5 FONDS DESCRIPTION YUKON LAW SOCIETY FONDS m of textual records 9 audio cassettes (7:08:09) : (Audio Magnetics - XHE C60) 1 photograph : col. print (Kodak paper) ; 17 x 10.5 cm The Yukon Law Society's primary duty is to serve and protect public interest in the administration of justice and to preserve the rights of all persons in the relationship between members and clients. Its focus is threefold: to consider, discuss and take action in all matters pertaining to the practice of law and the administration of justice in Canada generally, and in the Yukon Territory; to represent the legal profession in the Yukon Territory; and to establish or adopt and to enforce appropriate Codes of Legal Ethics in the Yukon Territory. The Yukon Law Society serves its members by offering Continuing Legal Education classes, informing practitioners of legislative decisions, coordinating insurance coverage, and organizing social events. It recommends guidelines for legal fees and establishes rules regarding the administration of trust accounts which clients have entrusted to their lawyers. Complaints against members of the legal profession are investigated by the Discipline Committee of the society. The executive of the Yukon Law Society consists of no less than six members, four elected from the resident membership and two non-members appointed by the Commissioner of the Yukon Territory. The executive positions have been President, Vice-president (Admissions), Vicepresident (Discipline), Secretary, and Treasurer. Every lawyer practicing in the Yukon must maintain membership in the Yukon Law Society. The first executive members were Erik Nielsen, President; Robert W. Miller, Secretary; and Allan R. Lueck, Treasurer. The Yukon Law Society has administrative relationships with the Yukon Law Foundation and the Canadian Bar Association - Yukon Branch. Established in 1970, the Yukon Law Society was originally called the Yukon Bar Association; the name officially changed in By 1992 the name had been changed to the Law Society of Yukon. 1

6 Inventory to the Yukon Law Society fonds The fonds consists of records of the Yukon Law Society, , including correspondence, minutes, financial and personnel records, reports, sound recordings of a conference, and reference material. The records document the creation, development and operation of the Yukon Law Society, and are arranged into the following series: Administrative records; Executive records; Financial records; Personnel / Membership; Yukon Law Foundation; and Canadian Bar Association - Yukon Branch. Title notes Title based on name of the society at the time the predominant number of records were created. The series and sub-series were determined by the archivist based on the file plan provided by the Yukon Law Society. Immediate source of acquisition Donated by the Yukon Law Society in 1988, 1989, 1990 and A group of files received in 1990 were added to accession 88/122 in November The sound recordings in accession 89/11 were recorded by Yukon Archives staff with permission from the Yukon Law Society and individual speakers. General notes Discipline files, previously listed in the Yukon Law Society finding aids printed in June 1994 and March 1995, were removed due to privacy issues and returned to the Law Society of Yukon in As a result, files COR 971 f10, f11 and f13 and COR 995 f7 are no longer located at Yukon Archives. At a later date, it was determined that some documents in the files were printed on the backs of other unrelated documents in an effort to reuse paper. Some of the recycled paper contained solicitor / client information. The side of the page without the solicitor / client information was photocopied, placed in the file, and the original document was returned to the Law Society of Yukon in The sound recordings of the conference were recorded by staff of the Yukon Archives, with permission of the Yukon Law Society and the individual speakers. Published material (PAM ) has been transferred to the Yukon Archives Library. 2

The executive worked out of their own firms' offices until 1985, when the Yukon Law Society rented an office in Whitehorse and hired the first administrative secretary. The series consists of the administrative records of the Yukon Law Society. This includes correspondence, minutes, memos, notes, articles, and reports. The records are arranged into the following sub-series: Committees; Correspondence; Education; Insurance; Legal aid; Legislation; Meetings; Office; Organizations; Federation of Law Societies of Canada; Press; Social / community affairs; and Year end reports. The title is based on the contents of the series. The series and sub-series were established by the archivist. Sub-series description follows. Committees m of textual records The Yukon Law Society was often asked to contribute expertise to various national and territorial standing committees affecting the legal profession. The Yukon Law Society and Canadian Bar Association also maintained other ongoing committees. The sub-series consists of Yukon Law Society correspondence, agendas, minutes and news releases as well as background papers and reports generated by the various 5

