. Mr. Drake said in his opinion he believes the Township should adopt a snow removal ordinance in town. Upon motion by Deputy Mayor McCauley seconded by Committeeman Ferrera, the aforesaid resolution was unanimously approved upon call of the roll. 3. Resolution authorizing the following personnel actions and appointments in the Finance and Administrator/Clerk offices: Lisa Strothers transfer from the position of Secretary to the Administrator/Clerk to the position of Clerk to the Tax Collector/Treasurer to fill a vacancy in the Finance Office, at an annual salary of $37, (37.5 hour work week), Siobhan Weikel to the position of Secretary to the Administrator/Clerk, at an annual salary of $37, (40 hour work week) and John DeDomenico, Clerk to the Tax Collector/Treasurer, salary to be set at $37, (37.5 hour work week), as required by the union contract all effective October 5, WHEREAS, there exists a vacancy in the position of Clerk to the Tax Collector/ Treasurer; and WHEREAS, the Chief Finance Officer recommends the transfer of Lisa Strothers, who is currently the Secretary to the Administrator/Clerk, to the position of Clerk to the Tax Collector/Treasurer in the Finance Office, at a salary of $37, per year for a thirty seven and half hour work week, and as an experienced employee, Lisa Strothers is granted Permanent Employee Status as Clerk to the Tax Collector/Treasurer in the Finance Office effective October 5, 2010; and WHEREAS, the Administrator/Clerk has determined that to ensure continued effectiveness the position of Secretary to the Administrator/Clerk needs to be filled and recommends the appointment of Siobhan Weikel, who has served in a part time capacity in the Administration office for six years, to the non union position of Secretary to the Administrator/Clerk, effective October 5, 2010, at a salary of $37, per year for a forty hour work week; and WHEREAS, the salary for John DeDomenico, Clerk to the Tax Collector/ Treasurer, is to be set at $37, per year for a thirty seven and one half hour work week and effective October 5, 2010, as required by the AFSCME contract Article XXXIII Wages, Section H, Paragraph 2. 12

13 NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey that it does hereby authorize the above personnel actions effective October 5, Mayor DelCore reported these personnel changes are designed to continue efficiency in serving the public at the municipal building and will create savings for taxpayers. Mayor DelCore said Mrs. Strothers, who has done an outstanding job in the Administration Office as Secretary to the Administrator, has elected to transfer to an opening in the Finance Department. Before coming to the Township, Mrs. Strothers was the Teller Operations Supervisor at the Hillsborough Bank of America branch office, so the operations in the Finance Office are a good fit for her talents. Mayor DelCore said we will miss her in the Administration office. Mayor DelCore reported the Finance Office has two vacancies, due to both a retirement last year and the Deputy Treasurer's leaving this month. The Township will fill only one of those vacancies through Mrs. Strothers' transfer. Mayor DelCore said Ms. Weikel will fill the vacancy in the position of Secretary to the Administrator created by Mrs. Strothers' transfer. Ms. Weikel is a graduate of Monmouth University, and Hillsborough High School, and has served in the Administration Office for six years in a part time capacity, so we know her work well and look for a smooth transition and continued efficiency in the Administration office with her appointment. Mayor DelCore stated the Administration Office which had six full time employees in 2003, continues to operate now with four full time employees, including Mr. Davis as both the Administrator and Clerk. Mayor DelCore said under the terms of the white collar contract, Mrs. Strothers' move to the Finance Office necessitates an adjustment in Mr. Dedomenico's salary. As a result of the changes, the Township will save over $12,000 in salary costs. Upon motion by Committeeman Wagner seconded by Committeeman Ferrera, the aforesaid resolution was unanimously approved upon call of the roll. 4. Resolution authorizing the following personnel actions and appointments in the Building and Municipal Court offices: Christina Mirra, as a part time clerk in the Municipal Court office, at a rate of $13.00 per hour, not to exceed 29 hours per week for the period of October 12, 2010 to November 9, 2010, Larry Ditzel, as a part time Plumbing Inspector, at the rate of $28.00 per hour, not to exceed 29 hours per week effective September 29, 2010 to December 31, 2010, and Nancy DiMeglio, as a part time Technical Assistant, at a rate of $14.50 per hour, not to exceed 29 hours per week effective September 29, 2010 to November 30, 2010, all appointments to fill existing vacancies. WHEREAS, there exists a vacancy in the Municipal Court, due to the scheduled retirement of Dorothy Quirico; and WHEREAS, the Township Administrator/Clerk and the Court Administrator recommend the hiring of Christina Mirra, as a part time clerk in the Municipal Court office, at a rate of $13.00 per hour, not to exceed 29 hours per week, for the period of October 12, 2010 to November 9, 2010; and 13

