1 Minutes of Regular Session Meeting City Council of the City of Unionville May 21, 2015 Present: Mayor Don Fowler Alderman Nancy Jones Alderman Gary Davis Alderman Kellie Purdy City Clerk Donna Tracy City Administrator John Roach City Attorney Jim Garrett Not Present: Alderman Carl Burns Pledge of Allegiance was led by Mayor Don Fowler First visitor of the night Llona Weiss from the Department of Economic Development of Energy presented a program the City can participate in that is a low interest loan that will save money and a great way to buy new LED Street Lights. It will save the City $9, a year and the payments will be $9, a year for ten years. After that the rest is a savings to the City. Alderman Gary Davis made a motion to accept the loan from the Department of Economic Development of Energy to buy new LED lights for the City. The motion was seconded by Alderman Kellie Purdy. Ayes: Alderman Gary Davis, Alderman Nancy Jones and Alderman Kellie Purdy. Nays none Motion carried. A group of concern citizens talk to the Council about the drainage problems they are having in their home. Ask if the Council could get together and come up with some ideas on the best way to fix the problems. Alderman Kellie Purdy did tell the group she would like to see the water and sewer guys go look at the problem and come up with some ideas to help by the next Council meeting on June 4, Mayor Don Fowler called for a motion to approve the consent agenda. Alderman Nancy Jones made a motion to approve the consent agenda. The motion was seconded by Alderman Kellie Purdy. Ayes: Alderman Gary Davis, Alderman Nancy Jones and Alderman Kellie Purdy. Nays none Motion carried.

2 After much discussion Council decided they should not have offered to pay Brad Hamm money to help with his drainage issues this would be using tax payer money for private property. They will let him know they won t be able to help him out with his project. The did talk with the sewer guys that did attend the meeting and some of the ideas they did come up with was to smoke the sewers clear some brush and hope the new sewer project coming our way will take care of most of the problems. The bottom line property owners have to take care of their own property. Bank Resolution from Farmers Bank of Northern Missouri updated with new names of the new council members and Amy Homann with on-line banking. Alderman Nancy Jones made a motion to accept the new bank resolution with Farmers Bank of Northern Missouri. The motion was seconded by Alderman Kellie Purdy. Ayes: Alderman Gary Davis, Alderman Kellie Purdy and Alderman Nancy Jones. Nays: none motion carried. City Administrator John Roach spoke to the Council about setting up a new noninterest bearing checking account for the CDBG Half of Million Dollar Sewer Grant. Alderman Nancy Jones made a motion to set up the non-interest bearing checking account for the CDBG Half of Million Dollar Sewer Grant. The motion was seconded by Alderman Kellie Purdy. Ayes: Alderman Gary Davis, Alderman Kellie Purdy and Alderman Nancy Jones. Nays: none motion carried. City Administrator John Roach told Council Lagers will come to City Hall June 1 st at 10:00 am talk to the City Employee s about their retirement plan. MPUA will try to come to Unionville on June 22 nd to a special meeting to meet with Council to answer questions. Council wants to ask about retro fitting and getting their plant back on line. Mike from MPUA was at the meeting he did invite Council come to headquarters and MPUA will buy their lunch. City Administrator John Roach did speak to Council about having a Grand Opening on June 9, 2015 at Noon. The City will put an ad in paper KTVO will be there talk about the new pool. Also that evening there will be a pool party for the City Employees and their families along with Mayor and City Council.

3 Magen and Donald Mendenhall came to the meeting to ask about their Commercial Business in a Residential Area. After much discussion it was decided to have a public hearing. Alderman Gary Davis made a motion to have a public hearing. The motion was seconded by Alderman Nancy Jones. Ayes: Alderman Gary Davis, Alderman Nancy Jones and Alderman Kellie Purdy. Nays none motion carries. The Hearing will be posted in the paper on May 27, 2015 and June 3, Must be posted fifteen days on June 18, 2015 their Public Hearing will be held on the Magen and Donald Mendenhall property. Commercial Business in a Residential Area the hearing will start at 5:30pm. Mayor Don Fowler asks the Council if they had any objections to the new Park Board Members. He has asked for a motion to approve the new members as follows Darl Salisbury, Gary Fuller, Lois Demry, Jeff Pauley and Bonnie Stahlnecker. Alderman Nancy Jones made a motion to approve the new Park Board Members. The motion was seconded by Alderman Kellie Purdy. Ayes: Alderman Kellie Purdy, Alderman Nancy Jones and Alderman Gary Davis. Nays none motion carried. Mayor Don Fowler asked if there is any new business. None Alderman Kellie Purdy did ask why closed session is taken off the Agenda. She did have items she wanted to discuss. Mayor Don Fowler asked if there is any old business. Alderman Nancy Jones did ask the City Administrator does the City have a cell phone policy in place. He said no there is not he also made the comment himself and Chief Corwin has taken them off the Cell Phone Plan. Also it was ask if he had been working close with Barb Tomlin with the hold harmless agreement with Big Bam. How the hand rails are coming along and did the wording on Chan two ever get change about why the electrical rates are going up. Also has the City Administrator been working on the back tax letter with the City Attorney? Alderman Gary Davis wants to make the work comp policy to read all City Employees who gets hurt at work the City will pay for their time in rehab, therapy and office calls. Alderman Nancy Jones made a motion for a new work comp policy to be put into place. The motion was seconded by Alderman Kellie Purdy.

4 Ayes: Alderman Kellie Purdy, Alderman Gary Davis and Alderman Nancy Jones. Nays none motion carried. Alderman Kellie Purdy wants to change the Personal Manual she want to review the call back and the on call policy. She wants it put back the way it used to be. At the next meeting she is asking Council to review this and approved to put back in the Manual. Alderman Kellie Purdy once again ask why was closed session taken off this meeting she wanted to go into closed session she has very important items to discuss. Mayor Don Fowler said if you want to go into closed go into closed so at the point the motion was made to go into closed session. Alderman Nancy Jones made a motion to go into closed session per RSMo (3) Hiring, firing, disciplining or promoting of particular employees by a public body when personal information about the employee is discussed or recorded. Motion seconded by Alderman Kellie Purdy. Roll Call Vote: Alderman Gary Davis aye, Alderman Nancy Jones aye and Alderman Kellie Purdy aye, Nays none motion carried. After the discussion started the City Attorney Jim Garrett, City Administrator John Roach and City Clerk Donna Tracy left the room. After much discussion City Administrator John Roach and City Clerk Donna Tracy came back into the room. Alderman Nancy Jones made a motion for immediate termination of the City Administrator John Roach s contract due to his job performance. Let it be noted in his personal file at City Hall will be a list of reasons exactly why he was let go of his duties. The motion was seconded by Alderman Kellie Purdy. Roll Call Vote: Alderman Gary Davis aye, Alderman Nancy Jones aye, Alderman Kellie Purdy aye Nays none motion carried. City Administrator John Roach terminated on Thursday May 21, 2015 at 9:45pm. The City Attorney Jim Garrett did join the meeting at this point spoke to Council.

5 Alderman Nancy Jones made a motion to go out of closed session. Motion was seconded by Alderman Kellie Purdy. Roll Call Vote: Alderman Gary Davis aye, Alderman Nancy Jones aye, Alderman Kellie Purdy aye Nays none motion carried. Mayor Don Fowler called for a motion to adjourn. Alderman Nancy Jones made the motion to adjourn. The motion was seconded by Alderman Kellie Purdy. Ayes: Alderman Nancy Jones, Alderman Kellie Purdy and Alderman Gary Davis. Nays none motion carries.