The 1989 Continuing Legal Education Conference was on "The Constitutional Status of Yukon". Its Open Forum, featured the Government Leader, Tony Penikett and Leader of the Opposition, Willard Phelps, during a territorial election campaign. The sub-series consists of records arising from educational programs that the Yukon Law Society was involved in, including the Continuing Legal Education (CLE) program sponsored by the Canadian Bar Association. Included is correspondence, class lists, evaluation forms, course outlines, scholarship applications, requests for library purchases, and a report "Professional Legal Training in Australia". Also included are sound recordings of the presentations delivered at the 1989 Continuing Legal Education Conference, "The Constitutional Status of Yukon". Speakers gave legal, historical and political perspectives on the comparison of Alaska and Yukon constitutional development, the Meech Lake Accord and implications for the Yukon, Yukon's claim to have crown status, native rights, and the future of Yukon's constitutional status. 9

Excess coverage for lawyers is voluntary. The sub-series consists of correspondence to the Yukon Law Society from law societies and law firms regarding Errors and Omissions insurance, and correspondence and information concerning the Canadian Lawyers Insurance Association (CLIA), excess coverage and mandatory coverage for lawyers. The establishment of the legal aid plan in Ontario in 1967 altered the concept of legal representation for the poor from one of "charity" to one of "right". The remaining provinces and territories followed suit and the Yukon Territory established a Legal Aid Act in A tariff of fees was introduced in the Yukon to provide lawyers acting under legal aid certificates with reasonable remuneration. At this time the Yukon Legal Aid Board consisted of six members, three appointed by the Commissioner of the Yukon Territory and three appointed by the executive of the Yukon Law Society. Lawyers volunteered their names for legal aid service; Social Services later opened the Legal Aid contract for tender. 21 Administrative records Organizations m of textual records The Yukon Law Society corresponded with a number of private and public organizations in the Yukon and across Canada, including the CBC (Canadian Broadcasting Corporation), the Canadian Judicial Council, the Canadian Law Information Council, the Commonwealth Secretariat, the Justice of the Peace Council, the Legal Services Society, the Sheriff's Office and the Yukon Foundation. The sub-series consists of Yukon Law Society correspondence, memos, minutes, reports, survey results, expense statements, and organizational by-laws. 22 Inventory to the Yukon Law Society fonds 93/119 COR Y-400 Yukon Law Foundation / Indemnification Fund [Correspondence] Federation of Law Societies of Canada m of textual records The Federation of Law Societies was incorporated in 1972 to study matters of essential concern to the legal profession in Canada, and to increase cooperation and dialogue among governing bodies of the legal profession. The Federation assumed two main responsibilities: to operate as a forum for the exchange of views and information of common interest to the governing bodies; and to improve the general public s understanding of the legal profession in Canada. As an umbrella group for provincial and territorial legal societies, the Federation offers Continuing Legal Education courses in subjects of current national interest and discusses problems in competency, discipline, errors and omissions insurance, compensation funds, legal aid programs, Bar admission programs, and matters affecting the independence of the profession. The executive consists of five elected members (President, Vice-president, Pastpresident, Secretary-Treasurer, and Co-ordinator of Continuing Education). As a matter of practice, the directors each represent one of the five regions of Canada, namely, the Maritime Provinces, Quebec, Ontario, the Prairie Provinces, and British Columbia. The membership of the Federation consists of two representatives from each of the governing bodies appointed by such governing bodies. The directors of the Federation are also members. Each of these persons has the right to exercise one vote and may appoint any other member as his or her proxy. The Federation is financed by an annual assessment on each governing body based on the number of active members each year. 27 EXECUTIVE RECORDS m of textual records Until 1985 the Yukon Law Society executive consisted of four directors (President, Vicepresident, Secretary and Treasurer). The 1982 executive members were Donald Kidd, President; Paul O'Brien, Vice-president; Dennis Claxton, Secretary; and Grant Macdonald, Treasurer. In 1985 the position of Vice-president was divided into two areas of responsibility, First Vicepresident in charge of Discipline and Second Vice-president in charge of Education and Admissions. The series consists of materials generated and received by the Yukon Law Society executive. They include correspondence, notes and memos, minutes and agendas, reports, nomination forms, certificates and financial statements. The series is divided into the following sub-series: Elections; Meetings; President s correspondence; First Vice-president s correspondence; Second Vice-president s correspondence; and Treasurer's correspondence. Elections m of textual records Each candidate to executive must be nominated by two other members of the Yukon Law Society. The sub-series consists of material relating to the 1982, 1984 and 1987 Yukon Law Society executive nominations and elections. It consists of correspondence, memos, nomination forms and minutes of meetings. 23