14 WHEREAS, the Director of the Building Department recommends the appointment of Larry Ditzel, a licensed Plumbing Sub Code Official, as part time Plumbing Inspector, to fill a vacancy in the Building Department, at the rate of $28.00 per hour, not to exceed 29 hours per week, on an as needed basis, effective September 29, 2010 to December 31, 2010; and WHEREAS, the Director of the Building Department recommends the appointment of Nancy DiMeglio, as a part time Technical Assistant, at the rate of $14.50 per hour, not to exceed 29 hours per week, effective September 29 to November 30, NOW, THEREFORE BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey that the personnel recommendations of the Township Administrator/Clerk, the Court Administrator and the Director of the Building Department hereby be accepted and approved. Mayor DelCore said one of the methods that have been implemented to hold down personnel costs is using part time employees, rather than full time employees where appropriate and possible. Part time employees do not receive benefits, vacation time, sick time, holidays, etcetera that are afforded to full time employees and this creates a cost savings for taxpayers. Mayor DelCore said Ms. Mirra will work on a part time basis until mid November in the Municipal Court Office, temporarily replacing Dorothy Quirico, the long serving, full time Deputy Court Administrator, who is retiring. Mrs. Quirico will be missed and we wish her well in retirement. Mayor Delcore stated Mr. Ditzel will replace, on a part time, as needed basis, a part time Plumbing Inspector who has left the Township. All of the part time inspectors work on a per diem, as needed basis. If there are no inspections to be done or plans to be reviewed, they are not called in to work. Mayor Delcore said the Building Department has seen significant increase in business this year and we are advised that the vacant positions must be filled in order to keep pace with inspections, plan reviews, and permit application intake. That is also why Mrs. DeMeglio is being added as a part time Technical Assistant in the Building Department, filling a vacant full time position temporarily. Upon motion by Deputy Mayor McCauley seconded by Committeeman Wagner, the aforesaid resolution was unanimously approved upon call of the roll. 5. Resolution authorizing the Chief Finance Officer to process a salary based on the rate of $20.71 per hour for Fire Marshal John Andreychak, effective October 1, 2010, as established and approved by the Hillsborough Township Board of Fire Commissioners on September 14, WHEREAS, the Office of Fire Safety is governed by the Hillsborough Township Board of Fire Commissioners, an autonomous group elected by the voters; and WHEREAS, at their September 14, 2010 meeting, the Board of Fire Commissioners approved a salary based on the rate of $20.71 per hour for John Andreychak, Fire Marshal, beginning October 1, 2010; and 14

15 WHEREAS, the Chairman of the Board of Fire Commissioners has submitted the Commission s approval to the Township Administrator/Clerk and the Township Chief Finance Officer. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey, that it hereby authorizes the Chief Finance Officer to process the salary for John Andreychak, Fire Marshal at the rate of $20.71 per hour, effective October 1, 2010, as approved by the Hillsborough Township Board of Fire Commissioners. Mayor DelCore reported the independently elected Fire Commisson over see and sets the salaries for the personnel in the Fire Safety Office, not the Township Committee. The Township simply affords the Fire Commission a shared service of payroll administration, eliminating a duplication of services. This resolution authorizes the CFO to make the change in salary for payroll purposes. Upon motion by Committeeman Wagner seconded by Deputy Mayor McCauley, the aforesaid resolution was unanimously approved upon call of the roll. 6. Resolution rescinding the resolution awarding 2010 contract for Municipal Alliance services to Amelia Carella for the Girls on the Run program, effective September 30, 2010 and awarding a new contract to Larisa McCann, in an amount not to exceed $ WHEREAS, on March 23, 2010 by way of resolution, the Township Committee awarded various Municipal Alliance Contracts for the year 2010, including one contract to Amelia Carella to provide Girls on the Run program services, in an amount not to exceed $1,250.00; and WHEREAS, due to the rescinding of Amelia Carella s contract, effective September 30, 2010, it is necessary to replace the aforementioned individual and award a new contract to Larissa McCann for the Girls on the Run program; and WHEREAS, there is a need to enter into service contracts with various vendors all below the Local Public Contracts Law and below the Local Unit Pay-to-Play Law threshold; and WHEREAS, Larissa McCann shall provide services for the Girls on the Run program, for the period from October 1, 2010 through December 31, 2010, in an amount not to exceed $625.00, and WHEREAS, it is necessary to award new contracts so that the Hillsborough-Millstone Municipal Alliance can continue to provide educational programs and activities throughout the school year; and WHEREAS, funds are available and have been certified as such by the Chief Finance Officer, said certification is attached to this resolution. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey as follows: 1. The Mayor and Township Administrator/Clerk are hereby authorized to execute the Township s standard form of agreement for services and any modifications thereto and related constituent documents as may be found acceptable by the Township Committee. 15

The contract awarded to Amelia Carella, for the Girls on the Run program, on March 23, 2010 is hereby rescinded effective September 30, A notice of this action shall be printed in the official Township newspaper. Mayor DelCore said Ms. Carella is not able to continue to participate in the Girls on the Run program. The change is recommended by the Hillsborough Municipal Alliance Committee. All of these programs are funded through the county alcohol and drug abuse prevention grant. Upon motion by Deputy Mayor McCauley seconded by Committeeman Ferrera, the aforesaid resolution was unanimously approved upon call of the roll. 7. Resolution awarding a contract to Tilcon New York, Inc. for 2010 Road Paving and Maintenance, in amount not to exceed $747, WHEREAS, the Assistant Township Engineer, has determined that there is a need for the acquisition of the following: 2010 Road Paving and Maintenance"; and WHEREAS, sealed bids were opened and read on September 22, 2010, at 11:00 a.m. which was the time and place provided for in the Invitation to Bid entitled 2010 Road Paving and Maintenance ; and WHEREAS, seven (7) sealed bids were received on September 22, 2010, at 11:00 a.m. at which time bids were opened and read; and WHEREAS, the seven (7) bids received are as follows: BIDDER TOTAL BID Tilcon New York, Inc. $747, Mannon Excavating & Paving $763, Schifano Construction Corporation $824, Top Line Construction $757, Renda Roads, Inc. $822, P & A Construction, Inc. $865, DeSantis Construction, Inc. $808, and WHEREAS, Tilcon New York, Inc. bid on all of the items in the quantities requested; WHEREAS, Tilcon New York, Inc. is the lowest bidder in the total amount of $747,000.00; and WHEREAS, the Township Assistant Engineer and the Township Attorney have reviewed the bid packages of the recommended vendors set forth hereinabove and finds them to be in conformance with the Local Public Contracts Law and the Township Instruction to Bidders; and 16

17 WHEREAS, an award of contract is made to Tilcon New York, Inc.; and WHEREAS, a certification of availability of funds shall be made in connection with each purchase order in accordance with N.J.A.C. 5:34-5.3(b)(2); and NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey as follows: 1. Award of contract is hereby made to Tilcon New York, Inc., at the unit price for each bid item, in an amount not to exceed $747, The Mayor and Township Clerk are hereby authorized to execute the Township s standard form of contract for goods, products and supplies and for services to Tilcon New York, Inc. in accordance with the recommendations of the Assistant Township Engineer as set forth herein above. 3. A notice of this action shall be printed in the official Township newspaper. Mayor DelCore reported Tilcon New York submitted the lowest bid of the seven bidders for the road paving projects, funded through the capital budget approved earlier in the year. Dukes Parkway West, a portion of Camplain Road, and Taurus Drive are scheduled for the paving. The Township received a $200,000 state road grant for Dukes Parkway West. Upon motion by Committeeman Wagner seconded by Deputy Mayor McCauley, the aforesaid resolution was unanimously approved upon call of the roll. CONSENTS Mayor DelCore offered the following consent agenda: 1. Resolution approving the request from Patrick Seiwell for the release of Development Review Escrow, in the amount of $ WHEREAS, a request has been received from Patrick Seiwell for the release of Development Review Escrow; and WHEREAS, the Hillsborough Township Planner certifies that all work related to the review of the above has been completed; and WHEREAS, the Hillsborough Township Planner recommends that the Township Committee take action to release the $ Development Review Escrow because the work has been completed. WHEREAS, Hillsborough Fire Company #2 is preparing to make necessary repairs to the firehouse roof and is requesting that construction permit fees be waived. NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Hillsborough, County of Somerset, State of New Jersey that Building Department permit fees in connection with the above referenced project be and are hereby waived. 3. Resolution accepting the retirement of Dorothy Quirico, Deputy Court Administrator in the Municipal Court Office, effective October 29, 2010 and authorizing the Township Administrator/Clerk to post for the position of Violations Clerk.