The executive occasionally called a special meeting to discuss a single pressing issue. Agendas were circulated and minutes were kept. The sub-series consists of correspondence of the executive of the Yukon Law Society, notes and memos, agendas, minutes and documents to be considered for future meetings. 31 Executive records Treasurer's correspondence m of textual records The Treasurer of the Yukon Law Society was responsible for all financial matters of the society and corresponded with numerous societies, law firms and government departments. The sub-series consists of the Yukon Law Society treasurer s correspondence, notes, memos, certificates, drafts of financial statements, minutes of executive meetings, reports, a Yukon Bar Association constitution, and a Society grant application to the Yukon Law Foundation. 33 FINANCIAL RECORDS m of textual records Financial statements of the Yukon Law Society were drawn up by the Treasurer, although insurance companies usually addressed their correspondence to the society's President. The series consists of the Yukon Law Society financial correspondence, policy drafts, minutes of the Yukon Law Foundation, monthly reports, and statements of receipts and expenditures. The title is based on the contents of the series. 35 PERSONNEL / MEMBERSHIP m of textual records Membership in the Yukon Law Society was voluntary until a revision in the Legal Professions Act (1985) made membership compulsory for all individuals practicing law in the Yukon Territory. Membership is open to all lawyers admitted to the Bar in Canada or who have articled for 12 months in the Yukon. Many individuals living outside of the Territory choose to retain non-resident membership. All members in good standing pay annual fees and, in return, receive courses in Continuing Legal Education, notices of meetings of interest to legal professionals, group insurance, information regarding legislation, and the right to elect the society's executive. The Yukon Law Society keeps records of its members' appointments to Boards as well as regulating members through its Discipline Committee. The series consists of the personnel and membership records of the Yukon Law Society. Included is correspondence, legislation, fee schedules and membership lists. The records are arranged into the following sub-series: Admissions; Appointments; Court personnel; Discipline; Fees; and Membership lists. The title is based on the contents of the series. 43 YUKON LAW FOUNDATION m of textual records The Yukon Law Foundation was established in 1979 to administer the interest earned on the trust accounts of the Yukon's resident barristers and solicitors. Its first undertaking was to reimburse the public for any losses caused through misappropriation or wrongful conversion of property by a lawyer. The Foundation solicited and reviewed claims against the indemnity fund. Payments were subsequently made from the fund. The Foundation also permits grants for legal education and research, law reform and the publication of information about the law, and the establishment and maintenance of law libraries. The executive of the Yukon Law Foundation consists of a president and five other members. The first executive was composed of Ron Veale (President) and members Donald Kidd, W.G.N. Egbert, W.B. Kelly, E. Walters and P. O'Donoghue. The first administrative secretary was Vicki Hancock. The series consists of records of the Yukon Law Foundation kept with the Yukon Law Society records. Included is correspondence, minutes, financial statements, applications for grants, details of a contract, agenda, reports, press releases, a ledger, and a list of grants.
